1 REQUIREMENTS

1.1 Project Description Oberon Council is committed to upgrading Oberon Sewage Treatment Plant (STP) to improve environmental outcomes and operation. The upgrade will comprise the construction a new STP near the existing plant. The new plant will be based on the intermittently decanted extended aeration process (IDEA).

The STP upgrade is part of the Oberon Sewerage Project, which is co-funded by Oberon Council and the NSW Government under the Restart NSW program.

1.2 Project Objectives The project aims to achieve the following objectives:

Meet the regulatory requirements and contemporary environmental standards.

Be based on known technology with proven track record.

Provide Council with a modern, robust, safe and efficient STP.

Be delivered within the budget.

1.3 This Consultancy Below is a summary on the scope of works:

Part A – Concept Design:

Review and validate the Oberon investigation report prepared by Arup.

Prepare a brief for geotechnical investigation required for the design.

Undertake concept design for the STP including the effluent discharge outfall.

Prepare cost estimates to a level of accuracy of -10% and +25%.

Prepare a concept design report, including concept level drawings.

Part B – Review of Environmental Factors (REF):

Provide environmental advice and information as input into design development.

Undertake and document assessment of the potential environmental impacts of the project, as defined by the concept design.

Propose and document environmental safeguards and mitigation measures to reduce and manage the project’s risks.

Prepare an REF report to enable Council to make a determination as to whether the project is likely to have significant environmental effects.

Part C – Documentation for D&C contract:

Prepare conditions of contract and specification of design and construct contract for the STP.

Scope of works for each part are described in subsequent sections of this Brief.

1.4 Limitation The Consultant for this project is may not be part of a team bidding for the D&C contract for this project.

Council may, but is not obliged to, retain the Consultant for assistance during the D&C contract.

1.5 Consultancy Objectives The objective of this consultancy is to enable Council to proceed with commissioning a contractor for the design and construction of the STP.

The focus is on:

Addressing technical, regulatory and environmental aspects in a coordinated manner to ensure that the new STP is effective, efficient and meets regulatory requirements, contemporary environmental standard, performance requirements and community expectations.

Providing robust basis and documentation for a D&C contract for the new STP.

1.6 Contractual Arrangements Oberon Council will enter a contract with the successful consulting firm. The contract will comprise the following documents:

1. Australian Standard AS4122-2010 General Conditions of Contract for Consultants. The insurance cover for public liability and professional indemnity are $10 million and $5 million respectively.

2. This brief and any addenda.

3. The Consultant’s proposal.

4. Letter of acceptance from Council.

The Investigation Report (ARUP, November 2017, is available to the Consultant as background. This report will not form part of the Contract.

1.7 This Brief In case of discrepancies with the other documents, the requirements of the brief, modified by any addenda and Council’s acceptance letter, will prevail.

2 EXISTING OBERON STP

2.1 Location The town of Oberon is located in the east of the Central Tablelands region of New South Wales. It is approximately a three-hour drive from Sydney or Canberra. Oberon is the highest town in the Greater Blue Mountains region and approximately 1100 metres above sea level.

The main industries in Oberon are farming, forestry and wood products. According to the Australian Bureau of Statistics 2016 census, there were 5,300 people in the Oberon Shire and 2600 residents who lived in Oberon town.

2.2 Existing Oberon STP The Oberon STP was constructed in 1965 and a capacity upgrade was undertaken in 1988. The Oberon STP is a conventional trickling filter which is comprised of the following treatment process units:

A balance or equalisation tank;

Inlet works with grit channel, flow measuring flume and mechanical spiral screen;

Two sedimentation tanks (2600 EP);

Two trickling filters (3800 EP);

One clarifier (6000 EP);

Two sludge digesters (4000 EP);

Alum dosing facility;

Three sludge lagoons (7000 EP);

Sludge drying bed (1000 EP) and sludge drying lagoon;

Effluent ponds (20 days detention) and discharging effluent to the nearby Fish River.

Figure 1 provides an overview of the Oberon STP, with details of the process units are shown in Figure 2.

