I am happy to report to you that on February 12, 2009, the New York State Public

Service Commission issued an order commencing public hearings on Con Edison’s con-

tracting out practices and procedures. This is the first hearing of its kind in anyone’s

memory. Con Edison jealously guards any information about its use of contractors. The

light of public scrutiny will now be shown on Con Edison’s deep dark secrets of its rela-

tionship to its Contract work force.

Year after year, your Union has been trying to ferret out Con Edison’s relationship

with the Contractors it hires to do our work. In all previous rate cases and other hearings

the Administrative Law Judge allowed Con Edison to dodge and evade our questions by

skirting the issues and giving answers such as: “The Company does not track this

information. The Company objects to this question as unduly broad. No such doc-

umentation is available and the Company objects to this question as it is not rele-

vant to the pending proceeding.” Con Edison will not get away with those answers

anymore. This is part of the Commission’s order:

Con Edison is expected to cooperate in full and good faith with all forms ofdiscovery, including depositions, by staff and interested parties and to provideprompt access to all requested books and records and, as needed, utility personnel.Con Edison is directed to preserve and maintain any and all documents and recordsrelating to the events, contracts and employees underlying this Order or otherwiserelated to or within the scope of the inquiry established in this Order.

Your Union is a full participant in these hearings and will question and depose Con

Edison’s witnesses. Standby for the fireworks. We will keep you informed as events tran-

spire.

The Local 1-2 Executive Board is the governing body of your Union.

It represents the membership and takes all necessary actions between Membership

Meeting. It formulates the policy of the Union, to be carried out by the Officers of the

Union. By its very nature it is a widely diverse group representing our members at a host

of different Employers.

A Local 1-2 Executive Board Member is a crucially important position in our Union.

We wish our new Board members every success in representing our members.

SCHOLARSHIP

College-bound children ofcurrent and retired Local 1-2Members are eligible to compete for$1,000 grants under the Union'sannual scholarship competition,announced Local 1-2. The programprovides 22 scholarship grants,each in the amount of $1,000, to beused toward the payment of collegetuition and books.

"By offering these scholar-ships, we are investing in our chil-dren and in the future. We considerthat a wise and prudent investment.We urge all eligible students to par-ticipate in this contest," the Local’sPresident said.

To qualify as a candidate, astudent must be a child of a Local 1-2 Member or Retiree, and be a highschool Senior graduating in 2009.The scholarship will be paid only to

those who have declared their inten-tion to enroll or are already enrolledin a post-high school institution certi-fied by the Department of Educationin the state where the institution islocated. Applications (see boxbelow) must be completed andmailed to Local 1-2 Utility WorkersUnion of America, AFL-CIO, 5 West37th Street, 7th Floor, New York, NY10018. All applications must beaccompanied by a copy of the offi-cial transcript of high school gradescovering the first six terms. Thedeadline for filing is Friday, June 26,2009.

After the initial applicationstep, scholarship candidates will berequired to write an essay of 500words or less at the Union office ona date to be announced. The topicof the essay will not be revealed

until that morning. Students will berequired to bring their own writingimplements and paper to completethis phase of the competition.

Members themselves, broth-ers and sisters of Members and thechildren of full-time Union Officersare excluded from participating inthe contest. The 22 winners will bechosen on the basis of their schooltranscript records and the writtenessays. Winners will be notified bymail sometime in August and willreceive their scholarships at Local 1-2's first General MembershipMeeting after the summer, usuallyheld in September. So don't wastetime. Complete the applicationbelow, get a copy of your highschool transcript and send in thematerial as quickly as possible.

EMPLOYEE FREE CHOICE ACT

Finally, to help workers gain higher wages and

better benefits, we need once again to level the

playing field between organized labor and employ-

ers. Since the early 1980s, unions have been

steadily losing ground, not just because of changes

in the economy but also because today’s labor laws

and the make-up of the National Labor Relations

Board have provided workers with very little protec-

tion. Each year, more than twenty thousand workers

are fired or lose wages simply for trying to organize

and join unions. That needs to change. We should

have tough penalities to prevent employers from fir-

ing or discriminating against workers involved in organizing efforts. Employers should

have to recognize a union if a majority of employees sign authorization cards choosing

the union to represent them. And federal mediation should be available to help an

employer and a new union reach agreement on a contract within a reasonable amount

of time.
