Mission Statement
The New Jersey Racing Commission (“NJRC” or “Commission”) regulates horse racing, pari-mutuel wagering, account wagering and exchange wagering in the State of New Jersey. The NJRC is tasked with ensuring the integrity of the sport and the wagering thereupon through efficient oversight of all racing and wagering related entities and activities. The NJRC is also responsible for the health and safety of the racing participants.

Pamela Clyne, LCSW, SAC
Chairman
Appointed 2012 - Present Appointed as Chairman April 17, 2014 Pamela Clyne is a resident of New Egypt in Ocean County, New Jersey where she resides with her husband, retired Superior Court Judge of the Ocean Vicinage, the Honorable James D. Clyne. Pamela and her husband own a 25-acre horse farm and are lifelong equine enthusiasts. Pamela has a Master’s Degree in Social Work from Rutgers University and is certified in several behavioral healthcare disciplines. Formerly, Mrs. Clyne was the Executive Director of Reindancer Therapeutic Riding Center where she worked with a group of individuals with a wide range of special needs. Mrs. Clyne practices behavioral healthcare for veterans suffering from PTSD and children suffering with autism. Some of Mrs. Clyne’s practices involve therapeutic horseback riding and equine assisted psychotherapy.
Anthony T. Abbatiello
Appointed 2006 - Present Anthony T. Abbatiello’s love for horses has resulted in nearly 60 years of devoted service to the racing industry. Mr. Abbatiello is a co-founder of the Standardbred Breeders and Owners Association of New Jersey and served as its president for 28 years. Mr. Abbatiello was instrumental in the efforts to establish the Meadowlands Racetrack and was responsible for bringing the Hambletonian Stake to the Meadowlands. A national leader in the harness racing industry as well, Mr. Abbatiello served as chairman of the board of directors for the United States Trotters Association and was also chairman of its Finance Committee. He was an officer of the Harness Horsemen International, chairman of the board of the American Horse Council in Washington, DC, and a trustee of the Harness Racing Museum & Hall of Fame. Commissioner Abbatiello has received many accolades in recognition of his lifetime of service to the harness racing industry, including the Harness Horse International’s Man of the Year Award, New Jersey Horse Council’s Horseman of the Year in 1982, the 1988 Clem McCarthy Good Guy Award, the United States Harness Writers Association’s 1992 Proximity Award and selection to the National Italian-American Sports Hall of Fame. In 2006, the Standardbred Breeders & Owners Association of New Jersey renamed the New Jersey Classic for Abbatiello. He was inducted into the Harness Racing Hall of Fame on July 2, 1995. In addition to his many accomplishments in the harness racing industry, Mr. Abbatiello distinguished himself in service of his country as well, becoming a decorated war veteran during

the Korean War. Mr. Abbatiello demonstrated courage under fire and received numerous individual and unit citations including the Combat Infantry Badge, Silver Star, Bronze Star for Valor, two Purple Hearts, the Presidential Unit Citation, a Korean Campaign Ribbon with Four Battle Stars and the Korean Service Medal. During his time serving in Korea, Mr. Abbatiello rose to the rank of Captain.
Manny Aponte Appointed 2011 – Resigned May 16, 2016 Manny Aponte is First-Vice President of Investments for the Aponte Waters Financial Consulting Group of Wells Fargo Advisors, LLC. He has served in that capacity since 2006. From 1999 to 2006 he was a Financial Advisor with Morgan Stanley. A graduate of Richard Stockton College, Commissioner Aponte has been active in community organizations, serving as a board member of the American Conference on Diversity as well the Hispanic Alliance of Atlantic County. Commissioner Aponte has also served as a member of the Egg Harbor Township Planning Board since 2009.
Dr. Michael Arnone, DDS
Appointed 2013 - Present Dr. Michael Arnone attended Seton Hall University and attended St. Francis College. He received his D.D.S. from Temple University School of Dentistry. He continues to practice dentistry in Red Bank, NJ. Dr. Arnone was a member of the New Jersey General Assembly from 1989 to 2004 and served as Mayor of Red Bank from 1978 to 1990. Commissioner Arnone has served on several other local government agencies and committees including service as a Commissioner of the Red Bank Fire and Police. Dr. Arnone also served his country as a member of the United States Army from 1959-1961, achieving the rank of Captain. Dr. Arnone continues to practice and reside in Red Bank.

