Claims for death and permanent total disability

benefits of uniformed members of the PNP stated

under Memorandum Circular No. 2011-009, pursuant

to the provisions of RA 6975, as amended

or sickness benefits of

uniformed PNP membersshall be filed and acted

upon in accordance with

these rules.

Disability  – any loss or

impairment of the normal

functions of the physical or

mental faculties of a PNPmember which reduces or

eliminates his capability to

continue with his presentemployment.

Total Permanent Physical Disability – anyimpairment of the mind or body which renders the

disabled uniformed PNP member incapable of

performing substantially the duties of a police

officer and which is expected to be long, continuedand of indefinite duration, provided, that

irreparable loss of the power of speech, or sense

of hearing, or loss of one or both hands or feet,

or loss of one eye or both eyes, or loss of thelimbs or brain injury resulting in in-

curable imbecility or insanity shall be

considered permanent total disability.

In all cases, the disability shall be deemed

permanent if it has persisted for a period

exceeding six (6) months, without fixed

healing period and renders the PNP memberincapable of performing his duties and

functions; Provided Further, that in case the

disability is found

to be permanent beyond doubt upon

medical examination of said member,

the waiting period of six (6) months

Shall no longer be applied.

 WHAT ARE THE GROUNDS

FOR COMPENSABILITY?

1) The PNP member must have been injured at

the place where his work requires him to be

and must have been performing his official

functions;

 A. For the injury and resulting disability

or death to be compensable, the injury

 must be the result of an employment

accident satisfying any of thefollowing conditions:

FOR COMPENSABILITY?2) If the death or injury is sustained elsewhere,

the uniformed PNP member must have been

executing a lawful order from his Chief

of Police or from his supervisor, as thecase may be;

3) The death or injury is sustained by reason

of the performance of official duty.

4) When a PNP member is accidentally

injured at a point reasonably proximate to

the place of work, while he is going to

and coming from his work.

 WHAT ARE THE GROUNDS

FOR COMPENSABILITY?B. For the sickness and the resulting

disability or death to be compensable,

the sickness must be the result of an

occupational disease listed in Rule VIIof this Rules. Otherwise, proof must be

shown that the risk of contracting the

disease is increased by the working

conditions.

The following are classified as occupation

disease:

1. Skin cancer

2. Cataract leading to blindness;

3. Rabies;

4. Tuberculosis and its implications;

5. Poisoning:

a) Carbon dioxide poisoning;

b) Carbon monoxide poisoing;

c) Lead poisoning;

d)Food poisoning;

6. Diseases caused by abnormalities in temperature andhumidity:

a) Heart stroke;

b) Frostbite/Freezing.

  7) Cerebrovascular accidents- as long as it is not due and/oraggravated by chronic alcoholism and/or cigarette

smoking.

a) CVA Embolism

b) CVA thrombosis

c) CVA thrombo-embolism

d) CVA hemorrhage

8) Parasitism- Compensability should be based on the principle

of:a) Greater risk acquiring the disease in the place of

work than in the place of usual residence.

b) Disease was acquired in endemic areas (i.e. areaswhere said disease is prevalent)

9) Cardiovascular diseases:

a) Acute myocardial infraction;

b) Congestive heart failure class IV-E

10) Pneumonia-

a) Viral pneumonia

b) Bacterial pneumonia

11) Peptic ulcer diseases- as long as it is not due tochronic alcoholism.

12) All forms of psychoses/ schizophrenic disorders.

13) Physical traumas resulting in:

a) Death;

b) Loss of limb/s or its functions.

c) Blindness;

d) Deafness.14) Diarrhea and its complications;

15) Cancer of the brain;

16) Diabetes and its complications.

The following ailments are not occupational

diseases and subject to proof that the risk of

contracting the same are increased by theworking conditions.

1.Viral hepatitis;

2. Cancer of the liver;

3. Cancer of the lungs;

4. Cancer of the pancreas;

5. Cancer of the stomach and intestine

6. Liver cirrhosis and its complications.

   NOTICE- The uniformed PNP member or

his authorized representative shall notify his

Chief of Police or immediate supervisor during

the period that he is absent due to sickness or

injuries. He shall however file an application

for leave of absence immediately upon his

return to Office.

Injuries or death involving a PNP member shall

 be reported to his police office or unit

assigned within twenty four (24) hours

from its occurrence and an investigation

relative thereto shall be immediately

conducted.

