FCC upheld its $2000 fine, which was basically a wrist slap for failure to give notice of its intention to air phone talks. The actual incident occurred back in October, 1973 when some profanity accidently got on the air. FCC requires that listeners be forewarned before"conversations" are broadcast on the air. Heftel Broadcasting attorneys insisted that utterances of "hello" or " I listen to the new sound of 13Q" were not conversations within the ordinary sense of the word. FCC obviously disagreed and noted that "cash calls are not only invasions of privacy, but also expose the listening or viewing public to the answer of the party called "no matter what the answer may be." We spoke with Bill Tanner, National Program Director for the Heftel radio stations who told R&R that since the incident the policy has been to always pre -record cash call bits with the listeners. When the call is made they first make the recipient of the call aware that it is 13Q calling and ask if they mind being taped. They also remind listeners even after the first consent, at the end of the conversation, that they have been taped and ask for a second approval. If the contestant refuses permission station just refers on air to a cash call made to a certain area of the city and that the person did not know the answer. Many people felt that "Cash Call" would be outlawed by FCC, but this action allows the contest as long as the precautions are taken. Counsel for Heftel is not satisfied with the moral victory and will appeal the decision. ELTON LP Elton John's new album "Captain Fantastic And the Brown Dirt Cowboy" is shipping gold the first day and platinum the second day, sometime the week of May 19th. The album design has been described as a "spectacular effort" containing pieces of Elton's personal memoribilia plus a complete lyric book. Sources say the artwork is so incredible and complicated that attempts to reproduce it as a billboard have failed. BERNS TO KLIF Don Berns to KLIF.. Dallas as afternoon drive from WYSL.. Buffalo.     FCC Hits 'Cash Call' ContestIf your station is running the Cash

    An estimated 25,000 youngstersfrom ages 12 to 50 made a historic20 mile hike on April 20th for WH-BQ-Memphis' Superwalk onbehalf of the March of Dimes.March officials are expecting that$200,000 or more will be collectedfrom pledges made to par-ticipants. "Q" Superjocks DudeWalker and Mason Dixon wereamong the walkers.

    99X WALKATHON99X -New York also jumped on thecharity bandwagon in theirWalkathon for the March ofDimes. They raised over $200,000via the feet of 25,000 walkers inthe city. All told in these radiowalkathons, over a half milliondollars in these few cities will beraised.

Thelocation of the van was not givenon the air, but, much to the staff'samazement, a lucky listenerdrove by the van 7 seconds afterthe announcement.

    Do You REALLY UnderstandThe Parallels?

    At the R&R Convention we received several questions about stationplacement in the Parallels. Because of the hundreds of new subscribers in thepast couple of months we felt it necessary to again define how to effectivelyuse the Parallels.

    R&R backs up every chart position showing the statistics that cause thefinal positioning on the R&R back page Rock Chart. In all other publicationsand tip sheets you must assume that their systems and information is correct.When you see a number or a bullet on their charts you have nowhere to lookup the research in which to find out why.

    R&R has the Parallels. This section lists every record being charted, andmany that aren't. We list all our reporting stations and show their chart ac-tion on each record that they are playing. You are then able to see the actionthat caused a record to move up or down a chart, and ascertain from thejumps why a record did or did not get a bullet,even see regional records at aglance.

    The Parallels are broken into three sections. This is done to group similarstations together by playlist size and record rotation. PI are the top 15markets with stations playing 20-32 records. This allows programmers tojudge how much rotation a certain record will get if it is on this type of station.It also shows you what a "debut 29" really means. It puts a slightly differentemphasis on lower end chart jumps than, say, a station playing 45 records.Parallel 2 stations are all other markets and the stations in them that reportto R&R with the same tight list qualifications as P1. P3 are all markets withstations playing 35 and more records. This also includes stations that playsome extra product at night. Again, this allows a programmer to better un-derstand what kind of rotation factor a record might get at that station.

    The Parallels are not structured to rate stations by their importance, butrather by their playlist length and rotation factor. This gives programmersand record representatives a bit more insight to what a record is doing at agiven station.

