    •(c) For different packing material used or, different drug delivery systems or any other speciefeatures/forms claimed, the ceiling prices, as specified in Column No. 5 above, shall be applicabhunless the companiesapproaches NPPA for specific price approvals for its formulations.

    (d) The prices fixed/notified hereinabove under the provisions of DPCO, 1995 have to be mandatorilimplemented by the manufacturing /marketing company notwithstanding its status of compliance cconditions for such formulation pack under the Drugs and Cosmetics Act, 1940.

    (e) The manufacturer and marketing company for the above said formulation shall be required to take th<requisite prior approval from the competent Authority for any change in the composition of the abovisaid formulation with written prior intimation to the National Pharmaceutical Pricing Authority.

    (f) The ceiling price arrived on the basis of above shall not exceed the MRP by multiplying the ceiliniprice by a factor of 1.04 as per the existing rates of excise duty and VAT.

    (g) The MRP arrived as above shall besubject to payment ofGovernment levies / taxes as applicable amnecessary adjustment in the factor of 1.04 shall necessarily be required to be made by thtmanufacturer/marketing company, whenever the existing rate of excise duty and/or VAT undergoes ;change, subject to the condition that the excise duty and/orVAT so calculated shall in no case exce&the actual excise duty and/or VAT paid by the manufacturer/marketing company or as applicable aper the factor of 1.04. The manufacturer/marketing company shall be specifically liable to ensure thicompliance of this condition.

    (h) Any other formulation / composition not covered in the above table that has any one ofthe schedule*drugs in Column No. (3) as one of its ingredients, it shall be subject to the price ceiling at respectiviserial number of the table, as the case may be, unless the manufacturer has got hereafter specifiprice fixed by the NPPA for that formulation.

    (i) The manufacturer or marketing company not complying with the ceiling prices and conditions specifi©in notes hereinabove within 15 days from the date of above said notification, shall be liable to deposovercharged amount along with the interest under the provisions ofthe DPCO, 1995 read with the E(Act, 1955.

    (j) Consequent to the issue of ceiling price of the formulation pack(s) in this notification, the price order(sissued prior to this date of notification stand automatically withdrawn.

    S.O.1541(E) - In exercise of the powers, conferred by sub-paragraphs (1) and (2) of paragraph 9 amparagraph 11 of the Drugs (Prices Control) Order, 1995, read with No. S.O. 637 (E) dated the 4th Septembei1997 issued by the Government of India in the Ministry of Chemicals and Fertilizers and in supersession of thuOrder of the Government of India in the Ministry of Chemicals and Fertilizers, (National PharmaceuticsPricing Authority) No. S.O. 2735(E), dated 16th November, 2012, in so far as it relates to formulation packmentioned in the table below, except in respect of things done or omitted to be done before suclsupersession, the National Pharmaceutical Pricing Authority, hereby fixes the prices as specified in column (5of the table below as ceiling prices exclusive of excise duty and local tax, if any, and in column (6) of the tabl<below as Equivalent MRP inclusive of excise duty and education cess, sales taxA/AT of each of th«Scheduled formulations specified in the corresponding entry in column (2) of the said Table with the strengtland pack size specified respectively in the corresponding entries in columns (3) and (4) thereof:

    NPPA in its 132th Authority Meeting held on 16.05.2013 duly considered the aforesaid price fixation ordeand approved the prices of Human Insulin Injection imported finished form formulations having domesticindigenous substitute as per the guidelines approved in 121st Authority Meeting held on 22.7.2011 for sue!imported formulations. Accordingly, prices for Human Insulin Injection imported finished form were approve*in "public interest" under various provisions of the DPCO, 1995, in order to ensure fair amaffordable/reasonable price to consumer public.

    (a) The prices fixed are the maximum retail prices in column (6) (inclusive of excise duty and local taxesany) for the specified pack and packs of similar strength, and companies cannot claim exemption oiany ground therefrom, unless specifically permitted by the Government/NPPA through an order.

    (a) The manufacturers of above mentioned scheduled formulations having maximum retail price higherthan the ceiling price specified in column (5) of the table hereinabove, shall revise the MRP to anamount not exceeding the ceiling price plus local taxes, wherever applicable in accordance withparagraph 13 (1) and 24 of the DPCO.2013.

    (b) The manufacturers may add local taxes only if they have paid actually to the Government on theceiling price mentioned in the column (5) of the above table.

    (c) The ceiling price for a pack of the schedule formulation shall be arrived at by the manufacturer inaccordance with the ceiling price specified in column (5) of the above table as per provisionscontained in paragraph 11 of the Drugs (Prices Control) Order, 2013. The manufacturer shall issuea price list in Form-V as per the paragraph 24 (2) of the DPCO, 2013.

    (d) All the existing manufacturers of above mentioned scheduled formulations having MRP lower thanthe ceiling price specified in column (5) in the above table plus local taxes as applicable, if any, shallcontinue to maintain the existing MRP in accordance with paragraph 13 (2) of the DPCO, 2013.

    (e) Where an existing manufacturer of scheduled formulation with dosage or strength or both asspecified in the above table, launches a new drug as per paragraph 2 (u) of DPCO.2013 then suchexisting manufacturer shall apply for prior price approval of such new drug to the NPPA in Form I asspecified under schedule-ll of the DPCO, 2013.

    '(f) The manufacturers of above said scheduled formulation shall furnish quarterly return to the NPPA, inrespect of production / import and sale of scheduled formulation in Form-Ill of scheduled-ll of theDPCO, 2013. Any manufacturer intending to discontinue above said scheduled formulation shall

    'furnish information to the NPPA, in respect of discontinuation of the production and / or import of schedulesformulation in Form-IV of scheduled-ll of the DPCO, 2013 at least six months prior to the indenteddate of discontinuation.

    (q) The manufacturer not complying with the ceiling price and notes specified hereinabove in thisnotification shall be liable to deposit overcharged amount along with the interest thereon under theprovisions of the Drugs (Prices Control) Order, 2013 read with the Essential Commodities Act, 1955.

    (h) Consequent to the issue of ceiling price of the scheduled formulation as specified in column (2) ofthe above table in this notification, the price order(s) if any, issued prior to the above said date ofnotification, stand withdrawn.

    S.0.1546(E) - In exercise of the powers, conferred by paragraph 4, 11 and 14 of the Drugs (Prices Control)Order, 2013, read with S.O. No. 1394(E) dated the 30th May, 2013 issued by the Government of India in theMinistry of Chemicals and Fertilizers, the National Pharmaceutical Pricing Authority (hereinafter referred asNPPA) hereby fixes the prices as specified in column (5) of the table herein below as ceiling prices exclusiveof local tax applicable, if any in respect of the Scheduled formulations specified in the corresponding entry incolumn (2) of the said Table with the strength and unit specified respectively in the corresponding entries incolumns (3) and (4) thereof:

    The manufacturers of above mentioned scheduled formulations having maximum retail price higherthan the ceiling price specified in column (5) of the table hereinabove, shall revise the MRP to anamount not exceeding the ceiling price plus local taxes, wherever applicable in accordance withparagraph 13 (1) and 24 of the DPCO.2013.

    The manufacturers may add local taxes only if they have paid actually to the Government on theceiling price mentioned in the column (5) of the above table.

    The ceiling price for a pack of the schedule formulation shall be arrived at by the manufacturer inaccordance with the ceiling price specified in column (5) of the above table as per provisionscontained in paragraph 11 ofthe Drugs (Prices Control) Order, 2013. The manufacturer shall issuea price list in Form-V as perthe paragraph 24(2) ofthe DPCO, 2013.

    All the existing manufacturers of above mentioned scheduled formulations having MRP lower thanthe ceiling price specified in column (5) in the above table plus local taxes as applicable if any shallcontinue to maintain the existing MRP in accordance with paragraph 13 (2) of the DPCO, 2013'.

    Where an existing manufacturer of scheduled formulation with dosage or. strength or both asspecified in the above table, launches a new drug as per paragraph 2 (u) of DPCO 2013 then suchexisting manufacturer shall apply for prior price approval of such new druq to the NPPA in Form Iasspecified under schedule-lIof the DPCO, 2013.

    The manufacturers of above said scheduled formulation shall furnish quarterly return to the NPPA inrespect of production / import and sale of scheduled formulation in Form-Ill of scheduled-ll of the

    DPCO, 2013. Any manufacturer intending to discontinue above said scheduled formulation shall furnishinformation to the NPPA, in respect of discontinuation of the production and / or import of schedulesformulation in Form-IV of scheduled-ll of the DPCO, 2013 at least six months prior to the indenteddate of discontinuation.

    (g) The manufacturer not complying with the ceiling price and notes specified hereinabove in thisnotification, shall be liable to deposit overcharged amount along with the interest thereon under theprovisions of the Drugs (Prices Control) Order, 2013 read with the Essential Commodities Act, 1955.

    (h) Consequent to the issue of ceiling price of the scheduled formulation as specified in column (2) ofthe above table in this notification, the price order(s) if any, issued prior to the above said date ofnotification, stand withdrawn.

    S.0.1552(E) - In exercise of the powers, conferred by paragraph 4, 11 and 14 of the Drugs (Prices Control)Order, 2013, read with S.O. No. 1394(E) dated the 30th May, 2013 issued by the Government ofIndia in theMinistry ofChemicals and Fertilizers, the National Pharmaceutical Pricing Authority (hereinafter referred asNPPA) hereby fixes the prices as specified in column (5) of the table herein below as ceiling prices exclusiveof local tax applicable, if any in respect of the Scheduled formulations specified in the corresponding entry in'column (2) of the said Table with the strength and unit specified respectively in the corresponding entries incolumns (3) and (4) thereof:

    The manufacturers of above mentioned scheduled formulations having maximum retail price higherthan the ceiling price specified in column (5) of the table hereinabove, shall revise the MRP to anamount not exceeding the ceiling price plus local taxes, wherever applicable in accordance withparagraph 13 (1) and 24 of the DPCO,2013.

