MERGER OF THE POSTS OF EXAMINER-Ill AND EXAMINER-I! AS EXAMINER-I!IN GS/MI WEF 01.01.2006

2. Consequent to implementation of recommendations of 6th CPC and Ministry ofFinance/ Deptt of Expenditure Gazette Notification No. GSR 622(E) dated 29 Aug 2008[Part B, Section 1(ii) and Part C, Section 1(ii) and their OM No. 1/1/2008-IC dated 13 Nov2009, vide CAO/CP Cell letter under reference, the posts of Examiner-Ill in the pre-revisedpay-scales of ~5,000-8,000 and Examiner-II in the pre-revised pay-scale of ~5,500-9,000in GS/MI had been merged as Examiner-II in revised scale of pay ~9,300-34,800 in PB-2with Grade Pay of ~4,200 w.e.f. 01.01.2006 as under:

As per DOP&T OM dated os" March 2009 "all post in one or more pre-revisedscales are merged with a higher pre-revised scale and given a common replacementscale/grade pay scale, the suitability of the incumbents, except Group-'A' need not beassessed for granting them the higher replacement scale/grade pay/ pay-scale, there isalso no need for the incumbents to complete any minimum eligibility service in the earlierscale of pay. There will be no change in the inter-se-seniority of the incumbents in themerged grade which shall be decided based on the general instructions on the subject."Hence, the existing DPC for the higher/highest grade will be the DPC for the mergedgrade.

4. However, revised RRs in respect of above mentioned grades are being framed bythe MPR Division. The revised pay structure approved includes a number of mergedgrades with a common grade pay and the concept of Pay Band with Grade Pay introducedeffective from 01.01.2006. In so far as the issue of regulation of service rendered prior to01.01.2006 is concerned while the general rule may be that such regular service bedeemed to be service rendered in the corresponding Grade Pay / Pay-Scale approvedeffective from 01.01.2006 or from a subsequent date, as the case may be. Since themerger is effective w.e.f. 01.01.2006 only, even notional benefits of the merger cannot beextended for periods falling prior to 01.01.2006. For the purpose of computing minimumqualifying service for promotion, the service rendered on a regular basis by an officer priorto 01.01.2006 or the date from which the revised pay structure passed on the 6th CPCrecommendations has been extended, shall be deemed to be service rendered in thecorresponding Grade Pay/Pay-scale extended based on the recommendations of theCommission.

As per MoD ID No.410/2009/D(Civ-l) dated 24 Aug 2009 mentioning the authority ofDOP&T Dy No.3505/CR/2009-Estt(RR) dated 13.08.2009, "all posts under sub-para (i),Section 1, Part B & C of CDS(RP) Rules, 2008 should stand merged/upgraded wef 01 Jan2006 without waiting for amendment of RRs, since these have already been approved bythe Government".

6. As per clarification issued vide para 2 of OOP&T OM No.20020/4/2010-Estt.(O)dated 13.09.2012, seniority of officers holding post in grades which have been merged inpursuance to recommendations of e" CPC will be determined as follows:

I. The status of government servant as on 29.08.2008 including those whohave earned promotion between 01.01.2006 to 29.08.2008 will be protected asappointment/promotions are made as per the provisions of statutory recruitmentrules applicable to the post/grade. The merger of the pay scale(s) of the post(s) asrecommended by 6th CPC have been made effective w.e.f. 01.01.2006; the seniorityof government servant which existed on 29.08.2008 (date of acceptance ofrecommendation of s" CPC) will be maintained i.e., the holder of post having higherpay scale or post which constituted promotion post for the post in the feeder grade,will rank enbloc senior to those holding post having lower pay scale or the post infeeder grade;

Where posts having different pay scales prior to e" CPC recommendationand now after merger have come to lie in the same Pay Band with same GradePay, the inter-se seniority of all the employees will be fully maintained withemployees in a higher pre-revised pay scale being placed higher vis-a-vis anemployee in a lower pay scale. Within the same pre-revised pay scale, senioritywhich existed prior to revision would continue; and,

IV. The availability of officers nominated on the basis of panel of promotiongiven by OPC or selection list given by selecting Authority will be decided as on29.08.2008.

7. In view of the above, draft inter-se-seniority of the present incumbents in themerged grade of Examiner-I! is attached as Annexure to this Note. You are requested tocirculate the same to all concerned. Discrepancy, if any, may be brought to the notice ofthis office within 15 days from the issue of this note.

8. This Note supersedes all the Seniority Lists issued wef 01 Jan 2006 till date for thegrades of Examiner-II and Examiner -Ill.
