    TREATY BETWEEN THE UNITED STATES OF AMERICA AND THE RUSSIANFEDERATION ON MEASURES FOR THE FURTHER REDUCTION AND

    LIMITATION OF STRATEGIC OFFENSIVE ARMS

    The United States of America and the Russian Federation,hereinafter referred to as the Parties,

    Believing that global challenges and threats require newapproaches to interaction across the whole range of theirstrategic relations,

    Working therefore to forge a new strategic relationshipbased on mutual trust, openness, predictability, andcooperat on,

    Desiring to bring their respective nuclear postures intoalignment with this new relationship, and endeavoring toreduce further the role and importance of nuclear weapons,

    Committed to the fulfillment of their obligations underArticle VI of the Treaty on the Non-Proliferation of NuclearWeapons of July 1, 1968, and to the achievement of thehistoric goal of freeing humanity from the nuclear threat,

    Expressing strong support for on-going global efforts innon-proliferation,

    Seeking to preserve continuity in, and provide new impetusto, the step-by-step rocess of reducing and limiting nucleararms while maintaining the safety and security of theirnuclear arsenals, and with a view to expanding this process inthe future, including to a multilateral approach,

    Guided by the principle of indivisible security andconvinced that measures for the reduction and limitation ofstrategic offensive arms and the other obligations set forthin this Treaty will enhance predictability and stability, andthus the security of both Parties,

    Recognizing the existence of the interrelationship betweenstrategic offensive arms and strategic defensive arms, thatthis interrelationship will become more important as strategicnuclear arms are reduced, and that current strategic defensivearms do not undermine the viability and effectiveness of thestrategic offensive arms of the Parties,

    Mindful of the impact of conventionally armed ICBMs andSLBMs on strategic stability,

    Taking into account the positive effect on the worldsituation of the significant, verifiable reduction in nucleararsenals at the turn of the 21st century,

    Desiring to create a mechanism for verifying compliancewith the obligations under this Treaty, adapted, simplified,and made less costly in comparison to the Treaty Between theUnited States of America and the Union of Soviet SocialistRepublics on the Reduction and Limitation of StrategicOffensive Arms of July 31, 1991, hereinafter referred to asthe START Treaty,

    Recognizing that the START Treaty has been implemented bythe Republic of Belarus, the Republic of Kazakhstan, theRussian Federation, Ukraine, and the United States of America,and that the reduction levels envisaged by the START Treatywere achieved,

    Deeply appreciating the contribution of the Republic ofBelarus, the Republic of Kazakhstan, and Ukraine to nucleardisarmament and to strengthening international peace andsecurity as non-nuclear-weapon states under the Treaty on theNon-Proliferation of Nuclear Weapons of July 1, 1968,

    Welcoming the implementation of the Treaty Between theUnited States of America and the Russian Federation onStrategic Offensive Reductions of May 24, 2002,

    Have agreed as follows:

    Article I

    1. Each Party shall reduce and limit its strategic offensivearms in accordance with the provisions of this Treaty andshall carry out the other obligations set forth in this Treatyand its Protocol.2. Definitions of terms used in this Treaty and its Protocolare provided in Part One of the Protocol.

    Article I1

    1. Each Party shall reduce and limit its ICBMs and ICBMlaunchers, SLBMs and SLBM launchers, heavy bombers, ICBMwarheads, SLBM warheads, and heavy bomber nuclear armaments,so that seven years after entry into force of this Treaty andthereafter, the aggregate numbers, as counted in accordancewith Article I11 of this Treaty, do not exceed:

    (a) 700, for deployed ICBMs, deployed SLBMs, and deployedheavy bombers;

    (b) 1550, for warheads on deployed ICBMs, warheads ondeployed SLBMs, and nuclear warheads counted for deployedheavy bombers;

    (c) 800, for deployed and non-deployed ICBM launchers,deployed and non-deployed SLBM launchers, and deployed andnon-deployed heavy bombers.2. Each Party shall have the right to determine for itselfthe composition and structure of its strategic offensive arms.

    Article I11

    1. For the purposes of counting toward the aggregate limitprovided for in subparagraph l(a) of Article I1 of thisTreaty:

    (a) Each deployed ICBM shall be counted as one.

    (b) Each deployed SLBM shall be counted as one.(c) Each deployed heavy bomber shall be counted as one.

    2. For the purposes of counting toward the aggregate limitprovided for in subparagraph l(b) of Article I1 of thisTreaty:

    (a) For ICBMs and SLBMs, the number of warheads shall bethe number of reentry vehicles emplaced on deployed ICBMs andon deployed SLBMs.

    (b) One nuclear warhead shall be counted for eachdeployed heavy bomber.3. For the purposes of counting toward the aggregate limitprovided for in subparagraph l(c) of Article I1 of thisTreaty:

    (a) Each deployed launcher of ICBMs shall be counted asone.

    (b) Each non-deployed launcher of ICBMs shall be countedas one.

    (c) Each deployed launcher of SLBMs shall be counted asone.

    (d) Each non-deployed launcher of SLBMs shall be countedas one.

