RECALLING that. on 5 March 2016. Mr. Jean de Dieu Kamuhanda filed a motion pursuanllo
Rules 86(H). en. and (1) of the Rules of Proced ure and Evidence of the Mechan ism ("Rules")
requesting the resci ssion of protec tive measures granted 10 Witness ALM . a deceased De fence
wi tness, by the Internat ional Criminal Tribunal for Rwanda (WICTR"l in the case of Tbe Prosecutor
", Jean de Dieu Kamuhanda, Case No. ICfR·99-54, and the reclassification of Witness ALM's
pseudonym sheet and closed session transcr ipts as pU blic;2
RECALLING that, on 29 March 2016. I denied the Motion on the basis that: (i) any consent given
by a member or members of Witness ALM 's fam ily 10 rescind the deceased witness ' s protective
measures could not substitu te for the witness 's consent to such rescission; and (ii) Kemuhanda had
not demonst rated a compelling showing of exigent circumstances justifying the resc ission of the
protective measu res or tha t the requested resciss ion is necessary to prevent a miscarriage of justice;J
RECALLING that, on 8 August 2016. I granted Kamubaeda's request for certification to appeal
the Decision of 29 March 20 16,( and that he filed his appeal on 14 August 2016;'
NOTING tha t. on 14 November 2016, Ihe Appeals Chamber granted Kamuhanda's appeal , in part,
holding that: (i) Rules 86(F)(i), (H), and [I] of the Rules do DOt apply in the circumstances of this
case as Kamuhanda is a party to the "first proceedings" and seeks rescission of prot ective measures
granted 10 one of his own witnesses; (ii) Rule 86(A) of the Rules is applicable mutatis mutan d is to
ma nors of rescission or variation of protective measure s sought by a part y in its own case; and
(iii) the security concerns of mem bers of a deceased witness's family may constitute a relevant
consideration in dete rminin g whether the protective measures granted to the witness should remain
in place or be rescinded under Rule 86(A) of the Rules;6

DEING SEISED O F the instruction of the Appeals Chamber that the matter be remanded to me for
further considera tion consistent with the Decision o f 14 Nove mber 2016;7
RECA LLING that, on 2:\ Novemb er 2016, I ordered: (i) the Wit ness Support and Protection Unit
of the Mechanism ("WISP") 10 provide me with any informa tion and Inform me of its view on the
implications that rescinding witness ALM' s protective measures might have on the witness' s
immediate family ; and (ii) Kamuha nda and the Prosecution to file submissions and supporting
informati on, if any. identifying factors that weigh for or agai nst the rescis sion of Witness ALM' s
protect ive measures unde r Rule 86(A) of the Rules ."
NOTING the Registrar' s submission of 7 Decembe r 2016, indicating, inter alia, that the WISP:
(i) has no independent co nfirm ation that Witness ALM is deceased or that he informed his family
that he test ified as a protected witness before the ICTR; and (ii) that it would need to cons ult with
Wi tness ALM 's immediate famil y me mbers 10 ascertain whether he is deceased and to assess the
po tential implications for his fam ily of rescinding his protective meas ures;9
NOTING the Prosecutio n' s submission of 14 December 20 16 that, in applying Rule 86{A) of the
Ru les, consent of immediate family members is not a substi tute fo r the consent of a deceased
witness (0 resc ission of protective measu res and that potential concerns of family members, other
than immediate family members, whose privacy and securi ty may be compro mised by any variation
or rescission of a deceased witness ' s protective measures are releva nt to determining whethe r such
protec tive measures should be rescinded;'?
NOTING Kamuhanda ' s submission of 24 December 20 16, wherein he: (i) submits that
Wi tness AIM's death certi ficate is pub licly available on the Mec hanism 's database; (ii) states that