    The manufacturers may add local taxes only if they have paid actually to the Government on theceiling price mentioned in the column (5) of the above table.

    The ceiling price for a pack of the schedule formulation shall be arrived at by the manufacturer inaccordance with the ceiling price specified in column (5) of the above table as per provisionscontained in paragraph 11 of the Drugs (Prices Control) Order, 2013. The manufacturer shall issuea price list in Form-V as per the paragraph 24 (2) of the DPCO, 2013.

    All the existing manufacturers of above mentioned scheduled formulations having MRP lower thanthe ceiling price specified in column (5) in the above table plus local taxes as applicable if any shallcontinue to maintain the existing MRP in accordance with paragraph 13 (2) of the DPCO, 2013.

    Where an existing manufacturer of scheduled formulation with dosage or strength or both asspecified in the above table, launches a new drug as per paragraph 2 (u) of DPCO 2013 then suchexisting manufacturer shall apply for prior price approval ofsuch new drug to the NPPA in Form Iasspecified under schedule-ll of the DPCO, 2013.

    The manufacturers of above said scheduled formulation shall furnish quarterly return to the NPPA inrespect of production / import and sale of scheduled formulation in Form-Ill of scheduled-ll of theDPCO, 2013. Any manufacturer intending to discontinue above said scheduled formulation shall

    (g) The manufacturer not complying with the ceiling price and notes specified hereinabove in thisnotification, shall be liable to deposit overcharged amount along with the interest thereon under theprovisions of the Drugs (Prices Control) Order, 2013 read with the Essential Commodities Act, 1955.

    ORDER

    S.0.1558(E) - In exercise ofthe powers, conferred by paragraph 4, 11 and 14 ofthe Drugs (Prices Control)•Order, 2013, read with S.O. No. 1394(E) dated the 30th May, 2013 issued by the Government of India in theMinistry of Chemicals and Fertilizers, the National Pharmaceutical Pricing Authority (hereinafter referred asNPPA) hereby fixes the prices as specified in column (5) ofthe table herein below as ceiling prices exclusiveof local tax applicable, if any in respectofthe Scheduled formulations specified in the corresponding entry incolumn (2) ofthe said Table with the strength and unit specified respectively in the corresponding entries incolumns (3) and (4) thereof:

    NOTE:

    .(a) The manufacturers ofabove mentioned scheduled formulations having maximum retail price higherthan the ceiling price specified in column (5) of the table hereinabove, shall revise the MRP to anamount not exceeding the ceiling price plus local taxes, wherever applicable in accordance withparagraph 13 (1) and 24 of the DPCO.2013.

    (b) The manufacturers may add local taxes only if they have paid actually to the Government on theceiling price mentioned in the column (5) of the above table.

    (c) The ceiling price for a pack of the schedule formulation shall be arrived at by the manufacturer inaccordance with the ceiling price specified in column (5) of the above table as per provisionscontained in paragraph 11 of the Drugs (Prices Control) Order, 2013. The manufacturer shall issuea price list in Form-V as per the paragraph 24 (2) of the' DPCO, 2013.

    (d) All the existing manufacturers of above mentioned scheduled formulations having MRP lower thanthe ceiling price specified in column (5) in the above table plus local taxes as applicable, if any, shallcontinue to maintain the existing MRP in accordance with paragraph 13 (2) ofthe DPCO, 2013.

    (e) Where an existing manufacturer of scheduled formulation with dosage or strength or both asspecified in the above table, launches a new drug as perparagraph 2 (u) of DPCO.2013 then suchexisting manufacturer shall apply for prior price approval ofsuch new drug to the NPPA in Form Iasspecified under schedule-ll of the DPCO, 2013.

    (f) The manufacturers of above said scheduled formulation shall furnish quarterly return to the NPPA inrespect of production / import and sale of scheduled formulation in Form-Ill of scheduled-ll of theDPCO, 2013. Any manufacturer intending to discontinue above said scheduled formulation shall

    furnish information to the NPPA, in respect of discontinuation of the production and / or import of schedulesformulation in Form-IV of scheduled-ll of the DPCO, 2013 at least six months prior to the indenteddate of discontinuation.

    (g) The manufacturer not complying with the ceiling price and notes specified hereinabove in thisnotification, shall be liable to deposit overcharged amount along with the interest thereon under theprovisions of the Drugs (Prices Control) Order, 2013 read with the Essential Commodities Act, 1955.

    (h) Consequent to the issue of ceiling price of the scheduled formulation as specified in column (2) ofthe above table in this notification, the price order(s) if any, issued prior to the above said date ofnotification, stand withdrawn.