    (e) Each deployed heavy bomber shall be counted as one.(f) Each non-deployed heavy bomber shall be counted as

    one.4. For the purposes of this Treaty, including counting ICBMsand SLBMs:

    (a) For ICBMs or SLBMs that are maintained, stored, andtransported as assembled missiles in launch canisters, anassembled missile of a particular type, in its launchcanister, shall be considered to be an ICBM or SLBM of thattype

    (b) For ICBMs or SLBMs that are maintained, stored, andtransported as assembled missiles without launch canisters, anassembled missile of a particular type shall be considered tobe an ICBM or SLBM of that type.

    (c) For ICBMs or SLBMs that are maintained, stored, andtransported in stages, the first stage of an ICBM or SLBM of aparticular type shall be considered to be an ICBM or SLBM ofthat type.

    (d) Each launch canister shall be considered to containan ICBM or SLBM from the time it first leaves a facility atwhich an ICBM or SLBM is installed in it, until an ICBM orSLBM has been launched from it, or until an ICBM or SLBM hasbeen removed from it for elimination. A launch canister shallnot be considered to contain an ICBM or SLBM if it contains atraining model of a missile or has been placed on staticdisplay. Launch canisters for ICBMs or SLBMs of a particulartype shall be distinguishable from launch canisters for ICBMsor SLBMs of a different type.5. Newly constructed strategic offensive arms shall begin tobe subject to this Treaty as follows:

    (a) an ICBM, when it first leaves a production facility;

    (b) a mobile launcher of ICBMs, when it first leaves aproduction facility;(c) a silo launcher of ICBMs, when the silo door is first

    installed and closed;(d) an SLBM, when it first leaves a production facility;(e) an SLBM launcher, when the submarine on which that

    launcher is installed is first launched;(f) a heavy bomber equipped for nuclear armaments, when

    its airframe is first brought out of the shop, plant, orbuilding in which components of such a heavy ,bomber areassembled to produce complete airframes; or when its airframeis first brought out of the shop, plant, or building in whichexisting bomber airframes are converted to such heavy bomberairframes.6. ICBMs, SLBMs, ICBM launchers, SLBM launchers, and heavybombers shall cease to be subject to this Treaty in accordancewith Parts Three and Four of the Protocol to this Treaty.ICBMs or SLBMs of an existing type shall cease to be subjectto this Treaty if all ICBM or SLBM launchers of a typeintended for such ICBMs or SLBMs have been eliminated orconverted in accordance with Part Three of the Protocol tothis Treaty.7. For the purposes of this Treaty:

    (a) A missile of a type developed and tested solely tointercept and counter objects not located on the surface ofthe Earth shall not be considered to be a ballistic missile towhich the provisions of this Treaty apply.

    (b) Within the same type, a heavy bomber equipped fornuclear armaments shall be distinguishable from a heavy bomberequipped for non-nuclear armaments.

    (c) Heavy bombers of the same type shall cease to besubject to this Treaty or to the limitations thereof when thelast heavy bomber equipped for nuclear armaments of that typeis eliminated or converted, as appropriate, to a heavy bomberequipped for non-nuclear armaments in accordance with PartThree of the Protocol to this Treaty.8. As of the date of signature of this Treaty:

    (a) Existing types of ICBMs are:(i) for the United States of America, the Minuteman

    11, Minuteman 111, and Peacekeeper;(ii) for the Russian Federation, the RS-12M, RS-12M2,

    RS-18, RS-20, and RS-24.(b) Existing types of SLBMs are:

    (i) for the Russian Federation, the RSM-50, RSM-52,RSM-54, and RSM-56;

    (ii) for the United States of America, the Trident11.

    (c) Existing types of heavy bombers are:(i) for the United States of America, the B-52G, B-

    52H, B-IB, and B-2A;(ii) for the Russian Federation, the Tu-95MS and Tu-

    160.(dl Existing types of ICBM launchers and SLBM launchers

    are(i) for the Russian Federation, ICBM launchers RS-

    12M, RS-12M2, RS-18, RS-20, and RS-24; SLBM launchers RSM-50,RSM-52, RSM-54, and RSM-56;

    (ii) for the United States of America, ICBM launchersMinuteman 11, Minuteman 111, and Peacekeeper; the SLBMlaunchers Trident 11.

    Article IV

    1. Each Party shall base:(a) deployed launchers of ICBMs only at ICBM bases;(b) deployed heavy bombers only at air bases.

    2. Each Party shall install deployed launchers of SLBMs onlyon ballistic missile submarines.3. Each Party shall locate:

    (a) non-deployed launchers of ICBMs only at ICBM bases,production facilities, ICBM loading facilities, repairfacilities, storage facilities, conversion or eliminationfacilities, training facilities, test ranges, and space launchfacilities. Mobile launchers of prototype ICBMs shall not belocated at maintenance facilities of ICBM bases;

    (b) non-deployed ICBMs and non-deployed SLBMs only at, asappropriate, submarine bases, ICBM or SLBM loading facilities,maintenance facilities, repair facilities for ICBMs or SLBMs,storage facilities for ICBMs or SLBMs, conversion orelimination facilities for ICBMs or SLBMs, test ranges, spacelaunch facilities, and production facilities. Prototype ICBMsand prototype SLBMs, however, shall not be located atmaintenance facilities of ICBM bases or at submarine bases.4 . Non-deployed ICBMs and non-deployed SLBMs as well as non-deployed mobile launchers of ICBMs may be in transit. EachParty shall limit the duration of each transit betweenfacilities to no more than 30 days.

