violations. The DAAPP shall be made available to all employees and students and shall be distributed at least annually. To ensure that all students and employees receive DAAPP materials, Shear Perfection Academy shall implement the following measures: 9 Annually, all current students and employees are made aware of the DAAPP by

means of electronic mail. 9 New students are provided the DAAPP disclosure as a part of orientation to

ensure that all students receive the program materials regardless of enrollment date.

9 Employees are provided a copy of the DAAPP disclosure in the employee Policies and Procedure manual.

9 New Staff members are informed of the policy during the new hire orientation process to ensure that all employees receive the program materials regardless of hire date.

Procedure: Shear Perfection Academy will abide by the following protocol in distributing its DAAP annual disclosure to students and employees: 9 DAAPP will be reviewed prior to distribution by appropriate Shear Perfection

Academy officials to determine whether updates to the policy are necessary considering best practices and applicable Federal, State, and local laws.

9 Annual disclosure communication will be drafted and approved. 9 Shear Perfection Academy will compile a list of all current students and

employees with working email addresses. 9 Shear Perfection Academy will distribute the disclosure communication and

DAAPP materials via electronic mail to all current students and employees. 9 Any students or employees without a working e-mail address or whose emails are

undeliverable will be provided annual disclosure and DAAPP materials in school mailbox or via U.S. mail.

9 Shear Perfection Academy will provide a copy of disclosure email to Compliance Director for record-keeping purposes.

In addition, Shear Perfection Academy will provide the DAAPP disclosure to students and employees by other means as listed in the Policy above to ensure that students and employees receive program materials regardless of enrollment or hire date. Shear Perfection Academy will preserve at all times a copy of the DAAPP as part of the Policies and Procedure manual located at the school location.

Sexual Harassment Policy Sexual harassment is a form of sex discrimination defined as unsolicited conduct of either verbally, nonverbally, or physically sexual nature that makes someone uncomfortable or embarrassed. According to the federal Equal Employment Opportunity Commissions (EEOC), sexual harassment is sexual attention that is: Unwelcome and Unwanted, Harmful, or Illegal. Shear Perfection Academy firmly commits to creating and supporting a lawful environment which will, under no circumstance, tolerate any type of sexual misconduct, harassment, or discrimination.

Bullying Bullying is a form of harassment which is unwanted and aggressive behavior that involves a real or perceived power imbalance. The behavior is repeated, or has the potential to be repeated, over time. Bullying includes actions such as making threats, spreading rumors, attacking someone physically or verbally, and excluding someone from a group on purpose. Shear Perfection Academy is a respectful, safe and friendly environment which allows students to thrive and learn to the best of their ability. Any sign of bullying has serious consequences. If a student feels like he/she has been bullied, or notices bullying activities, they need to report it to the office to be handled properly. Student’s privacy will be enforced in the process.

Crime Awareness and Campus Security Program and Disclosures As require by Title II of Public Law 101-542, the Crime Awareness and Campus Security Act of 1990, Shear Perfection Academy has prepared the following information for distribution to its students and employees, effective June 15, 2015. This information will be updated on an annual basis and made available to current students and employees. Specific information regarding the following includes:

(1) A statement of current campus policies regarding procedures and facilities for students and others to report criminal actions or other emergencies occurring on campus and policies concerning the institution’s response to those reports, including policies for making timely reports to members of the campus community regarding the occurrence of crimes described in the next paragraphs

Shear Perfection Academy at 5620 Nolensville Pike, Nashville, TN 37211, abides by the following policy with regard to the reporting of criminal actions and/or emergencies that may take place on school property: In the event of any type of criminal activity or emergency, the senior administrative staff person (Campus Director, Financial Aid Director or Administrator, etc.) must be immediately notified. In their absence, the senior faculty member or administrative staff member must be notified. In the absence of any employee of the school, the relevant governmental agency must be notified. In the event of criminal activity and/or emergency, all relevant governmental agencies must be alerted at once by the senior administrative staff or faculty member and a decision will be made as to the safety of the campus facility and the assurance of the well-being of students and staff. The campus should be cleared until relevant governmental agencies are on the scene. These decisions are made upon reasonable, logical, and common sense observations by the school staff. Students are encouraged to make note of any activity of a criminal suspicious nature and bring it to the attention of the school staff. Students and school employees will be notified of any occurrence of a criminal nature, through normal communication channels including, but not limited to, bulletin boards, memos, classroom announcements, etc.

(2) A statement of current policies concerning security of and access to campus facilities, and security considerations used in the maintenance of campus facilities.

Access to school facilities is limited to those hours of operation listed above in the catalog. Students are not permitted on school property without school faculty or staff present to unlock the facility, provide instruction or supervision, and to secure the facility at the end of the school day. At no time will the school campus be without at least one staff member or employee on site while the campus is open to students. The last school employee to leave the facility is charged with the responsibility to safeguard the facility including locking all exterior and interior doors, turning off all lights, equipment, and heating/air conditioning units, and completing any other tasks necessary to secure the facility. Shear Perfection Academy does not provide or maintain housing units for students.

