Diane Cornell Selected to Receive 2017 FCBA Excellence in Government Service Award Diane Cornell has been selected to receive the FCBA’s 10th annual award for outstanding government service, which will be presented at the FCBA Spring Reception on June 29. The award was first given in 2008 to recognize individuals with long-term careers in federal government in the communications field who are dedicated to the pursuit of excellence in public service.

Two of the nominating members of the FCBA, Jennifer Warren and Bryan Tramont, said “Diane has been an extraordinary public servant in every sense of the word -- as a policy leader in IB, WTB and the Chairman’s Office, in the private sector at CTIA and Inmarsat, and in the Bar as an FCBA President and chair of virtually

everything. In each role, she has made remarkable contributions as a creative problem solver and been a generous and thoughtful mentor. Her commitment to creating sound public policy and a positive workplace, coupled with her can-do spirit, integrity, humor, ready smile and loyal friendship make her an ideal recipient of this year’s Excellence in Government Service Award.”

especially for a course so close to downtown DC. Westfields Golf Club, just off Route 66 in Centerville, VA, is a Fred Couples designed course and one of best in the area -- while still being fun and accessible for the high-handicappers among us. Westfields is also considered one of the best places in the area to hold a golf outing, combining a great course with terrific hospitality.

Additionally, we’ve decided to stick with scheduling the Tourney in the afternoon this year so that our workaholic friends can get in a few hours at the office (or plenty of time to warm up on the range). Shotgun start will be at 1:00 p.m. followed by a delicious post-round Buffet BBQ Dinner.

As always, all of the proceeds from the Tournament go straight to the FCBA Foundation to support its wonderful programs, including the Scholarship programs and the Summer Legal Internship program. Over the years, the Tournament has raised over $400,000 for the FCBA Foundation charities, all under the auspices of getting together with your colleagues for an enjoyable day of golf! Thursday, May 18, 6:00 – 8:15 p.m.FirstNet: Developments, Challenges, and Opportunities in the Nationwide Public Safety Broadband NetworkThe FCBA Engineering and Technical and Homeland Security and Emergency Communications Committees will host a CLE on Thursday, May 18 from 6:00 – 8:15 p.m. entitled “FirstNet: Developments, Challenges, and Opportunities in the Nationwide Public Safety Broadband Network.” This program will be held at Wiley Rein LLP, 1776 K Street, NW.

On March 30, 2017, the Department of Commerce and First Responder Network Authority (FirstNet) announced the selection of AT&T to build the first nationwide wireless broadband network dedicated to America’s first responders. This new public-private partnership represents a major step in the development of a robust public safety communications infrastructure, using 20 MHz of prime broadband spectrum to help millions of first responders operate faster, safer and more effectively, while also making excess capacity available to supplement commercial broadband systems. The Department of Commerce has also stated that it expects this effort to create 10,000 jobs in the first two years of the contract alone. The FirstNet system is expected to achieve unprecedented coverage, reliability, and interoperability

while also coexisting with state-deployed public safety communications systems. As the rubber meets the road, what technical, legal, and policy challenges must be addressed?

At its April Open Meeting, the FCC adopted a long-awaited order in the Business Data Services (“BDS”) proceeding finding that the BDS marketplace is generally competitive, such that continued legacy regulation is more likely to impede the introduction of new services and raise prices than to benefit consumers, but maintaining price caps with a productivity factor in areas lacking sufficient competition. The order follows a voluminous data collection and extensive lobbying from parties with starkly different perspectives on the appropriate regulatory structure for the services formerly known as

“special access.” This CLE will begin with a panel of FCC representatives from the Wireline Competition Bureau (“WCB”) that will provide an overview of the order’s conclusions and discuss its implementation, followed by a discussion from a panel of stakeholders who will provide a variety of perspectives and predictions following the FCC’s ruling.

Roy J. Stewart(1938 - 2017)Roy Stewart, former FCC Mass Media Bureau Chief and head of the Media Bureau Office of Broadcast License Policy, died April 10, 2017 at Fairfax Hospital, Fairfax, Virginia, after a brief illness. He was 78.