mem bers of the witness' s family arc aware of his status as a protected witness; and (iii) provides an
email address and a tele phone number for a member of Witness ALM's family; II
RECALLING tha t. on 1J January 2017. 1 ordered. inter alia: [i] Kamuhanda to provide to the
W ISP infonnation and documentation confirming thai Witness ALM is deceased and a list of
names and contact infonnat ion for Witness ALM 's famj ly members. particularly those currently
living in Rwanda or neighbouring countries such as the Democra tic Republic of Congo ("D RC);
(ii) the WISP 10 make reasonable efforts to co ntac t Witness ALM 's family members. particularly
those living in Rwanda or neighbouring countries such as lite ORe. 10 determine any security
implications for such individuals if Witness ALM' s protective measures were to be rescinded;
(iii) the WISP to conduct a risk assessment of the implications of such a rescission, and provide
any infonnation and its view on the implications that rescission might have on the security of these
individuals or other family members; and (iv) Kamuhanda and the Prosecution 10 file any response

NOTING the Registrar's Submission of 3 February 2017, wherein he states that the WISP bas
received confirmation that: (i) Witness ALM is deceased i'" (ii) witness ALM' s immediate family
members. who reside outside Africa, do not believe that rescinding the protective measures would
have adverse consequences on their security or safety;·" ( iii) no family members reside in the DRC
and only distant relatives may reside in Rwanda; IJ and (iv) Kamuhanda' s former investigator
possesses no information about family members residi ng in Rwanda or the DRC;16
NOTING FURTHER that the WISP: (i) is of the view that resc inding Witness ALM's protective
measures would have no adverse security implications on immediate family members but is unable
to provide any information on the security implications for distant relatives residing in Rwanda or
else where; 17 and (ii) requests permission to review and redact. if necessary, Witness AIM's
judicial records prior to any disclosure Ihat may be ordered. to ensure they do not contain
information related to other protected witnesses;11

CONSIDERING that the Protective Measures Decision granted protective measures, in part, due to
fears of prospective witnesses' relatives living in Rwanda and neighbou ring countries such as the
DRC;~
CONSIDERING FURTHER that the Protective Measures Decision provides that Kamu handa is
"at libert y [... J 10 request a Judge or Trial Chamber, at any lime, to amend the protective measures
sought or to seek additional measures for [his] witnesses, if necessary";"
CONSIDEHING that Articles 19(2) and 20 of the Statute of the Mecha nism C'Slatu te") require a
balancing of the right of the accused to a fair trial , the rights of victims and witnesses to protection,
and the right of the public 10 access infomt.ation;1.2
CONSIDERING thai , in tbe absence of a witness's consent , varying or rescinding protective
measures may be warranted where there is a change in the clrcumstaaces tholt initially justified
granting the protective measures;21
CONSIDERING that Witness ALM is now deceased and that one of the reasons for granting the
protective measures, namely the fears of relatives living in Rwanda and neighbouring countries
such as the DRe , no longer exists as the WISP and Kamu handa are not aware of family members of
Witne ss ALM who reside in Rwanda orthe DRC;

FINDING, therefore, thai these changes in circumstances j ustify the rescission of witness ALM 's
protective measures;
PURSUANT TO Article 20 of the Statute andRules 55 and 86 of the Rules;
HEREBY GRANT the Motion and rescind the protective measures afforded 10 Witness ALM in the
Protective Mea..ures Decision;
IM..-nw e r the Registrar 10:
(i) lift (he confidentia lity of Exhib it 047 . w itnes s ALM's pseudonym sheet. and
reclassify it as public;
Oi) review the closed sess ion tran scripts of Witness ALM's testimony in the
KOllluholldn case to determine whether there is any information related ro other
protected witnesses that must be redacted;
(iii) lift the confidentiality of Witness ALM' s closed session transcripts in so far as
they do not contain information related to other protected witnesses and reclassify
the transcripts as public: and
(iv) file a public version of the Registrar's 3 february 2017 Submission with any
necessary redactions.