The concerned police station or office

shall submit to the Commission or

 NAPOLCOM Regional Office a copy of the

Investigation Report within thirty (30)

days from the occurrence of theinjuries or death

or in case of physical incapacity, his duly authorizedrepresentative.

in the order of precedence: 

1) Surviving spouse;2) Surviving dependent legitimate children;

3) Non-dependent legitimate children and

illegitimate children;

4) Surviving parents;

WHO MAY FILE CLAIM FOR TOTAL

PERMANENT PHYSICAL DISABILITY?

In case a uniformed PNP member who has

been found to be disabled refuses to apply for

total permanent physical disability retirement,

he/she shall be separated or attrited pursuant tothe provisionof Section 29 of R.A. No. 8551 as

implemented by Memorandum Circular No.

2008-005 “Prescribing  Policies, Procedures

and Guidelines Governing the Attrition Systemfor Uniform

Personnel of the PNP”

 WHO MAY FILE CLAIMFOR DEATH BENEFITS?

B. If a deceased PNP member during his lifetime

contracted a second marriage after the death of his

first spouse, the surviving dependent legitimate

children of the first marriage, if any, shall be entitledto a proportionate share of the benefits applying

suppletorily the provision of Article 888 of the New

Civil Code which states that “the  legitimacy of

legitimate children and descendants consists of on-

half of the hereditary estate of the father and of the

mother. The latter may freely dispose of

the

remaining half, subject to the rights of

illegitimate children and of the surviving”

 WHO MAY FILE CLAIMFOR DEATH BENEFITS?

The dependent legitimate children of

the first marriage shall, in support of

their claim, submit proof evidencing

filial relationship with the deceasedPNP member.

C. If the deceased PNP member is a Mohammedan, the

award of compensation benefits to the beneficiaries

shall be made in accordance with the provision ofPD 1083 (Code of Muslim Personal Law of thePhilippines).

SURVIVORSHIPBENEFITS?

When a PNP member who has been retired

under permanent total disability under RA 6975, as

amended, dies within five (5) years from the date of

his disability retirement, his surviving spouse or, ifthere be non, his surviving dependent legitimate

children shall be entitled to the pension for theremainder of the five-year guaranteed period.

 WHERE TO FILE CLAIM FORDEATH BENEFITS OF PNP

 MEMBER? A claim for permanent total disability or death

benefits of a PNP member shall be filed with the

Office of the NAPOLCOM Provincial Officer of theprovince or city where the PNP member is stationed

or in any of the Regional Offices of the Commission

having administrative jurisdiction of the unitassignment of the deceased PNP member.

 WHERE TO FILE CLAIM FORTOTAL PERMANENTPHYSICAL DISABILITYBENEFITS OF PNP MEMBER?

 All uniformed PNP members assigned with the

National Headquarters, National Support Units (NSUs)

and other PNP special units shall submit their individual

 Application letter for Total Permanent Physical Disability(TPPD) retirement under oath to the Directorate for

Personnel and Records Management (DPRM) thru the

Pension Retirement and Benefits Administration (PRBS)

for recording and appropriate action.

 All PNP members assigned with the Police

Regional Offices shall submit their individual

application for TPPD to the Regional Personnel

and Human Resource Development Division

a) Service record duly issued or authenticated by the PNP

Directorate for Personnel and Records Management(DPRM);

b) Certified copy of the latest appointment;

c) Clearance from money and property accountability;

d) Certification of non pending case from the Office of theOmbudsman, NAPOLCOM, PNP, IAS, and PLEB;

e) Detailed Investigation Report (ROI) from the Chief of

Police or immediate superior or supervisor, as to the

cause and extent of the disability;

Internal Revenue for reasonable medical and

hospitalization expenses, necessary transportation

and subsistence incurred on account of service-

connected

benefits shall be filed with the Office of the

NAPOLCOM Provincial Officer of the province or

city where the PNP member is stationed or in the

Regional Office of the Commission having

administrative jurisdiction of the unit assignment ofthe deceased PNP member. The following must be attached to the claim:

a) Service Record issued or duly authenticated by thePNP Directorate for Personnel and Records

Management (DPRM);

Police or immediate superior or supervisor as to the

circumstances or cause of death;

e) Clearance from money and property accountability;

f) Marriage Contract of the surviving spouse with the

deceased and the Birth Certificates of the surviving

children, if any, issued by NSO;

NSO;

h) Official Receipts duly registered with the BIR for

reasonable medical and hospitalization expenses,

necessary transportation and subsistence incurred

on account of service-connected diasbility;Purchase of medicine in excess of P50.00 shall be

evidenced by doctor’s prescription.