2.3 New Site The proposed site for the new STP is to the south of the existing STP. The approximate boundaries of the available site are shown as red square on Figure 3.

Council is in the process of surveying the site. The survey will be provided to the Consultant.

The consultant is required to determine the optimal layout of the new STP within this site. The impact of tree removal (if required), shall be assessed by the REF.

The drying bed, east of the proposed site, may be used for the new STP.

3 CONCEPT DESIGN

3.1 Inputs The documents listed in this section, except the survey and geotechnical investigation, are available to tenderers.

3.1.1 Investigation Report and Supporting Documents

The Oberon STP Investigation - Options Report (Arup, 23 October 2017) summarises the investigation carried out for this project. Influent Data

Influent characterisation report prepared by DCM Process Control.

Flow data for the past 3 years.

Influent temperature monitoring data.

3.1.2 Survey Council will carry out of survey.

3.1.3 Geotechnical Investigation Council will carry out geotechnical investigation based on a brief prepared by the Consultant. The outcomes of the investigation will be provided to the Consultant.

3.2 Scope of Work

3.2.1 Work Breakdown Structure Below is a proposed list of tasks. The Consultant may modify the WBS to suit their methodology and organisation structure.

Review of Investigation Report.

Design basis.

Preliminary investigations.

Concept design including concept drawings.

Cost estimation.

Concept design report and drawings.

These tasks are described in the following sections.

3.2.2 Review of Investigation Report The data and outcomes of the investigation are divided into three categories as described below.

Category 1 – Data modified by Council

Design Loadings Use the following average dry weather flow (ADWF) estimates for the concept design.

Current (2020): 1160 kL/d

Year 2030: `2120 kL/d

Design the plant for 2050 loading and develop a staging strategy.

Stage 1 will have capacity to treat at least the 2030 loadings, and the subsequent stage(s) will be increase the plant’s capacity to accommodate the forecast 2050 loadings.

For each major component of the plant, define Stage 1 optimal capacity and identify an appropriate upgrade path from Stage 1 to the ultimate stage.

Category 2 – Accepted by Council

Biological Process Council has resolved to adopt the intermittent decanted extended aeration (IDEA) as the core biological process.

Effluent Criteria Deign the plant to meet the effluent targets specified by the EPA, listed in Table 1.

3.2.3 Design basis Develop a Design Basis to be adopted for the Concept Design. The Design Basis shall cover items such as, but not limited to the following:

Influent specification

Develop an influent characterisation profile using available plant influent data provided by Council and/or other sources. Undertake the necessary cross checks for flow and loading information based on population data and raw sampling data provided by Council.

Process design envelope

Develop a process design envelope for the Concept Design. The envelope will identify all required constraints, staging, and limits (start-up conditions and redundancy provisions), and absolute requirements, to ensure that a robust design is developed.

Design criteria

Including items such as engineering and operations design criteria, performance requirements and redundancy provisions to be provided by the individual process units.

Identify additional items for the design basis in the proposal.

3.2.4 Preliminary Investigations

Geotechnical investigation Prepare a brief for geotechnical investigation and site contamination assessment, matching the plant’s proposed layout. The geotechnical investigation report shall be suitable for both concept design and detailed design.

Council will commission a geotechnical consultant to carry out the geotechnical / contamination investigation in accordance with the brief.

General site constraints assessment Review the general site constraints including, but not limited to:

Site services.

Routes for influent pipe and for effluent discharge pipeline, including connection to existing pipe.

The outfall area for the construction of the new discharge embankment.

Capacity of existing sludge lagoons and appropriateness to be used as part of the new STP.

Capacity of existing drying and appropriateness to be used as part of the new STP.

Access road and stormwater drainage.

Operational constraints in reusing existing infrastructure.

Geotechnical investigation brief.

General site constraints assessment Technical Note summarising the documentation reviewed, constraints identified and implications on the design shall be prepared.

Following the submission of a draft Design Basis report, facilitate a Design Basis Workshop at Council’s Oberon Office, to discuss and review the details of the proposed design basis. Following discussion and comments from the Workshop, revise the Design Basis and finalise. The design basis report is a hold point.

If appropriate, review the risk management plan (developed in the Inception Workshop).

3.2.5 Concept Design Upon approval to proceed to Concept Design phase, progress with the design and documentation of the Concept Design. The level of detail provided with the design shall be suitable to estimate the cost with an accuracy of -10% and +25%. The expected deliverables are outline below.

Process Design Process equipment sizing including odour control system (if required).

Utilities requirement (e.g. potable water, service water, compressed air).

Process flow diagram including mass and flow balance.

Process and instrumentation diagrams (including pipe sizing and materials selection).

Hydraulic profile.

Operation and control philosophy.

Staging strategy.

Start-up and commissioning approach including cutover plan from the existing STP to new STP.

Civil, Structural and Mechanical Design General arrangement drawings of major structures and mechanical

equipment

Preliminary foundation design, based on geotechnical investigation.

General arrangement drawings of pipework (both underground and above ground).

Plans and longitudinal sections of effluent discharge pipework, including stabilisation work to the creek embankment and bed.

Site stormwater drainage.

Road, access and fence layout.

Site services layout, routes of pipes and conduits, power and lighting.

Contour plan of finished site, earthworks and retaining walls.

Work and management of the existing effluent ponds, as they are likely not be part of the process of the new plant.

Decommissioning approach for the existing STP.

Site single line diagram.

Motor and instrumentation list.

SCADA block diagram (including interfaces with the existing system).

High voltage upgrade requirements (if necessary).

Requirement for standby generator.

Control system, alarms and communication philosophy.

3.2.6 Cost Estimate Provide capital and O&M cost estimate (-10%/+25%) for all work required for the construction of the new plant, including temporary works. Include the cost to decommission the existing plant as a separate part of the cost estimate.

3.2.7 Concept Design Report Document the concept design for all stages in a report, including in the appendices. The concept design shall be suitable as the basis for the next stage, design and construct (D&C) contract.

3.2.8 Drawings Prepare concept design drawings in sufficient details to convey the designers requirement and be suitable to use as a basis for the detailed design. Prepare the drawings to be legible and clear when printed on A3 paper. Include scale and north point where appropriated. Submit the drawings in three revisions:

Early draft (approximately 50% complete.

90% draft, together with the draft concept design report.

Final, together with the final Concept Design Report.

3.2.9 Project Meetings and Workshops The following project meetings and workshops are required as a minimum:

Inception Meeting: Refer to Section 7.1.

Design Review Workshop: Convene a minimum of two design review workshops. The first meeting will be to discuss the outcomes of the Design Basis report, and the second at an appropriate time during the concept design. The purpose of the workshops is to present the Consultant’s work to Council and key stakeholders and receive feedback.

HAZOP / CHAIR Workshop: Convene and facilitate a combined Hazard and Operability (HAZOP) and Construction Hazard Assessment Implication Review (CHAIR) workshop with Council and its nominated stakeholders. Appoint an experience workshop facilitator who shall ensure that constructability, operability and maintainability aspects are addressed during the workshop.

Safety in Design Assessment: Undertake a Safety in Design assessment and maintain a designer risk register for the duration of the concept design. This may be an internal meeting in the Consultant offices.

Monthly progress meetings between Council and the Consultant’s project team, by phone or teleconference facilities.

4 REVIEW OF ENVIRONMENTAL FACTORS

4.1 Introduction An environmental assessment is required to meet the statutory planning requirements and help inform development of the concept design so that impacts can be avoided and minimised where possible in the early design stages. It is also required to inform Council and the community about the potential environmental impacts of the project and the mitigation and management measures to be implemented. Therefore, integration of the concept design with the environmental assessment is expected.

The environmental assessment for the project is to be presented in the form of a Review of Environmental Factors (REF), which is further detailed below.

4.2 Purpose The REF is to be prepared by qualified and experienced personnel to fulfil the requirements under Part 5 of the Environmental Planning and Assessment Act 1979 (EP&A Act), and to take into account all matters affecting, or likely to affect, the environment as a result of the proposal.

The REF is required to:

Provide environmental advice and information as input into design development.

Undertake and document assessment of the potential environmental impacts of the project, addressing both the construction and operation phases.

Propose and document environmental safeguards and mitigation measures, during construction and operation, to reduce and manage the impacts and risks.

Enable Council to make a determination as to whether the project is likely to have significant environmental effects.

Provide a framework for the preparation of environmental management plan (EMP) by the D&C contractor

4.3 Confirmation of Statutory Planning State Environmental Planning Policy (Infrastructure) 2007 (ISEPP) aims to facilitate the effective delivery of infrastructure across the State.

Clause 106 of ISEPP permits development for the purpose of sewage treatment plants or bio solids treatment facilities to be carried out by or on behalf of a public authority without consent on land in a prescribed zone.

Under the Oberon LEP 2013, the Oberon STP site is located on land zoned as RU1 – Primary Production, which is a prescribed zone for the purposes of ISEPP. Therefore, provided the proposed works do not constitute a significant impact on the environment, the proposal can be assessed and determined by Council under Part 5 of the EP&A Act.

If it is identified by the REF that the proposed upgrade works are likely to have a significant impact on the environment, the proposal may need to be referred for assessment under Part 5.1 of the EP&A Act to the Department of Environment and Planning.

Notify Oberon Council immediately if during the REF process it is determined that a significant environmental impact is likely to occur and environmental assessment under Part 5.1 is thought to be warranted.

4.4 Scope of Work

4.4.1 Work Breakdown Structure Below is a proposed list of tasks. The Consultant may modify the WBS to suit their methodology and organisation structure.

Data collection and review.

Regulatory Framework.

Specialist studies.

Environmental assessment / Identification of impacts and risks.

Mitigation measures / safeguards.

REF report.

4.4.2 Preliminary Tasks and Meetings Prior to the REF, carry out the following tasks:

Inception meeting: Refer to Section 7.1.

Background research and literature review, including collation of any existing information or baseline data from available Council reports, online database searches, or any other sources.

Specialist field surveys / studies as required. See further detail around specialist studies below.

Environmental risk review and workshop. Convene and facilitate a workshop with Oberon Council in Oberon to discuss any environmental issues, constraints, or risks identified in the above tasks. These should also be shared with the design team, together with an overview of the associated implications.

Progress meetings are required to be attended monthly via telephone conference.

4.4.3 REF Report Present an assessment of the potential environmental impacts of the proposed Oberon STP upgrade during any works associated with construction, operation and maintenance. Consider the factors identified in Clause 228 of the Environmental Planning and Assessment Regulation 2000.

Submit a methodology for the REF with the tender response, along with a draft Table of Contents.

The REF report shall include, but not necessarily be limited to, the following:

A summary, introduction and background to the proposal.

Site identification and mapping.

An outline of the strategic need and the options and alternatives considered.

Identification of the project objectives, including environmental, social and economic objectives.

Overview of relevant planning and environmental legislation.

A description of the preferred upgrade option. (Key design information that can be used to support an Environmental Protection Licence should be clearly identified including effluent quality, annual pollutant loads, daily and annual volumetric loads).

A clear and logical discussion around justification of the preferred option.

A description of the existing environment, including surrounding land uses.

An environmental assessment of the preferred option (environmental benefits and impacts are to be quantified where possible, otherwise a qualitative valuation is to be made) and recommendation of proposed environmental safeguards and mitigation measures to minimise and manage impacts.

Assessment of cumulative impacts.

Beneficial effects of the proposal.

Adverse effects of the proposal.

Proposed environmental safeguards and mitigation measures with clearly assigned responsibilities and timeframes, including:

Issues to be managed during the detailed design phase

Issues to be managed by the construction contractor

Issues to be managed during operation and maintenance of the facility.

Requirement of any Environmental Management Plans for the construction and operational and phases.

A summary of any licences, additional approvals or permits required.

Conclusion and justification of the proposal regarding the outcome of the assessment, including consideration of the criteria of ecologically sustainable development.

References and glossary of terms.