Peter J. Cofrancesco III
Appointed 2001 – December 2008; Re-Appointed April 21, 2010 – present Peter Cofrancesco serves as Executive Officer of the Grinnell Group. Grinnell is a family-owned and operated business and has interests in manufacturing construction materials and transportation services, as well as commercial and residential real estate development. The company was named the 2003 New Jersey Family Business of the Year, an award that recognizes significant contributions to New Jersey’s economy and community. Mr. Cofrancesco attended Delaware Valley College and concentrated his studies in the field of business management. Commissioner Cofrancesco also received an Honrary Doctorate in Humane Letters from Centenary College in 2003. Other than his business and personal accomplishments, Mr. Cofrancesco is active in many community and professional organizations, including serving as a Director of many college and hospital foundations, the New Jersey State Fair and the Interlocking Concrete Pavement Institute. Commissioner Cofrancesco has made a name for himself in the industry of American Quarter Horses and currently serves as a Director of the American Quarter Horse Association. Mr. Cofrancesco, along with his family, have owned an unprecedented 24 American Quarter Horse Association World Champions, and have received the prestigious Leading Owner Award five times. Mr. Cofrancesco has served two terms on the New Jersey Racing Commission and has been heavily involved in the New Jersey horse racing industry for many years. Recently, Mr. Cofrancesco was nominated for the American Quarter Horse Hall of Fame and will be inducted in 2017.
Anthony DePaola Appointed 2013 – June 4, 2016 (died in office) Anthony DePaola was employed by the United States Postal Service for most of his life. He also was a supervisor of mutuel clerks at the Meadowlands Racetrack and was the Athletic Director of several high schools. He was a graduate of East Orange High School and was honorably discharged from the U.S. Army. Throughout his life, Commissioner DePaola was active in many government agencies in Berkeley Township and Ocean County. Specifically, he was Commissioner of the Ocean County Board of Health as well as the Missing and Exploited Children Committee. In Berkeley Township, Mr. DePaola served on the Board of Education and was Chairman of the Zoning Board, as well as Chairman of the Sewage Authority.

David Gruskos Appointed 2014 – Resigned April 13, 2016 David Gruskos is the owner and president of Reliable Automotive Equipment. As a resident of Oceanport, he has been involved in many community activities as a volunteer and had served on the Oceanport Planning and Zoning Board for ten years between 1994 to 2004. Until his appointment to the Racing Commission, Mr. Gruskos was an active thoroughbred racehorse owner and has extensive knowledge of horse racing matters in New Jersey. He has assisted Monmouth Park Racetrack in fund-raising activities and was a member of Oceanport’s Monmouth Park Advisory Board.
Francis X. Keegan, Jr. Appointed 2006 - Present Francis X. Keegan, Jr. a lifelong horseman, was appointed to the Commission in 2006. Formerly, he was President of the New Jersey Thoroughbred Breeders’ Association, President of the New Jersey Thoroughbred Horsemen’s Association and has held esteemed membership of many national and international horsemen organizations, including the Thoroughbred Club of America, the Green Mountain Horse Association and the National Hunt Association. He was also a patron of the Monmouth County Hunt. Commissioner Keegan has bred, owned and raced horses in New Jersey since 1963 and has been a successful consignor at numerous thoroughbred auction sales including Saratoga and Keeneland. Mr. Keegan is a graduate of Seton Hall University and attended Fordham Law School. He also served as an infantry officer in the United States Army. Commissioner Keegan is a Wealth Management Advisor and First-Vice President of Investments with UBS Financial Services, Inc. and in March 2016 celebrated 50 years with the firm. In addition to his public service, Commissioner Keegan has served on the board of numerous banks, including Carteret S & L Bank of Commerce in Newark and Monmouth Community Bank.

