TheU.S.DepartmentofEnergy(DOE)preparedthisbrochuretoencourageandhelpyoutoparticipateintheNationalEnvironmentalPolicyAct(NEPA)process.AllFederalagenciesmustcomplywithNEPA,buttheirproceduresvary.ThisbrochuredescribesDOE’sNEPAprocess,focusingonyourroleinDOE’spreparationofEnvironmentalImpactStatements(EISs).
What is NEPA?
NEPAisaFederallawthatservesastheNation’sbasiccharterforenvironmentalprotection.ItrequiresthatallFederalagenciesconsiderthepotentialenvironmentalimpactsoftheirproposedactions.NEPApromotesbetteragencydecisionmakingbyensuringthathighqualityenvironmentalinformationisavailabletoagencyofficialsandthepublicbeforetheagencydecideswhetherandhowtoundertakeamajorFederalaction.ThroughtheNEPAprocess,youhaveanopportunitytolearnaboutDOE’sproposedactionsandtoprovidetimelyinformationandcommentstoDOE.
ToimplementNEPA,allFederalagenciesfollowproceduresissuedbythePresident’sCouncilonEnvironmentalQualityintheCodeofFederalRegulations(40CFRParts1500-1508).DOEalsofollowsitsownsupplementaryprocedures,foundin10CFRPart1021.
How Does DOE Prepare an EIS?
TheEISprocessconsistsofseveralsteps,eachwithopportunitiesforyoutobeinvolved.
• Notice of Intent.First,DOEpublishesaNoticeofIntenttoprepareanEISintheFederal Registerandmakeslocalannouncements.ThisnoticestatestheneedforactionandprovidespreliminaryinformationontheEISscope,includingthe

How Does NEPA Work?
Earlyinitsplanningprocessforaproposedaction,DOEconsidershowtocomplywiththeNationalEnvironmentalPolicyAct(NEPA).Theappropriatelevelofreviewdependsonthesignificance(i.e.,thecontextandintensity)ofthepotentialenvironmentalimpactsassociatedwiththeproposedaction.TherearethreelevelsofNEPAreview:
• Environmental Impact Statement (EIS) –FormajorFederalactionsthatmaysignificantlyaffectthequalityofthehumanenvironment,NEPArequirespreparationofanEIS.AnEISisadetailedanalysisofthepotentialenvironmentalimpactsofaproposedactionandtherangeofreasonablealternatives.PublicparticipationisanimportantpartoftheEISprocess.
• Environmental Assessment (EA) –WhentheneedforanEISisunclear,anagencymayprepareanEAtodeterminewhethertoprepareanEISortoissueaFindingofNoSignificantImpact.AnEAisabriefanalysis.DOE’sproceduresprovidenotificationandcommentopportunitiesforhoststatesandtribes.DOEalsomayprovidenotificationandcommentopportunitiesforotherinterestedpeople.DOEthenconsidersanycommentsreceived,makesrevisionsasappropriate,andissuestheEA.