(3) A statement of current policies concerning campus law enforcement, including: (i) The enforcement authority of security personnel, including their working

relationship with state and local police agencies and whether those security personnel have the authority to arrest individuals.

All school administrative personnel are empowered by the school to act in the school’s behalf as security personnel. All employees are to work with any and all law enforcement/police agencies with jurisdiction in the area where the school is located. NO employee of Shear Perfection Academy is empowered to arrest, search, or otherwise detain individuals against their will.

(ii) Policies that encourage accurate and prompt reporting of all crimes to the campus police and the appropriate police agencies.

As that Shear Perfection Academy does not have any police authority of its own, it is the responsibility of all faculty and staff members to report any possible crime or emergency to the school administration. Anyone who offers information regarding potential criminal activities and/or emergency situations is assured that in no way will their stepping forward affect their ability to continue their education or their employment.

(4) A description of the type and frequency of programs designed to inform students and employees about campus security procedures and practices and to encourage students and employees to be responsible for their own security and the security of others.

Students are made aware of their responsibilities and channels of communication regarding security procedures and practices as part of their introductory orientation as they begin classes. Employees are informed of security procedures and practices during staff meetings and through memos from the administrative staff as necessary.

(5) A description of programs designed to inform students and employees about the prevention of crimes.

Special programs designed to inform students and employees regarding crime prevention are available from local law enforcement agencies, upon request. Individual instructors may also provide programs regarding crime prevention to their students as part of the regular curriculum of the school.

(6) Information on a student’s option to notify proper law enforcement authorities, including on-campus and local police, and a statement that institutional personnel will assist the student in notifying these authorities, if the student requests assistance of these personnel. (i) Notifications to students of existing on- and off-campus counseling, mental

health, or other student services for victims of sex offenses. (ii) Notifications to students that the institution will change a victim’s academic status

after an alleged sex offense and of the options for those changes, if those changes are requested by the victim and are reasonably available.

(iii) Procedures for campus disciplinary action in cases of an alleged sex offense,

including a clear statement that:

(A) The accuser and the accused are entitled to the same opportunities to have others present during a disciplinary proceeding.

(B) Both the accuser and the accused shall be informed of the outcome of any institutional proceeding brought alleging a sex offense. This does not constitute a violation of the Family Educational Rights and Privacy Act. For purpose of this requirement, the outcome of a disciplinary proceeding means only the institution’s final determination with respect to the alleged sex offense and any sanction that is imposed against the accused.

(C) Disciplinary proceeding means only the institution’s final determination with

(7) A statement of policy concerning the monitoring and recording through local police

agencies of criminal activity in which students engaged at off-campus locations of student organizations which are recognized by the institution, and are engaged in by students attending the institution, including those student organizations with off-campus housing facilities.

(8) A statement of policy regarding the possession, use, and sale of illegal drugs and

enforcement of Federal and State drug laws. Shear Perfection Academy does not condone, nor will it accept as policy, the possession, use, and/or sale of illegal drugs by students or staff on school grounds, during any and all class activities, especially those officially sanctioned by the school administration. Students or staff found in violation of this policy will be disciplined as directed by Shear Perfection Academy. This policy will be reviewed at students’ orientation and to all staff as part of the staff orientation prior to beginning work. Shear Perfection Academy will fully cooperate with any and all governmental agencies and law enforcement organization to effectively control the use of illegal drugs.

(9) A description of any drug or alcohol-abuse education programs, as required under section 1213 of the HEA. For the purpose of meeting this requirement, an institution may cross-reference the materials the institution uses to comply with section 1213 or the HEA.

Shear Perfection Academy’s Drug and Alcohol Abuse Prevention Policy is detailed as a separate statement (above), and is covered as part of the regular student orientation, prior to or on the first day of classes. In addition, all employees are also required to review this policy and to agree to work within its restrictions regarding drug and alcohol use.

(10) A statement of policy regarding the institution’s campus sexual assault programs to prevent sex offenses, and procedures to follow when a sex offense occurs. The statement includes the following:

(i) A description of educational programs to promote the awareness of rape, acquaintance rape, domestic violence, dating violence, sexual assault, and stalking.

a. Procedures students should follow if a sex offense, domestic violence, dating

violence, sexual assault, or stalking has occurred, including information in writing about it.

The institution operates all programs according to a schedule of 900 hours per academic year of instruction. The maximum time allowed for transfer students who need less than the full course requirements will be determined based on 70% of the scheduled contracted hours. Students who have not completed the course within the maximum timeframe may continue as a student at the institution on a cash pay basis. ACADEMIC PROGRESS EVALUATIONS The qualitative element used to determine academic progress is a reasonable system of grades as determined by assigned academic learning. School’s grading scale includes in the policy that students are required to maintain a GPA of 75% based on their academic performance through the course of the program. Students are assigned academic learning and a minimum number of practical experiences. Academic learning is evaluated after each unit of study. Practical assignments are evaluated as completed and counted toward course completion only when rated as satisfactory or better (the computer system will reflect completion of the practical assignment as a 100% rating). If the performance does not meet satisfactory requirements, it is not counted and the performance must be repeated. At least two comprehensive practical skills evaluations will be conducted during the course of study. Practical skills are evaluated according to text procedures and set forth in practical skills evaluation criteria adopted by the school. Students must maintain a written grade average of 75% and pass a FINAL written and practical exam prior to graduation. Students must make up failed or missed tests and incomplete assignments. Numerical grades are considered according to the following scale: 93 - 100 EXCELLENT 85 - 92 VERY GOOD 75 - 84 SATISFACTORY 74 and BELOW UNSATISFACTORY DETERMINATION OF PROGRESS STATUS

