Automatic Texas Prescription Monitoring Program Registration

On January 11, 2018, the Texas State Board of Pharmacy sent an email to all Texas dentists notifying them that a Texas Prescription Monitoring Program (PMP) account had automatically been setup and they needed to follow the provided link to complete the registration process.

The TDA has confirmed that the email is not spam and is a legitimate email from the Texas State Board of Pharmacy.

Dentists needing to complete their PMP account registration can follow the instructions below to create an account. Texas State Board of Dental Examiners regulations require dentists to conduct at least one self-query a year through the PMP.

Instructions to Create a Prescription Monitoring Program Account:

Dentists who do not already have a Prescription Monitoring Program (PMP) account need to click on the link received in the email from the Texas State Board of Pharmacy at “[email protected]” on January 11, 2018. This will take you to the PMP password reset screen to complete the following steps:

1. From the password reset screen, type in the same email address at which you received the pharmacy board’s email on January 11, 2018.

2. Click on “Request Password Reset.” This will send a new link to your email.

3. Open the email and click on the new link. The new link will take you to the PMP AWARxE browser with fields to enter a password and confirm it. The password must contain at least 8 characters, including 1 capital letter and 1 special character, such as !@#$. You must already have a Drug Enforcement Registration to create a PMP account.

If you have any questions concerning your registration, please contact the PMP: [email protected] or 512-305-8050. Visit www.pharmacy.texas.gov/PMP to view the program database.

Early Bird Registration ENDS March 30!

From The Editor .

Editor’s Message…. Robbie Henwood DDS, PHD, MAGD “Private Practice Relationships?”

Where is it today? Is it really true that “Mom & Pop” shops are a thing of the past? Will they be truly gone within 5 or 10 years? My belief is they are not gone and there will always be a place for them in our futures.

Why would this matter to our members? It matters to each and every practicing dentist and also those about to start their careers. The decision has to be made concerning the type of practice to begin with, the type to continue with, and the time to change or quit. There is no null option in this arena. Either we choose or change or we get run over. The issue here is to enlighten the profession about the changing environment to permit a proactive selection and avoid the reactive changes that will occur if we just wait to be forced along.

Oh, it certainly is true the rules are changing. It is true this format for practice is changing and even “mom and pop” need to update their approach. It seems like such a short time ago when many faculty at our “Number 1” dental school laughed about “wet-fingered dentistry”. All charting was on paper and photography was only used for research and specific documentation.

Today we see intraoral photography routinely as an integral part of diagnosis along with x-rays and in some specialties cone-beam CT as standards being expected daily. The 40MB hard drives have been replaced with terabyte drives and most submissions to insurance claims companies are electronic. The idea of “wet-fingered” dentistry appears frightening. Indeed, the other day I saw a mother having her children all use hand sanitizers after being in a public place. Everyone is avoiding fat and sugar and thinking about exercise as shown in the proliferation of gyms. Many things are better and I now have to ask my staff to manage my phone because I am over-whelmed by what it can do. I am also overwhelmed by what patients do with them while in the chair.

Tomorrow, but for the patients whom we may see as a necessary evil, because “if only they did not come in we could get everything right and never make mistakes”, we would not be there. Patients are our “raison d’etre” and we’d better not forget it. This is where I think the “mom & pops” have the solution. They are closer to the patients. The same person meets the patients for the first visit, diagnoses the conditions, discusses the patients concern, arrives at a treatment plan, and schedules the work. When the patient returns, the same dentist does the work and afterwards that same dentist stands by the work. We get to treat children, then teens, then adults, and then again children of those we started with. It is a rewarding profession. We can make decisions concerning donation of care to our faithful but needy patients through tough times and afterwards. We can take vacations, attend CE courses when

we choose and take our time as we see fit during patient care times. We do have some things we may wish were different but one big deal is that we can make decisions.

The days of “Big Clinic Dentistry” are here and it may not be a bed of roses for them. Yes, they may negotiate higher fee schedules (perhaps 30% in some cases) with the insurance companies. Sure, they may buy from the main suppliers at discounts (maybe even 30% in some cases). They may be negotiating with the ADA for membership discounts and political support for corporate dentistry. They may have leverage with the banks, the insurance companies and the suppliers. They may even have and they may exercise extreme leverage with their employees. However, they may not have leverage with the patients.

