The Loddon Shire Council has preparedAmendment C9 to the Loddon Planning Scheme.

The Amendment affects various parcels ofland throughout the whole of the municipality.What the Amendment does.

The Amendment proposes to make thefollowing changes to the Loddon PlanningScheme:l include in the Floodway Overlay those areas

of the Shire identified as having the greatestrisk and frequency of being affected byflooding;

l include in the Land Subject to InundationOverlay those areas of the Shire identified aslikely to be affected by a 1 in 100 year flood;

l inserting Clause 44.03 and Schedule 44.03s(Floodway Overlay) into the LoddonPlanning Scheme;

l amend the schedule to Clause 61 to updatethe list of maps forming part of the Scheme.This Amendment is required to update the

extent of the flood overlays as a result of moreaccurate information on flooding obtainedunder the Flood Data Transfer Project managedby the Department of Sustainability andEnvironment for regional Victoria.

The Flood Data Transfer Project hascollected and reviewed all flood data informationcurrently available with the objective ofproducing high quality, consistent andcomprehensive flooding information. The datawas collected from the Department ofSustainabi l i ty and Environment , localgovernment and water authorities.

The Floodway Overlay has been applied toareas that have the greatest risk and frequency ofbeing affected by flooding. It includes areas thatconvey active flood flows or store floodwater.

The areas are included in the land subject toInundation Overlay are likely to the affected by

a 1 in a 100 year flood. Flooding in these areasis less severe although some property damagemay occur. The Overlay seeks to ensure that thedevelopment maintains the free passage offloodwaters, minimises flood damage, iscompatible with flood hazard and local drainageconditions and will not cause any significant risein flood level or flow velocity.

The Proposed Regulations amend the Fisheries Regulations 1998 to provide for thedetermination and payment of compensation in relation to the compulsory cancellation of accesslicences as a result of a direction under Section 61 (Ministerial Directions) of the Fisheries Act1995 (Ôthe ActÕ).

The Regulations are required by operation of Sections 61(1)(b) and 63 of the Act and thereforethe alternatives to Regulation are considered in the context of assessing compensation. It wasconcluded a formula based model with an independent negotiator was the most desirable.

The objective of the Proposed Regulations is to ensure that where a Ministerial Direction hasbeen issued to cancel licences, licence holders can be assured that their claim for compensation willbe assessed under a consistent, fair, reasonable and expeditious process.

The proposed regulatory changes to achieve these objectives provide for:

1. a formula which the Secretary must apply in making a determination for compensation (for allclasses of transferable and non-transferable access licences, including licences with a quotaentitlement);

2. an independent negotiator to act as an intermediary between the Secretary and the applicant; and

3. various related administrative procedures, specifically a claims application procedure and themanner in which a compensation claim may be paid.
