In terms of the National Environmental Management Act (Act 107 of 1998, as amended) (NEMA) the 2014 NEMA Environmental Impact Assessment (EIA) Regulations, as amended, promulgated in Government Gazette 40772 and Government Notice (GN) R327, R326, R325 and R324 on 7 April 2017, a full Scoping and EIA Process is required for the construction of the Kap Vley WEF. A separate Basic Assessment Process is required and will be undertaken for the development of the associated electrical infrastructure including a transmission line to connect the wind farm to the Gromis or the new Eskom substation,. The Council for Scientific and Industrial Research (CSIR) has been appointed by the Project Applicant to undertake the separate required Basic Assessment as well as the Scoping and EIA Processes for the proposed project. A hard copy of the Draft Scoping Report is available for public viewing at the Kleinzee Library as well as at the Kleinzee Police Station. The Draft Scoping Report can also be downloaded from the following website: https://www.csir.co.za/environmental-impact-assessment As a registered I&AP on the project database, you are hereby notified of the release of the Draft Scoping Report for the proposed Kap Vley WEF for a 30-day review period, ending on 30 November2017. Please submit your comments before or on this date to Ms Reinett Mogotshi at the contact details provided below. Purpose of the meeting: This meeting constitutes the Pre-Application Meeting with DEA to discuss the Environmental Impact Assessment (EIA) for the proposed Kap Vley Wind Energy Facility that is currently being undertaken by CSIR. It is also to discuss the proposed associated electrical infrastructure of the project which will constitute a separate Basic Assessment (BA) process. The meeting is to provide an overview of the proposed WEF and associated electrical infrastructure and to confirm the proposed EIA and BA processes to be undertaken. This includes the proposed approaches and requirements of the Scoping, EIA and BA processes. It also includes the Public Participation Process, Alternatives and Cumulative impacts to be included and assessed as well as the proposed EIA Schedule. The meeting will also provide feedback on the approach and progress to date to secure a biodiversity offset for the project as it falls within an area of high biodiversity sensitivity. 1. Notes - Welcome and introductions

ME welcomed all participants to the meeting. The participants introduced themselves.

2. Notes - Overview of the Kap Vley Wind Energy Facility

RM presented an overview of the proposed project (see Appendix 1 for the full presentation):

• Kap Vley WEF near Kleinzee in the Northern Cape:

o juwi is proposing the development of the Kap Vley WEF and associated electrical infrastructure:

Located approximately 30 km south east of Kleinzee in the Northern Cape. It falls within the Namakhoi Local Municipality which falls under the Namaqualand District Municipality.

Maximum number of turbines: 56

Maximum turbine height and rotor diameter: 150 m & 160 m respectively

o Proposed Scoping and EIA – to be undertaken for the WEF

o Separate BA process to be undertaken for the electrical infrastructure component associated with the proposed WEF. The BA and EIR processes will run concurrently. One integrated PPP will be followed to ensure that the timeframes for the issuing of the Environmental Authorisations for the proposed Kap Vley WEF and the electrical component are aligned.

o Specialist studies will be undertaken to inform the EIA Process - Please refer to slide 12 of the Presentation in Appendix 2 for a full list of the specialist studies.

o In addition to the specialist studies, a Biodiversity Offset study will be undertaken by Simon Todd Consulting as the site falls within a Critical Biodiversity Area (CBA) 1 & 2. Juwi is taking a pro-active approach and investigating the potential need and opportunity for an offset to compensate for the likely impact of the development. Meetings have been held with WWF, SANParks and the Department of Environment and Nature Conservation of the Northern Cape Province (DENC).

o In principle support letters were obtained from WWF and SANParks for the process of determining an offset whereby land will be acquired from WWF to expand the Namaqua National Park (See Appendix 3).

3. Notes - Key Questions and Discussion

CSIR QUESTION DEA RESPONSE ACTION

Confirmation of EIA and BA Processes/ Approaches:

o Submit two separate applications, i.e. one for Scoping and EIA (Kap Vley WEF) and one for the BA process (associated electrical infrastructure).

o Submit separate Scoping and EIA Reports and a Separate BA Report.

o Undertake one integrated PPP for the BA and EIA Processes

o The final EIA Report and the final BA Report to be submitted to DEA simultaneously to align Environmental Authorisations from DEA.