Born in Brooklyn, New York, Roy earned a B.A. degree from University of Virginia and a J.D. from Cornell Law School. In 1965, following military service, he joined the TV Applications Branch of the FCC Broadcast Bureau, beginning a career that would span over four decades. In 1989, he became Chief of the FCC Mass Media Bureau. He served in that capacity for 13 years and then headed the Office

of Broadcast License Policy until his retirement in 2009.

As a native New Yorker, Roy was an avid fan of the Rangers and the Knicks. In addition, he and his wife, Patricia, enjoyed traveling abroad, with France, and especially Paris, as favorite destinations.

Jonathan Blake, a former FCBA President and head of Covington & Burling’s communications and media practice, remembers Stewart as “the epitome of a public servant – always straightforward, fair, and focused on trying to do the right thing, as well as someone who had fun and loved his work.”

As former FCC Chairman Dick Wiley observes, “Over the years I have had an opportunity to work with many highly

competent FCC staff officials, both during my own Commission tenure and as a lawyer practicing before the FCC. Roy will always stand out among them as one of the most able, knowledgeable, and dedicated public servants I have ever known. It is also true that Roy did not suffer fools gladly, and if he didn’t agree with you, he would make it quite clear. However, beneath that occasionally gruff demeanor, he was someone who always tried to find viable solutions for problems presented to him. In my view, Roy Stewart was one-of-a-kind, and his passing brings back many wonderful memories but also a lot of personal sadness.”

Roy is survived by his wife, Patricia Zimmer Stewart, daughters Teresa and Cristina, and a granddaughter, Presley Julio.

Wheeler, where she headed the Process Reform initiative, and handled satellite, international and consumer protection matters for the Chairman’s office. Earlier in her career, Diane was Acting Senior Legal Advisor to FCC Chairman Reed Hundt, and telecommunications legal advisor to Commissioners Sherrie Marshall and Patricia Diaz Dennis.

Diane’s Bureau roles included Chief of Staff/Associate Chief of the Wireless Telecommunications Bureau, where she was involved in a wide range of wireless communications issues, including various spectrum-related rulemakings and issues involving 3G mobile systems. In the 1990s, she served as Chief of the

Telecommunications Division of the International Bureau and as Chief of the International Policy Division of the Common Carrier Bureau; in these roles she was responsible for international policy rulemakings, authorizations, and international conferences, and played a significant role in the 1997 WTO Basic Telecommunications Agreement and the related rulemakings. Her FCC career started in the Policy and Program Planning Division of the FCC’s Common Carrier Bureau in 1987. Her awards at the FCC included the Gold Medal for Distinguished Service and the FCC Chairman’s Outstanding Service Award & Special Achievement Award.

Before and between her FCC stints, Diane held several private sector positions. She started her law career as an associate at Squire Sanders & Dempsey, and after

her first FCC tour she served as Vice President, Regulatory Policy at the CTIA - The Wireless Association, where she worked on a wide variety of regulatory issues affecting wireless carriers and manufacturers. Immediately before returning to the FCC, Diane was Vice President, Government Affairs at Inmarsat, a mobile satellite communications provider, where she was responsible for overseeing regulatory matters worldwide.

Diane has been active in the FCBA throughout her career; she served as President in 2007-2008, held several other FCBA offices, and chaired many committees. Diane is also a former President of USA Badminton, and continues to participate in her lifelong sports passion. She received her B.A from Wesleyan University and her J.D. from the University of Pennsylvania.

Young Lawyers and Social Media Committees Host Inaugural Facebook Live Brown Bag Lunch to an Audience of HundredsThe Young Lawyers and Social Media Committees hosted the FCBA’s first-ever Facebook Live event on Tuesday, April 18, a brown bag panel on “Leveraging Social Media for Digital Advocacy and Client Engagement.” Kristine Fargotstein (FCC) moderated a discussion with Maura Corbett (Glen Echo Group) and Jameson Dempsey (Kelley Drye) on how to make the most of social media profiles and the role of social media in advocacy today. Maura and Jameson shared their thoughts on how new media and traditional media complement one another in furthering a client’s or company’s advocacy strategy.