    5. Test launchers of ICBMs or SLBMs may be located only attest ranges.6 . Training launchers may be located only at ICBM bases,training facilities, and test ranges. The number of silotraining launchers located at each ICBM base for silolaunchers of ICBMs shall not exceed one for each type of ICBMspecified for that ICBM base.7. Each Party shall limit the number of test heavy bombers tono more than ten.8. Each Party shall base test heavy bombers only at heavybomber flight test centers. Non-deployed heavy bombers otherthan test heavy bombers shall be located only at repairfacilities or production facilities for heavy bombers.9. Each Party shall not carry out at an air base joint basingof heavy bombers equipped for nuclear armaments and heavybombers equipped for non-nuclear armaments, unless otherwiseagreed by the Parties.10. Strategic offensive arms shall not be located ateliminated facilities except during their movement throughsuch facilities and during visits of heavy bombers at suchfacilities.11. Strategic offensive arms subject to this Treaty shall notbe based outside the national territory of each Party. Theobligations provided for in this paragraph shall not affectthe Parties' rights in accordance with generally recognizedprinciples and rules of international law relating to thepassage of submarines or flights of aircraft, or relating tovisits of submarines to ports of third States. Heavy bombersmay be temporarily located outside the national territory,notification of which shall be provided in accordance withPart Four of the Protocol to this Treaty.

    1. Subject to the provisions of this Treaty, modernizationand replacement of strategic offensive arms may be carriedout.2. When a Party believes that a new kind of strategicoffensive arm is emerging, that Party shall have the right toraise the question of such a strategic offensive arm forconsideration in the Bilateral Consultative Commission.3. Each Party shall not convert and shall not use ICBMlaunchers and SLBM launchers for placement of missile defenseinterceptors therein. Each Party further shall not convertand shall not use launchers of missile defense interceptorsfor placement of ICBMs and SLBMs therein. This provisionshall not apply to ICBM launchers that were converted prior tosignature of this Treaty for placement of missile defenseinterceptors therein.

    1. Conversion, elimination, or other means for removal fromaccountability of strategic offensive arms and facilitiesshall be carried out in accordance with Part Three of theProtocol to this Treaty.2. Notifications related to conversion, elimination, or othermeans for removal from accountability shall be provided inaccordance with Parts Three and Four of the Protocol to thisTreaty.3. Verification of conversion or elimination in accordancewith this Treaty shall be carried out by:

    (a) national technical means of verification inaccordance with Article X of this Treaty; and

    (b) inspection activities as provided for in Article XIof this Treaty.

    Article VII

    1. A database pertaining to the obligations under this Treatyshall be created in accordance with Parts Two and Four of theProtocol to this Treaty. Categories of data for this databaseare set forth in Part Two of the Protocol to this Treaty.2. Each Party shall notify the other Party about changes indata and shall provide other notifications in a mannerprovided for in Part Four of the Protocol to this Treaty.3. Each Party shall use the Nuclear Risk Reduction Centers inorder to provide and receive notifications, unless otherwiseprovided for in this Treaty.4. Each Party may provide additional notifications on avoluntary basis, in addition to the notifications specified inparagraph 2 of this Article, if it deems this necessary toensure confidence in the fulfillment of obligations assumedunder this Treaty.5. The Parties shall hold consultations within the frameworkof the Bilateral Consultative Commission on releasing to thepublic data and information obtained during the implementationof this Treaty. The Parties shall have the right to releaseto the public such data and information following agreementthereon within the framework of the Bilateral ConsultativeCommission. Each Party shall have the right to release to thepublic data related to its respective strategic offensivearms.

    6. Geographic coordinates relating to data provided for inPart Two of the Protocol to this Treaty, unique identifiers,site diagrams of facilities provided by the Parties pursuantto this Treaty, as well as coastlines and waters diagramsprovided by the Parties pursuant to this Treaty shall not bereleased to the public unless otherwise agreed by the Partieswithin the framework of the Bilateral Consultative Commission.7. Notwithstanding paragraph 5 of this Article, the aggregatenumbers of deployed ICBMs, deployed SLBMs, and deployed heavybombers; the aggregate numbers of warheads on deployed ICBMs,deployed SLBMs, and nuclear warheads counted for deployedheavy bombers; and the aggregate numbers of deployed and non-deployed ICBM launchers, deployed and non-deployed SLBMlaunchers, and deployed and non-deployed heavy bombers, may bereleased to the public by the Parties.

    Article VIII

    In those cases in which one of the Parties determines thatits actions may lead to ambiguous situations, that Party shalltake measures to ensure the viability and effectiveness ofthis Treaty and to enhance confidence, openness, andpredictability concerning the reduction and limitation ofstrategic offensive arms. Such measures may include, amongother things, providing information in advance on activitiesof that Party associated with deployment or increasedreadiness of strategic offensive arms, to preclude thepossibility of misinterpretation of its actions by the otherParty. This information shall be provided through diplomaticor other channels.

    Article IX

    b

    By mutual agreement of the Parties, telemetric informationon launches of ICBMs and SLBMs shall be exchanged on a paritybasis. The Parties shall agree on the amount of exchange ofsuch telemetric information.