We in private practices are seeing the results of patients presenting for second opinions on what they feel is excessive treatment proposals and concerns that the one who diagnosed them is not the one treating them. If patients determine that the personal close nature of dental treatment demands personal close relationships then the “Big Clinic” model may see a loss of numbers and they may not meet their necessary goals. Many businesses can consolidate successfully and benefit from the economy of scale such as seen with banks and airlines. If you don’t like your airline you are welcome to change but the other one will be the same. If you want to change banks you can but the other one will probably be the same. But if you call the “Clinic” because of some concerns and get told “she no longer works here” and “there is no guarantee” you may see the old “mom and pop” concept as a more attractive option. Employees of the “Clinics” may discover the work they do pays for everything they get plus some very nice incomes for investors and CEO’s. Those nice benefits come at a price and I believe that is “relationships”.

I mention patients last because the future of “Mom & Pop” shops depends upon them valuing RELATIONSHIPS and being willing to go to the dentist during working hours and paying more in some cases to develop a relationship they trust. Yes, I am a strong believer in TRUST and I am committed to the belief that the foundation for our business is in “individual trusting individual”.

Respectfully submitted. …..Robbie

President’s Message... Victoria Vickers, DDS

This New Year started off early for your SADDS Board of Directors. We had a surprise visit from the ADA President, Dr. Joe Crowley and his wife Paulette. They were in town for an event hosted by Ft. Sam and we invited them for a meet and greet with the board, ASDA president and the Alliance president. It was a whirlwind visit since they only had an hour to spend with us. He answered questions from board members and shared an update on ADA business.

He felt certain the McCain Ferguson Act would be repealed by the Senate this coming year in a bipartisan move. He discussed ADA legal action against Delta Dental when they dropped their reimbursement rate by 17% in some states and to out-of-network providers. He also discussed the ADA and some of the smaller DSOs coming together in talks that would benefit both organizations. We will show a short video of his discussion at the February general meeting hosted by the New Dentist Committee.

This meeting will be held at a new location, Maggiano’s at the Rim off La Cantera Parkway. There will also be a new format to this meeting. Instead of having one speaker, we will have a panel discussion entitled “The End of the Solo Practice….Maybe,

Maybe Not? The panel is comprised of a variety of different practice models from our local community and will be moderated by Dr. Josh Austin. No matter where you stand in your career-young dentist, mid- career or thinking of retirement-this will be an excellent opportunity to hear about the state of the modern dental practice.

In other news, Dr. Bill Dodge has announced his retirement from the Dental School. As many of you know Bill, you know how dedicated he has been to our school. He has held many positions at the school culminating in his service as Dean, has overseen the construction of the new school and has continued to keep the high national recognition of our school during his tenure. Please send your congratulations for his milestone achievements.

I look forward to the coming year and to our exciting CE courses we offer. Please check the schedule in the newsletter and mark your calendars!

Best regards, Vicki

André Jones, DS3 UTHSCSA SADDS New Dentist Committee, Student Liaison

Future Dentists Need Your Help!

The 4th year dental students at UTHSCSA are nearing the end of their long awaited graduation! The WREB Live Patient Dental Exam is quickly approaching, and while this is an exciting time, it can also be a very stressful time for our “new” Dentists. Unfortunately, the most stressful and uncontrollable part of the license examination is locating reliable patients with the necessary procedure requirements needed to receive proper credit.

With this being said, SADDS is supporting our “new” Dentists by partnering with local San Antonio Dentists to help our near graduates find patients in need of the required dental procedures.

If you have a patient that meets the requirements listed below, and may benefit from these specific procedures at no cost,

then please email DS4 Daniel Yates [email protected].

SADDS reps will be distributing official referral pads to participating dentists. You may also email Daniel directly without the official referral pad so he can schedule a free screening for qualification with his fellow fourth year dental students.

Requirements are as follows: - Class 2 Carious lesion OR - Scaling and root planing

Together with your help, we can help a patient and future Dentist in need!