The Facebook Live event was a major success, reaching 1,659 people total as of press time, with 682 unique video views by 604 unique viewers. The YLC very much appreciates FCBA members’ interest in the event. If you don’t already, be sure to like and follow the FCBA on Facebook so future programming will appear in your Facebook news feed! An archive video of the brown bag event is also available on the Facebook page.

The YLC would like to thank Maura, Jameson, and Kristine for a great discussion and for beta testing the Facebook Live format, as well as Kelley Drye for hosting the event and videoconference facilities. In addition, the YLC would like to thank the Social Media Committee Co-Chairs Mark Brennan, Joy Ragsdale, and Jeremy Berkowitz for their efforts to help organize the Facebook Live portion of the event.

A Successful Year for the YLC’s Law School Outreach Program This spring, the FCBA’s Young Lawyers Committee continued its annual tradition of holding law student outreach events to introduce students to Communications Law. Tim Doughty, Bill Durdach, Lauren McCarty, and Calisha Myers oversaw the law student outreach program on behalf of the Young Lawyers Committee.

In the lead-up to the 2017 Silicon Flatirons Conference, The Colorado Technology and Law Journal, led by Editor-in-Chief Karyn Kesselring, held a “primer” series happy hour at the school to provide

students with an up-close and personal introduction to the subject matter to be covered at the Conference. Professor Blake Reid moderated a fireside chat with guests Jon Sallet (Brookings Institute), Amina Fazlullah (Benton Foundation), Mark Walker (Cable Labs), and Andrew Schwartzman (Georgetown University Law).

Howard University School of Law students attended a panel discussion on March 8, where they heard from Markham Erickson (Steptoe & Johnson), Alyssia Bryant (Mintz Levin), Kara Romagnino (CTIA), and Joy Ragsdale (FCC). The panelists discussed the growing nature and breadth of careers in communications law as well as specific growth areas like privacy and IoT.

On March 14, The George Washington University Law School hosted a variety of communications professionals to speak with current law students about the diverse career options available in the field. Panelists included Jessica Almond (FCC), Jennifer Holtz (Kelley Drye & Warren), Hadass Kogan (DISH Network), and Tom Power (CTIA). Panelists provided insight on helpful courses to take during law school, transitioning from law school to full time employment, and the positives and negatives of different career paths. Special thanks to Jane Lee of GW Law for her help in organizing and moderating this event.

On March 29, Sade Oshinubi (Wireless Infrastructure Association) moderated a panel discussion on careers in communications law at UDC Law. Arturo Chang (NTIA), Matthew Conaty (FCC), Emilie de Lozier (Wilkinson Barker Knauer), and Megan Stull (Google) shared their experiences working in different sectors of the industry and offered advice on navigating the job market. Thanks to UDC Law student David O’Brien for his help in organizing this event.

On April 4, American University WCL’s Communications & Media Law Society hosted a panel with several communications professionals to speak with current law students about various career opportunities in the field. Panelists included WCL alumnae Angela Kung (FCC), Meredith Singer (Wiley Rein), Brendan Haggerty (ATT), and Kevin Rupy (USTA). Panelists answered questions about law school, the bar exam, and career opportunities in the communications law field. Special thanks to Carolyn Mahoney for her help in organizing and moderating this event.

Penn Law hosted a panel on April 5, featuring Andrew Fisher (Comcast), Sam Cullari (Reed Smith), Kevin Werbach (The Wharton School), and Ross Slutsky (Kelley Drye). The panelists discussed the importance of networking and maintaining relationships within the communications field and gave students insights into recent policy changes at the FCC. Special thanks to UPenn 2L Shelby Rokito for organizing the event.

During the first panel, Sarah spoke with Shawn, Parul, Maria, Erin and Daudeline about ways to increase diversity in the bar. The second panel featured Danielle asking Matt, Nirali, Davina and Johanna questions about how young attorneys can maintain a work-life balance without harming their careers.
