The public is welcome to call into the meeting and listen to the Council discussion. Information for how to access the meeting will be available prior to the start of the meeting at https://www.cityofnisswa.com/calendar.php. Anyone who wishes to address the Council may submit their questions or comments to the City Clerk at [email protected] before the meeting. Emails received prior to the meeting will be read aloud during the Open Forum portion of the meeting. We appreciate your patience as we work through changes to our usual meeting processes. Due to the Shelter in Place order by Governor Walz until May 4th, the regular City Council Meeting for the City of Nisswa will take place virtually via Go To Meeting. The public is welcome to call into the meeting and listen to the Council discussion. CITY OF NISSWA MINUTES – REGULAR COUNCIL MEETING

WEDNESDAY, MARCH 18, 2020 7:00 P.M. – CITY HALL

The regular meeting of the Nisswa City Council was held on Wednesday, March 18, 2020 at 7:00 p.m. at City Hall. Members present: Heidmann, Hoff, Jacobson, Johnson. Members absent: Ryan. Also, present: City staff - Jenny Max, Jon Stainbrook, Tom Blomer, City Engineer Mark Hallan, City Attorney Tom Pearson, the Echo Newspaper. Audience members: 3

A. Call to Order - Mayor Heidmann called the meeting to order at 7:04 p.m. The Pledge of

Allegiance was recited. Mayor Heidmann read the Amendments to the agenda and asked for any questions or concerns regarding the Amendments.

B. Consent Calendar (NOTICE TO PUBLIC) – All matters listed are considered routine by the

Council and will all be enacted by one motion. There will be no separate discussion of these items unless good cause is shown prior to the time the Council votes on the motion. 1. D. REPORTS 1. City Administrator

a. COVID-19 Update - Max prepared a memo regarding what each city department has done to address any staffing concerns or protocols that may need to change during the COVID-19 pandemic. Max noted the Pickle Factory has been the most impacted thus far with Governor Walz’s Executive Order closing restaurants, but the off-sale remains open. The Pickle Factory full-time staff will be working the off-sale and they also have tasks that can be completed during slow times. Spirits of Nisswa has been very busy. They are working on minimizing physical contact with customers such as when a transaction occurs with cash, and when products are exchanged between employee and a customer. Max outlined various options for improving employee safety and maximizing opportunities to use social distancing with customers. Max stated that various other Cities and Counties have closed their buildings to the public and recommended that the City of Nisswa close City Hall to the Public until April 6, 2020. The two-week precautionary closing of Nisswa City Hall would only see the doors locked, but the employees would still come to work and answer phones, emails, and perform their regular duties in service to the city. The closing of City Hall would also mean the cancelling of all public meetings until the next regularly scheduled City Council Meeting on April 15th. The City Council gave a general consensus that it was in the best interest of the employees and safety of the citizens of Nisswa to close City Hall to the Public for two weeks. After two weeks’ time they will reassess and take further action if needed. Mayor Heidmann stated that staff should make signs and post on the website and on social media on how our residents can contact the city.

Motion by Hoff, seconded by Jacobson to approve the closing of City Hall to the public until April 6, 2020. Motion carried unanimously.

Motion by Hoff, seconded by Johnson to cancel all public meetings for the month of April. Motion carried unanimously.

2. City Attorney – no updates. 3. City Engineer – Hallan noted the MPCA has received the City’s application and has opened the

public comment period for 30 days, ending on April 1st. Hallan has also assisted with answering any MPCA questions on the application. The Hazelwood Bridge project is moving forward and Hallan has provided updated cost estimates to the State for an anticipated project to occur later this year.

E. NEW BUSINESS 1. Update from County Highway Department re: CSAH 13 Project for 2021 – Steve

Stroschein, Crow Wing County Highway Department gave an update regarding the CSAH 13 construction project scheduled for 2021. The County received public feedback that was positive and changed a few areas of design due to public requests. This project was originally chosen to be done as a result of the crash history on the road. At the start of this project the Highway Department created project goals. One of the major goals was creating a safer road for motorists. Another primary goal was to maintain the integrity and history of the road so that it was still scenic and enjoyable to the public. The road project was created to use the suburban design which is cheaper and more scenic for the residents of this area. Currently storm water drainage is going directly into the lake. They are creating a pond to collect storm water so that it can be treated before going into the lakes. The Highway department is also working on trying to get utilities to go underground so there are less poles in the area. The right of way design will need to be approved sometime in April. Stroschein said the County will ask the City for municipal consent for the project at the April City Council Meeting. At this time there is zero cost to the City of Nisswa and to the residents for this project. There should be no assessments to the citizens of this area for this project. With the current Coronavirus situation there has been no setbacks and no impact to construction. The Council thanked Stroschein for the update.

