In this context, fhn i stry Pape r No. 4 of 1977 lvhich

(t a bled in this House on 8th f eb ru ary , 1977) included a banned

list of i mport s expanded signific ~ ntly compared with the bann ed

li s t which u p to then p rev a iled . The list al though entitled

" Ba nned Li s t of Impor ts" included i tems tota lly banned from

impo rtati on as ~e ll as other it em s subj e cted to restricted

entry .

In practice, those items which are not totally

banned , but only p a rti a lly so are deRlt with administratively

by the Ministry cf Indu st ry and Cemmerce to accommedate •ur

Car icom partners, par ticuL3r publ i c a nd social p rogrammes, our

ex8ort tr ade , the tourist industry a nd ot her interests which

th e Mini ster con siders of vital importance to the nation. In

th is c o ntext the n the tendency has a lways been to apply the

At the same time, items which are totally prohibited are

3llowed to be imported on a No Funds basis.

Against this background, the whole matter of the

treatment of items on the " Ban ned List" the importation of which,

theoretical ly at least, is completely prohibited, is seen to be

somewhat unclear, both in an admi ni strat ive sense and in inter­

pretat ion. Logically, an item should be p laced on a banned li st,

or be subj ect to a total embargo only where the intention is th at

the item should not be brought into the country at all, that i s,

the intenti~n to remove it completely from usage within the

cou ntry. On the other hand, an item should be placed on a

Lestr icted li st where it is the intention on economic, social

and moral considerations to apply high though varying levels of

r e strictions.

Objective

The main objective ef this Paper therefore is to

make a clear distinction between those items for which the

intention is to institute total prohibition - a Banned List

and those in respect of which the ob j ect ive is to apply a high

level of r estriction - a Restricted List.

~his banned list consists only of items whose

impor tation is to~~lly prohi bited regardless of source, purpose

for which required and whether ~r not Jamaican funds will be

used for the transaction. It is necessarily therefore a short

list as set out in Appendix I attached . It follows that no

~ ncouragement will be given to the production of such items

locally. It will be realised that very serious thought has

been given to the compilation of this list and accordingly the

r~mov~ l of a n item from the list or the additio n of an item

to this lis t will r eq uire the specific approva l of Cabinet.

The restr i cted list as shown at Appendix II attach e d,

now embraces those items which, with few ex c ep tions, were

formerly on the ori g i na l bann ed list of imports together with

an exp~ nd ed range of oth e r it ems , wh ic h have since b e en deeme d

to warran t inclusion. Amendments to the list in terms of

omissi o ns and add itions have been made in consultation with

private sector ncga ni sations"

economic and other de v e lopment objectives are subject to high

though varying l evels of rest ricti on" It will be appreciated

th at thi s l i st will b e subject to addi ti ons , deletions, and

modific at ion s as po licy a ictates from tim2 to timeo

changes ho wever , wi ll not require Cabinet approval but will be

carried ovt at my discretion, thereby prov iding the ne cessary

flexibility in keep i ng the list current and up to date.

It i s not the i ntention that import licences will

normally be i ss u ed for items on this res t r ict e d list. Neverthe-

'less, g iven thG fact that th e restrict ~d list spans an ex tre me ly

wide r a n r:JG of i !:ems, coverin <J various pol i cy consideration.s,

it is expected t~a t the n eed will a ri se to vary the general

rul e s ince a devet~oinJ econom; i s always exposed to dynamic and

unforseen ch~·ng~s es?ec i a ll y when it i s subj0cterl to foreign

exchange constraints.