    KROY-Sacramento brought out the coloring book talents of theirlisteners, distributing thousands of ready -to -color posters in storesthroughout thearea.Over 18,000 entries were received. The grand prizewinner received an all expenses paid vacation in Hawaii. Shown withsome of the entries are T.N. Tanaka, News Director and "Uncle" ByronPaul, morning personality.

    WSH E.. Ft. Lauderdale ventured into macabre with their recent AliceCooper Nightmare contest. Listeners were invited to create the mostnightmarish invitation to Alice Cooper's Nightmare, with the grandprize of dinner with Alice and tickets to his concert. Among 500 entrieswas a young lady who went so far as to get a rabies shot, find a coffin, liein it, and procceed to let 15 white mice crawl over her while someonecaptured the event on film. Winning entry was a red -tinted photographof a 10 year old girl waking up to the sheer terror of a tarantula crawlingacross her face. Diamond began hisillustrious career at the age of eightat Merced's local rocker KPLZ andKPLZ -FM, doubling as a scream-ing jiving Top-40'er on the AMand as a mumbling cosmic hip guyon the FM side. Very few knew thatShadoe was only eight years old, ashe maintained a shadowy existencea la Wolfman Jack's black -whiteimage. Mornings he blasted the AMdrive airways, exhorting Mer-cedians to "Wake up in the nittygritty city," while utilizing theentire 27 second intro to "Spirit InThe Sky" to promo contests, cross-plug and cliche his way into quicknotoriety. Late evenings he woulddon his peace rag and rope belt, dropa bottle of Blue Nup- or two, andfreshly mellowed out, hit the FMwith talk of consciousness levels,canyons of the mind and crystalizingof the brain while intro-ing theJethro Starship and Hank Sappa.

    As he tells it: "It was all a chanceaccident of fate. My mom, who wasa riveter in the Merced chopperfactory, sent me down to the oneJewish deli in town for a loaf ofseeded rye and half a pound ofwhitefish. I took a number and askedfor the items when my turn came up.The hirsute man who_ had taken thenext number turned toward me andlooked down transfixed. He told methat his name was Rum Jacobsonand that he thought my voicesounded like pastrami dipped inchicken fat and did I want to con-sider a career in radio?

    When I informed him that I hadonce been told that I sounded likeDavid Susskind and that I wasflattered but I was still in thirdgrade, he said that third grade hadnot deterred Charlie Van Bloke fromstarting his career at KLIF.Anyway, I was hooked and began atKPLZ the next day, after quitting

    school, taking an overnight crashcourse for my first class ticket, andmoving into a small apartment nearthe station with newsman J. PaulBradbuy.

    I broke a lot of records at KPLZ ,being solely responsible for "DoubleBarrell," "Hair" and "Letter to aTeenage Son,',' and was invited tospeak at the Hal Crudman con-vention in Vegas on the perils ofcombining a career in small marketradio with maintaining a rapportwith the other kids during recess.That turned out to be my big break.While watching a famous musicpublisher named Manny Mavin ofScene-Germs-Bumblia Music at thecrap table I was approached by aman about 5 foot 20 inches who saidhis name was Tab Duck and that heconsulted 45 AM stations around thecountry. He said he wanted me tostart immediately at the Visalia AMas morning man and that he didn'twant me to change my name. AsShadoe W. Diamond is my real nameI was thrilled, since my good friend

    Bwana Jimmy from school hadfollowed me into radio and his momand dad, Mr. and Mrs. ArthurJimmy were upset when his namewas changed to Danny T. Stonely.

