PRESIDENT’S MESSAGE

Greg Raab, Adjusters International

It was truly an honor to be install-ed as President of NAPIA this past June in Hershey, PA. I am excited to take on the challenge of living up to the example set by the in-credible list of leaders who have come before me. The job has been made much easier by two key factors. The first is the fan-tastic momentum I inherit from my predecessor, Jeff Gould, who was tireless in his efforts to elevate our profession – especially in the legislative arena. Jeff, in partner-ship with our NAIC Consultant Ann Frohman and NAPIA Coun-sel Brian Goodman, continues to make tremendous strides within the NAIC to have our association recognized as valued members of the insurance industry. COUNSEL’S

CORNER

Brian S. Goodman, Esq.

A lot has transpired since our June convention in Hershey, PA. Recently, NAPIA President Greg Raab, NAIC Consultant Ann Froh-man and I attended the National Association of Insurance Commis-sioners (NAIC) Summer Meeting in Boston, MA. We had productive meetings with a number of state regulators, including those from Wisconsin, Virginia, Florida and Missouri. As a result of our active involvement, NAPIA continues to grow and gain presence and respect at the NAIC level. Importantly, I am also pleased to write that the NAIC Plenary Committee approved the three letters from the Public Adjuster Working Group to the public, contractors and the industry regarding the proper role of public adjusters, particularly after a declared catastrophe. On the legal front, we had great success with our amicus brief in Texas in that the intermediate appellate court's ruling, favorable to the industry, was essentially affirmed by the Supreme Court of Texas by refusing to take cert (the final appeal) on the properly decided UPPA issue from the intermediate appellate court. As of this writing, we are preparing our amicus brief in the Colorado appraisal case, which will be filed at the Supreme Court of Colorado, in a most important legal action impacting the appraisal process in the first party property context. As we enter into the fall, state legi-slators are beginning to gear up for the next legislative session. If

any of you in your local jurisdic-tions learn of any bills proposed which will effect public adjusters, please get them as soon as possi-ble to the NAPIA Officers and/or the Legislative Committee so we can get a quick jump on any legi-slative measures. I will be joined by Ann Frohman in October at the First Party Claims Conference to present a class en-titled Dealing with the Unlicensed and the Effects of Assignments of Benefits. This year marks the 10th anniversary of the conference and, once again, it offers a great deal of current legal and other important information for public adjusters. I hope to see many of you there as well as the Mid-Year Meeting taking place a few months later in Savannah, GA.
