AGENDA ITEM 7.1

MEETING DATE: January 8, 2020

Subject: Regulation III-Section 4: Nepotism. Consideration, discussion, and possible

approval to hire Stevynn Trevino, a stepchild of current employee, Jace Thelin, within the same Department of Police.

Petitioner(s): Mindy Falk, Human Resources Director and Pete Krall, Police Chief

Recommendation: That the Civil Service Commission hear the joint request by the Police Department

and Human Resources to the Civil Service Commission and approve the hiring of Stevnynn Trevino to the position of Police Officer Recruit.

BACKGROUND Human Resources and the Police Department made a process error and hired Ms. Trevino into the position of Police Recruit on December 2, 2019 prior to receiving approval for an exception to the nepotism regulation from Civil Service. Ms. Trevino properly disclosed the relationship however, due to a process error in the application, it was missed by Human Resources. Compounding this oversight is that leadership at the Police Department has changed in the last 6 months. Under the prior leadership, the Police Chief had years of experience to know that he could not hire a candidate with a nepotism issue without first going to Civil Service. New leadership recognized the nepotism issue but was not aware that it had to go to Civil Service prior to the candidate being hired. Moving forward, Human Resources will make sure that the staff in the interviews are trained on the nepotism procedures. Human Resources staff will advise the department of the need to work the Civil Service process into the hiring timeline if there is such an issue. New leadership at the Police Department is now trained and aware of the requirement to go to Civil Service to request an exception to the nepotism rule in order to hire a candidate where nepotism exists. Through better training in both departments, the goal is to avoid this error in the future. Finally, Human Resources researched whether the application can be updated if an error, such as the one described above, is discovered. At present, the application cannot be altered from what was submitted by the candidate. Therefore, both Human Resources and the department will need to be vigilant in flagging any such issues without relying on the recruiting computer system. Human Resources will monitor future software changes and developments to see if this is a possibility later. Civil Service Regulation III, Applications and Applicants, Section 4 reads as follows: Section 4. Nepotism

a. Hiring – No hiring authority shall hire relatives within the third degree of consanguinity or affinity of

any current employee in the same department, except as provided in section (c) of this regulation. b. Supervision – No employee shall directly supervise a relative within the third degree of

consanguinity or affinity in the same department, except as provided in section (c) of this regulation. c. Exceptions

1) The Civil Service Commission may, by majority vote, grant an exception to sections (a) and (b), provided that the department director and the Human Resources Director jointly request the exception.

Human Resources Director, Mindy Falk, and Police Chief Pete Krall, jointly request that the Civil Service Commission make an exception to the Civil Service Regulation regarding Nepotism, specifically Subsection C of the Regulation. This request is based on the employment of Stevynn Trevino to the position of Police Officer Recruit. Ms. Trevino went through the competitive hiring selection and background process, and was determined to be a qualified candidate based upon her own merits. Stevynn Trevino is the stepchild of Jace Thelin, Police Sergeant, employed at the Sparks Police Department. The City is committed to ensuring that Police Sergeant Thelin would not supervise, review performance or give work direction to Stevynn Trevino. MOTION It is recommended that the Civil Service Commission approve the hiring of Stevynn Trevino to the position of Police Officer Recruit, retroactive to December 2, 2019.

Recommendation: That the Civil Service Commission approve to exhaust the Eligibility List Submitted

BACKGROUND Regulation IV, Section 14, of the Civil Service Rules and Regulations allows the Commission to declare an eligibility list void at any time. Human Resources contacted all eligible candidates to schedule an interview. Every individual on the eligibility list was given an opportunity to schedule an interview. At this time, Human Resources has exhausted all eligible candidates.
