ForewordTitle 39 of the New Jersey statutes is o�cially entitled “Motor

Vehicle and Tra�c Regulations.” This comprehensive body of mo-tor vehicle law was originally codi�ed in 1921 and is amendedfrequently during each legislative term.

The title is divided into two subtitles, Subtitle 1 ranges fromN.J.S.A. 39:1-1 through N.J.S.A. 39:5G-1. Subtitle 2 begins atN.J.S.A. 39:6-23 and extends to the end of the title at N.J.S.A.39:13-8. Great care should be utilized when reviewing statuteswithin Title 39 since the laws frequently refer to other enact-ments “within this subtitle.” Thus, for example, the referencewith N.J.S.A. 39:5-36 to “a violation of any of the provisions ofthis subtitle” refers to the statutes contained within Subtitle 1.

Beyond the use of subtitles, Chapters 3 and 4 are furthersubdivided into a series of Articles. Many of the statutes withinthese chapters refer to the Article where the law has beencodi�ed. The range of Articles in Chapters 3 and 4 are as follows:

PrefaceThis annotated version of Title 39, the New Jersey Motor Ve-

hicle Code is intended to provide the user with a practical, porta-ble and easy-to-use resource for legal research. The book hasbeen speci�cally designed with the goal of becoming an indis-pensable tool for busy practitioners who require speedy and ac-curate answers to the complex legal issues that often are a partof New Jersey motor vehicle law.

In order to accomplish this goal, the book utilizes three novelapproaches to the annotations. The �rst is related to relevance.Rather than track older case law that no longer has any practicalrelevance, impact or in�uence on today’s substantive law or pro-cedure, the editorial choices in this volume re�ect a selection ofcases based upon the current state of the law. That is to say, theannotations are intended to acquaint the reader with relevantand meaningful cases that interpret, re�ne, explain and in�uencethe statute in question. For the most part, the cases cited willstem from the era that began with the adoption of the currentState Constitution of 1947.

The second technique is related to the organization of thecitations. In order to more easily follow the historical develop-ment of the law, the annotations for each statute have beenorganized chronologically by court. Thus, for example, the readerwill �nd all of the Supreme Court citations related to a particularstatute listed chronologically from the most recent case to theoldest with the subject of each annotation clearly listed. Thesame organization will also apply to citations from the AppellateDivision and the trial level courts.

Finally, the annotations themselves are designed to providethe reader with clear, concise and accurate information about thespeci�c legal issue decided in the case and how it relates to thestatute. In order to accomplish this, many hundreds of the an-notations are comprised of the actual language used by the judgeor justice who wrote the decision. These citations will always befound in quotations with accompanying pinpoint citations. Allother annotations have also been written with the issues of clar-ity and accuracy in mind. Once again, pinpoint citations will beused whenever possible so that the precise point of law referredto in the annotation can be quickly found in the published

decision.

As a practical matter, it is likely that Title 39 is used moreoften, by more practicing attorneys and sitting judges than anyother Code among the New Jersey Statutes Annotated. This isdue to the fact that the statutes included within this Code touchupon such an enormously wide variety of legal disciplines, rang-ing from criminal law and all manner of tra�c enforcement to in-surance law and personal injury practice. The editorial selectionsrelated to the annotations in this volume take this into consider-ation and are intended to provide the maximum amount of rele-vant, useful and accurate information to the broadest spectrumof New Jersey legal professionals.