2. Approve the 2019 City of Nisswa Audited Financial Statements - Motion by Johnson, seconded by Jacobson to approve the 2019 Audited Financial Statements. Motion carried unanimously.

3. Recommendation from Planning Commission re: Rezone Application 003-20 for Nisswa LLC

a. Parcel 1 – PID 28110527 Rezone from Shoreland Residential to Commercial Waterfront - Motion by Jacobson, seconded by Hoff to approve Ordinance Amendment/Rezone Application 003-20 for PID 28110527 for Nisswa LLC from Shoreland Residential to Commercial Waterfront and to publish the summary in the local newspaper. Motion carried unanimously.

b. Parcel 2 – PID 28110526 Rezone from Shoreland Residential to Commercial Waterfront - Motion by Jacobson, seconded by Johnson to approve Ordinance Amendment/Rezone Application 003-20 for PID 28110526 for Nisswa LLC from Shoreland Residential to Commercial Waterfront and to publish the summary in the local newspaper. Motion carried unanimously.

4. Recommendation from Parks & Recreation Advisory Commission re: Resolution Supporting Application for Local Trail Connections Program - Motion by Johnson, seconded by Jacobson to approve the Resolution Supporting Application for Local Trail Connection Program. Motion carried unanimously.

5. Recommendation from Parks & Recreation Advisory Commission re: Resolution Supporting Application for Regional Trail Program Funding - Motion by Johnson, seconded by Hoff to approve the Resolution Supporting Application for Regional Trail Program Funding. Motion carried unanimously.

Approve the 2020 Agreement for Professional Services Between the City of Nisswa and the Brainerd Lakes Area Economic Development Corporation. - Motion by Johnson, seconded by Hoff to approve the 2020 Agreement for Professional Services Between the City of Nisswa and the Brainerd Lakes Area Economic Development Corporation. Motion carried unanimously.

8. Approve Road Maintenance Agreement Between the City of Nisswa and Lake Edward Township - Mayor Heidmann would like to have a discussion with Lake Edward Township regarding a complaint the City of Nisswa received from a resident. The resident complaint is regarding Lake Edward Township’s response time to plowing a section of road in this agreement. Heidmann offered to contact the Township to discuss; the Council asked Heidmann to report back with the Townships’ feedback. Motion by Jacobson to table until the April City Council meeting.

9. Personnel Updates - Motion by Hoff, seconded by Johnson to approve the March 2020 Personnel Updates. Motion carried unanimously.

10. Lift Station 3 Improvements Bid Results – Hallan indicated the City received only one bid from R & R Excavating, Inc. in the amount of $761,879.00. He noted he received calls from several contractors asking about the project. The bid was considerably higher than the Engineer’s estimate of $350,000. Hallan believes the tight schedule was the biggest reason why contractors decided to not bid the project at this time. Hallan suggested the City re-bid the project at a later time and will work with Public Works on the details. Motion by Jacobson, seconded by Johnson to reject the bid from R & R Excavating, Inc. in the amount of$761,879.00 for the Lift Station 3 Improvement Project. Motion carried unanimously.

11. Lift Station #3 Pump Purchase Memorandum - Motion by Jacobson, seconded by Johnson to approve the purchase of a pump for Lift Station #3 from Electric Pump, in the amount of$16,578.00. Motion carried unanimously.

F. OLD BUSINESS1. Information Regarding Proposed Liquor Law Changes in Grocery Stores – Max noted

Terry Wallin and Brian Farrell attended an MMBA Conference in St. Paul and spoke to ourRepresentatives regarding the proposed bill to allow grocery stores to sell liquor. Rep.Heintzeman was very supportive of the City of Nisswa’s point of view on this issue. Currentlythis Bill is not active but will most likely start to gain more momentum next year and we willneed to remind our representatives of our position on this bill.

2. Council Discussion re: Council Liaison Structure – tabled until next month’s meeting.

G. COUNCIL REPORTS1. Mayor – Heidmann noted he met with the City Administrator regarding the declaration the

Governor made on closing restaurants and the impact that would have on our local businessesas well as the City.

Action Requested: Approve the pay rate adjustment for Spirits of Nisswa and Pickle Factory employees

as a result of the COVID-19 pandemic as presented.

Background Information:

The Liquor committee discussed a few pay rate options presented by Brian Farrell and Jenny Max as a

result of the potential exposure the liquor store employees face during the COVID-19 pandemic. Farrell

and Max noted that sales at Spirits from March 13-30th have surpassed last year's numbers by just over

$50,000. Spirits has been very busy and staff has done a tremendous job at keeping everything running

smoothly, despite a very stressful situation.