Peter T. Roselle
Appointed 2013 – Present Peter T. Roselle is currently the owner and CEO of Meadowbrook Industries, LLC, Waste Industries, LLC, Regional Industries, LLC, and Premier Waste Services, Inc. He has 20 years experience in the solid waste and recycling collection and transportation industries. Commissioner Roselle received a B.S. Degree in Business Management and Finance from Monmouth University. He joined the Board of Trustees of Riverview Medical Center in March 2011. He is an active volunteer in the community and serves on committees for several organizations, including Monmouth University, Jersey Shore University Medical Center, Meridian Health System and the NJDEP Clean Communities Council. Commissioner Roselle resides in Tinton Falls with his wife and daughter.
Frank Zanzuccki Executive Director Appointed 1992 – Present Frank Zanzuccki received a B.S. Degree in Accounting from St. Francis College, Loretto, PA. He was the Chief Accountant for United Mine Workers of America from 1975-1978. He started his career with the New Jersey Racing Commission in 1978 and served in various positions before being appointed Executive Director in 1992. Director Zanzuccki is nationally recognized as a prominent member of the horse racing industry. In 1998, Mr. Zanzuccki was awarded the prestigious Len Foote Award in recognition of outstanding contributions to the horse racing industry. He has also served on the Board of Directors of the Association of Racing Commissioners International (ARCI), becoming the first non-commissioner to be elected to this position. Director Zanzuccki was subsequently elected as an officer of the ARCI and served as its chairman from April 2004 through April 2005. Frank currently serves as the chairman of the New Jersey Horse Racing Injury Compensation Board.

Commission Structure and Composition
The New Jersey Racing Commission is a nine-member, bi-partisan body. The members are appointed by the Governor, by and with the advice and consent of the Senate, for a term of six years. One such member shall be designated by the Governor to serve as chairman of the Commission.
The nine-member Commission is tasked with regulating horse racing and wagering on such racing in the State of New Jersey. The Commission drafts regulations and implements policy relating to all matters involving horse racing and the wagering thereon. Further, the Commission and its staff conduct permitting and licensing procedures, including issuing licenses to all horse owners, trainers, jockeys, drivers, veterinarians, and all other persons involved in the horse racing industry in New Jersey. The Commission and its staff determine whether to issue permits which allow entities to conduct horse racing and the wagering thereupon, and to operate the facilities where racing and wagering occur. In New Jersey, wagers can be made at teller counters at all three operating racetracks, all six operating Off-Track Wagering Facilities and the Borgata Hotel Casino and Spa in Atlantic City, as well as via internet, mobile application and telephonically.
The New Jersey Racing Commission has a full-time staff of employees who are charged
with conducting the daily functions involving regulation of horse racing in the State of New Jersey. In addition to the full-time employees, the Commission maintains a pool of per diem employees to supplement staff as needed. Many of the part-time and seasonal employees only work on days when racing is conducted. The full-time Commission staff consists of administrative functionaries, investigators, race officials, financial analysts, veterinarians, and support personnel.
In addition to permitting and licensing responsibilities, the Commission is tasked with
ensuring the integrity of the sport and the wagers made thereupon. Every wager made is recorded and checked for accuracy and compliance with the Commission’s rules. Commission staff calculates financial information from these wagers for proper distribution of funds. Staff oversees all operational aspects of pari-mutuel wagering, account wagering and exchange wagering to best ensure the integrity of the wagering aspects of the sport.
The Commission employs racing officials to monitor the running of every race that takes
place in New Jersey. Other than the races themselves, the New Jersey Racing Commission has jurisdiction over all licensees and licensed tracks, farms and training facilities, as well as any location in the State of New Jersey where a racehorse is located. Should a violation occur anywhere the Commission has jurisdiction, the racing officials are tasked to issue penalties and make judgments on all matters involving violations of the Commission’s rules.
Furthermore, the New Jersey Racing Commission employs a staff of investigators to
monitor the activities at all of the racetracks, off-track wagering facilities, participating casino simulcast facilities, off-track stabling facilities and training facilities.

Additionally, Commission veterinarians are employed to ensure the safety of the human and equine participants of the sport. Commission veterinarians are present at every live race to verify that each horse is fit to race. In addition to observation of the races themselves, Commission veterinarians are responsible for taking post-race blood samples from selected horses to be tested for the presence of any drugs or substances foreign to the natural horse. This testing is done in conjunction with a testing laboratory that has entered into a contract with the New Jersey Racing Commission. Throughout the year of 2016, Truesdail Laboratories in Irvine, California served as the contracted laboratory.
During the calendar year of 2016, the following persons served on the Commission: Anthony T. Abbatiello, Manny Aponte, Dr. Michael Arnone, Pamela Clyne, Peter J. Cofrancesco III, Anthony De Paola, David Gruskos, Francis X. Keegan, Jr. and Peter Roselle.
On April 17, 2014, Commissioner Pamela Clyne was designated chairman and has served in that capacity since that time.
On April 13, 2016, Commissioner David Gruskos resigned his post and was not involved in any Commission matters after that date.
On May 16, 2016, Commissioner Manny Aponte resigned his post and was not involved
in any Commission matters after that date.
Tragically, Commissioner Anthony De Paola died on June 4, 2016 due to complications from a surgical procedure. He is mourned and missed by his fellow Commissioners and Commission Staff.
At year’s end, there are 6 sitting Commissioners and 3 vacancies awaiting appointment.
Further, the New Jersey Racing Commission employs staff to implement its policies. The full-time staff is led by an Executive Director who is responsible for overseeing the day-to-day operations of the Commission. Frank Zanzuccki has served as the Executive Director since his appointment in 1992 and continued that post throughout the entire year of 2016.

Budget
The Total Operating Budget for the fiscal year of 2016 is $7,620,350. This represents an increase of $116,114, or 1.55%, from the total operating budget of fiscal year 2015. The increase in budget for the current year is attributed to the increase in fringe benefit rate (35.2% to 37.6%). Also, the budget includes the annual assessment for the work and efforts of the Division of Law related to Sports Wagering Legislation in the amount of $375,000. For budgetary purposes, operational activities are broken down into four functional areas. New Regulations Claiming Rules
Subchapters N.J.A.C. 13:70-12, Claiming (Horse), and N.J.A.C. 13:71-14, Claiming
(Harness), of the New Jersey Administrative Code, underwent a thorough restructuring in 2016. The primary purposes of these amendments were to reflect current industry practice, lessen the risk of death or severe injury to human and equine racing participants, provide greater protection to claimants, protect the health of the horses participating in racing and to maintain the integrity of the sport. The claiming rules for both horse racing and harness racing had not been updated in quite some time and many of the rules did not reflect the current practices of many racing jurisdictions, both domestically and internationally.
After completing the initial proposal process, the Commission voted to advertise the
proposed amendments for public comment on July 13, 2016. The proposal was thereafter published on August 15, 2016 in the New Jersey Register Volume 48, Number 16. On November 16, 2016, the Commission voted to adopt the amendments as proposed. The adoption of the rules, along with responses to public comments, was published on December 19, 2016 in the New Jersey Register Volume 48, Number 24.

Permit Applications The New Jersey Racing Commission is responsible for granting permits to allow persons or entities to conduct thoroughbred and standardbred racing in the State of New Jersey. Pursuant to N.J.S.A. 5:5-38, each person, partnership, association or corporation desiring to conduct a race meeting within the State of New Jersey must submit a permit application to do so. This past year, permit applications were due by October 15, 2016. A separate permit must be submitted for each requested race meeting. On October 15, 2016 the New Jersey Thoroughbred Horsemen’s Association (NJTHA) submitted an application to conduct two thoroughbred race meetings in 2017. The request specified that racing would occur on 71 dates in the year 2017, with one meet consisting of 56 days of racing to be conducted at Monmouth Park and a second meet consisting of 15 days of thoroughbred racing to be conducted at the New Meadowlands Racetrack. Included with the NJTHA’s permit application was an application for a special permit, pursuant to N.J.S.A. 5:5-38.2, to conduct a one day steeplechase race meeting in Far Hills, NJ. Also on October 15, the New Jersey Racing Commission received three applications to conduct standardbred race meetings, one from New Meadowlands Racetrack, LLC and two from FR Park Racing, LP. Along with these three applications was correspondence from the Standardbred Breeders and Owners Association of New Jersey endorsing the proposed race meetings. New Meadowlands Racetrack, LLC proposed to conduct a race meeting consisting of 91 race days to run from January 6, 2017 through December 30, 2017. FR Park Racing, LP proposed to conduct two separate race meetings, the first to consist of 49 racing days between January 5, 2017 through May 6, 2017, while the second would consist of 46 racings days between September 1, 2017 through December 30, 2017. The New Jersey Racing Commission held a public meeting on November 16, 2016 to discuss the issuance of permits to the applicants. The Commissioners tabled the vote on the special racing permit for the Steeplechase race meeting at Far Hills until all notifications and approvals are obtained. The Commission voted unanimously to grant permits to the applicants on the other matters.