Appendices, including any specialist study reports

Include maps, tables, and graphics in the REF to convey certain information where appropriate. Any maps should be orientated so that north is to the top of the page and include appropriate legends and scales.

If impacts are assessed as potentially significant, notify Oberon Council to discuss options regarding the design of features to ensure this scale of impact does not occur.

4.5 Environmental Assessment

4.5.1 General Environmental Factors The REF shall include, but not be limited to, the following environmental factors and considerations:

Site contamination and acid sulphate soils.

Surface water quality, flooding and hydrology

Terrestrial and aquatic ecology.

Visual amenity and landscaping requirements.

Air quality and odour.

Traffic and access.

Noise and vibration.

Waste management and resource use.

Aboriginal heritage.

Non-Aboriginal heritage.

Bushfire risk.

The list of environmental factors above should not be assumed to be the total list of factors to be assessed. All possible environmental impacts should be included in the assessment process.

As a guide, the following general procedure should be followed for the assessment chapters of the REF:

Identify issues.

Analyse and assess the impacts of those issues.

Evaluate the likely environmental significance of the impacts.

Detail strategies to mitigate impacts or provide environmental safeguards.

4.5.2 Specialist studies The following specialist studies and tasks are required:

Water quality Prepare a desktop receiving environment water quality assessment to determine the likely impact of future effluent flows from the Oberon STP on water quality in Fish Creek during dry and wet weather.

Ecology The REF will contain a section on Terrestrial Ecology. This desktop assessment will account for both publicly available information and information provided by the Council (if any) of both Terrestrial and Aquatic aspects of the location to identify the environmental constraints.

The local flora and fauna will be identified for the area. Known occurrences will be established and the likelihood of these species will be reviewed. The information will be analysed for risks of impacts relating to the clearing and release requirements of the site. Desktop verified maps will be produced to provide reference of the known vegetation communities, waterways, known regulatory features, as well as establishing the proximity to environmentally sensitive receptors.

Legislative requirements pertaining to environmental constraints will be identified. These requirements will be reviewed in relation to the project site constraints and based on the site aspects. Recommendations will be made for actions needed to meet approval and permit requirements.

The assessment will be summarised, and where applicable draw on relevant aspects from the other REF chapters that might apply the environmental constraints. In addition to the summation possible future requirements of surveys and monitoring will be identified and discussed.

This assessment should also determine suitable construction methods to complete the upgrade of the existing discharge point into Fish Creek River. An assessment should be prepared to ensure that the upgraded discharge point complies with the following requirements;

Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act)

Noxious Weeds ACT 1993

Water Act 1912

Contaminated land A site contamination investigation will be carried out by Council (refer to Section 3.2.4). Based on the outcome of this investigation, determine environmental concern associated with the current and/or past activities within construction zone or from neighbouring sources. The assessment should include:

Identification of past and present potentially contaminating activities.

Identification of potential contamination types.

Discussion of site conditions.

A preliminary assessment of site contamination.

Assessment of the need for any further investigations.

Archaeology Carry out an Aboriginal Heritage Due Diligence Assessment in accordance with the Due Diligence Code of Practice for the Protection of Aboriginal Objects in New South Wales (DECCW, 2010).

Noise and Vibration Prepare a noise and vibration impact assessment that quantifies and assesses the levels likely to occur during the construction and operational phases of the Oberon STP to ensure compliance of the upgrade with the following:

Odours Prepare an air quality and odour assessment that quantifies and assesses odour emissions from the site during operation to ensure that the upgraded plant complies with the requirements and objectives contained in the following:

Protection of the Environmental Operations Act (1997) which defines the term of “offensive” odours and restricts the emission of such from EPA licensed facilities.

The odour assessment shall be undertaken in two stages as follows:

Stage 1 - Preliminary Investigation to identify the likelihood of offensive odours impacting on sensitive receptors as a result of the upgrade.

Stage 2 - Detailed Investigation to establish odour sources and complete dispersion modelling of two scenarios (current and future operations) in accordance with EPA requirements.