    KV IS in Visalia wasn't big enoughfor my talents so Duck and hisassistant Ernie Borres moved mequickly to New York City where theyslotted me on their New York rockerWJEW-FMas a 6 pm jock to go headto head against the Walter Cronkitenews. My local P.D. there, FastmanStone, couldn't control me much andafter a while I only took my ordersfrom the man, Tab Duck himself,who still lived in L.A. in a housecalled The House. An interestingsidelight to all this is that my veryfirst discoverer, Rum Jacobson hadnow bought the deli in Merced andseemed upset that many of hissandwich inventions were beingeaten by Duck and Borres in thebigger cities. He, for instance, saidthat he had created the idea ofPeanut Butter and Herring onPoundcake but that Duck andBorres had given the recipe toFongool's Italian Restaurant, apopular record and radio hangout inLos Angeles. Oh, and by the way,Bob Pillson, the ambitious youngparking boy at Fongool's was nowbrokering time at KMPC on Sundaynights and quickly gaining a repamong teeny radio boppers as"Your Funky Eater." I spottedPillson as a possible challenge to myrightfully -earned place as top youngjock in the country, although

    I wascalmed somewhat by the fact thatPillson at 10 was 2 years older than I.

    would get really bombed and acouple of promoters would have totake me home, where they would fixme up with some Rolalds and tuckme in to sleep itoff with my bear andmy Ken doll. My favorite recordguys were Perry Towel and TykeMatkinstun of Bumblia Recordscause I really looked up to them. Wedrifted apart though cause by thetime I was nine they had to look up tome. But I'll never forget those daysof wine and roses when I was on topat Fongool's. It was also those daysof Klein and Rosen 'cause MickeyKlein of Fatco Records and DerbyRosen, an indie guy, popped formany a Veal Fongoolia.

    One day I guess I overstepped mybounds at Fongool's cause I arrivedthere already blotto from a fewhours at another watering hole, theMolly Gotcha down the street. As Iwalked into the place I immediatelypunched promo man Chick Faggertin the face, just on principle. You seeChick hadn't bought me a drink in 2days and I thought I had a right to beticked off. Faggert didn't takekindly to this and he and columnistClod Hallway took me out into theparking lot and taught me a lessonI'll never forget. They took down myknickers and gave me the spankingof my life. Then they called my Bossat The House and said they were sickof catering to my every whim andfrom now on they would only cater tomost of my whims.

    Well, the thought that certainwhims would not be catered to anylonger was enough to grow me upquick. I suppose the jet lag of doingmy AM show every morning atWJ EW and then winging coastwardfor the nightly scene at Fongool'swas finally getting to me. And so Iwillingly quit my gig, moved per-manently back to the coast where Iam now quietly living in amonestary in Downey getting myhead together and calmly plottingthe day when I, Shadoe W. Diamondwill return newly matured,teenaged, dried out andspiritually evolved, ready 'foranother shot at that wild and woolywacky world of Radio. Because yousee, once you've walked down thebad road, there's always a good roadahead, cause the good road is justdown the road right past the badroad, and if you've walked down thatbad road, the good road can't be toofar along. That is, as long as you'vepassed the bad road."

    by Candy TuskenThe new Paul McCartney single is due out mid -May and is off the completed

    "Venus & Mars" album titled "Listen To What The Man Said" which is an up -tempo song, but not a rocker. Capitol expects to sell several million of thealbum and reports from those who have heard it say it's a killer. The albumpackaging itself Is still in a process of flux. The idea of including T-shirts andfive framed pictures along with bulky artwork attached to the album (but-tons, and protruding designs) for The Press has been scrapped. Word wasthat the promotion would have cost a cool $70,000 as designed and conceivedby Linda McCartney.

    A designer flew in from London to discuss possible ideas with the Tower.Said a Capitol spokesman "the album design still is changing, but we wereable to give their designer ideas of what would be most beneficial andsaleable from a marketing aspect. At this point, we really don't know whatthe packaging will turn out to be, but it will be what Paul and Linda want."

    Sly Stone was at The Beverly Hills Hotel in L.A. last weekend and receivedseveral calls from Equinox's Terry Melcher. One Beach Boy was overheardto say that Melcher was going to produce Sly on his next album and both havebeen spotted in the studio together. Since Equinox's contract with RCAspecifies that all Equinox endeavors must be released on that label, there is achance that Epic will lose Sly. However, the talk for several months has beenthat Sly was leaving the label anyway with the reason being rumored as "non-cooperation of the artist." Sly left L.A. immediately and flew to San Fran-cisco upon hearing of the death of Tom Donahue. Sly was a close friend ofDonahue's and attributes his discovery and career success directly to thelegendary and much beloved radio pioneer ...