    Article X

    1. For the purpose of ensuring verification of compliancewith the provisions of this Treaty, each Party undertakes:(a) to use national technical means of verification at

    its disposal in a manner consistent with generally recognizedprinciples of international law;

    (b) not to interfere with the national technical means ofverification of the other Party operating in accordance withthis Article; and(c) not to use concealment measures that impede

    verification, by national technical means of verification, ofcompliance with the provisions of this Treaty.2. The obligation not to use concealment measures includesthe obligation not to use them at test ranges, includingmeasures that result in the concealment of ICBMs, SLBMs, ICBMlaunchers, or the association between ICBMs or SLBMs and theirlaunchers during testing. The obligation not to useconcealment measures shall not apply to cover or concealmentpractices at ICBM bases or to the use of environmentalshelters for strategic offen'sive arms.

    Article XI

    1. For the purpose of confirming the accuracy of declareddata on strategic offensive arms subject to this Treaty andensuring verification of compliance with the provisions ofthis Treaty, each Party shall have the right to conductinspection activities in accordance with this Article and PartFive of the Protocol to this Treaty.2. Each Party shall have the right to conduct inspections atICBM bases, submarine bases, and air bases. The purpose ofsuch inspections shall be to confirm the accuracy of declareddata on the numbers and types of deployed and non-deployedstrategic offensive arms subject to this Treaty; the number ofwarheads located on deployed ICBMs and deployed SLBMs; and thenumber of nuclear armaments located on deployed heavy bombers.Such inspections shall hereinafter be referred to as Type Oneinspections.3. Each Party shall have the right to conduct inspections atfacilities listed in Section VII of Part Five of the Protocolto this Treaty. The purpose of such inspections shall be toconfirm the accuracy of declared data on the numbers, types,and technical characteristics of non-deployed strategicoffensive arms subject to this Treaty and to confirm thatstrategic offensive arms have been converted or eliminated.

    In addition, each Party shall have the right to conductinspections at formerly declared facilities, which areprovided for in Part Two of the Protocol to this Treaty, toconfirm that such facilities are not being used for purposesinconsistent with this Treaty.

    The inspections provided for in this paragraph shallhereinafter be referred to as Type Two inspections.4 . Each Party shall conduct exhibitions and have the right toparticipate in exhibitions conducted by the other Party. The

    purpose of such exhibitions shall be to demonstratedistinguishing features and to confirm technicalcharacteristics of new types, and to demonstrate the resultsof conversion of the first item of each type of strategicoffensive arms subject to this Treaty.

    Article XI1

    To promote the objectives and implementation of theprovisions of this Treaty, the Parties hereby establish theBilateral Consultative Commission, the authority andprocedures for the operation of which are set forth in PartSix of the Protocol to this Treaty.

    Article XI11

    To ensure the viability and effectiveness of this Treaty,each Party shall not assume any international obligations orundertakings that would conflict with its provisions. TheParties shall not transfer strategic offensive arms subject tothis Treaty to third parties. The Parties shall holdconsultations within the framework of the BilateralConsultative Commission in order to resolve any ambiguitiesthat may arise in this regard. This provision shall not applyto any patterns of cooperation, including obligations, in thearea of strategic offensive arms, existing at the time ofsignature of this Treaty, between a Party and a third State.

    Article XIV

    1. This Treaty, including its Protocol, which is an integralpart thereof, shall be subject to ratification in accordancewith the constitutional procedures of each Party. This Treatyshall enter into force on the date of the exchange ofinstruments of ratification.2. This Treaty shall remain in force for 10 years unless itis superseded earlier by a subsequent agreement on thereduction and limitation of strategic offensive arms. Ifeither Party raises the issue of extension of this Treaty, theParties shall jointly consider the matter. If the Partiesdecide to extend this Treaty, it will be extended for a periodof no more than five years unless it is superseded earlier bya subsequent agreement on the reduction and limitation ofstrategic offensive arms.3. Each Party shall, in exercising its national sovereignty,have the right to withdraw from this Treaty if it decides thatextraordinary events related to the subject matter of thisTreaty have jeopardized its supreme interests. It shall givenotice of its decision to the other Party. Such notice shallcontain a statement of the extraordinary events the notifyingParty regards as having jeopardized its supreme interests.This Treaty shall terminate three months from the date ofreceipt by the other Party of the aforementioned notice,unless the notice specifies a later date.4. As of the date of its entry into force, this Treaty shallsupersede the Treaty Between the United States of America andthe Russian Federation on Strategic Offensive Reductions ofMay 24, 2002, which shall terminate as of that date.

    PROTOCOL TO THE TREATY BETWEEN THE UNITED STATES OF AMERICAAND THE RUSSIAN FEDERATION ON MEASURES FOR THE FURTHERREDUCTION AND LIMITATION OF STRATEGIC OFFENSIVE ARMS

    Pursuant to Article I of the Treaty between the UnitedStates of America and the Russian Federation on Measures forthe Further Reduction and Limitation of Strategic OffensiveArms, hereinafter referred to as the Treaty, the Partieshereby agree upon the following provisions regardingimplementation of the Treaty.

    This Protocol is organized into ten Parts.Part One, Terms and Their Definitions, contains the

    definitions of terms that are used in the Treaty and thisProtocol.