The requirements for Stage 2 should be confirmed with Council before proceeding with the works. If Stage 2 is required, submit a proposed scope, methodology and fee for the additional work required along with a justification. The additional work shall not be undertaken without prior written approval by Oberon Council.

Waste Prepare a waste management assessment and strategy to consider the following:

Waste management during construction, including volume and disposal/reuse of any spoil generated as a consequence of the works.

Waste management during operation, including beneficial use of by-products and residuals (including bio-solids, grit and screenings) and the implications for the preferred treatment processes.

A financial assessment to be made of any options considered, and for each delivery option

Visual Impact Include a conceptual photomontage showing what the upgraded facilities will look like and the likely impacts it will have upon the visual amenity of the surrounding land users.

Additional specialist studies or tasks thought to be required should be identified in the tender response.

4.6 Risks and Mitigations Section Prepare an appendix to the REF report, that will specify the minimum standards and issues for construction EMP and operation EMP

This section shall include a list of risks and mitigation measures, to be used by the D&C contractor, and by Council, as a framework for environmental management.

4.7 Liaison with External Parties Advise the relevant regulators and stakeholders in writing of the proposed works and invite their comments. Assess any comments received and incorporate them into the assessment as required. Incorporate the timing of this communication process into the project program and carry out public consultation with the community.

5 DOCUMENTATION FOR D&C CONTRACT

5.1 Scope of Works

5.1.1 Introduction Council is planning to deliver the project through a D&C contract for the detailed design, construction and commissioning of the new STP.

5.1.2 Scope The scope of works of this part of the works includes the preparation of the following the D&C contract documents:

Special conditions of contract.

Specification.

Schedules.

Prepare comprehensive, clear and complete documents. It is the Consultant’s responsibility to prevent cost variations to the D&C contract due to discrepancies, omissions or ambiguities in the documentation.

5.1.3 Other Contract Documents The D&C contract documents will also include the following docuents:

The Concept Design Report and drawings, described in Section 3.

The REF, described in 4.

Conditions of tendering will be prepared by Council.

General Conditions of Contract (refer Section 5.4).

5.1.4 Work Breakdown Structure Below is a proposed list of tasks. The Consultant may modify the WBS to suit their methodology and organisation structure.

Special conditions of contract.

Specification.

Schedules.

5.2 Workshop Facilitate a workshop in Oberon to understand the Council requirements. Propose appropriate time for the workshop, which may coincide with the 60% submission.

5.3 Deliverables Submit the documents listed in the following sections in three revisions:

60% draft.

90% draft.

5.4 General Conditions of Contract Council proposes to use AS 4300 as the General Conditions of Contract. Any modification will be done by way of Special Conditions.

Prepare annexures as required.

5.5 Special Conditions of Contract Prepare Special Conditions of Contract to address specific contract issues, to modify the General Conditions if required and to add information as appropriate.

5.6 Specification The specification shall comprise the following elements.

5.6.1 General Specification The General Specification shall address standard requirements such as concrete, earthworks, electrical works, pipework and steelwork.

Pre-published specification such as Natspec, or the Consultant’s standard specification, may be used. Provide details of the proposed specification with the tender.

Provide additional information to demonstrate the suitability of the specification if required by Council.

5.6.2 Project Requirements This is project-specific specification. It shall list the requirements of the project including, but not limited to:

Scope of works.

Design criteria.

Design requirements.

Redundancy requirements for all equipment.

Performance requirements of the plant, systems, sub-systems and equipment items.

Mechanical equipment to be used. Detail specific equipment items, with option for the contractor to propose an approved equivalent.

Electrical equipment to be used.

Control equipment and requirements (PLC / SCADA / MHI / UPS). As far as possible, equipment-specific PLCs should be avoided, and equipment shall be controlled from the central PLC.

Inspection and testing requirements.

Submissions by the contractor.

Environmental management.

Site facilities including office for the Superintendent Representative.

Pre-commissioning, commissioning and proving.

Training and handover.

The project requirements shall be a complete and comprehensive document, without ambiguities or discrepancies.

5.6.3 Control Narrative Prepare control narrative (functional specification) describing the proposed automation and control of the plant.

