SEALED QUOTATION FOR SUPPLY OF LABORATORY EQUIPMENT

SRI LANKA PHARMACEUTICAL LABORATORYTENDER REFERENCE: PROCUREMENT COMMITTEE, UNIVERSITY OF COLOMBO

INSTRUCTIONS TO TENDERERS

01. INVITATION TO TENDER

The Chairman of the Department Procurement Committee, University of Colombo, is calling for sealed quotations up to 2.30 p.m. hours on 4 October 2017 for the supply, installation, commissioning, repair and maintenance during warranty period of the list of analytical equipment with specifications given in the annexed document.

SCOPE OF WORKS The Scope of Work consist, supplying, installation, commissioning, training of two members, & maintenance of NEW EQUIPMENT FOR THE SRI LANKA PHARMACEUTICAL LABORATORY, University of Colombo, Sri Lanka.

The submitted tender shall consist of the following documents:i. Duly filled offered Specifications against the Tender Compliance Reportii. Schedule of Prices.iii. a) A list of Equipment Supplied by your company, and the contact persons to

obtain comments of the equipment and your services. b) Manufacturer’s technical literature, and specifications illustrations and

full particulars and specifications.c) Local and foreign training provided by you to the customers.

02. ELIGIBILITY OF TENDERS

Tenders will be entertained only from manufacturers or their accredited agents in Sri Lanka, who could provide documentary evidence of their ability to install, maintain and provide after sales service, and training for the product supplied. Training for the equipment can be provided by foreign experts when local agent is not capable of training.

03. CURRENCY OF BID Tenderer from a country outside the Asian Clearing Union should quote in a freely convertible currency in Sri Lanka such as US $ or Euro or Yen.

04. SUBMISSION OF TENDER

a) The original tender together with the Tender Guarantee of 2% of the value must be submitted before the time of tender opening in duplicates. Both these envelopes shall be enclosed in securely sealed cover marked “TENDER FOR EQUIPMENT OF SRI LANKA PHARMACEUTICAL LAB" at the left hand corner of the envelope and addressed to THE CHAIRMAN, DEPARTMENT PROCUMENT COMMITTEE OF SRI LANKA PHARMACEUTICAL LABOROTORY, NO: 94, COLLEGE HOUSE, UNIVERSITY OF COLOMBO, COLOMBO 03, SRI LANKA.

b) Tenders shall be sent by registered post or delivered personally to the Tender Box, Registrar’s Office, University of Colombo, Sri Lanka on or before 2.30 pm on 4 October 2017

c) When tenders are sent by post, time and date of receipt will be taken as that certified by the authorized officer of the Procurement Committee, Sri Lanka Pharmaceutical Laboratory, University of Colombo, in the case tenders received directly, the person who delivers the tender is entitled to a receipt.

d) Tender will be immediately opened after the submission time of tenders at the office.

e) Tenders received after 2.30 pm on 4 October 2017 will be rejected.

05. VALIDITY OF TENDER

Tender shall remain valid for 90 days after the date of tender closing.1. ERRORS SHOULD BE CORRECTED AS FOLLOWS

a. Where there is discrepancy between the amounts in figures and word, amount in words will govern And

b. Where there is discrepancy between the unit rate and line item total resulting from multiplying the unit rate by quantity i. The unit rate as quoted will govern ,

ii. Unless in the opinion of the procurement committee there is an obviously gross misplacement of decimal point in the unit rate, in which case the line item total as quoted will govern and the unit rate will be corrected.

The amount stated in the form of bid adjusted in accordance with the above procedure with the concurrence of the bidders shall be considered as binding upon the bidder. If the bidder does not accept the corrected amount of bid, his bid should be rejected.However if the total bid price increases due to corrections of above mistakes, the corrections should be readjusted within the tender price in consultation with the tenderer.Where the adjusted price is lower than the tendered price the adjusted figure will be the bid price. If the tenderer does not agree for such adjustments, his bid should be rejected without affecting his bid security.

06. DOCUMENTS ESTABLISHING ELIGIBILITY OF THE BIDDERS AND GOODS

i. The Bidder shall furnish, as part of its Bid, certification Establishing both the Bidder's eligibility to bid and that the origin of the Goods. The bidder shall in this bid indicate the name, address, telephone/fax numbers, E-mail address of his agent in Sri- Lanka. A duly filled executed Power of Attorney authorizing such local agent, valid for the period of contract, to act on behalf of the foreign bidder should be forwarded with the Bid document.