The Committee discussed a few different options for a pay rate adjustment along with the appropriate

time frame for the rate increase. Following discussion, a recommendation was made by the Liquor

Committee to the City Council to provide a one-time $3.00 per hour pay adjustment to all Spirits of

Nisswa and Pickle Factory employees for all hours worked between March 10th and May 3rd . The

approximate cost of this one-time pay adjustment is $9,416.00.

April 13, 2020The League supports financially protecting public safety and health care workers, but says the state needs to fund themeasure, which could cost as much as $500 million.

Under a bill passed by the House and Senate last week, public safety and health care workers who contract COVID-19 will becovered by workersʼ compensation.

The new law (Chapter 72 (https://www.revisor.mn.gov/laws/2020/0/Session+Law/Chapter/72/)), which was signed by Gov. Tim Walz onApril 7, requires that if these workers get COVID-19, it should be presumed that they were exposed at work.

Law could devastate workers’ comp systemThe League opposed the legislation, insisting that the impact of the presumption could be substantial given theunprecedented nature of the pandemic. While protecting public safety workers is paramount, a great deal of unknownsremain about how the pandemic will unfold. Using the state s̓ own projections, the League estimates that workersʼcompensation costs for public safety employees could range from $100 million to more than $500 million.

Without financial backing from the state, the new law could have significant negative implications for the long-term financialand administrative stability of the workersʼ compensation system. For public employers, the cost to compensate workers whocontract COVID-19 will be passed on to property taxpayers at a time of pronounced economic instability.

Unfortunately, legislative leaders were unable to to reach agreement on a financial plan that would have provided state orother assistance to moderate the financial impact on local units of government.

League continues to advocate for city assistanceSince the law s̓ passage, the League has contacted key legislators in an effort to structure a financial response package. ChiefHouse author of the bill, Rep. Dan Wolgamott (DFL-St. Cloud) and Assistant Senate Majority Leader Eric Pratt (R-Prior Lake)are working with the League to develop legislation.

The League has also been collaborating with other local government associations and nongovernmental stakeholders onidentifying funds and mechanisms to cushion the impact on local economies. This includes using a portion of the federal aidMinnesota will be receiving to reimburse organizations that are faced with a high amount of COVID-19-related workersʼcompensation costs.

The League will continue to work with key legislators on a proposal to provide state assistance to address the financialimplications of this new law. Please contact your legislators to make sure they are aware of city concerns and urge them tosupport forthcoming funding legislation.

WHEREAS, on March 13, 2020 the Governor of the State of Minnesota issued Executive

Order 20-01 to declare a Peacetime Emergency due to the evolving public health emergency

known as COVID-19; and

WHEREAS, the impacts of COVID-19 have resulted in the temporary closure of school

systems and various types of businesses including Public Accommodations state-wide; and

WHEREAS, on March 25, 2020 the Governor of the State of Minnesota issued Executive

Order 20-20 to direct Minnesotans to Stay at Home which was subsequently extended through

Executive Order 20-33 until May 4, 2020; and

WHEREAS, on April 7, 2020 the State of Minnesota Legislature passed a Bill providing

for worker’s compensation coverage for public safety and health care workers who contract

COVID-19 while working and was subsequently ratified by Governor Walz; and

WHEREAS, the City of Nisswa fully supports the desire of the Legislature and Governor

to provide COVID-19 coverage for public safety and health care workers; and

WHEREAS, the Bill does not provide a funding source to cover the cost of providing

COVID-19 coverage and has placed an unreasonable burden on the state’s workers’

compensation programs due to the unanticipated and historic pandemic; and

WHEREAS, the potential cost of providing COVID-19 coverage for public safety and

health care workers has been estimated to be between $100 million - $500 million; and

WHEREAS, the impacts of the estimated cost of COVID-19 coverage, if placed on the

shoulders of the state’s workers’ compensation programs, could substantially impact the City of

Nisswa’s annual operating budget and the annual operating budgets of all municipalities across

the State of Minnesota; and

WHEREAS, the City of Nisswa desires to work with the Legislature and the Governor in

the spirit of collaboration to find an appropriate funding source to adequately cover the cost of

COVID-19 coverage for public safety and health care workers.

NOW THEREFORE BE IT RESOLVED that the City of Nisswa asks the Legislature and

Governor of Minnesota to quickly and expeditiously determine a funding source to cover the

estimated costs of COVID-19 coverage so as to not unduly burden the state’s worker’s

compensation programs and subsequently the annual operating budgets for cities of all sizes

across the State of Minnesota.