Exchange Wagering N.J.S.A. 5:5-168, et seq., the Exchange Wagering Act, became effective on January 28, 2011. In 2015, the New Jersey Racing Commission enacted N.J.A.C. 13:74C, Exchange Wagering, which set forth rules regulating exchange wagering in the State of New Jersey. In 2015, as reported last year, the first exchange wagering license was granted to the New Jersey Sports & Exposition Authority, the license to manage and operate the exchange was granted to Darby Development, LLC and the license to act as services agent and provider was granted to Betfair US, LLC. At the time, the Commission set forth numerous conditions that must be satisfied prior to the system becoming operational. The New Jersey Racing Commission determined that all of the conditions were eventually met and the exchange wagering system became operational on April 18, 2016. Upon becoming operational, New Jersey became the first and only state in the nation to offer exchange wagering. As of the end of this calendar year, New Jersey remains the only state in the nation to offer this type of wagering on horse racing.
Off-Track Wagering Facilities As of December 31, 2016, there are six Off-Track Wagering Facilities licensed to operate in New Jersey. They are located in Vineland, Toms River, Woodbridge, Bayonne, Gloucester Township and Hillsborough. All operated for the full calendar year of 2016. The financial handle of these facilities is attached. On or about October 11, 2016 the New Jersey Racing Commission received an application for an Initial Off-Track Wagering License for a facility to be located in Egg Harbor Township, New Jersey. The process for an initial OTW License requires both the New Jersey Sports & Exposition Authority as well as the operator of the facility, in this case ACRA Turf Club, LLC, to submit completed applications. The Commission received both completed applications and is in the process of reviewing them.
New Jersey Horse Racing Injury Compensation Board The Commission encouraged the creation of this Board that provides group workers’ compensation insurance for the horse racing industry. The Board consists of representatives of the public and private sector including members of horse racing organizations, the state Department of Banking and Insurance, and the New Jersey Racing Commission. The program covers horse racing industry employees. In 2016, the Board continued in the assigned risk program with NJM providing the insurance coverage. Pursuant to N.J.S.A. 34:15-139, the Board is required to submit an annual financial report and a report of its activities to the NJRC no later than March 31st of each year.

Casino Simulcasting The only casino licensed to conduct simulcasting of horse races is the Borgata Hotel Casino and Spa. The New Jersey Racing Commission regulated the wagering at the Borgata Casino throughout 2016 and continues to do so. The financial handle of the facility is attached.
Horsemen’s Organizations
There are three major horsemen’s organizations operating in New Jersey: the New Jersey Thoroughbred Horsemen’s Association, the Standardbred Breeders’ and Owners’ Association of New Jersey, and the Thoroughbred Breeders Association of New Jersey. The horsemen’s organizations operate independently but are mandated by statute to receive portions of the proceeds of the wagering handle. It is the Commission’s responsibility to determine that the proper percentages are distributed to each organization. In 2016, there were no major issues relating to the statutory distribution of these monies.
Pilot Program Existing legislation created a “pilot program” allowing horse wagering terminals to be implemented in bars and restaurants in northern New Jersey should certain conditions be met. In 2015, one application was received for such an implementation. Although a license was granted to the applicant, no such machines were installed and the applicant allowed its license to lapse. In 2016, a new application to participate in the pilot program was received. Several deficiencies were noted in the application and the applicant was asked to provide additional information for review by the Commission. No further action is expected until 2017.