07. DOCUMENTS ESTABLISHING THE BIDDER'S QUALIFICATIONS TO PERFORM THE CONTRACT i. The documentary evidence of the Bidder's qualifications to perform the contract, if its

Bid is accepted, shall establish to the Purchaser's satisfaction. (a) That in the case of a bidder offering to supply goods under the contract which

the bidder did not manufacture or otherwise produce, the bidder has been duly authorized by the Goods manufacturer or producer to supply the Goods to or in the purchase's country.

(b) That the bidder has the financial, technical and production capability necessary to perform the Contract, and

(c) That the bidder shall provide documentary proof that his/her agent in Sri- Lanka is equipped and able to carry out the maintenance, repair and spare parts-stocking obligations prescribed by the Contract.

08. CONVERSION OF SINGLE CURRENCY

i. To facilitate evaluation and comparison, the purchaser will convert all Bid prices, expressed in the various currencies to Sri- Lanka Rupees, at the selling exchange rate established by the Central Bank of Sri- Lanka, for similar transactions on 30 days prior to closing date of the Tender.

09. EVALUATION AND COMPARISON OF BIDSi. The purchaser will examine the Bids to determine whether they are complete, whether

they are from eligible bidders, whether these are eligible goods, whether any computational errors have been made, whether required guarantees have been furnished, whether the documents have been properly signed, and whether the Bids are generally in order.

ii. The comparison shall be of the ex-factory /ex-warehouse /off-the-shelf price of the Goods to be offered from within the suppliers country such price to include all costs as well as duties and taxes paid or payable on components and raw material incorporated or to be incorporated in the Goods and the C & F port-of-entry price of the Goods to be offered from outside the Purchaser's country.

10. CONTACTING THE PURCHASER

i. No Bidder shall contact the purchaser on any matter relating to its bid, from the bid opening to the time the Contract is awarded.

ii. Any effort by a bidder to influence the Purchaser's decision in respect of bid evaluation, bid comparison or contract award will result in the rejection of the bidder's bid.

iii. The Purchaser reserves the right to accept or reject any bid or any part bid and annul bidding process and reject all Bids at any time prior to award of Contract, without thereby incurring any liability to the affected bidder or bidders or any obligation to inform the affected bidder or bidders of the grounds for the Purchaser's action.

GENERAL CONDITIONS OF CONTRACT1. Any Tender which is not in conformity with any or all of the conditions laid down herein

and in the Tender specifications will be rejected.

2. Tenders must be submitted on the Formatted Tender Documents issued by the Sri Lanka Pharmaceutical Laboratory, University of Colombo and where applicable, all such documents must be properly completed where necessary using the same format but with extended space.

3. The Bidders whose tender is accepted will be responsible for providing all labour, materials, tools, plant and equipment required to carry out the work and make it a complete operating installation under the contract while conforming to good engineering practice and a high level of workmanship.

4. The Tender should be valid for a period of 90 days from the date of closing the Tender.

5. THE University of Colombo shall establish an irrevocable Letter of Credit for the foreign component value quoted in the schedule of price.

(a) The successful tenderer shall submit the necessary Proforma Invoices and other connected documents.

(b) THE University of Colombo shall be responsible for clearing the goods from port, transport and delivery of the goods to the site of Sri Lanka Pharmaceutical Laboratory, University of Colombo.

6. The Agreement for subcontracting the supply, installation and commissioning of the Equipment by the Supplier without the approval of the University of Colombo will not be allowed.

7. The Procurement Committee, Sri Lanka Pharmaceutical Laboratory, University of Colombo, reserves to itself the right without question to reject any or all of the Tenders received without assigning any reasons thereof and is not bound in any way to accept the lowest or any tender.

8. The expenses incurred in connection with the preparation of the Tender shall be borne by the Tenderers.

9. AFTER SALES SERVICE

The manufacturer / local agent shall also stock all spares, accessories and consumables as may be required for the use of the product from time to time. They shall also be responsible for supply of after sales service, training installation and maintenance of equipment.The tenderer should also attach to the original tender the following documents.

1. A certificate declaring the guarantee of availability of spare parts for a period of 10 years from the date of supply of equipment.