Re: COVID-19 Update and Recommendations for City Operations through May 4th.

Action Requested: Approve the recommendations outlined below as it relates to City Operations through May 4th.

Background Information:

Governor Walz has extended the Shelter in Place Order until May 4th. As a result City departments are making adjustments to operations. The following is my recommendation for how the City will approach compliance with this Order:

City Hall: Recommend City Hall remain closed to the public until May 4th. All departments will continue to practice social distancing within their departments and also interacting with other departments.

Administrator/Clerk/Finance: Staff is currently working at home a majority of the time, with scheduled days in the office as needed. My recommendation is for staff to continue this structure until April 20th; at that time staff will come back to work per the usual schedule Monday-Friday, 8-4:30pm.

Planning & Zoning: Staff will continue to work from home through April 21st, returning to work April 22nd.

Parks & Recreation: Staff has been working on projects they are able to do, and will continue doing what they can at this time. Staff is working on ideas for future park programming to help re-engage the community at the right time.

Police: Staff has been reporting to work according to their regular schedule. No changes recommended.

Fire: The department has cancelled training for the time being. They have made adjustments to how they respond to medical calls but are still responding as usual to fire calls. No changes recommended.

Public Works/Sewer: Staff will be reporting back to work beginning April 13th and will separate into 2 groups, one for sewer (1 employee) and one for maintenance (3 employees). Contact with the public will resume only for time sensitive issues such as locates or inspections.

Pickle Factory: The off-sale is open and we have been able to provide hours for our full-time employees. Terry Wallin is only scheduling one employee per shift at this time to minimize staff costs. My

recommendation is to keep the off-sale open through May 4th with their normal hours. A summary of the Pickle’s off-sale revenues from March 20th-April 10th is attached to this memo for your reference. Spirits of Nisswa: The store has remained open throughout this time. Sales were extremely high for a while and still show higher than normal sales volumes compared with last year. Brian conferred with his staff and made the decision to shorten the hours open to the public to allow changes in their approach to stocking and cleaning to maintain staff safety. Current hours are Monday-Saturday, 10am-8pm and closed on Sunday. My recommendation is for Sprits’ normal hours to resume beginning Monday, May 4th. Note: I may have an adjustment to the Spirits’ hours recommendation as Brian Farrell and I are still discussing the details. City Meetings: Regularly scheduled City meetings have either been cancelled or conducted virtually for the month of April. The exception to this is the upcoming Board of Appeals meeting on April 21st that is hosted by the City at City Hall but conducted by Crow Wing County. The County will have protocols in place to maintain social distancing while still conducting this meeting in person. The public will be asked to wait in the lobby area and the County will have one person come into the Council Chambers at a time. City meetings are expected to resume per the normal schedule beginning in May.

ROAD MAINTENANCE AGREEMENT

THIS AGREEMENT is entered into this 1st day of May, 2020, between the City of Nisswa, Minnesota and the Township of Lake Edward, Minnesota;

WHEREAS, the City of Nisswa and the Township of Lake Edward have a common boundary, and;

WHEREAS, certain roads which service both governmental units run partly on the common boundary, and;

WHEREAS, the lower portion of the East Clark Lake Road, located wholly in the Township of Lake Edward, is an extension of that part of the East Clark Lake Road which shares a common boundary between the parties, and;

WHEREAS, all of these roads have a blacktop, and;

WHEREAS, it is in the interest of each jurisdiction to facilitate the maintenance of each type of road surface, and;

WHEREAS, maintenance shall be defined as mowing, brushing, crack filling, blading gravel, patching potholes, and snowplowing, all as needed, and;

WHEREAS, improvements shall be defined as addition of gravel, major patching, skin patching with a paver, overlays or seal coats, widening, culvert placement, replacement or repair, drainage improvements and similar work;

NOW THEREFORE, each municipality agrees that it will maintain roads, as needed, at no cost to the other party to this agreement, those portions of road set out on the attached map dated May 1, 2020;

1.) The City of Nisswa will assume responsibility for the maintenance of those portions of road set out in blue (part of Middle Cullen Road, South Clark Lake RD), and;

2.) The Township of Lake Edward will assume responsibility for the maintenance of those portions of road set out in pink (East Clark Lake Road, Lake Hubert Drive), and;

3.) The cost of mutually agreed upon improvements shall be shared equally on roads which share a common border, and;

THIS AGREEMENT shall be in effect for one (1) year from the date first above written and will automatically renew each year following. Either party may terminate this agreement upon giving ninety (90) days' written notice to the other party.
