A New NCMA Fellow in San Diego By Maurice Caskey, CFCM, CCCM, Fellow, Chapter Award Chair

It is with great pleasure that we recognize Daniel A. Chalfant as a recipient of the NCMA Fellow Award. This award is well deserved in recognition of Dan’s contributions to the contracts management profession and NCMA. The award will be presented to Dan at World Congress 2017 in Chicago, Illinois, on July 26, 2017. The Fellow designation is the Association’s second highest award. It has a tradition dating back to 1967. As a Fellow, Dan is charged to:

• Maintain a leadership role in NCMA and the contract management profession;

• Participate as a member of the Council of Fellows and as an active member of the San Diego chapter;

• Contribute to enhancing and expanding the professional acceptance of NCMA membership and certification; and

• Mentor the development of new NCMA leaders.

You might ask what does it take to become a Fellow? Award applications are submitted through Maurice Caskey, the Chapter Fellows and Awards Chair. The annual deadline for nominations is December 1. Preparing an application generally takes a few weeks from the time it is started until it has been signed and submitted. An extensive amount of documentation (e.g., copies of papers, certificates, diplomas) is required to support the application. Therefore, it isn’t too soon to start thinking about submitting an application for 2017. Applications are submitted electronically to the NCMA national office. The applications are reviewed by the Awards and Honors Working Group, which then makes its selections by March 1 of each year. The application includes 9 categories of professional and NCMA activities, with 29 maximum points obtainable—a minimum of 17 points is required to be eligible for a Fellow Award. Documentation must be submitted for each of the following categories:

• NCMA membership (2 points) • Academic and professional training (6 points) • Work experience in the contract/acquisition profession (4 points) • NCMA service—chapter level (5 points) • NCMA service—national level (5 points) • Publications (2.5 points) • Volunteerism—non-NCMA event (1.5 points) • Academic service (2 points) • National awards and recognitions (1 point).

Dan comfortably met the 17-point minimum requirement based on his extensive professional experience and NCMA participation. He currently works as a cost/price analysis specialist at General Atomics Aeronautical Systems, Inc. He has over 30 years of experience in contract management that includes managerial level positions. He has been an active NCMA member for over 15 years. Dan currently serves as President of the San Diego NCMA Chapter and has been the vice president and education director. He has presented at various NCMA chapter events and has published two articles in Contract Management magazine. He is a Certified Federal Contracts Manager (CFCM) and Certified Professional Contracts Manager (CPCM). Dan holds a MBA from the University of California Irvine and a BA in Business Economics from the University of California Santa Barbara. He has made professional presentations at the Institute of Supply Management (ISM) and the Government Contract Pricing (GCP) Summit in San Diego. He is also an adjunct instructor at San Diego State University, College of Extended Studies, teaching Sourcing and Cost/Price Analysis. A Special Thanks to Barbara Hubbard – CPCM Study Group Chair

The NCMA San Diego Chapter Officers would like to recognize and thank Barbara Hubbard, Sr. Contracts Administrator at KOAM Engineering Systems, Inc. (KES), who for the past 4 years had successfully hosted, mentored, guided and motivated the CPCM study groups. In addition, Barbara coordinates with the local contracts professional who help facilitate the study groups and offer their insight and knowledge regarding the material being reviewed each week. Over a period of 11 weeks the CPCM study group had 12 participants with 6 students taking the CPCM exam.

