On behalf of our Client, Viva Energy (Australia) Pty Ltd, please find attached all relevant material tosupport an application for a development approval at 86 Avon Terrace, York (refer to aerial image inFigure 1).
A Shell sign and service station sign (price board) are situated on the northern boundary facing AvonTerrace. Other signage on site consists of Shell branded canopy fascia and various businessidentification signage (refer to Figure 2).

The application relates to a proposed upgrade to the advertising signage on the existing Shell servicestation site.

2.0 Site Details
The site subject to the development application is an existing Shell Service Station located at 86 AvonTerrace, York. The relevant property details are summarised in Table 1.

3.0 Proposal
An advertisement signage upgrade is proposed to the existing Shell service station site including thefollowing:
· 1 x Illuminated pylon sign (referred to as flag sign on plans) - 7m high x 2m wide in the samelocation;
· 1 x illuminated monolithic sign (referred to as price board on plans) – 2.7m high x 1.4m wide inthe same location;
· 2 x new height markers – 210mm high x 2.8m wide (maximum possible width) located beneaththe service station canopy facing north and;
· 1 x new illuminated canopy pecten sign – 1.2m wide x 1.2m high attached to the corner of thecanopy wall facing north.
It is noted that the above changes to signage will be accompanied by other signage upgrades that donot require planning approval as they constitute replacement signage in accordance with currentlydisplayed structures and materials. This includes replacement of the existing canopy fascia with newnon-illuminated fascia panels and replacement of two advertising signs (which consist of hoopedbollards and leader boards). The replacements are to be placed in the same locations with the samedimensions as existing signs. These are considered to be ‘like for like’ replacement.
The details associated with each proposed sign are summarised below and illustrated within proposedsignage plans depicted within Attachment 4.3.1 Pylon Sign (flag sign)
The existing Shell service station currently has an illuminated advertising sign with the Shell emblem.This is proposed to be replaced with an updated illuminated sign with dimensions of 5m high x 2mwide and a depth of 400mm. In accordance with the local planning policy for signage, this sign isdefined as a pylon sign. The sign will not consist of any flashing parts. The location of the signage willremain the same as the existing sign.
3.2 Monolithic Sign (Price Board)The existing non-illuminated price board is proposed to be replaced with an internally illuminated priceboard. The sign has dimensions of 2.7m high x 1.4m wide. The sign will display fuel prices and will notconsist of any flashing parts. The proposed sign consists of Shell red and white panelling. Inaccordance with the local planning policy for signage the price sign is defined as a monolithic sign.
3.3 Height Markers
A height marker is currently provided on the canopy fascia wall, however overtime this has faded.Two new height markers are proposed to be displayed beneath the canopy roof in the form ofseparate signage. The sign will have dimensions of 210mm high x 2800mm wide and will be installedat a minimum height of 5m. The ‘5 metre height’ text will be displayed in red on a white background.
3.4 Canopy Pecten Sign
The Shell service station does not currently have a canopy pecten sign. The canopy consists of ayellow fascia wall with a wide red stripe through the bottom half of each side. Attached to the northerncanopy fascia will be a new internally illuminated Shell Pecten Sign with dimensions of 1200mm widex 1200mm high.

4.0 Planning AssessmentProposed works are subject to the Town Planning Schedule No.2 (TPS2) and Shire of York’s localpolicy for signage, Advertising Signage. The TPS2 is to be read in conjunction with council’s localpolicy for signage. The proposed works have been assessed against relevant requirements within thelocal government policy as follows:
Section 3.1 York Town Planning Scheme No.2
Clause 4.1 of the Scheme requires that all development, including the erection, placement anddisplay of any advertisements, requires the prior approval of the local government. A person must notcommence or carry out any development without first having applied for and obtained the planningconsent of the local government under Part 7.
Schedule 8 of the Scheme identifies advertisements that are exempt from requiring planning approvalfrom Council. The proposed signs do not meet the requirements set out in the table of exemptions andwill therefore require planning approval.
Section 6 – Advertising standards
Specific requirements for particular types of signage have been outlined in section 6 of the local policydocument. All proposed signs have been measured against specifications and are consideredconsistent with these standards.
Section 7.2 – Assessment Criteria
In considering applications Planning Officers are to have regard to the assessment criteria set out inthis section. Responses to these criteria have been provided below.
7.2.1 Character of the Area
The subject site is situated within the southern portion of the York Town Centre. Surrounding landuses are a mix of commercial activities including food and drink premises and retail stores. TheMunicipal Office and Town Hall are also located in walking proximity of the site. Signage character ofthe immediate surrounds predominantly consists of wall signs and under veranda signs. A pylon sign(flag sign) and monolith sign (price board) currently exist on the Shell Service site.
7.2.2 Special Areas
The proposed signage will not diminish the appearance of significant elements in the immediate areaas the proposed signs are similar to the current planning package on the site.
7.2.3 Views and Vistas
The proposed signs are setback within the site boundaries and do not impede on any significant viewsor viewing rights to other advertisers.
7.2.4 Streetscape, setting or landscape
Signage along the street is generally setback within site boundaries or situated beneath canopies.Size and style vary in accordance with the varying uses.
The proposed signs do not create ‘clutter’ or ‘unsightliness’ as the proposed signage package issimilar to existing signage on the site. As such, the proposed signs are considered sympathetic to theircontext and consistent with signage within the surrounding streetscape.
7.2.5 Site and building
Signage is considered appropriately proportioned to the site and building and will provide visibility ofthe service station within proximity of the site.
7.2.6 Associated devices and logos with advertisements and advertising structures
Structures have been designed as an integral part of the proposed signage package to ensureseamless and well-thought signage is displayed.

