1%-'(-%1 may not #e &rosecuted under this su#section. 7+ce&t as other)ise &roidedin this su#section, any &erson )ho iolates this su#section is uilty of a class C felony."f, at the time of the offense the &erson is in or on, or )ithin one thousand feet 300.'meters of the real &ro&erty com&risin a &u#lic or &riate elementary or secondaryschool or a &u#lic career and technical education school, the &erson is uilty of aclass 4 felony. . 7+ce&t as &roided #y section 19-03.1-'5, a court may order a &erson )ho iolatesthis cha&ter or cha&ter 19-03.' to undero a dru addiction ealuation #y a licensedaddiction counselor. The ealuation must indicate the &ros&ects for reha#ilitation and)hether addiction treatment is re6uired. "f ordered, the ealuation must #e su#mittedto the court #efore im&osin &unishment for a felony iolation or a misdemeanoriolation.