Sincerely, André Jones [email protected] SADDS New Dentist Committee Member Class of 2019 Fundraising Chair | UT School of Dentistry at San Antonio

New Dentist Committee Message

Bart Wilson, DMD, Chair

“It’s that time of year again

If you have any suggestions or would like to help out with the New Dentist Committee, feel free to contact us at [email protected] or 210.732.1264

Welcome to 2018 SADDS Members! It’s that time of year again... I’m not talking about filing your past due taxes from two years ago or re-committing to your gym routine, I’m talking about joining us for the February general membership meeting sponsored by none other than The New Dentist Committee, open to ALL members. This is surely a meeting you will not want to miss, even if you have not joined us for any SADDS meeting since the first Bush presidency.

What can you expect from this meeting, you ask? We are bringing dental friends and foes together in the same room and working through issues we are facing right now with the rise of corporate practice influence in what was once dominated by the mom/pop solo offices. To bring clarity to these multifactorial issues, we have invited five successful local dentists that have found their stride in a variety of practice models ranging from solo to nationwide corporate practices. These accomplished peers of ours will sit on a panel led by the gifted Dr. Josh Austin to keep the conversa-tion focused, positive and beneficial for all attendees. Questions from the audience will be entertained after some introductory questions.

Here is a sampling of topics:

1. Student debt forcing career decisions

2. #new grads > retiring dentists

3. Supplier pricing

4. Change of referral patterns

5. Turnover of providers affecting patient care

We are incredibly excited to get the year started with this conversation and this fresh format, but we need you, the members, to come out in droves to keep the conversation going. So with that, we formally invite ALL of our members to join us at Maggiano’s February 13th at 5:30 pm to kick off the year in FAT TUESDAY style! RSVP via call to SADDS, SADDS website or Evite!

Also in February we have the CE Conference on Saturday, February 24th downtown at St. Anthony’s Hotel. This is a GREAT meeting with Jill Wade, DDS & Hal Stewart, DDS. You don’t want to miss this one!

ADA President Reception Legal Update

On February 23, 2017, the Acting Chair of the U.S. Federal Trade Commission (FTC) Maureen K. Ohlausen an-nounced the establishment of the FTC’s Economic Liberty Task Force to advance economic liberty issues, with a particular focus on occupational licensing regulations under the antitrust laws. In her remarks, Chair Ohlausen cited the FTC Supreme Court victory in the North Carolina Dental case.

For background – the North Carolina State Board of Dental Examiners received complaints from dentists that non-dentists were charging lower prices for teeth whitening services than dentists did. The Board took enforcement action, which led non-dentists to cease offering teeth whitening services in North Carolina. The FTC filed an administrative complaint alleging that the Board’s concerted action to exclude non-dentists from the market for teeth whitening services in North Carolina constituted an anti-competitive and unfair method of competition un-der the Federal Trade Commission Act. This case eventually was decided by the U.S. Supreme Court in 2015, in North Carolina State Board of Dental Examiners v. Federal Trade Commission. The decision hinged on whether the actions of the Board had state-action antitrust immunity and found that there was no immunity because the Board was controlled by active market participants (i.e. licensed practicing dentists) and was not subject to active supervision by the State of North Carolina. The Court affirmed that the Board’s actions against non-dentist teeth whitening service providers and manufacturers violated antitrust law.

In April 2016, the Texas Sunset Advisory Commission Staff Report on the Texas State Board of Dental Examiners referenced the North Carolina Dental case. In that report, the Staff recommended decreasing the size of the Board and changing its composition to have dentists be in the minority. The Staff recommendation was not followed by the Texas Legislature when it continued the Board’s existence in the 2017 Sunset Bill. Instead, the Texas Legislature kept dentist members in the majority of the Board. This composition leaves the Board open to antitrust claims under the state-action ruling in the North Carolina Dental case decision. The 2017 Sunset Bill does require that Board members be trained in antitrust law.