    Part Two, Categories of Data Pertaining to StrategicOffensive Arms, contains the categories of data with respectto items subject to the Treaty.Part Three, Conversion or Elimination Procedures, contains

    procedures governing the conversion, elimination, or othermeans for removal from accountability of strategic offensivearms and facilities.

    Part Four, Notifications, contains the iist ofnotifications provided for in Article VII of the Treaty.

    Part Five, Inspection Activities, contains provisionsgoverning the conduct of inspection activities provided for inArticle XI of the Treaty.

    Part Six, Bilateral Consultative Commission, hereinafterreferred to as the BCC, contains provisions governing theoperation of the BCC, established pursuant to Article XI1 ofthe Treaty.

    Part Seven, Telemetric Information, contains theprocedures associated with the fulfillment of obligationsconcerning telemetric information, pursuant to Article IX ofthe Treaty.

    Part Eight, Provisional Application, governs provisionalapplication of certain provisions of the Treaty and thisProtocol.Part Nine, Agreed Statements, contains Agreed Statements

    regarding the Treaty and this Protocol.Part Ten, Final Provisions, contains general provisionsapplicable to this Protocol.

    PART ONE - TERMS AND THEIR DEFINITIONSFor the purposes of the Treaty and this Protocol:

    1. (1. The term "air base" means a facility at whichdeployed heavy bombers are based and their operation issupported.2 . ( 2 3 . ) The term "aircraft" means any manned machine thatcan derive support in the atmosphere from interaction with theair other than the interaction of the air with the Earth'ssurf ce.3 . ( 8 6 . ) The term "aircrew member" means an individual whoperforms duties related to the operation of an airplane andwho is included on the inspecting Party's list of aircrewmembers.

    4 . ( 2 2 . ) The term "air-launched cruise missile" or "ALCM"means an air-to-surface cruise missile of a type, any one ofwhich has been flight-tested from an aircraft or deployed o n abomber after December 31, 1 9 8 6 .5 . ( 7 0 . ) The term "airplane" means a power-driven, heavier-than-air aircraft that derives its lift in flight chiefly fromaerodynamic reactions on surfaces that remain fixed undergiven conditions of flight.6 . ( 5 . ) The term "ballistic missile" means a missile that isa weapon-delivery vehicle that has a ballistic trajectory overmost of its flight path.

    7. (69.) The term "basing area" means an area within an ICBMbase for mobile launchers of ICBMs, in which deployed mobilelaunchers of ICBMs are based and in which fixed structures formobile launchers of ICBMs are located.8. (9.) The term "bomber" means an airplane of a type, anyone of which was initially constructed or later converted tobe equipped for bombs or air-to-surface issiles.9. (32.) The term "conversion or elimination facility"means

    (a) For ICBMs or SLBMs, a specified facility for theelimination of ICBMs, SLBMs, and launch canisters;

    (b) For mobile launchers of ICBMs, a specified facilityfor the conversion or elimination of mobile launchers ofICBMs

    (c) For SLBM launchers, a specified facility for theconversion or elimination of SLBM launchers;

    (d) For heavy bombers, a specified facility for theconversion of heavy bombers, or the elimination of heavybombers.10. (21.) The term 'cruise missile" means a missile that isan unmanned, self-propelled weapon-delivery vehicle thatsustains flight through the use of aerodynamic lift over mostof its flight path.11. (14. The term "declared data" means, for the data theaccuracy of which is confirmed during inspection activities:

    (a) Data with respect to items subject to the Treaty,specified according to categories of data contained in PartTwo of this Protocol;

    (b) Data included in notifications provided in accordancewith Part Four of this Protocol that update the data accordingto categories of data contained in Part Two of this Protocol;

    (d) Information that the inspected Party provides toinspection teams during pre-inspection procedures.12. (67.) The term "deployed heavy bomber" means a heavybomber equipped for nuclear armaments, other than a test heavybomber or a heavy bomber located at a repair facility or at aproduction facility.13. (63.) The term "deployed ICBM" means an ICBM that iscontained in or on a deployed launcher of ICBMs.14. (66.) The term "deployed launcher of ICBMs" means anICBM launcher that contains an ICBM and is not an ICBM testlauncher, an ICBM training launcher, or an ICBM launcherlocated at a space launch facility.15. (65.) The term "deployed launcher of SLBMs" means anSLBM launcher installed on a submarine that has been launched,that contains an SLBM, and is not intended for testing ortraining.16. (64.) The term "deployed mobile launcher of ICBMs" meansa mobile launcher of ICBMs that contains an ICBM and is not amobile test launcher or a mobile launcher of ICBMs located ata space launch facility.