The control narrative shall be of sufficient details to allow the contractor to prepare technical specification for the control system. As a minimum, the control narrative shall include for each process unit / equipment:

Description of the functionality.

Relevant instruments.

Inputs and outputs, including frequency of sampling.

Normal operation and, if appropriate, operation under special conditions.

Trigger points, and security levels for changing them.

Critical control points.

Response when trigger levels reached including delay.

Default response / position (ie, input signal missing).

Manual control.

Feedback loops.

Control loop (PID or other).

Alarms, including resets.

Process flow chart, prepared using suitable software (eg. InDesign).

In addition, the control narrative shall include: sections describing the plant, overall control philosophy, communication protocol, records storage and management and security.

5.7 Schedules Prepare tender schedules. It is intended tenders by D&C contractors will be structured along the schedules. All information provided by the contractors will be in this structure, even if additional information is provided as text, photographs, technical data etc. Schedules shall include, but not limited to:

Tender form.

Schedule of Prices.

Schedule of O&M costs.

Schedule of compliance.

Schedule of departures.

Schedule of equipment, including technical data.

Schedule of environmental management.

Schedule of quality management including ITPs.

Schedule of project team including experience and organisation structure.

Schedule of contractor’s experience.

Schedule of design team and experience.

Schedule of subcontractors and experience.

Program.

Schedule of proposed methodology including plant commissioning.

6 DELIVERABLES

6.1 Project Management Deliverables In addition to the deliverables specified in Sections 3, 4 and 5, the following project management deliverables are required.

Project control plan including program consistent with the proposal – within one week of commencement. Refer to Section 7.2 for further information.

Monthly reports including project control plan, program and designer risk register.

Agendas for meetings and workshops – one week before the date of the meeting.

Minutes of meetings, workshop reports and copies of presentations – within one week of the meeting.

Technical notes. Technical notes are interim deliverables as appropriate to document and communicate specific issues. The need for technical notes will be determined by the Consultant and Council as the project progresses.

6.2 All deliverables

6.2.1 Revisions Submit the documents listed in Sections 3 and 4 and minutes of meetings, as drafts and finals. The stages of deliverables of Section 5 are specified in Section 5.3 and for the concept drawings in Section 3.2.8. Other deliverables are required as finals only.

Council, and possibly other stakeholders, will review the draft documents. Following the review, Council will provide a consolidated set of comments to the Consultant within:

Four weeks for the Concept Design Report and REF report.

Two weeks for other documents.

Finalise the draft documents based on Council’s comments.

6.2.2 General Requirements Council requires high quality submissions. All reports and submission shall be submitted in plain English, free of grammatical and typographical error.

If, in the opinion of Council, the documents are not of acceptable standard, Council may direct the Consultant to submit another draft or another final. Prepare and submit additional revisions as directed. No additional fee will be paid for re-submission required under this paragraph.

6.3 Final Submissions

6.3.1 Submissions Include the following with the submission of each final report, including the D&C Contract documentation:

Compiled electronic file (pdf) linked and indexed.

Two bound colour hard copies. Drawings shall be in A3 format.

All calculations including cost estimates, process, hydraulic and electrical.

Electronic files in native format (Word, AutoCAD, Excel, InDesign etc) of reports, drawings, sketches, flow charts and calculations.

6.3.2 Copyright Council’s preference is to have copyright in the documents submitted.

If not acceptable to the Consultant, Council may consider an arrangement whereby the Consultant retains the copyright in some or all of the documents. In this case, the Consultant will grant Council an unconditional and irrevocable licence for the use of the documents, and any IP vested in them, by Council, its agents and contractors (including D&C contractors). This licence will give Council the permission to modify the documents and use them in any way for any activity associated with Oberon STP.

Nothing in this clause reduces the Consultant’s responsibility for the contents of the documents and submissions.

7 PROJECT MANAGEMENT

7.1 Project Inception Convene a project inception meeting at Council’s office in Oberon. The meeting will cover the required project preliminaries and confirm the scope of works and project program. At the project inception meeting, facilitate a project risk assessment, which shall be used as the basis for a project risk register which is to be maintained by the Consultant throughout the project.