New Jersey Human and Equine Testing Program The New Jersey Racing Commission is also responsible for administering testing for the human and equine participants of horse racing in the State of New Jersey. New Jersey Racing Commission veterinarians and animal health inspectors are employed to take blood and urine samples from selected horses after each race. Further, jockeys and drivers must submit to random urine tests and breathalyzer tests. The following is a summary of the results of those tests for 2016:

Rule Violations and Administrative Law Hearings A survey of the Racing Commission’s records has revealed 309 violations of the New Jersey Racing Commission rules in 2016. For a full listing and description of the violations, please visit http://www.nj.gov/oag/racing/njrcrulings.html and enter the appropriate date range. Of those found in violation, certain licensees chose to appeal those decisions to the Office of Administrative Law. As of December 31, 2016, there are 15 appeals of Racing Commission rulings awaiting decisions. In the calendar year of 2016, the Commission resolved several contested matters either via settlement or issuance of a final decision. Hearings have been scheduled before an Administrative Law Judge in several of the matters and the Commission anticipates the remaining pending matters to be resolved in 2017. The following matters were resolved in 2016 via either settlement or issuance of a final decision:
Douglas Nunn v. New Jersey Racing Commission
On July 24, 2014, Douglas Nunn ignored the orders of racetrack officials by opening the overhead door of the paddock area and proceeding into the paddock area to school his horse while work crews were performing required maintenance in the area. On July 30, 2014, the New Jersey Racing Commission Board of Stewards at Monmouth Park racetrack found Nunn in violation of N.J.A.C. 13:70-1.15, N.J.A.C. 13:70-1.8 and N.J.A.C. 13:70-16.4. The stewards imposed a fine of $1,000 upon Nunn for his actions. Nunn appealed the ruling and the case was transmitted to the Office of Administrative Law on September 12, 2014. In an effort to amicably resolve the matter, the New Jersey Racing Commission and Douglas Nunn agreed to enter into settlement negotiations. The Commission agreed to lower the fine to $500 and Nunn admitted to the charged violations. Nunn also dropped his appeal of the matter and waived his rights to any future appeal. The parties signed the settlement agreement and the Commission voted to accept the terms of the settlement at the New Jersey Racing Commission public meeting that took place on February 10, 2016.
Alejandro Maymo v. New Jersey Racing Commission
On May 10, 2014, the horse “Mr. Fahrenheit,” trained by Alejandro Maymo, tested positive for two anti-inflammatory drugs that are not permitted to be used in conjunction with one another. On June 6, 2014 the Board of Stewards at Monmouth Park Racetrack found Maymo in violation of N.J.A.C. 13:70-14A.9(f)(3), N.J.A.C.13:70-1.15 and 13:70-20.7. As required by N.J.A.C. 13:70-14A.9(g)(1), the Board of Stewards imposed a $500 fine and 15 day license suspension upon Maymo. Maymo appealed the ruling and the case was sent to the Office of Administrative Law on July 10, 2014. A motion for summary decision was filed on behalf of the Racing Commission. On February 3, 2016, the Administrative Law Judge issued an initial decision finding that the facts were undisputed and that the penalty imposed was appropriate pursuant to the Commission’s duly enacted rules. The Commission voted unanimously to adopt the

Administrative Law Judge’s initial decision in its entirety at the Commission’s meeting held on April 6, 2016.
Jeffrey Dauplaise v. New Jersey Racing Commission
On April 2, 2015, the horse “Fountainbleu Volo,” trained by Jeffrey Dauplaise, entered into a qualifying race at Freehold Raceway. The post-race blood test of “Fountainbleu Volo” returned a positive finding for stanozolol, a steroid. As a result of the positive test, the State Steward ordered the New Jersey State Police to conduct a search of Daulplaise’s barn and office located at Showplace Farms in Englishtown, NJ. Upon arrival, Inspector Mark Wettengill of the New Jersey State Police Horse Racing Squad discovered no less than 6 refrigerated substances as well as 75 bottles of drugs and 37 syringes on shelves beside the refrigerator. Along with these substances, Inspector Wettengill also discovered a clipboard with various receipts, invoices and written prescriptions referencing additional drugs. On March 7, 2016, the Board of Judges found Dauplaise in violation of numerous regulations of the New Jersey Racing Commission and assessed a cumulative penalty of a 5-year license suspension and $25,000 fine. Dauplaise appealed the ruling and requested a stay of the penalties pending resolution of the appeal. On March 21, 2016, the Executive Director of the New Jersey Racing Commission issued a ruling denying Dauplaise’s request for a stay. Dauplaise then filed an emergent application for a stay with the Appellate Division of the New Jersey Superior Court. Dauplaise’s motion was denied by the Appellate Division. Thereafter, in an effort to amicably resolve the matter, Dauplaise and the New Jersey Racing Commission agreed to enter into a settlement agreement. The terms of the settlement lessened the suspension from 5 years to 3 years and increased the fine from $25,000 to $35,000, to be paid in installments. Dauplaise agreed to withdraw his appeal and waived all rights to any future appeals in this matter. A majority of the Commission voted to accept this settlement proposal at the Commission’s meeting held on September 14, 2016.
New Jersey Racing Commission v. New Jersey Sports and Exposition Authority
In January 2013, the New Jersey Sports and Exposition Authority (“NJSEA”) notified the New Jersey Racing Commission that a particular account wagering patron had incurred a deficit of approximately $286,000 in his wagering account. Thereafter, the Commission learned that the NJSEA had engaged in an improper action with the patron in regards to the procedure utilized when depositing funds into his wagering account. Upon receipt of a check or notice of a wire transfer, the NJSEA was immediately crediting the patron’s account as if cash had been deposited. When the wire transfers failed to arrive and certain checks went unpaid, the patron’s account accumulated a deficit of approximately $286,000. The NJSEA used its own monies to satisfy the debt in order that the New Jersey account wagering system would not be negatively impacted. The patron eventually paid his debt in full. In order to avoid the expense and inconvenience of prosecuting an administrative hearing and potential appeal, the Commission and the NJSEA entered into settlement negotiations. The Commission and the NJSEA eventually entered into a settlement agreement whereby the NJSEA