    17. (62. The term "deployed SLBM" means an SLBM that iscontained in a deployed launcher of SLBMs.18. (46.) The term "distinguishable" means different on thebasis of the totality of external and functional differencesthat are observable by national technical means ofverification, or, when such observations may be inconclusivein the opinion of the inspecting Party, that are visibleduring inspection activities.19. (11. The term "each year" means during a period of 12months commencing on the date of entry into force of theTreaty or on an anniversary of that date.20. (43.) The term "facility" means an ICBM base, submarinebase, air base, maintenance facility, basing area, silolauncher group, ICBM loading facility, SLBM loading facility,production facility, repair facility, storage facility,training facility, conversion or elimination facility, testrange, heavy bomber flight test center, or space launchfacility.21. (74.) The term "fixed structure for mobile launchers ofICBMs" means a unique structure, within a basing area,designed to contain mobile launchers of ICBMs.22. (12. The term "front section" means that portion of thepayload of the final stage that contains the reentry vehicleor reentry vehicles and may, depending on design, include aplatform for a reentry vehicle or reentry vehicles,penetration aids, and a shroud.23. (80. The term "heavy bomber" means a bomber of a type,any one of which satisfies either of the following criteria:

    (a) Its range is greater than 8000 kilometers; or(b) It is equipped for long-range nuclear ALCMs.

    A bomber shall not be considered to be a heavy bomber ifit meets neither criterion (a) nor criterion (b) or ifotherwise agreed by the Parties.24. (81.) The term "heavy bomber equipped for non-nucleararmaments" means a heavy bomber that is not equipped for long-range nuclear ALCMs, nuclear air-to-surface issiles, ornuclear bombs.25. (82.) The term "heavy bomber equipped for nucleararmaments" means a heavy bomber equipped for long-rangenuclear ALCMs, nuclear air-to-surface issiles, or nuclearbombs.26. (85.) The term "heavy bomber flight test center" means afacility, other than a production facility for heavy bombers,at which test heavy bombers are based and their operation issupported.27. (3.) The term 'ICBM base" means:

    (a) For mobile launchers of ICBMs, an area in which oneor more basing areas and one associated maintenance facilityare located;

    (b) For silo launchers of ICBMs, an area in which one ormore groups of silo launchers of ICBMs and one associatedmaintenance facility are located.28. (56. The term "ICBM launcher" means a device intendedor used to contain, prepare for launch, and launch an ICBM.29. (27.) The term "ICBM loading facility" means a facility,outside an ICBM base and outside a test range, where ICBMs formobile launchers of ICBMs are loaded onto or unloaded frommobile launchers of ICBMs.30. (24 ) The term "in-country escort" means a group ofindividuals designated by the inspected Party to accompany and

    assist inspectors and aircrew members throughout the in-country period.31. (48. The term "in-country period" means the period oftime from the arrival of the inspection team or aircrewmembers at the point of entry until their departure from thecountry through the point of entry.32. (17.) The term "inspection activities" means inspectionsand exhibitions.33. (30.) The term "inspection activity site" means alocation at which inspections or exhibitions may be conducted.34. (29.) The term "inspection site" means a location atwhich Type One or Type Two inspections may be conducted.35. (16.) The term "inspection team" means the group ofinspectors assigned by the inspecting Party to conduct aparticular inspection activity.36. (15.) The term "inspector" means an individual specifiedby one of the Parties to conduct inspection activities andincluded on that Party's list of inspectors.37. (25.) The term "intercontinental ballistic missile" or"ICBM" means a land-based ballistic missile with a range inexcess of 5500 kilometers.38. (54. The term "launch" means the initial motion andsubsequent flight of an ICBM or SLBM.39. (61.) The term "launch canister" means a container,directly associated with an ICBM or SLBM, that can be or hasbeen used for transporting and storing an assembled ICBM orSLBM, with or without its front section, and from which anICBM or SLBM can be or has been launched.

    40. (60.) The term "launcher of missile defenseinterceptors" means a device intended or used to contain,prepare for launch, and launch missile defense interceptors.41. (20. The term "long-range ALCM" means an ALCM with arange in excess of 600 kilometers.42. (89. The term "long-range nuclear ALCM" means a long-range ALCM that is nuclear-armed.43. (44.) The term "maintenance facility" means a facilitythat is part of an ICBM base and at which ICBMs and ICBMlaunchers are maintained and their operation is supported.44. (52.) The term "missile defense interceptor" means amissile that was developed, tested, and deployed in order tointercept ICBMs, SLBMs, or their reentry vehicles.45. (35.) The term "mobile launcher of ICBMs" means anerector-launcher mechanism for launching ICBMs and the self-propelled device on which it is mounted.46. (42 ) The term "new typeu1 eans, for ICBMs or SLBMs, atype of ICBM or a type of SLBM, the technical characteristicsof which differ from the technical characteristics of an ICBMor SLBM, respectively, of each type declared previously in atleast one of the following respects:

    (a) Number of stages.(b) Type of propellant of any stage.(c) Either the length of the assembled missile without

    front section or the length of the first stage, by more thanthree percent.

    (d) Diameter of the first stage, by more than threepercent.