Council envisages that one inception meetings will be held for all components of the Consultancy, and expects that the Consultant will ensure that key project personnel attend the meeting. Council may consider two inceptions meetings (one for the concept design and one for the REF) if requested by the Consultant.

The objectives of the inceptions meeting are:

Carry out joint inspection of the site.

Confirm the scope and methodology, including specialist studies.

Introduce project team member with a view to forming a cohesive team.

Transfer knowledge and information.

Establish key contacts and communication protocols within the team and with external stakeholders.

Agree on program,

7.2 Project Control Plan Prepare Project Control Plan (PCP) summarising the project management and control framework that will be used throughout the project. Include

Detailed program, presented as a Gantt chart, including tasks, milestones, workshops and meeting, submission dates and review periods. The program shall include dependencies and precedences, and show the critical path.

Project organisational structure and the roles and responsibilities of key personnel.

Safety management procedures and systems to be adopted for the project

Quality Management.

Sub-contractor management.

Submit the PCP within 10 working days of commencement. Keep the PCP updated and modify when changes occur.

7.3 Progress Reporting Submit monthly progress reports, showing potential or current project issues, and appropriate mitigation strategy. The Consultant may use their own standard project update report templates. The update shall include at least:

A progress update of each major scope task (including comments regarding progress).

Identification of any work scope, time, and quality issues (including options for elimination/mitigation).

Updated Gantt Chart showing percentage complete for each task.

Other parts of the PCP when modified.

7.4 Project Team Notify Council of any changes to the Consultant’s project team and the reason for the change. Change of key personnel requires that the replacement personnel would have at least the same experience and qualification as the person being replaced. If, in the opinion of Council, the replacement person is not suitable, the Consultant will appoint another replacement,

Key personnel are the Consultant’s project manager, the first level of personnel reporting to the project manager and the project manager of any subconsultant.

7.5 Program Complete the work within 8 months of commencement. Completion means submission of final reports / documentation.

The program submitted with the first project control plan will become the project program. This may be modified by extensions of time approved by Council.

Council will apply liquidated damages of $2,500 per month or part thereof, up to a limit of $10,000, to late completion.

8 PAYMENTS Submit monthly invoices before the last working day of the month. Invoices shall be structured as per the work breakdown structure listed in the proposal, showing the progress on each task within the month and overall progress.

Council may require additional information to justify the invoice.

A prerequisite for accepting and processing invoices is the receipt of a satisfactory progress report for the month.

Payment will be made within 15 days of receipt of the invoice, or receipt of a satisfactory progress report.

9 INFORMATION TO TENDERERS This section will not be part of the contract between Council and the Consultant

9.1 Proposals Submit a proposal with the following information included as a minimum:

Appreciation of the project.

Methodology and work breakdown structure to address the requirements of the Brief.

Proposed project team, including sub-consultant, with CVs. Include organisation structure showing at least one level below the Consultant’s project manager (eg, team leaders, task managers).

Experience of key personnel in similar work with similar process configurations, including at least three referees.

Preliminary program defining key activities, milestones and timeframe.

Deliverables (drawings, reports, schedules, etc.).

Working arrangements and location of Consultant’s project team during the project.

Statement of compliance with this Brief and addenda, and/or proposed departures.

Lump sum fee, excluding GST, as per the work breakdown.

9.2 Submission Submit proposals through Tenderlink before the advertised closing date.

9.3 Evaluation of Proposals Proposals will be evaluated on the following criteria:

Track record and experience in similar projects (25%). Council recognises that the adopted process, IDEA, is not used extensively outside NSW. Therefore, experience in the design of IDEA plants in NSW will form part of the evaluation.

Ability to work cooperatively with Council, based on checks of references by the tenderer (15%).

Methodology (15%).

Fee (40%).

Program (5%).

Council may contact tenderers for clarifications during the tender assessment period.

Council is not obliged to accept the lowest cost, or any, proposal.

Council may exclude proposals that do not meet the requirements of this Brief.