Proposal for EIA and BA approaches (i.e. to undertake separate processes and one integrated PPP) is acceptable.

ME enquired whether consent was obtained from all the landowners. CvdW confirmed that consent was obtained, except from the land owners for the two farm portions to be traversed by the new roads to be constructed. CvdW indicated that since there are only linear activities occurring on these properties, he is of the view that landowner consent is not required for these two properties, the same way consents are not required for properties only traversed by powerlines. .

ME referred to Section 39(1) of the NEMA Regulations and indicated the need for consents for these properties will be confirmed as part of the approval of these meeting notes.

ME asked that the EAP on the project is not working on the SEA, and ML confirmed that she is not part of the SEA team.

ML to proceed with the proposed approach to submit two separate Applications for Scoping and EIA and the BA processes. Integrated PPP to be followed for the above.

ME to confirm whether consent must be obtained from landowners for the construction of roads as linear activities on their properties.

ME confirms, after discussions internally, that seeing that the new roads to be constructed is directly related to the Wind Energy Facility, it cannot be isolated, and hence, seeing that landowner consent is needed for the properties in question for the wind energy facility, then landowner consent is needed for the new roads.

If the CSIR can prove that the new roads constructed are not for the purpose of the Wind Energy facility, then the DEA may change its opinion.

Confirmation on Alternatives:

o No-go alternative will be assessed

o There are no site /location alternatives and motivation why these are not included will be provided in the Scoping Report. juwi identified three

It is important that each specialist provides a detailed assessment of the no-go alternative in their specialist reports to be included in the EIA Reports.

Alternatives do not refer to site/location alternatives only. It also includes other alternatives, e.g. technology

Kiap: unfeasible due to environment i.e. nearby Goegab Nature Reserve;

Brazil: unfeasible due to land ownership; and

Kap Vley: Feasible and taken forward for S&EI process.

Three powerline routing alternatives will be assessed in the BA.

TS asked which one is the preferred powerline routing alternative? CvdW confirmed it will be the shortest routing alternative and this will be confirmed once the Eskom substation is built.

Please identify all other feasible alternatives in the Scoping Report.

The “No-go” alternative will also be included and assessed in detail by the specialists and will be included in the EIA Reports.

Uncertainty regarding turbine capacity, number and model at this stage.

Turbine specifications will only be finalised during the EIA phase as new or updated models or specifications become available all the time.

ME notes it is understandable that some turbine specifications will only be finalised closer to construction. It is however important that the “worst-case scenario” be presented and assessed by the specialists.

These ranges will affect the sweep area and the potential kill zone of birds and bats and will impact the significance ratings these impacts, e.g. bats will be affected at a lower sweep area. It is therefore important for the relevant specialists to assess all possible ranges. The tip height ranges will affect the visual study and must therefore be considered and assessed by the visual specialist.

Confirmation on approach to assess cumulative impacts:

Assess other renewable energy projects and associated electrical infrastructure (e.g. powerlines) within a radius of 50 km. Should solar projects be considered as well?

DEA agrees with CSIR proposal to assess other renewable energy projects and associated electrical infrastructure projects within a radius of 50 km.

Wind and solar projects must be considered to determine the cumulative impacts as similar impacts may be effected, e.g. the loss of vegetation or habitat.

Specialists will be requested to consider and assess cumulative impacts associated with other renewable energy projects (wind and solar) and electrical infrastructure within 50 km of the project site.

Confirmation on the proposed approach to acquire a biodiversity off-set for the project:

The Kap Vley WEF site is located in a CBA1 and CBA2. A biodiversity offset is required and juwi is investigating the potential to contribute to the WWF land acquisition programme in the area to expand the Namaqua NP as an offset. A Draft Biodiversity offset study was prepared by Simon Todd Consulting and will be included in the scoping report.

ME notes that the determination of a biodiversity offset is a sensitive issue and needs to be addressed in an appropriate manner by all affected parties. ME cautions not to provide a direct financial offset to any government department. ME agrees with the proposed approach of juwi to contribute to the WWF Land Acquisition Programme to expand the Namaqualand National Park. The final offset study needs to be included in the Draft EIA Report. The requirements of the Draft National Biodiversity Offset Guideline (April 2017) must be adhered to.