2. Printed illustrated technical literature of the equipment quoted3. Details of the after sales service facilities available in Sri Lanka including the

facilities for training and illustrations if necessary. Where necessary experts from the manufacturer should be sent to install and commission the equipment supplied at no expense to the Procurement Committee, Sri Lanka Pharmaceutical Laboratory, and University of Colombo.

10. All equipment supplied shall carry a comprehensive "Parts and Labour" warranty for a minimum period of two year from the date of installation or commissioning where necessary.Such warranty will require the availability of service and maintenance facility in Sri Lanka with competent technical staff, maintenance equipment and tools, workshop facilities and sufficient stocks of spare parts to be supplied free of charge.Please give details of these facilities indicating full name, address, telephone/fax numbers and contact name of the person.

11. PATENT RIGHT (AND OTHER THIRD PARTY RIGHTS) AND ROYALTIES The suppliers shall at all time indemnify and keep indemnified the University of Colombo against any and all claims at any time arising on Account of patent rights or other rights, whether from manufacturers or others from the use in Sri Lanka of the goods supplied.

12. All bidders are instructed to submit all the technical literature, brochures and other details pertaining to the machine with the tender. These who do not submit these details with the tender are not considered.

13. Use of Contract Documents and Information

13.1 The Supplier shall not, without the Purchaser’s prior written consent, disclose the Contract or any provision thereof, or any specification, drawings, pattern, sample or information furnished by or on behalf of Purchaser in connection therewith, to any person other than a person employed by the Supplier in the performance of the Contract. Disclosure to any such employed person shall be made in confidence and shall extend only as far as may be necessary for purposes of such performance.

13.2 The supplier shall not, without the Purchaser’s prior written consent, make use of any document or information specified herein except for purpose of performing the Contract.

13.2 Any document, other than the Contract itself, specified shall remain the property of the Purchaser and shall be returned (in all copies) to the Purchaser, on completion of the Supplier’s Performance under the Contract, if so required by the Purchaser.

14. Change OrdersChange mutually agreed upon as a Change shall constitute a part of the work under this Contract, and the provisions and conditions of the Contract shall apply to say Change.

15. Contract Amendments15.1 No variation in or modification of the conditions and terms of the Contract shall

be made except by written amendment signed by the parties.16. Subcontracts

16.1 The Supplier shall not subcontract all any part of the Contract without first obtaining the Purchaser’s approval in writing of the subcontracting and the subcontractor.

16.2 The Supplier guarantees that any and all subcontractors of the Supplier for performance of any part of the work under the Contract will comply fully with the terms of the Contract applicable to such part of the work under the Contract.

17.1 The Purchaser or its representative shall have the right to inspect and/or to tests the Goods to confirm their conformity to the Specifications. The Special Conditions of Contract and/or the Specifications shall specify what inspections and tests the Purchaser required and where they are to be conducted. The Purchaser shall notify the Supplier in writing of the identity of any representatives retained for these purposes.

17.2 The inspections and tests may be conducted on the premises of the Supplier or its subcontractor(s) at point of delivery and at the final destination of the Goods. Where conducted on the premises of the Supplier, all reasonable facilities and assistance, including access to drawings and production data, shall be furnished to the inspectors at no charge to the Purchaser.

18. Warranty

The Supplier warrants to the Purchaser that the Goods supplied under the

Contract will comply strictly with the Contract, shall be brand new in every

respect and shall be free from defects. The Supplier further warrants to

Purchaser that all materials, equipment and supplies furnished to the Supplier

for the purpose of the Goods will be new, merchantable of the most suitable

grade, and fit for their intended purposes. The Purchaser shall promptly notify

the Supplier in writing of any claim arising under this warranty.

a. Upon receipt of such notice, the Supplier shall repair or replace the defective Goods or parts thereof, without cost to the Purchaser other than, where applicable the cost of inland delivery of the repaired or replaced Goods or parts from the port of entry to the final destination.

b. If the Supplier, having been notified, fails to remedy the defect(s) in accordance with Contract, the Purchaser may proceed to take such remedial action as may be necessary, at the Supplier’s expense. The Supplier’s Warranty pursuant to this is without prejudice to any other rights or remedies, which the Purchaser may have against the Supplier under the Contract.

Supplier shall be entirely responsible for all taxes, stamp duties and other such levies imposed outside the Purchaser’s country.