agreed to make a payment of $20,000 for the alleged violation of the Off-Track and Account Wagering Act and the Commission’s rules. Pursuant to N.J.S.A. 5:5-44.8a, the full $20,000 payment will be utilized for the Backstretch Fund. At the Commission’s meeting held on November 16, 2006, the Commission unanimously voted to approve the terms of the settlement.
Carmen Auciello v. New Jersey Racing Commission
On March 14, 2014, the horse “Miss Machqueen,” trained by Carmen Auciello, tested positive for methylprednisolone. On September 9, 2014 the Board of Judges at the New Meadowlands Racetrack found Auciello in violation of N.J.A.C. 13:71-7.29(a)(13), N.J.A.C. 13:71-23.1 and N.J.A.C. 13:71-23.6. As a result of these violations, the Board of Judges imposed a $500 fine and 15-day license suspension upon Auciello. Auciello appealed the ruling and the case was transmitted to the Office of Administrative Law. A hearing was conducted before Administrative Law Judge Margaret Monaco on February 1, 2016. On September 6, 2016 Administrative Law Judge Monaco issued an initial decision finding that the facts were undisputed and that the penalty imposed was appropriate pursuant to the Commission’s rules. The Commission voted unanimously to adopt the Administrative Law Judge’s initial decision in its entirety at the Commission’s meeting held on November 16, 2016.
Pending Legal Proceedings
NCAA, et al. v. Governor, Zanzuccki, et al. New Jersey passed a law in 2014 that would allow sports betting to occur in casinos and racetracks. A conglomerate of the largest sports organizations in the United States challenged the law as a violation of the Professional and Amateur Sports Protection Act (“PASPA”). A lawsuit was brought by the sports organizations and in December of 2014 the federal District Court enjoined sports betting at casinos and racetracks, finding that the New Jersey law was a violation of PASPA. The defendants appealed this ruling and the Third Circuit affirmed the District Court’s ruling in a 2-1 opinion on August 25, 2015. Defendants moved the Third Circuit to rehear the appeal en banc. The Third Circuit granted the Defendants’ motion. In the past year, as is relevant to this Annual Report, several notable actions occurred in this matter. On February 17, 2016, the Third Circuit heard oral argument of this case en banc. On August 9, 2016, the Third Circuit again upheld the ruling of the District Court, this time in a 9-3 opinion. The State of New Jersey and the New Jersey Thoroughbred Horsemen’s Association petitioned the United States Supreme Court for a writ of certiorari. Subsequently, five other states have filed amicus briefs arguing that the Third Circuit, in its August 9, 2016 decision, radically expanded federal preemption and disregarded the Supreme Court’s anti-commandeering jurisprudence. The Supreme Court’s determination on whether to grant certiorari is pending and a decision is not expected until 2017. Until these legal matters are resolved, sports betting remains impermissible in New Jersey.
