These proposed rules become effective October 1, 2017. History: The division solicited public proposals for the 2017 ORSC from August 1, 2016 to September 14, 2016. The Residential and Manufactured Structures Board selected a code review committee to review the base code, public proposals, Oregon amendments, alternate methods, and code interpretations. The ORSC review committee completed an analysis of the 2015 International Residential Code, existing Oregon code amendments, statewide interpretations, alternate method rulings, and 16 public code amendment proposals. The review committee met eight times beginning November 30, 2016, finalizing its recommendations to the board on April 5, 2017. On May 10, 2017, the Residential and Manufactured Structures Board approved the review committee’s recommendation for the 2017 ORSC and recommended that the code be sent to public hearing. The Building Codes Division received the recommendations from the Residential and Manufactured Structures Board from its May 10, 2017, meeting. After reviewing the recommendations, and pursuant to Oregon Revised Statute 455.030(5), the division is denying the following code proposals: 1. Public proposal 17-08, relating to special stairways; and 2. Public proposal 17-09, as modified by the committee to Appendix W, relating to wildfire hazard mitigation. IDENTIFY HOW CHANGE IMPACTS COSTS IN CATEGORIES SPECIFIED

Description of proposed change: (Please attach any draft or permanent rule or ordinance) These proposed rules adopt the structural, mechanical, and low-rise apartment code provisions of the 2017 Oregon Residential Specialty Code. Description of the need for, and objectives of the rule:

ORS 455.610 requires the division to adopt, and amend as necessary, a low-rise code “that contains all the requirements, including structural design provisions, related to the construction of residential dwellings three stories or less above grade.” Furthermore, ORS 455.020 and 455.110 require the division to adopt a uniform state building code that conforms to model building codes generally accepted and in use to govern the “construction, reconstruction, alteration and repair of buildings and other structures” and the “installation and use of mechanical, heating and ventilating devices and equipment” in buildings and other structures. The current code is the 2014 Oregon Residential Specialty Code, which is based on the 2009 edition of the International Residential Code (IRC), with Oregon amendments. These proposed rules adopt the 2015 IRC with Oregon amendments, and will be known as the 2017 Oregon Residential Specialty Code.

Adopt, Amend & Repeal 918-480.

Materials and labor costs increase or savings:

Estimated cost increases include: Changes and expands the use and location of carbon monoxide alarms to rooms with a carbon monoxide source and requiring the

use of a hardwired combination carbon monoxide/smoke alarm. It’s estimated the increased cost for a combination carbon

monoxide/smoke alarm is approximately $20 more than a separate carbon monoxide alarm and a separate smoke alarm.

New requirement for sealing vapor barrier seams is a slight cost increase. However, the change may result in long term savings

based on increased efficiency savings from a sealed vapor barrier.

Requirement that drip edges be installed for shingle roofs increases costs approximately $200 per dwelling when a shingle roof is

installed.

Amendments to Chapter 11 regarding energy efficiency requirements are estimated to increase costs between $750-$1,300 depending upon the specific energy efficiency items selected by the home builder and whether the home heating system is gas or electric. Items that will increase costs include, but are not limited to, windows, ceiling insulation, wall heel height, framing and panel sizing, air sealing measures, lighting, and fixtures. However, costs may be offset by long-term savings based on increased energy efficiency. The actual cost impact cannot be determined at this time because it is dependent on the specifics of a particular building, design variables, construction methods, building type, and materials.

Requirement for the protection of concealed gas piping is estimated to increase costs approximately $50 per dwelling.

Requirements for the installation of a union within one-foot of a regulator when connected to rigid piping is estimated to increase

costs approximately $10 per dwelling.

The actual fiscal impact of Emergency Escape and Rescue Opening window well drainage requirements; masonry foundation wall requirement for #4 rebar instead of #3 rebar; additional fastener requirements in certain construction; pan flashing requirements; and masonry chimney caps and rain caps cannot be determined at this time because it is dependent on the specifics of a particular building, design variables, construction methods, building type, and materials.

Several changes were identified as cost savings and may reduce the overall cost increases identified. An accurate cost estimate cannot be quantified at this time because it is dependent on the specifics of a particular building, design variables, construction methods, building type, and materials.

918-480-0005 Adopted Oregon Residential Specialty Code

(1) The Low-Rise Residential Dwelling Code, identified in ORS 455.610, will be known as the Oregon Residential Specialty Code.

(2) The Oregon Residential Specialty Code is adopted pursuant to OAR chapter 918, division 8.

(3) Effective October 1, 2014 2017, the 2014 2017 Oregon Residential Specialty Code consists of the following:

(a) The 2011 Oregon Residential Specialty Code, 2015 Edition of the International Residential Code for One- and Two-Family Dwellings as published by the International Code Council, Inc., Chapters 1 through 24 and Chapter 44, Appendices E, F, G, H, K, R, S, and T, and as further amended by the Division. Chapters 25 through 43, Appendix A, B, C, D, I, J, L, M, N, O, P, Q, and U are not adopted as part of the Oregon Residential Specialty Code.

(b) The low-rise plumbing provisions of the Oregon Residential Specialty Code are adopted in the 2014 2017 Oregon Plumbing Specialty Code.

(c) The low-rise electrical provisions of the Oregon Residential Specialty Code are adopted in the 2014 2017 Oregon Electrical Specialty Code.

(d) Low-rise apartment construction provisions of the Oregon Residential Specialty Code are adopted in the 2014 Oregon Structural Specialty Code and the 2014 Oregon Mechanical Specialty Code.

(4) Applicability of code changes to pending applications. Code requirements in effect at the time a plan review or permit application is filed controls the construction under the application unless the applicant agrees to be controlled by subsequent changes.

(5) For the purposes of implementing a phase-in period for the 2014 2017 Oregon Residential Specialty Code, the 2011 2014 Oregon Residential Specialty Code is adopted for a period of 90-days beginning October 1, 2014 2017 and ending December 31, 2014 2017.

(6) During the 90-day phase-in period established in subsection (5), all building departments in the state are required to accept plans for low-rise residential dwellings designed to either the 2014 2017 Oregon Residential Specialty Code or to the 2011 2014 Oregon Residential Specialty Code. (1) The Oregon Residential Specialty Code is amended pursuant to OAR chapter 918, division 8. Amendments adopted during the code-cycle for inclusion into the Oregon Residential Specialty Code are placed in this rule, showing the section reference and a descriptive caption.

(2) Effective April 1, 2015 the Oregon Residential Specialty Code is amended according to the following:

(a) Amend Section R202 – definition for “Accessory Structure” and Section R325 Detached Group R Accessory Structures (Group U) for allowable area increases to detached Group R accessory structures; and

(b) Amend Section M2301 Solar Energy Systems specifying that residential solar photovoltaic installation requirements are now located in Section 3111 of the Oregon Structural Specialty Code.

(3) Effective February 1, 2016: (a) The Oregon Residential Specialty Code is amended by deleting Section G2415.11

“Underground gas pipe separation.” This amendment aligns the underground residential gas piping burial and separation requirements of the Oregon Residential Specialty Code more closely with the Oregon Mechanical Specialty Code and national model codes.

(b) The low-rise residential provisions in the 2014 Oregon Structural Specialty Code, Sections 907.2.11 and 908.7, for low frequency single- and multiple-station smoke alarms and carbon monoxide alarms is amended. NFPA 72 Section 29.3.8 and NFPA 720 Section 9.4.2.2 are not adopted. [Publications: Publications referenced are available for review at the division.