    47. (41. The term "non-deployed heavy bomber" means a testheavy bomber or a heavy bomber equipped for nuclear armamentslocated at a repair facility or at a production facility.48. (37.) The term "non-deployed ICBM" means an ICBM notcontained in a deployed launcher of ICBMs or on a deployedlauncher of ICBMs.49. (40.) The term "non-deployed launcher of ICBMs" means anICBM test launcher, an ICBM training launcher, an ICBMlauncher located at a space launch facility, or an ICBMlauncher, other than a soft-site launcher, that does notcontain a deployed ICBM.50. (39.) The term "non-deployed launcher of SLBMs" means anSLBM launcher, other than a soft-site launcher, that isintended for testing or training, or an SLBM launcher thatdoes not contain a deployed SLBM.51. (38.) The term "non-deployed mobile launcher of ICBMs"means a mobile launcher of ICBMs that does not contain anICBM, or a mobile test launcher of ICBMs, or a mobile launcherof ICBMs located at a space launch facility, unless otherwiseagreed by the Parties.52. (36.) The term "non-deployed SLBM" means an SLBM notcontained in a deployed launcher of SLBMs.53. (90.) The term "nuclear armaments" means, for heavybombers, long-range nuclear ALCMs, nuclear air-to-surfacemissiles, or nuclear bombs.54. (71.) The term "Open Skies airplane" means an airplaneperforming an observation flight in accordance with the OpenSkies Treaty of March 24, 1992, that is simultaneously usedfor transporting an inspection team to or from a point ofentry on the territory of the inspected Party.55. (47.) The term "period of inspection activities" means,for an inspection or exhibition, the period of time from the

    completion of pre-inspection procedures until the commencementof post-inspection procedures.56. (51.) The term "produce" means build, construct, ormanufacture in any quantity, and includes serial production aswell as one-of-a-kind anufacturing.57. (45.) The term "production facility" means:

    (a) For ICBMs or SLBMs, a facility at which:(i) ICBMs or SLBMs that are maintained, stored, and

    transported as assembled missiles in their launch canisters,are assembled, including the joining of all stages of suchmissiles and the loading of such missiles into launchcanisters.

    (ii) ICBMs or SLBMs that are maintained, stored, andtransported as assembled missiles without launch canisters,are assembled, including the joining of two or more stages.

    (iiij First stages of ICBMs or SLBMs that aremaintained, stored, and transported in stages are assembled.

    (b) For ballistic missile submarines, a facility at whichconstruction of ballistic missile submarines is performed.

    (c) For mobile launchers of ICBMs, a facility at whichthe erector-launcher mechanism of a mobile launcher of ICBMsis mounted on the self-propelled device.

    (d) For heavy bombers, a facility at which assembly of acomplete heavy bomber airframe is performed.58. (53.) The term "prototype" means, for ICBMs or SLBMs, anICBM or SLBM of a new type, no more than 20 missiles of whichhave been launched, and no launchers of missiles of which havebeen deployed.

    59. (13. The term "range" means:(a) For an ALCM, the maximum distance that can be flown

    by an ALCM of that type in its standard design mode flyinguntil fuel exhaustion, determined by projecting its flightpath onto the Earth's sphere from the launch point to thepoint of impact.

    (b) For a ballistic missile, the maximum distancedetermined by projecting the flight trajectory onto theEarth's sphere from the launch point of a missile of that typeto the point of impact of a reentry vehicle.

    (c) For an aircraft, the maximum distance that can beflown, without refueling, by an aircraft of that type whencarrying an ordnance load of 7500 kilograms, with a full fuelload in the internal and external fuel tanks and a flightprofile optimized to ensure minimum fuel consumption perkilometer, taking into account the distance covered duringclimb and descent. The fuel remaining in the fuel tanks afterlanding shall be no more than five percent of the maximumcapacity of the fuel tanks.60. ( 7 . ) The term "reentry vehicle" means that part of thefront section that can survive reentry through the denselayers of the Earth's atmosphere and that is designed fordelivering a weapon to a target or for testing such adelivery.61. (33. The term "repair facility" means:

    (a) For ICBMs or SLBMs, a specified facility, outside anICBM base or a submarine base, for the repair or maintenanceof ICBMs or SLBMs.

    (b) For mobile launchers of ICBMs, a specified facility,outside an ICBM base, for the repair or maintenance of mobilelaunchers of ICBMs.

    (c) For heavy bombers, a specified facility, outside anair base, for the repair or maintenance of heavy bombers.62. (19.) The term "rocket motor case" means the case thatremains after the solid propellant is removed from the solidrocket motor.63. (2.) The term "self-contained dispensing mechanism"means a device that separates from the final stage of amissile together with the front section and that independentlytargets and releases the reentry vehicle or reentry vehiclesand penetration aids.64. (49. The term "sequential inspection" means aninspection, conducted at facilities associated with the samepoint of entry, by an inspection team that has not departedthe territory of the inspected Party following the completionof the previous inspection.65. (87. The term "silo launcher of ICBMs" means an ICBMlauncher in a silo structure located in the ground.66. (88. The term "silo training launcher" means a full-scale silo launcher of ICBMs specified for training purposes.67. (55. The term 'SLBM launcher" means a device intendedor used to contain, prepare for launch, and launch an SLBM.68. (26.) The term "SLBM loading facility" means a shore-based facility, outside a submarine base, where SLBMs areloaded onto or unloaded from ballistic missile submarines.69. (57.) The term "soft-site launcher" means any land-basedfixed launcher of ICBMs or SLBMs other than a silo launcher.70. (77.) The term "solid-fueled ICBM" means an ICBM forwhich all stages are equipped with solid rocket motors.71. (76.) The term "solid-fueled SLBM" means an SLBM forwhich all stages are equipped with solid rocket motors.