Personnel Officer, as the case may be,

credits for absences incurred by reason of the

injury sustained or sickness which caused the

death of the PNP member and the subject of the

claim;

 j) Proofs of surviving legal heirs if claimant is other

than the surviving spouse or child;

k) If the claim is filed by a parent or by a brother or

sister, proof must be submitted indicating that the

deceased died single without any survivingchild/children.

 WHAT ARE THE PROCEDURESIN THE PROCESSING OFCLAIM?

a) Upon receipt of all required documents for such

claim, the NAPOLCOM Provincial Officer/Legal

Officer shall set a date for the conduct of formal

hearing of the claim.

b) Investigation of the claim and subsequent

preparation of the Report of Investigation (ROI)recommending approval or disapproval of the claim.

c) The NAPOLCOM Regional Director, after reviewingthe ROI prepared by the legal Officer, shall prepare

and sign the necessary adjudication either

approving or disapproving the claim.

d) Payment by the NAPOLCOM Regional Office of

 WHAT ARE THE PROCEDURESIN THE PROCESSING OFCLAIM?

e) Forwarding of the entire case records to Central

Office for payment of pension benefits (5-year

guaranteed monthly pension).

f) In such case wherein the Regional Office has nomore available funds to pay the claim, the Regional

Director shall forward the adjudication together with

the entire case records to the Legal Affairs Service,

Central Office and request payment of the claim.

g) The Police Welfare Benefits Division, Financial

Service shall process the necessary documents for

the payment of the approved claim.

 WHAT ARE THE PROCEDURESIN THE PROCESSING OFCLAIM?

The Regional Office shall send a letter to the

claimant notifying him if the claim is approved or

denied. If a claim is denied, the claimant will be

furnished with a copy of the Resolution and he/shecan file his/her appeal to the NAPOLCOM Regional

 Appellate Board (RAB) concerned within fifteen (15)

days from receipt to the decision/resolution.

 WHAT BENEFITS ARE AWARDED TOTOTAL PERMANENT PHYSICALDISABILITY BENEFICIARIES?

The following Total Permanent Physical Disability

benefits shall be awarded to a PNP member who incurred

such disability in line of duty or service-connected sicknessor injury: 

a. Gratuity equivalent to the claimant’s  one (1) yearbasic salary;

b. Lifetime monthly pension equivalent to 80% ofclaimant’s basic salary;

c. Reimbursement of reasonable expenses formedicines,

medical attendance, hospital fees, necessarytransportation and subsistence, and;

d. Restoration of deducted leave credits.

EFFECTIVITY DATE OF RETIREMENT OFUNIFORM PNP MEMBERS BASED TOTALPERMANENT PHYSICAL DISABILITY

The retirement of a PNP member by reason of

total permanent physical disability takes effect only

upon approval of the adjudication by the concerned

NAPOLCOM Regional Director.

If a uniformed PNP member has been

compulsory retired pursuant to Section 39 of R.A.6975,

as amended, prior to the approval of his claim by the

Commission for total permanent physical disability

benefits, it having been established that he incurred

such disability before his compulsory retirement, the

effectivity of payment of

pension by the Commission shall likewise commense

EFFECTIVITY DATE OF RETIREMENT OFUNIFORM PNP MEMBERS BASED TOTALPERMANENT PHYSICAL DISABILITY

In no case shall a uniformed PNP member be

allowed to file both optional retirement and an

application for total permanent physical disability.

Prior to the approval of the application by the

Commission, the uniformed PNP member shall

continue to report for duty and render police service

and receive his salary as such, unless he is physically

incapable of performing his duties or he has alreadyreached his compulsory retirement in which case he

shall automatically cease to report for duty and to

receive salary.

 WHAT BENEFITS ARE AWARDEDTO PNP DEATH BENEFICIARIES?

The following Death Benefits shall be awarded to

the beneficiaries of a PNP member; 

 A. Surviving spouse or, if there be none, the surviving

dependent legitimate or legally adopted children.

1. Gratuity equivalent to deceased PNP member one year basic

salary);2. Burial expenses equivalent to three (3) month’s basic salary

of the deceased;

3. Monthly pension equivalent to 80% of deceased’s  basic

salary for a period of five (5) years from the date of death;

4. Reimbursement of reasonable expenses for medicines,

medical attendance, hospital fees, necessary

transportation and subsistence, and;

5. Restoration of deducted leave credits for absences

incurred by reason of sickness or injury which caused his

death and the subject of the present claim.

WHAT BENEFITS ARE AWARDED TO

 WHAT BENEFITS ARE AWARDED TOPNP DEATH BENEFICIARIES?