    Irwin Steinberg announced last week that Phonogram and its labelsMercury, Philips and Vertigo will no longer be distributed through in-dependents with the future funneling of product to be handled by Phonodiscdistributors effective June 1st. Phonodisc and Phonogram both belong toparent company, Polygram Corp. and Steinberg explained to currentdistributors that "it is, of course, a natural evolution for this company whichwe approach with the hope that our new relationship with Phonodisc will be asfruitful, warm and rewarding as ours has been with you." Lots of talk andexcitement over at Warner Bros. regarding a new group just signed byWarner -Spector called Ca lhoon.The all -Italian band is reportedly the numberone draw in New York and Florida with a fan club of over 15,000 generated byperformances of the group who have never released a record. Warner -Spector is introducing their new find via a twelve inch record that features aseven minute one-sided song being mailed to discotheques across the countrythis week titled "(Do You Wanna) Dance, Dance, Dance" shortly followed bya 3:29 edited version for radio stations . . . Nigel Olsson was out at The BeachBoy's studio last week rumored to be arranged by Jim Guercio.

    The new hangout for superstars in New York is a membership -only clubowned by Ashley Pandell called "Ashleys" whose steady customers all lastweek were The Stones and Ron Wood. Another regular at the private dinner -dance club is John Lennon . . . Sparks member Russell Mael was surprisedlast week when he was presented with a Pacific Palisades High Schoolyearbook which featured him as one of the school's star halfbacks. Confusionarose when the year of the graduating class pointed out that Mael would nowhave to be an elderly twenty-six going on twenty-seven. He denied the im-plication and said "I'm twenty-one; I don't want to talk about it. No Com-ment." Said the presenter "well, maybe he did graduate when he was twelveyears old!" Former ABC head, Jay Lasker, and partner Howard Stark arenegotiating for backing for new record label with rumors that overseasmoney will be forthcoming from foreign investors ...

    PINK FLOYD SNUBS RADIOSupergroup Pink Floyd, who have been receiving less than enthusiastic

    reviews on their current tour, have turned down several nationally syn-dicated radio shows. The group, who is fast earning the reputation of beinguncooperative, were asked by several radio networks for five to ten minutesof phone chatter to coincide with two to three hours of Pink Floyd radiospecials. The stations said they would settle for any member of the group totalk on a ty subject they'd care to. The group flatly refused all phone or in -person interviews no matter how short; they reportedly kicked out ascheduled Rolling Stone interviewer from their hotel room alledgedly in-forming him that they didn't need them or anyone. Shadoe Stevens of L.A.'sKMET got the sameresponse from his request that the group comment onthe busting and harassment of their fans who attended their show. Shadoeproh-ptly played the group's song "Money" telling the audience that thegroup ref used to make any comments about the busts which he felt was prettyrude considering the people who attended and those who were busted aredirectly responsible for the success of the group. He elaborated that the fansthat make them money would like.to hear from the group and then proceededto run the needle across the record with a loud screech. Several sources claimthe problem with the group arose with the departure of mentor Sid Barrettwho conceived the idea of the group and their album "Dark Side Of TheMoon." Talk is that the group never recovered from his absence ...

    May 16th in Dayton, Ohio has been proclaimed as "Ohio Players Day" withthe keys of the city and an official proclamation to be presented to the groupby the Mayor on that date. The festivities will be broadcast and show live onThe Phil Donahue Show, which is comparalite to The Mike Douglas Show, andis one of the highest rated daytime TV fares in that area . . KLOS-L.A. had asurprise visit at two a.m. in the morning from Joan Baez who talked about hernew album "Diamonds & Rust" which she said is the most musical albumI've made to date. In tow with the singer was good pal, Marlon Brando .

