    O R D E R

    The appellant has filed this appeal dt. 30-07-08 which was received by thisCommission on 31-07-08 for non furnishing of the information by the PIO and AA.

    According to the appellant, he has requested the Dy.CGE/PIO by application dt.16-05-08 to furnish the xerox copy of his answer script in Hindi Subject of SSC March, 2008examinations. In response to the said application, the PIO through his lr.Rc.No.01/PIO/2007dt.16-06-08 has informed the applicant (appellant) that the evaluated answer scripts availablewith Public Authority are in his fiduciary relationship, the disclosure of which is exempted

    under Section 8 (1) (e) of the RTI Act and further the evaluated answer script is purely apersonal information, the disclosure of which has no relation to any public interest oractivity and is exempted under Section 8 (1) (j) of the RTI Act. He has also informed theappellant that there is no provision to furnish xerox copies of answer scripts in SSC schemeand hence the application was rejected u/s 8(1)(e) & 8(1)(j) of the RTI Act, 2005. Aggrievedby the response of the PIO, the appellant has preferred an appeal dt. 10-07-08 before theDGE/AA who through lr.No.01/AA/2008 dt. 24-07-08 has reiterated what the PIO hasfurnished to the appellant.

    Notices have been issued to the both the parties to appear before this Commission on19-11-08 on which date the appellant was called absent, whereas the PIO & AA were

    present.

    Heard the PIO and the AA.

    The DGE/AA has filed an affidavit stating, among others, that as per the amendmentmade by the Government to the GOMs.No.63 Education dated 16-01-1969 VideMemo.No.1862-K2/74-1, dt.24-07-1974, there is provision for re-totalling of marks only andthere is no provision for re-valuation of answer scripts and that there is no provision forsupply of xerox copies of valued answer scripts in the SSC Scheme. Further, the AA hassubmitted that nearly 13 lakh candidates appear for SSC Public examinations conducted bythe DGEs office every year and the total number of answer scripts in all the eleven papers

    amount to 1.43 crores and such being the magnitude of the answer scripts it is impracticableto supply the xerox copies of valued answer scripts.

    Having carefully examined the material papers on record and having gone throughthe contents of the affidavit filed by the DGE/AA, this Commission is of the considered viewthat the contention of the AA appears to be genuine and justified and in that view of matter,the appeal is liable to be dismissed and accordingly the same is dismissed.