    72. (78.) The term "solid rocket motor" means that part ofthe stage that consists of the case filled with solidpropellant.73. (28.) The term "space launch facility" means a specifiedfacility from which objects are delivered into the upperatmosphere or space using ICBMs or SLBMs.74. (75. The term "stage" means, for ICBMs or SLBMs, asection of a missile that is equipped with a propulsion unit,with the exception of the self-contained dispensing mechanism.75. (34. The term "storage facility" means:

    (a) For ICBMs or SLBMs, a specified facility, outside anICBM base, a submarine base, a test range, or a space launchfacility, for the storage of ICBMs or SLBMs.

    (b) For mobile launchers of ICBMs, a specified facility,outside an ICBM base, a test range, or a space launchfacility, for the storage of mobile launchers of ICBMs.

    (c) For heavy bombers, a specified facility, outside anair base, for the storage of heavy bombers.76. (4. The term "submarine base" means a facility at whichballistic missile submarines, as well as submarines that hadbeen previously equipped with SLBM launchers but afterconversion are incapable of launching SLBMs, are based, and atwhich shore-based support for such submarines, which mayinclude the assembly, loading, maintenance, and storage ofSLBMs, is provided.77. (6.) The term "submarine-launched ballistic missile" or"SLBM" means a ballistic missile with a range in excess of 600kilometers of a type, any one of which has been contained in,or launched from, a submarine.

    87. (10. The term "variant" means:(a) For heavy bombers, a classification, declared by the

    inspected Party, of airplanes of one type and one categorythat are distinguishable from other airplanes of the same typeand the same category.

    (b) For ICBMs and SLBMs, a classification, declared bythe inspected Party, of ICBMs of one type or SLBMs of one typethat are distinguishable from other ICBMs or SLBMs of the sametype.88. (68. The term "version" means, for mobile launchers ofICBMs of a type, a classification, declared by the inspectedParty, based on external or functional differences from othersuch items.89. (8.) The term "warhead" means a unit of account used forcounting toward the 1550 aggregate limit as applied todeployed ICBMs, deployed SLBMs, and deployed heavy bombers.90. (73. The term "weapon-delivery vehicle" means, forballistic missiles and cruise missiles, a missile of a type,any one of which has been launched or flight-tested, ordeployed to carry or be used as a weapon, that is, as anymechanism or any device that, when directed against anytarget, is designed to damage or destroy it.

    PART TWO - CATEGORIES OF DATA PERTAINING TO STRATEGICOFFENSIVE ARMSSection I. General Provisions1. The Parties shall use the categories of data contained inthis Part when providing data in accordance with the Treatyand this Protocol.2. No later than 45 days after signature of the Treaty, eachParty shall provide, in accordance with the Annex onInspection Activities to this Protocol, site diagrams offacilities and, if applicable, coastlines and waters diagramsfor each facility at which inspection activities may beconducted.3. No later than 45 days after entry into force of theTreaty, the Parties shall carry out an initial exchange ofdata according to the categories of data contained in thisPart, and shall provide, in accordance with the Annex onInspection Activities to this Protocol, photographs, unlesssuch photographs were previously provided in connection withfulfilling the requirements of the START Treaty.4. For the purposes of this Part and exchanges of data, themark "-- - denotes that the entry is not applicable in suchcase. The mark " * * * " denotes that this data will beprovided when available.5. Each ICBM, each SLBM, and each heavy bomber shall have aunique identifier.6. For the purposes of this Part, geographic coordinatesshall be expressed in latitude and longitude to the nearestminute, except in cases where two or more locations for whichgeographic coordinates are specified that are within oneminute of latitude and longitude of each other and that are ofthe same type or have the same appearance. In such cases, thelatitude and longitude shall be expressed to include seconds.

    PART THREE - CONVERSION OR ELIMINATION PROCEDURESSection I. General Provisions1. Conversion or elimination of strategic offensive armssubject to the Treaty shall be carried out in situ or atdeclared facilities.2. Elimination of strategic offensive arms subject to theTreaty shall be carried out by rendering them inoperable,precluding their use for their original purpose. Uponcompletion of elimination, an eliminated strategic offensivearm shall cease to be subject to the Treaty.3. If an ICBM launcher or SLBM launcher is converted to alauncher of ICBMs or a launcher of SLBMs of another type, itshall be considered to be a launcher of ICBMs or a launcher ofSLBMs of the type to which it was converted. If an ICBMlauncher, SLBM launcher, or heavy bomber is converted byrendering it incapable of employing ICBMs, SLBMs, or nucleararmaments, so that the other Party can confirm the results ofthe conversion, such a converted strategic offensive arm shallcease to be subject to the aggregate numbers provided for inArticle I1 of the Treaty and may be used for purposes notinconsistent with the Treaty.4. If one of the Parties decides to carry out a conversion orelimination of a type of strategic offensive arm subject tothe Treaty using procedures that it developed in accordancewith this Part, it shall notify the other Party of suchprocedures in accordance with Part Four of this Protocol. If,in the opinion of the other Party, the procedures developed bythe Party carrying out the conversion or elimination areambiguous or do not achieve the goals set forth in paragraph 2or 3 of this Section, the Party carrying out the conversion orelimination shall conduct a demonstration, within theframework of the BCC, of the procedures that it developed.After the demonstration, such procedures