The EAP to include the draft biodiversity offset study in the Draft Scoping Report. juwi to proceed with negotiations with WWF and SANParks to finalise the biodiversity offset and the offset study. It will be included in the Draft EIA Report.

Comments must also be sought from the relevant authorities, within the DEA as well as the NC on the proposed offset.

The offset must be finalised before the final EIAr is submitted to ensure it can be considered as part of the decision making process.

Confirmation on the specialist studies:

The specialist impact assessments have not been finalised. The final specialist studies to be included in the EIA will meet the requirements of Appendix 6 and will be included in the Draft and Final EIA Reports.

The draft inputs provided by the specialists to date can be included in the Draft and Final Scoping Reports. It should be marked as “scoping inputs from the specialists.” It will not be regarded as specialist impacts assessments and will not be required to meet the requirements of Appendix 6 of the NEMA EIA Regulations during the scoping phase. TS noted that she can comment on the ToRs for the specialist studies to be addressed in the final specialist studies to be included in the EIA Report.

ML to include the draft specialist inputs in the Draft and Final Scoping Reports. The final specialist studies will be included in the EIA Report and will adhere to Appendix 6 of the NEMA EIA Regulations.

Confirmation on the PPP:

Integrated PPP to be followed for the EIA and BA processes.

As indicated above, DEA accepts the proposed approach that an integrated PPP will be followed for the EIA and BA processes

Integrated PPP to be undertaken for the EIA and BA processes.

Issues will only be captured during the 30-day public review periods

ME: Issues can also be captured outside of the 30-day public review period. The EAP should be reasonable, e.g. if comments are a few days late, it can still be incorporated, otherwise comments to be included and addressed in the following phase. Comments on the final reports submitted after the final reports were submitted for decision-making, should be sent directly to DEA for their consideration.

It is important to maintain separate issues and responses trails for the EIA and BA. Comments can be received collectively, but the comments must be split for each process.

Comments will be captured during the 30-day public review periods, but also outside of these periods, where reasonable and where the extension will not lead to missing deadlines for report submissions and the lapsing of the Application. Should it not be possible to capture comments beyond the 30-day review period, the comments will be captured and responded to in the Issues and Responses trail of the next report (as applicable).

Please adhere to the legislated timeframes under section 3 of the 2014 NEMA EIA Regulations (as amended). Deliveries via courier should be done during office hours between 8-16H30. Deadlines may be missed if reports are delivered at security office after hours. If timeframes are not met, the Application will lapse and a new Application for EA would need to be lodged.

Request for Extension can be submitted in terms of Regulation 3 (7) of the NEMA EIA Regulations. However, this request will only be granted where exceptional circumstances can be demonstrated prior to the lapsing of the prescribed timeframe. Requests for Extension will not be granted if e.g. more time is requested to complete an Ecology study in the appropriate season.

The commenting period for DEA starts from the date that the Application or Report is received and stamped by DEA. The commenting period does not start from the date that the Application or Report is delivered at DEA, as this may be after the DEA offices have closed and it will therefore only be stamped the following day. It also does not start from the date that the application or report has been acknowledged.

Public participation or commenting on reports will not take place during the December holiday period, i.e. from 16 December to 5 January.

4. Way forward and Closure

ML to draft the meeting notes and send to DEA for approval and sign-off.

The meeting notes with the meeting reference number must be included as an appendix to the cover letter of the Application for EIA. This will ensure that the project will be assigned to TS and ME once the Application for the EIA has been lodged as they have attended the pre-application meeting and know the project background.

CvdW requests that the case officer should phone ML if she has any questions or if anything is unclear to avoid unnecessary delays and misunderstandings on the projects.

The meeting notes must be included in the Scoping, EIA and BA Reports.

ML and CvdW thanked DEA for the opportunity to meet with them and for providing feedback on the queries relating to the Scoping, EIA and BA approaches and processes for the proposed Kap Vley WEF and associated electrical infrastructure near Kleinzee in the Northern Cape.