Barbara, who received her CPCM certification in 2014 says, “I do this because I enjoy helping others”. I promised Courtney Kappel that if she created the content that I would continue to present it. So, since Courtney took the time to provide the opportunity for me, I am paying it forward by helping others. Courtney did all the hard work and I get the benefit of meeting/networking with fellow contracts professionals.” (Courtney Kappel, Contracts Manager, ViaSat Inc, and San Diego NCMA Education chair in 2014, created the syllabus, presentation materials and practice exams.) Currently, Barbara is hosting the CPCM study group once a year, typically in the January to March timeframe. The CPCM is an eleven week course that is focused on prepping to take and pass the CPCM exam. It is not intended to teach folks anything new, but she guarantees that you will learn something if you attend. Many students just take the class to enhance their contracting knowledge with no intention of taking the CPCM exam. For those interested in participating in future study groups, it is eleven weeks long. Each week, in advance of the meeting, members are expected to: (1) Read the assigned chapters in the Contract Management Book of Knowledge

(CMBOK), 4th Edition and CPCM Study Guide 3rd Edition, (2) Prepare a brief informal presentation on their assigned topic, (3) Answer the practice test questions applicable to that week, and (4) Familiarize themselves with the provided Power Point slides

Attendees are expected to actively participate in the weekly meetings. They should expect to spend about five hours a week toward study group activities (approximately three hours of homework plus two hours at each study session). Additional information can be found at http://ncmasd.org/education/studygroup.html If there is enough interest Barbara has volunteered to start a CFCM study group in the September to November timeframe. The CFCM preparation class will be an 8 week course, strictly based on the Federal Acquisition Regulations (FAR). Once again, our gratitude and appreciation goes out to Barbara for her tremendous support to the chapter and providing opportunity for our members to obtain their CPCM certification and excel in their contract management profession.

The chapter leaders also wish to thank KES for being a strong supporter of NCMA San Diego Chapter and for hosting the Contract Administrator Round Table (CART) meetings.

Contractor Purchasing System Reviews (CPSR) How to Pass and Maintain an Approved System

CPSRs are a mean by which the U.S. Government mitigates its risk in subcontracting by its suppliers, by evaluating the efficiency and effectiveness of contractors’ purchasing systems. Contractors which have contracts which include FAR 52.244-2 are subject to CPSR requirements, even if they may not have met the criteria in 44.302. Contractors that have contracts containing 52.244-2 and which do not have an approved purchasing system are required to obtain consent to subcontract prior to placing any cost type award and certain fixed price awards per 52.244-2(c).

This article cannot possibly cover everything Contractors need to know as CPSR compliance is the subject of days long seminars and workshops, at which many people still come up with many questions. The following is an overview of the topic.

The evaluation criteria used by DCMA to evaluate a purchasing system are found at DFARS 252.244-7001. There are 24 criteria there, which

primarily consist of the following: • Policies and procedures that cover listed criteria that adequately

cover applicable regulations and purchasing processes. Contractors policies will be evaluated to determine completeness in covering necessary regulations and processes, and the contractors’ compliance with such policies

• Public Law Compliance – contractors should know, understand and, and comply with public laws, including, but not limited to:

o Truthful Cost or Pricing Data, (fka Truth in Negotiations Act [TINA]) o Cost Accounting Standards (CAS) o Limitations on Pass Throughs o Small Business Subcontracting o Specialty Metals o Anti-lobbying o Defense Priorities Allocation System (DPAS) o Federal Funding Accountability and Transparency Act (FFATA, aka

Executive Compensation Reporting) o Debarment o Safeguarding Covered Defense Information and Cyber Incident Reporting o Counterfeit Avoidance

• Effective cost/price analysis • Level of competition • Flow down of clauses and terms and conditions • Proper purchase authorizations • Effective negotiation • Evidence of prior consent when required • Effective file documentation

Key things DCMA will look for throughout the evaluation of the criteria include the extent to which the purchasing function is controlling the process, the extent to which purchasing and CPSR compliance is supported by management, and how well purchasing interacts with interrelated functions. Since the programs, operations, and other parts of the technical community have significant involvement within the purchasing process, it is ESSENTIAL, that they be controlled and work within the confines of the purchasing policies and procedures. These functions can wreak havoc on a purchasing system if they exceed the bounds allowed and if DCMA perceives that purchasing is essentially

under their thumb, doing their bidding, and pushing paper at their direction, a contractor will absolutely fail the review. There are several resources for learning and staying informed of developments of CPSR requirements, including but not limited to:

• Various seminars and workshops around the country, e.g., Federal Publication Seminars, Public Contracting Institute, etc.