7.2.8 Illumination
The proposed monolithic sign and canopy pecten are to be internally-illuminated. The intensity of theillumination will be regulated in accordance with relevant legislative requirements which will ensurethere aren’t any safety impacts or detraction from local amenity.
7.2.9 Safety
Location of signs will remain the same as the existing signage, which is setback from the siteboundary and will not result in safety concerns for pedestrians, drivers and cyclists.
5.0 Conclusion
In summary, a development approval is sought for new advertising signs on the existing Shell servicestation site located at 86 Avon Terrace, York. The nature of the proposed advertising signage isconsistent with the existing use of the site as a service station. It is therefore recommended that thedevelopment application is approved by the Shire or York.

AECOM Australia Pty Ltd (AECOM) continues to act on behalf of Lendlease in relation to the abovementioned application. We write in response to Council’s Request for Further Information (dated 26September 2017).
To support the further information response please find enclosed updated signage and site plansprepared by AECOM and a response to the Shire’s Local Planning Policy No.3 – Heritage Precinctsand Places (Heritage Policy) within this letter.
We are pleased to present the additional information in order of points raised within the Request forFurther Information email.
1. The Shire’s Local Planning Policy No. 3 prohibits signs that break a roof line/parapet. Can youplease provide detail of how the pecten sign will be affixed to the canopy so this can beaccurately assessed. You could do this by annotating the elevations to illustrate this.
Details of the pecten sign attached to the canopy elevation have been provided in the updated signageplans enclosed with this letter.
As per our conversation on 26 September 2017, the proposed signage package requires a variation tothe Heritage Policy as the policy stipulates that signs should not break the parapet or roof line. Theproposed pecten sign will break the parapet of the existing service station canopy. However the signwill not break the roofline or parapet of the existing Shell Service Station building.
The proposed sign will be attached to the side elevation canopy and will protrude approximately 0.35metres above the canopy roof line. This sign is setback from the corner of the canopy and does notdirectly address the street frontage and therefore the impact on the streetscape is minimal.
Furthermore, as per our telephone discussion regarding this variation, the impacts of the variation tothe policy is considered minimal as proposed sign does not dominate the streetscape and does notdetract from the heritage significance in the precinct.
This proposed signs have also been assessed against the objectives of the heritage policy as follows:Table 1 Shire of York Heritage Precincts and Places - Clause 5.2 Policy Objectives

The proposed signs are replacing existingsignage of similar scale and content and will notresult in a proliferation of signage. The signageupgrade is proposed in accordance with theNational Shell Branding Strategy.

The existing wall signs and design of the canopywill not detrimentally impact on the significance ofthe heritage precinct.
To limit the number, scale and positioning ofadvertising signs.
Two of the proposed signs will be replacingexisting signs (flag sign and canopy sign). Theproposed new signs are the leaderboardsbeneath the canopy adjacent to the fuel pumps.The main purpose of these signs is to act as a

crash barrier for the fuel pumps. Furthermore,these signs are located at ground level and do notdominate the streetscape.
To ensure that advertising signs are in keepingwith the scale and character of the building uponwhich they will be attached and do not detractfrom the architecture of the building.
The proposed signs are well-proportioned to thescale and character of the building and have beenincorporated into the overall appearance of theService Station. The proposed internally-illuminated roof sign protrudes slightly over theroof line of the canopy. However, this sign islocated on the side elevation of the canopy anddoes not create a break along the street-frontcanopy elevation and does not detract from theheritage value of the precinct within site vicinity.This sign will not break the roof line or parapet ofthe existing Service Station building.
To ensure that signage is designed and located ina manner which enhances and conserves theheritage place with which it is associated.
The proposed signs are consistent with theexisting Shell signage on site. The signs includethe colours yellow, white and red and do notdominate the streetscape. The wall signs andcanopy structure will be retained and enhancedwith the addition of an internally-illuminated pylonsign and roof sign. These signs will be internally-illuminated, will not consist of flashing or movinglight and will improve site visibility for longerperiods. The illuminated elements will not detractfrom the heritage place as they are eitherincorporated into the built form or located alongthe site boundary whereby the signs cancontribute as being way-finders (pylon sign).
2. As per our discussion, the elevations refer to six leadership boards being erected which isincorrect and only two leadership board signs are proposed. Our records do not indicate thatthere are existing leadership boards on the property for these to be exempt as replacing like forlike, and will require development approval. Can you please amend the sign elevation plan torefer to two signs, and show location of these signs on the site plan.
The initial application plans inadvertently provided inconsistent information for the existing siteconditions. The application plans have been updated and we hereby request that the leaderboardsigns be included in the proposal and provide the following details to assist with your assessment:
Two new non-illuminated advertising signs (referred to as ‘leaderboards’) are to be located near thepump stations beneath the Service Station canopy. These signs consist of an information board(displaying types of fuel) situated within a hooped bollard. The sign has a height of 1.2 metres and awidth of 0.88 metres.
We note, the advertisement fees of $177.00 will be paid via telephone following the notice tocommence advertising.
We trust that the further information provided in this letter and the enclosed documents satisfiesCouncil’s request and that this application can now proceed to advertising. Should the informationprovided be considered to not meet the requirements of the request for further information, pleaseconsider this letter a formal request for an extension to the lapse date to enable further details to beprovided.