Students deemed not maintaining Satisfactory Academic Progress may have their Title IV Funding interrupted, unless the student is on warning or has prevailed upon appeal resulting in a status of probation. WARNING Students who fail to meet minimum requirements for attendance or academic progress are placed on warning and considered to be making satisfactory academic progress while during the warning period. The student will be advised in writing on the actions required to attain satisfactory academic progress by the next evaluation. If at the end of the warning period, the student has still not met both the attendance and academic requirements, he/she may be placed on probation and, if applicable, students may be deemed ineligible to receive Title IV funds. PROBATION Students who fail to meet minimum requirements for attendance or academic progress after the warning period will be placed on probation and considered to be making satisfactory academic progress while during the probationary period, if the student appeals the decision, and prevails upon appeal. Additionally, only students who have the ability to meet the Satisfactory Academic Progress Policy standards by the end of the evaluation period may be placed on probation. Students placed on an academic plan must be able to meet requirements set forth in the academic plan by the end of the next evaluation period. Students who are progressing according to their specific academic plan will be considered making Satisfactory Academic Progress. The student will be advised in writing of the actions required to attain satisfactory academic progress by the next evaluation. If at the end of the probationary period, the student has still not met both the attendance and academic requirements required for satisfactory academic progress or by the academic plan, he/she will be determined as NOT making satisfactory academic progress and, if applicable, students will not be deemed eligible to receive Title IV funds. RE-ESTABLISHMENT OF SATISFACTORY ACADEMIC PROGRESS Students may re-establish satisfactory academic progress and Title IV aid, as applicable, by meeting minimum attendance and academic requirements by the end of the warning or probationary period. A student who does not achieve the minimum standards is no longer eligible for Title IV, unless the student is on warning or has prevailed upon appeal of the determination that has resulted in the status of probation. The school is required to notify students of any evaluation that impacts the student eligibility for financial aid, if applicable INTERRUPTIONS, COURSE INCOMPLETES, WITHDRAWALS If enrollment is temporarily interrupted for a Leave of Absence, the student will return to school in the same progress status as prior to the leave of absence. Hours elapsed during a leave of absence will extend the student’s contract period and maximum time frame by the same number of days taken in the leave of absence and will not be included in the student's cumulative attendance percentage calculation. Leave of Absence Policy During the course of a student’s program, the need may arise for a student to take a leave of absence (LOA). Student may request an LOA in advance in writing per school’s policy, unless unforeseen circumstances prevent the student from doing so. To start the process, the student needs to meet with the school director and fill out a Leave of Absence form stating the reason for the leave and the length, along with the student’s signature. Leave of Absences are subject to approval and may be granted if there is a reasonable expectation that the student will return from the LOA within a reasonable time frame. Reasons for LOA could be but not limited to, hospitalization of student or close relative, death in the family, major illnesses or accidents. A student will not be granted an LOA if the LOA, together with any additional LOAs previously granted, exceeds a total of 180 days in any 12-month period. Additionally, LOAs must be a minimum of 14 days. They may return, at no charge, at a mutually agreed upon date in the future. If a student does not return from leave on the agreed documented date of return, student will automatically be considered as withdrawn. In the event the student cannot make the request in advance (i.e., due to a car accident or other unforeseen circumstance), then the school may still allow a leave and will collect the request at a later date. School will document the reason for its decision and why LOA was granted to the student. The beginning of the leave will be determined as the first date the student was unable to attend the school because of the accident, and an end date will be noted that will not exceed the 180 day maximum in a 12-month period. The school will maintain documentation in the file explaining the sequence of events. Students will not be assessed any additional charges as a result of a requested LOA. A student who is granted an LOA in accordance with the school’s policy is not considered to have withdrawn and no refund calculation is required at that time. The student’s contract period will be extended by the same number of calendar days taken in the LOA and that such changes to the contract period will be documented on a contract addendum to the enrollment agreement and the addendum will be signed and dated by all parties. If a student takes an unapproved LOA, or does not return by the expiration of an approved LOA, then the student will be withdrawn. Shear Perfection Academy takes student attendance daily; therefore, the student’s withdrawal date for the purpose of calculating a refund will be the student’s last day of attendance.

Cosmetology-Related Programs Career Training The TN Cosmetology, Esthetics, Nail Technician, & Instructor’s Courses range in clock hours and in length. This course can be completed in as little as 10-50 weeks with full-time attendance. Approximately one-fourth of the course time is devoted to post-graduate training in the chosen area of expertise, three-thirds is devoted to technical instruction in the areas of educational psychology, teaching methodologies (theory & practical), and business methods.
