Proposed EOI Model• Mandatory for 1st Round of New gTLDs• Deposit of US$55,000 (Refundable only if
New gTLD process does not launch within a specified time)
• Fully executed communications campaign prior to opening of EOI
• Participant and String submitted to be made public
URS & TM Clearing House• URS: Uniform Rapid Suspension
– Requirements similar to UDRP– Higher burden of proof on complainant– ~US$300 per proceeding– Registry Operator to Lock domain within 24 hrs– 20 Days for registrant to respond– Remedy: suspension of domain for remainder of term– Penalty for abusive complaints
• TM Clearing House– Central TM Clearing House (with multiple providers)
• Authentication & supporting Sunrise & TM Claims Services• Regional marks authentication service providers
– Separate and independent from ICANN
IDN gTLD Restrictions• 3 Character String Length
– New document proposes 2-Character IDN gTLD string to be acceptable
– 1-Character IDN gTLD to be further discussed as a policy consideration at ccNSO and GNSO respectively
• IDN Variant in TLD Strings– Recommending that IDN Variant TLD Strings not be
delegated– Variants may only be delegated when there is a
mechanism developed and tested, and the applicant has demonstrated that it can implement the mechanism in line with the accepted standards.
Post-Delegation DRPs• PDDRP: Post Delegation Dispute Resolution
Policy– Trademark oriented (not contractual compliance)– 2 types of eligible disputes:
• TLD string being identical or confusingly similar• Registry Operator substantially and systemically profiting from
infringing 2LD registrations
• RRDRP: Registry Restrictions Dispute Resolution Policy– Community gTLDs
• Registry Operator violated terms of the community-based restrictions in its agreement
• There is a measureable harm to the Complainant and the community named
Impact of New gTLD launch on ccTLDs
Competitive Impact• Studies consistently show no adverse
impact (or cannibalization) of ccTLD registrations from the introduction of new TLDs