The FTC is no stranger to Texas. On October 6, 2014, the FTC submitted comments to the Texas Dental Board on proposed amendments to rule 108.70 and proposed new rule 108.74. The FTC expressed concerns about the effect of such rules on Dental Services Organizations (DSOs) stating: “FTC staff are concerned that the proposed rules, if they are adopted and if they discourage dentists from affiliating with DSOs, may deny consumers of dental services the benefits of competition spurred by the efficiencies that DSOs can offer. The central theme of this letter is a relatively narrow one; it focuses on the nonclinical functions of a dental practice that are unlikely to affect the quality of professional dental care. The rules would restrict the choices dentists have when deciding upon the most efficient way to organize the nonclinical aspects of their practices, and deny them potentially signif-icant cost savings and the ability to focus their own efforts on provision of dental care, rather than on the business management aspects of running a dental practice. The use of DSOs for these nonclinical purposes may lead to lower prices and increased access to care.” The proposed amend-ments to rule 108.70 and proposed new rule 108.74 were not adopted by the Texas Dental Board.

The website of the FTC Economic Liberty Task Force is www.ftc.gov/policy/advocacy/economic-liberty Selected FTC actions on dentist, dental hygienist, and dental therapist licensing are available at www.ftc.gov/policy/advocacy/economic-liberty/selected-advocacy-relating-occupational-licensing

Expect dentistry to continue to be in the antitrust cross-hairs.

Legal Update

Senate Bill 313 was enacted at the 85th regular legislative session this past summer, and provides for a variety of rule changes which will undoubtedly have a bearing on the defense of Dental Board investigations. Perhaps one of the most benefi-cial changes affects the filing of anonymous complaints. The Dental Board, as of September of 2017, will no longer accept anonymous complaints addressing the conduct of an individual or entity. This of course will include complaints addressed to dentists, dental hygienists, registered dental assistants, and dental laboratories. While this type of complaint previously had been begrudgingly accepted by the Board, these complaints will now no longer be accepted. In the past, the credibility of anonymous complaints was always suspect. For many years, the Dental Board has been composed of fifteen members, consisting of eight dentists, two hygienists, and five public members. Recent changes have reduced the size of the Board to eleven members, which will consist of six dentists, three hygienists, and two public members. The current dental appointees to the Board include three general dentists, a periodontist, an oral maxillofacial surgeon, and a dental anes-thesiologist. Two of the current Board members, Dr. David Tillman and Dr. Bryan Henderson, had previously served on the Board. The other four dentists are all new appointees to the Board. Dr. David Tillman, a general dentist from Fort Worth, will serve as Presiding Officer of the Board. Of the three recently appointed hygienists to the Board, only one of those individuals, Ms. Lois Palermo, has prior Board experience. As of yet, the two public members of the Board have not been appointed by the governor. Consistent with prior practice, Board members are appointed by the governor for six year terms. With the current reduction in size of the Board from fifteen to eleven members, the Board has taken steps to increase their efficiency for resolution of complaints. Once a Dental Board investigation has been initiated, the vast majority of the cases which have not been previously dismissed, will be resolved at a Board Informal Settlement Conference (ISC). With the Board’s increased vigilance in both detecting and prosecuting alleged Board violations, more cases are now being scheduled at ISCs. In the past, a dentist member of the Dental Board was required to be present and represent the Dental Board at an ISC in all matters involving standard of care. Standard of care allegations represent the largest individual percentage of Board violations. With the reduction of dentist members on the Dental Board, and with an increasing number of ISCs scheduled each year, the Board has found it necessary to provide for an additional resource to assist the Board at ISCs. The Dental Review Committee (DRC), created by the 85th Legislature, will consist of nine members composed of six dentists, two dental hygienists, and one registered dental assis-tant to serve on the Committee. DRC members will be appoint-ed to six-year terms and will periodically assist the Board on Informal Settlement Conference Panels. Recent rule changes provide that each Informal Settlement Con-ference Panel will consist of one dentist and one other panelist, which may be a Board member or a DRC member. The Board Rules provide that the respondent dentist (the individual against whom allegations have been made) may waive the “two” panel-ist requirement. If the respondent elects to waive this requirement, the remaining Board panelist may be a dentist, dental hygienist or public member. In light of the fact that any

recommendation made by the remaining panelist may consist of a variety of sanctions ranging from warning to suspension of a license, a respondent’s decision to waive the required two member panel could possibly result in a standard of care sanction recommendation being made by a non-dentist member of that panel. In addition, should a dental healthcare provider become a recipient of a Board Order, and subsequently violate the mandates of the Order, the Board may refuse to renew the provider’s license. In FY 2017, a total of 324 cases were set for ISCs. Additionally, a total of 70 cases were referred by the Board to the State Office of Administrative Hearings and filed as contested cases to be set before an Administrative Law Judge. On a scheduled ISC date, the Dental Board will on average, set approximately eight cases. It is anticipated that in FY 2018, the Board will schedule some fifty ISC dates. Both the number of anticipated ISC dates, as well as the number of cases scheduled for ISC, will represent an increase over the numbers set in FY 2017. As recent as 2014, the Board’s average process time from receipt of a complaint to resolution was 485.6 days. Recent rule changes mandated by the legislature directs the Dental Board to promulgate rules requiring Informal Settlement Conferences be scheduled within 180 days from receipt of the official complaint. Furthermore, if within that 180 day investigation period the Board determines that the complaint is baseless or unfounded, the complaint has the potential to be dismissed. With the Board’s increased funding and additional resources, I anticipate the time between the filing of the complaint and the resolution will be significantly less than the previous years. Additional rule changes which may be forthcoming as a result of the passage of Senate Bill 313, may include a possible increase in the minimum number of required CE hours for dentists and dental hygienists, a modification of the time frame for licensure renewal, and clarifications to rules affecting individuals in the Peer Assistance Program (PRN). The Board may also develop an online examination for dentists with anesthesia permits which must be completed once every five years. Additional anticipated changes relate to the Board’s ability to inspect the offices of dentists holding sedation/anesthesia permits. The inspections may include in depth site visits and be conducted without ad-vance notice. Other changes, which are not discussed in this paper, may be found in the final revision of Senate Bill 313. The implementation of Senate Bill 313 will affect some aspect of the lives and practices of the more than 16,000 dentists and 12,000 hygienists licensed in Texas. It is incumbent for the practicing dental healthcare provider to have an intimate under-standing of these changes to preclude the possibility of any Board violation and subsequent disciplinary action.

Alliance News

The Alliance of the San Antonio District Dental Society celebrated the Holiday Season on Monday, December 4, 2017 with a Dinner Cruise on the River Walk that honored our member and State Alliance President, Patty Taylor. Everyone had a wonderful time as they traveled along the SA river enjoying dinner from Paesano’s on the River Walk and admiring all the beautiful Christmas lights.

President-Elect Kristen Huriega, along with former State President Barbara Westwood and former Alliance Presidents Diana Bruchmiller and Mary Coleman, toasted Gloria Morales and presented her with a 2017 Xmas ornament and a pair of James Avery earrings. The earrings had two hearts entwined that represented our longtime members and our newer members.

Our ASADDS chapter is very productive and successful at working alongside each other thus attracting new members such as Peggy Shaw, Jacqueline White and Ori Jauregui. We have become one of the most membered Alliance groups in the state of Texas.

On Tuesday, December 5, 2017, our Holiday meeting was held at the San Antonio Country Club. Our First and Second Vice Presidents, Gina Villarreal and Denise Bruchmiller, handled the arrangements, decorations and speaker. Denise's personal collection of Christmas Churches on all the tables added extra holiday charm.

Jeannette Morgan and Kelly Lemke assisted with greeting guests and new Nominating Committee Chairman, Mary Balderas, provided the devotional.

Our State Alliance President, Patty Taylor, was presented with a San Antonio themed gift basket that included many local items such as a lovely embossed leather notebook and mug from the Mayor's office as well as a Doseum membership, an embroidered San Antonio pillow from Adelante at the Pearl and a pair of autographed cds sent by Pat Green. Courtesy Chairman, Chita Harris, worked diligently to put the basket together.

Notable guests in attendance at the December meeting included several members that have served as Past State Presidents. They were Cindy Bates Muir, Mary Alice Bond and Karen Cox.

Many local Past Presidents such as Beverly Henwood, Carol O'Brian, Maxine Farrimond, Deneen Cochran, Eve Reed, Mary Rose Jaeckle and Lois Shockley enjoyed catching up with longtime members Annella Egbert, Carol Walters and Sidney Payne.

We enjoyed a delightful lunch as we listened to Angela Bartells, professional photographer, pass along tips for capturing memorable holiday family photos.

Later that same evening, Smiles Chairman, America Gies, presented the winners of the Miss Smiles Contest at the December meeting of the San Antonio District Dental Society that was held at the Plaza Club. The winners and their Dentist Sponsors were:

1) Miss Smile 2017: Denhi Ekiaka Rodriguez from John High School (Dentist: Dr. Jessica Gonzalez, Ortho: Dr. Maria Atique’, pictured on right)

2) 1st Runner Up: Grace Arden Valderama from Johnson High School (Dentist: Courtney Alexander and Dr. Susie Hayden, pictured on right, Ortho: Dr. Patrick Moore)

3) 2nd Runner Up: Blanka Bordas from Health Careers High School (Dentist: Dr. Deborah Keepers)

All in all, it was a wonderful start to the Christmas season! We hope to see you at the next meeting on

Tuesday, February 6, 2018.

L.G. Taylor, DDS October 9, 1922 - November 1, 2017

.

LG Taylor left us to be with his Lord and Savior Jesus Christ on November 1, 2017. LG was born on October 9, 1922 to Essie & Joe Taylor in Delta County in East Texas. Left to cherish his memories are his wife of 66 years, Edna Earnest Taylor, his daughters Elizabeth Rebecca “Becky” Taylor & Tenna Taylor Murphy and her husband Mike, and his son Thomas “Tommy” Taylor and his wife Dayna. He will also be missed by his eight awesome grandchildren, Taylor Murphy, Kenzie Murphy, Joe Taylor, Kaitlyn Murphy, Emma Taylor, Kathryn Murphy, Reagan Taylor, & Olivia Taylor. He was preceded in death by his son Joe Earnest Taylor, parents Essie & Joe Taylor, and his brother Glendale “Pete” Taylor, his mother & father in laws, Lillian & Walter Earnest. Dr. LG practiced dentistry in Del Rio for 50 years. He was given the name LG, which did not stand for anything, but the letters came from his grandfathers Luther & Gady. When he would introduce himself, many times he would say, “Hi, my name is LG. Do you know how to spell that?” He grew up working in the cotton fields in east Texas. After graduating from Cooper High School he attended 1 year at East Texas State College. When World War II began, he worked in a shipyard as a welder in Beaumont, Texas. He joined the Navy where he served on a hospital ship in the dental clinic as an assistant. That is how he discovered his love for dentistry. After the war, he attended San Diego State University earning a degree in history. He then moved to Abilene, Texas and attended Abilene Christian College to pursue studies in Bible. It was in one of his bible courses that he met the only female in the class, Edna Earnest. They married on June 1, 1951 in her mother’s living room. L.G. & Edna lived in San Marcos, Utopia, and San Diego before moving to Houston where he attended dental school at the UT Dental Branch. After graduating dental school, L.G., Edna, and their 2 young children Becky & Joe moved to Del Rio to begin his dental practice at 313 S. Main Street. Tommy was born shortly after their move to Del Rio and Tenna was born 8 years later. L.G. loved the Lord’s church. He served as deacon and then elder at the Central Church of Christ for over 50 years. He led a very active Christian life. He enjoyed sharing his faith, teaching bible classes, and shepherding. It brought him joy to visit people in the hospital, nursing homes, or those home bound. He was known for his “brownie ministry”. Dr. L.G. liked dentistry, but he loved his patients and those he worked with at the office. He was able practice his trade till he was 88 years young. He was recognized by the American Dental Association for his 50 years of service to the profession. L.G. continued his love of learning and of people. He will be truly missed by his family and friends. Pallbearers will be Ralph Sinclair, Rodney Lyman, Mike Coplan, Joe Robinette, Joe Taylor, & Mike Murphy. Honorary Pallbearers are Joe Montez, J.R. Rubio, Joe Rubio, Sr., Budge Smith and nephews Billy Taylor, & Robert Taylor. Visitation was on Friday, November 3, 2017 from 6-9 at G. W. Cox Memorial Funeral Home. Funeral Services were held at Central Church of Christ (402 Cantu Rd) on Saturday, November 4, 2017 at 11:00 am.
