I, PAUL NATHAN RAJAN, the Registrar of Motor Vehicles, in pursuance of section 59(2) of the Motor Vehicles Act, and with reference to section 42 of the Interpretation Act, exempt a person to drive an articulated vehicle specified in the Schedule from the requirements of section 55 of the Act, provided -

(a) the other requirements under Part VA, the Standards and Schedule 4 of the Act are complied with; and

(b) the articulated vehicle does not attach more than three trailers in the combination.

Control of Roads Act TEMPORARY ROAD RESTRICTIONS

I, PHILLIP HARRIS, Regional Director Katherine, as delegate of the Minister for Transport and Infrastructure, being satisfied saturated pavement may make the road or part of the road specified in column 1 of the Schedule subject to deterioration by the passage of vehicles, pursuant to section 11A(3)(a) and (5) of the Control of Roads Act, give notice of the following decisions: (a) pursuant to section 11A(1)(b) of the Act, use of the road

or part of the road is restricted to vehicles - (i) the mass of each of which does not exceed the mass

specified in column 2 of the Schedule; or (ii) the mass of each of which does not exceed the

percentage of the mass limit for the type of axle or axle group (other than a steer axle) specified in column 3 of the Schedule and the total number of axles of which does not exceed the number specified in that column;

(b) pursuant to section 11A(1)(d) of the Act, the restrictions on the use or manner of use specified in column 4 of the Schedule are imposed,

from 9.30am, Monday, 20 June 2011. For this notice, “GCM” or an expression relating the specifications for a vehicle has the same meaning as it has under the Motor Vehicle (Standards) Regulations; except that “GVM” has the same meaning as it has under the Australian Road Rules. Interpretation ActNOTIFICATION OF MAKING OF RULES UNDER

TOTALISATOR LICENSING AND REGULATION ACTI, DELIA PHOEBE LAWRIE, Minister for Racing and Gaming:

(a) under section 63(3) of the Interpretation Act and with reference to section 43 of the Act, revoke the notification of the making of rules under the Totalisator Licensing and Regulation Act dated 13 April 2011 and published in Gazette No. G17 of 27 April 2011; and

(b) under section 63(3) of the Interpretation Act, give notice that the authority administering the Totalisator Licensing and Regulation Act, which is the Northern Territory Licensing Commission, has made the following rules under section 46 of that Act:

Commercial Passenger (Road) Transport ActDETERMINATION OF MAXIMUM FARES

AND CHARGES FOR TAXISI, GERALD FRANCIS McCARTHY, Minister for Transport:

(a) under section 26(1) of the Commercial Passenger (Road) Transport Act and with reference to section 43 of the Interpretation Act, revoke the instrument entitled "Determination of maximum fares and charges for taxis" dated 23 February 2010 and published in Gazette No. G12 of 24 March 2010; and

(b) under section 26(1) of the Commercial Passenger (Road) Transport Act, determine the maximum fares and charges that may be charged for the hire or use of a taxi in the Alice Springs area, Darwin area, Katherine area, Nhulunbuy area or Tennant Creek area as set out in the Schedule.

SCHEDULEPart 1 Areas to which determination applies1 In this Schedule: Alice Springs area means the area within the town of

Alice Springs. Darwin area means all that area of land near Darwin

bounded by lines described as commencing at the intersection of Goode Road and the Stuart Highway; then westerly along Jenkins Road to Bees Creek Road; then northerly along Bees Creek Road to the centreline of Elizabeth River; then generally north-westerly along the centreline of Elizabeth River to Low Water Mark at its tidal limit; then generally north-westerly by Low Water Mark of its right bank and by straight lines across the mouths of all intersecting creeks and rivers to the mouth of Sadgroves Creek; then generally southerly and north-westerly to Emery Point, generally north-easterly past East Point to Lee Point and generally south-easterly by the Low Water Marks of Port Darwin, Beagle Gulf and Shoal Bay to the centre of the mouth of Hope Inlet; then generally south-easterly and southerly by the centrelines of Hope Inlet and Howard River to the northern boundary of Section 4076 Hundred of Bagot; then easterly and southerly by the northern and eastern boundaries of Section 4076 and its prolongation southerly to the northeastern corner of Section 247; then easterly to the north-eastern corner of Section 244; then southerly by eastern boundaries of Sections 244, 265, 4449 and their prolongation southerly to Girraween Road; then easterly along Girraween Road to Coral Road; then southerly along Coral Road, Oscar Road and its southerly prolongation, Trippe Road North, across Arnhem Highway and again southerly along Trippe Road and its prolongation southerly. to Goode Road at the south-eastern corner of Section 3043 Hundred of Strangways; then westerly along Goode Road to the point of commencement.

Katherine area means the area within a 5 kilometre radius of the Post Office at Katherine.

Nhulunbuy area means the area within a 13 kilometre radius of the Post Office at Nhulunbuy.

Tennant Creek area means the area within a 5 kilometre radius of the Post Office at Tennant Creek.

Part 2 Maximum fares and charges for areas other than Tennant Creek area

2 This Part applies to the Alice Springs area, Darwin area, Katherine area and Nhulunbuy area.

3 In this Part: applicable area means the Alice Springs area, Darwin

area, Katherine area or Nhulunbuy area. core period means the period starting from 6am and ending

immediately before 6pm. distance travelled means the rate expressed in dollars per

kilometre that may be charged for the distance travelled for a journey.

flagfall means the hire charge for a journey. special journey means a journey for a wedding, funeral or

other special occasion where the hiring includes waiting until the wedding, funeral or other special occasion has taken place and further carriage of the hirer immediately afterwards.

Tariff means Tariff 1, Tariff 2, Tariff 3, Tariff 4, Tariff 5 or Tariff 6.

Tariff 1, for an applicable area, means an amount specified in· the table for that area for a journey:

(a) made wholly within that area; and (b) starting on a weekday within the core period; and (c) for which a multiple hiring rate or high occupancy

rate does not apply. Tariff 2, for an applicable area, means an amount specified

time that must elapse before a charge of 10 cents may be made for a journey.

4 A high occupancy rate applies only in relation to a journey for carriage of 5 or more passengers in a taxi licensed to carry 6 or more passengers.

5 A multiple hiring rate applies in relation to a journey only if:

(a) a high occupancy rate does not apply in relation to the journey; and

(b) the journey is undertaken for a passenger who has agreed to multiple hiring of the taxi within the meaning of the Regulations.

6 Subject to clauses 7 and 8, the maximum fare or charge that may be charged for the hire or use of a taxi for a journey made wholly or partly within an applicable area is the sum of:

(a) the amounts calculated in accordance with the applicable Tariff in the table for that area for the flagfall, the distance travelled, . and the waiting time, for so much of the journey as is made within that area; and

(b) any applicable airport exit toll.7 If the journey is a special journey made wholly or partly

within the Nhulunbuy area, the maximum fare or charge that may be charged for the hire or use of the taxi for so much of the journey as is made within the Nhulunbuy area is as follows:

(a) if the duration of the journey is one hour or less - $47.60;

(b) if the duration of the journey is more than one hour: (i) for the first hour - $47.60; and (ii) for each hour or part of an hour after the first

hour - $23.30.8 If a taxi is soiled by a passenger in the course of a journey,

the maximum amount that may be charged for the cost of cleaning the taxi is $50.
