Interview Questions and the Law

Age: Can: ask for proof of date of birth

Can not: ask questions implying preference for a certain age group

Race/Color/Religion/Creed/Sex: Can not: ask anything regarding these areas

Arrests/Convictions: Can not: Arrests – no questions

Can: ask about specific conviction w/in 7 yrs relating to ability to perform job applying for

Citizenship: Can: ask if legally prevented from being employed and if you can provide proof of citizenship upon being hired

Can not: ask if you are a citizen/proof of citizenship nor ask questions to reveal ancestry, national origin etc.

Family/Marital Status: Can: ask if you can meet specific work schedules or if you have other responsibilities etc preventing you from meeting “work schedule requirements”

Can not: ask if you are married, divorced, etc or anything about spouse (ie: job/salary) or children (ie: childcare arrangements)

Height/Weight: Can: ONLY if height & weight are essential for job requirements/responsibilities

Handicaps/Health: Can: ask if you have any handicap/health issues preventing you from doing job responsibilities

Can not: ask general “Do you have any handicap?” questions

Military: Can: ask about education/training/work experience gained while in Armed Forces

Can not: ask about discharges or military experiences outside of non-US Armed Forces

Interview Questions and the Law

Name:• Can: ask if you’ve worked for them or a competitor under a different name (and ask for that name) or ask what name your references know you by

• Can not: ask about original name if changed by court order or through marriage or questions which could reveal marital status, ancestry/origin etc.

National Origin:

• Can: ask about ability to read, write, or speak foreign language

• Can not: ask about yours, your parent’s or spouse’s lineage, ancestry, national origin, descent, or birthplace

Organizations:• Can: ask about membership in organizations as long as name doesn’t include race, creed, sex, marital status etc.

Photographs:• Can: ask you to submit a photo for identification purposes AFTER HIRING

• Can not: ask for any photos before hiring

Pregnancy:

• Can: ask how long you will stay on job or what absences might be

• Can not: ask pregnancy questions, medical history re: pregnancy or any pregnancy related matters

Residence:

• Can: ask for address for contact purposes

• Can not: ask for names of those living with you or their relationship to you OR ask if you own or rent your home

•EXCEPTIONS:

•1) US Government may want employer to ask about your race, creed, color, sex, marital status or national origin

•2) Employers might ask these questions for info used to eliminate or prevent discrimination or used for

affirmative action