B. In the absence of the surviving spouse and

dependent legitimate children, the non-dependentlegitimate children together with illegitimate children,if any, or if there be none, the surviving parents of intheir absence, surviving brother and sisters of thedeceased PNP member, shall be entitled to the

following death benefits:1. Gratuity equivalent to deceased PNP member’s  one (1) year

basic salary;

2. Burial expenses equivalent to three month’s basic salary of the

deceased;

3. Reimbursement of reasonable expenses for medicines,medical attendance, hospital fees, necessary transportationandsubsistence;

4. Restoration of deducted leave credits for absences incurred

by reason of sickness or injury which caused his death andthe subject of the claim.

 MEDICAL AND HOSPITALIZATIONBENEFITS

Medical and hospitalization benefits shallembrace the following: 

a) Medical

1. Professional attendance and treatment

2. Consultative Professional Fees (Medical)

b) Surgical

1. Surgical operation or interview, after-care and follow-up2. Consultative Professional Fees (Surgical)

c) Hospital

1. Accommodation

2. Ambulance and operating room services

3. Clinical Laboratory service

4. Diagnostic services/procedure as may be necessary to diagnose or

effect a cure

d) Supplies

1. Drugs, medication or medical supplies

2. Any other goods or supplies prescribed for medical diagnose,

Care or treatment

PAYMENT AND/OR REIMBURSEMENTOF REASONABLE MEDICAL EXPENSES

Hospital Room Rate –  Hospital room rate shall notexceed P1,500.00/day except in the following cases:

c) In case of emergency when the patient needs to bebrought to a nearest hospital, the cheapest room

available must be chosen. As soon as the  patient’s condition improves or when the emergency ceases, the patient must be transferred to a room with a rate of notmore than P1,500.00/day. Otherwise, the excess shall beborne by the patient;

d) Any other cases related to the foregoing, uponevaluation and recommendation by the PNPPhysician or NAPOLCOM Medical Officer.

Professional and hospital bills shall beevaluated by the NAPOLCOM Medical Officer prior

to Approval by the Commission.

PAYMENT AND/OR REIMBURSEMENTOF REASONABLE MEDICAL EXPENSES

Medicines – Payment of necessary medicines, drugs,and other medical preparation duly prescribed by aphysician whether purchased from a reputable drugstore or supplied by the attending physician shall beallowed provided that the same shall not be more thanthe “retail  price”  prevailing in the local drug stores.Provided, further, that request for payment must beproperly supported by officials receipts, duly dated,numbered, and with corresponding doctor’s

PAYMENT AND/OR REIMBURSEMENTOF REASONABLE MEDICAL EXPENSES

Limitation on Reimbursement of Expenses –  TheCommission shall reimburse to a PNP member whosuffers injury or contracts sickness in line of duty allnecessary medical, surgical and hospital services, as thenature, seriousness, difficulty and complication of theinjury or sickness may require.

The Commission shall pay only reasonable,necessary, and relevant services. Therefore, except inemergency cases, a PNP member may undergo

laboratory work-ups and such other prescriptionprocedures only after he/she has been examined by the Clinic Physician who will then issue thenecessary referrals.

IN WHAT INSTANCES WILLCOMPENSATION BE DISALLOWED?

No claim shall be approved or compensation allowed

to a uniform PNP member or his beneficiaries when theinjury, sickness, disability or death is occasioned by anyof the following: a) By intoxication or drunkenness or vicious immoral

habits, or unauthorized or illegal use of regulated orprohibited drugs.

 b) By willful intention to injure or kill oneself.

c) By notorious or gorss negligence.

Shifting of Course

a) Shifting is done only once during the entire scholarship grantperiod and shifting after the second year of the course is notallowed;

Dropping of Subjects  – Dropping of subjects must be with the approval of the

school registrar, copy furnished the Commission. 

If a grantee stops or fails to continue during the semester or school

year due to sickness or justifiable reasons, he/she must inform the Commissioneither in writing, in person or thru his/her authorized representative and submit

medical certificate and/or supporting documents relative to his/her failure to finish

the semester or school year. 

He/She must enroll in the next semester or school year following the

period when he/she stopped.

Retaking of all the subjects shall be at the expense of the grantee, if the

Commission had already reimbursed the necessary expenses for the

semester or school year which he/she did not finish.

 ADMINISTRATIVE SANCTION

 Any PNP member or his representative and beneficiaries who, for the purpose of securingentitlement to any of these benefits or payments setforth under RA No. 6963 and its implementing Rules,

commits fraud, collusion, falsification,misrepresentation of facts or any other kind ofanomaly shall be subject to criminal andadministrative action this Commission may deemappropriate.