    WHO'S BOOMER CASTLEMAN?As you can see by the picture, Boomer Castleman paid a visit to R&R last

    week. Boomer is a native Texan and his full name is Owen BoomerCastleman. He has always been called Boomer which was his Mother'smaiden name. In 1963 Boomer decided to leave Texas and make his fortune InLos Angeles. He ended up laying at Ledbetters, a now defunct funky club onthe Strip, with a group called The New Society of which Michael Nesmith wasa member in his pre-Monkee's days. Boomer used to duet with anotherstruggling artist on Sunday nights, John Deutchendorf (better known now asJohn Denver.) A year later a hometown old friend joined Boomer, MichaelMurphey, who joined the New Society after Nesmith split. Boomer andMichael started to duet themselves and soon formed their own group calledThe Texas Twosome. Through their connections with Nesmith, who likedtheir material, the duo landed a job writing songs for Screen Gems and co -wrote several songs that have been recorded by B.W. Stevenson, Rusty Weir,Trini Lopez, Vic Dana, etc. Michael proceeded to do several projects withgroups including Kenny Rogers & The First Edition and Boomer headed backhome where he immediately became a high demand studio musician. Hecontinued to write and learned production enabling him to produce hiscurrent single and forthcoming album. About six months ago, he approachedABC with Judy Mae but the company wanted another producer for the songwhich Boomer declined. A month and a half ago, he had a verbal agreementwith GRC for the single which fell through. He then took the song to MUM'sLarry Douglas who uncharacteristically proclaimed "That's a number onesong. What's it going to take to sign you, Boomer?" The terms were agreedupon at once and within three weeks the single was off and running. The nameBoomer seems a misnomer for the gentle, quiet spoken artist who has beenwaiting a long time for a hit and plans to actively pursue a recording career.His album is being finished next week with a national tour planned once thealbum is out. The tour will include some "classy" clubs and auditoriumsthroughout the country. Said Boomer "I've played so many beer halls, I don'tthink I could face another one!"

    DANE FANS FOOLED BY THE DOCTORFun loving Dr. Hook were not at all perturbed when their lead-in act failed

    to show up for their concert in Copenhagen. The group disguised themselveswith glitter and makeup, went on stage and played oldies and old EnglishRock 'N Roll songs for a whole set while the crowd screamed for Dr. Hook.After the performance, the equipment was broken down and set up again forDr. Hook who came on again without the disguises and entertained foranother whole set. After the second to the last song, the roadies came out andproceeded to paint lead singer Ray Sawyer's face with make up and glitterrevealing him to be the lead singer of the "openin,g act." When the crowdrealized what Dr. Hook had done, the auditorium was filled with a deafeningroar of laughter, whistling, stomping and wild applause . . . By the way,Capitol did not sign Dr. Hook for five million dollars. The press releaseomitted the vital word "yen". Since the title of their new album i!"Bankrupt" the group though it would be funny to have the press release reac"Dr. Hook signed for five million ... yen." That should clear up the con.fusion . .

    Casablanca's hard rockers, Kiss, will be introducing new costumes May16th at Detroit's Cobo Hall designed by Moonstone who created La Belle'swardrobe. Hard to believe, but the new apparel is reported to be even moreextreme, complete with feathers and fur. Large video monitors will providecloseups of the act's faces during the performance at which 12,000 people areexpected to attend . . .Columbia Records has closed the deal with hot mid -west group, Northern Light, whose single, "Minnesota," is a local hit in thatarea after being pursued by several major labels .. . The Doobie Brothersdecided how each of them would like to be conveyed from their private jet toThe Century Plaza Hotel in L.A. for their four -night concert dates in Southern

    Although it looks like R&R hired a male secretary, behind those dark glasses is Ron Mael ofSparks who, along with his brother, Russell (holding ruler,) visited the R&R offices lastweek. Sparks will be back in the States for another tour in November -December after whichthey fly to France to film the new Jacque Tati movie "Confusion."