• Free or paid webinars. Federal Publications Seminars has a number of on-demand webinars many that are free.

• NCMA national seminars or webinars and Contract Management magazine articles and local chapter seminars and workshops. NCMA San Diego will be having a panel presentation on CPSRs in June of 2017.

Maintaining an approved purchasing system is not easy and should not be taken lightly. 98% of companies fail their first CPSR. Even companies that have passed previously later fail. The environment is constantly changing with new regulations, new review teams, new policies and procedures from DCMA, different philosophies by DCMA CPSR leadership, etc. Obtaining or maintaining an approved system is critical as penalties for failure are significant. Penalties include but not limited to the following:

• 5% to 10% payment withholds for one or more business system failures • Inability to bid on contracts that require approved system • Competitive disadvantage in bidding on contracts which consider system approval

in evaluation • Requirement for prior consent to subcontract • Additional oversight and audits by other agencies • Corrective action plan and monitoring

• Impact to reputation

A Certified Commercial Contracts Manager (CCCM) certification validates your education, training, experience and your knowledge of the Uniform Commercial Code.

Industry Certification in Contract Management–Defense

The ICCM–D is a certification awarded by the National Contract Management Association (NCMA) which parallels the Defense Acquisition Workforce Act (DAWIA) certifications in contracting. The formal education, experience, and specialized training required are the same for the ICCM–D and for DAWIA.

Industry Certification in Contract Management–Federal

The ICCM–F is a certification awarded by the National Contract Management Association (NCMA) which parallels the Federal Acquisition Certification in Contracting (FAC–C). The formal education, experience, and specialized training required are the same for the ICCM–F and for FAC–C.

Certified Federal Contract Manager (CFCM) Certification Study Group The San Diego Chapter of the National Contract Management Association (NCMA) will be conducting a Certified Federal Contracts Manager (CFCM) Certification Study Group. The CFCM Study Group will meet one night each week for 8 weeks and will have volunteer facilitators knowledgeable in contracting to help you prepare for the exam. The study groups will be hosted as follows:

Location: KES, Inc. 7807 Convoy Ct., Suite 200, San Diego, CA 92111

Dates: 9/5/17 to 10/24/17, Tuesday Evenings

Time: 6pm to 8pm There are 30 spots available for this study group and will be filled on a first come first serve basis. To reserve your spot please email Kristy Schultz at [email protected] and Barbara Hubbard at [email protected] Study group members are required to procure their own materials with the exception of the Power Point slides and practice tests which will be provided by the chapter. Members will be responsible for printing their own slides and practice tests. Following the conclusion of the study group, the chapter will host the certification exam on Saturday, November 4th, 2017 at KES from 9am-1pm. Applications and fees are due to NCMA Headquarters 45 days prior to the exam date. No walk-ins will be allowed. The paper exam cost is $50 for NCMA members and $90 for non NCMA members. NCMA San Diego Election Results

The annual NCMA San Diego Election of Chapter Officers, Chairs, and Board of Directors for the Program Year 2017-2018 took place in April and May of this year. In January, an election committee was appointed to conduct the annual election. The election committee was led by Quyen Tran, a former President of the San Diego chapter. Nominations were solicited on March 10, 2017 for Chapter Officers. Chapter Officers consist of the following seven (7) elected positions, President, Vice-President, Treasurer, Secretary, Education Director, Arrangements Director, and Membership Director. Nominations closed on March 24, 2017, The official ballot was distributed to all 387 chapter members on April 27, 2017 via email. The Election period closed on May 11, 2017. A total of 30 votes were received via mail for the Program Year 2017-2018 election. Thank you to all members who voted this year. The official results of the election are as follows:
