The $20 billion merger of EMI Group and Time Warner's music divi- sions has entered its last phase and, as the European Commission is now expected to deliver its verdict before October 18, doubt is growing about the clearance of the deal. In a last minute attempt to block it, opponents to the merger were putting the finishing touches to their final objections to meet with September 22 midday deadline set by the EC's competition department. The objections follow the presen- tation a few days earlier by EMI and Time Warner of a series of undertakings they hope would sal- vage the deal. Executives from both companies at the highest level met with the European Commissioner in charge of competition, Mario Monti, on September 18. "It took so long to get concessions on the table," reveals a senior Warner executive. "This deal is fighting for its life, and this past week, for the first time, EMI [inter- nally] is not confident [about the outcome]." The source admits "nobody expected either the virulence of the Commission's objections or the broad sweep of its conclusions." The undertakings were outlined in a document to the Commission seen by Music & Media. They include the selling of assets in sev- eral European countries so that their combined market share remains below 35% in these coun- tries.     LONDON/BRUSSELS - Will it be acase of Sing When You're Winningor will EMI and TimeWarner end up In Blue?

    The $20 billion mergerof EMI Group and TimeWarner's music divi-sions has entered itslast phase and, as theEuropean Commissionis now expected to deliver its verdictbefore October 18, doubt is growingabout the clearance of the deal.

    In a last minute attempt to blockit, opponents to the merger wereputting the finishing touches totheir final objections to meet withSeptember 22 midday deadline setby the EC's competition department.

    The objections follow the presen-tation a few days earlier by EMIand Time Warner of a series ofundertakings they hope would sal-vage the deal. Executives from both

    What's wrong with Europe? Why do European con-sumers seem to be turning their backs on music whileNorth Americans are in a buying frenzy?

    This is a legitimate question, especially after look-ing at the most recent global market statistics for1999 released by the IFPI.

    Throughout the first half of the past decade,Europe's cumulative sales were superior to NorthAmerica's, reaching a high point in 1996. Then it allstarted to crumble. Year after year, Europe started tolose ground, sinking to a new low in 1999. WhileNorth America now accounts for 39.3% of the world'stotal sales in value, Europe is down to 32.1%.

    Of course, much can be explained by currencyfluctuations, and it's no secret that the US dollarhas outperformed all the other currencies in recentyears (especially in 1999/2000). But there is cer-tainly more than exchange rates to explain why theEuropean market is at best at a standstill, at worse,in a recession.

    Compared to North America-and its principal

    component, the USA-music sales in Europe havebeen penalised by several factors: a fragmented set oflocal markets, making difficult to organise globalmarketing and promotion campaigns; the lack of asingle currency; higher wholesale prices and higherVAT rates applied to sounds recordings (in the regionof 16% to 20% on average in Europe with peaks at25%); a relatively weak retail base; and new competi-tion from CD -Rs and the Internet.

    All this has contributed to a rather poor perfor-mance in Europe. Most European countries are lag-ging far behind the US in terms of music sales percapita in value and units. While American consumersbuy an average of 4 CDs a year per capita, it's closerto 2.5 in most of Europe.

    Can anything be done to reverse this trend?For a start, music has to become more affordable.

    This will require a serious assess-ment on pricing policies andmakes it even more urgent for theEuropean Union to lower the VATrate on records. But music has tobecome an exciting part of lifeagain-and it is up to labels,artists, retail and the media tocombine their efforts to make thishappen.

    LONDON - The Emap PerformanceNetwork (EPN)'s music directorFrancis Currie is striking out onhis own to develop what hedescribes as a "digital" project.

    Currie refuses to be drawn fur-ther on the venture, for which healready has partners and is cur-rently seeking finance, but says itrevolves around an idea that"wouldn't wait," hence his decisionto leave the EPN music directorpost after just five months.

    The speculation is that Currie isthe latest senior UK programmerto move into the dotcom sector, fol-lowing the departure in Februaryof Chrysalis Radio's group pro-grammer Keith Pringle to start hisRide The Tiger venture and

    Emap for digital venturerumours that former Capital Radiogroup head of programmes CliveDickens may also be plotting Inter-net moves following his departurefrom Capital in July.

    Currie's appointment asmusic director (M&M, March25) followed a realignment ofEmap's business structureand the creation of the EmapPerformance Network, whichbrought together all the company'sUK music -related magazines, radiostations, TV channels and Internetventures in one division.

    "I had a fantastic time atEmap," says Currie, who pro-grammed music TV channel theBox and Soft AC station Magic105.4/London for Emap, priorbeing appointed EPN music direc-tor, which he describes as "the best

    job I've ever had."It is understood from Emap

    sources that Currie will not bereplaced as music director, but

    instead there will now begenre -specific heads of pop,rock and dance within EPN,working-like Currie-acrossprint, broadcast and newmedia and reporting to EPNmanaging director Dee Ford.

    Those appointments are expectedto be announced within the nextthree weeks.

    In addition, Piccadilly Key103/Manchester programme direc-tor Dave Shearer has beenappointed group head of music(M&M, September 16) with specif-ic responsibility for co-ordinatingmusic policy at Emap's Big Citychain of CHR stations.

    HILVERSUM - Dutch radio listen-ers are able to put together theirown radio shows, thanks to anInternet initiative set up by com-mercial CHR station Radio 538.

    In conjunction with softwarehouses Lost Boys and SoftMachine,the station's website(www.538webstation.com) is givinglisteners the chance to air theirown shows through a speciallydesigned CD-ROM.

    "I think we're the first radio sta-tion in the world to launch a con-cept like this," says Erik de Zwart,managing director at Radio 538."As an added bonus it will serve as

    the perfect means to discover newradio talent. Our own DJs will reg-ularly check these home-made pro-grammes."

    Webstation uses similar radiosoftware as the real 538 and fea-tures instructions and visuals bypopular 538 DJs such as EdwinEvers and Jeroen van Inkel.

    The DIY software also enablesaspiring radio DJs to download vin-tage 538 jingles for their own showson the web, while they are operat-ing their virtual 538 home studio.

    MADRID - AC/CHR stationCadena 100, which is ownedby Cadena COPE, has adopt-ed programming changes ina bid to turn the tide follow-ing a slump that saw itsdaily audience fall below theone million mark for the firsttime in four years.

    Cadena 100's nationaldirector Jordi Casoliva nowpresents the first two hoursof the popular morningshow La Jungla, with JoseAntonio Abelian takingover the last four hours, aswell as fronting his ownlate -night sports show.

    There is also a newevening programme, whichwill stick mainly to theCadena 100 playlist, butCasoliva says will be"younger, fresher, and more

    dynamic." In order toachieve "more internalcohesion," playlist slots willnow be heard on all pro-grammes. "This way thepresence of ourplaylist music willtangibly improve,"says Casoliva.

    "These are crucialtimes," says Casoli-va, "and, after yearsof stability, thingsare changing. We arerenewing our contents toadapt to the market's newtastes and evolutions."

    In another change,record labels are beinginvited to join the regularweekly playlist meetings inMadrid attended by region-al Cadena 100 program-mers. The station says themove is a "gesture" to theindustry and claims it will

    "We haven't done thisbefore, as we wanted toavoid complications 'with

    everybody pumpingus with their newsingles," says Caso-liva. "The idea is forour regional peopleto get to know theguys from the labels,and vice -versa. It's a

Thegroup said the results had been affected by the £6.5mexpenditure on the launch of its flagship stationTalkSport and the increased investment in sportsbroadcasting rights. The integration of The RadioPartnership and The Independent Radio Grouphelped to boost first-half turnover from £4.2m to£13.8m.

    SWEDISH MUSIC CHANNELS GO ON UNESTOCKHOLM - The biggest player in Swedish Internetradio, Spraydio-owned by Internet company Spray-is to launch two more channels catering for classicaland punk rock fans. Spraydio currently runs sevenchannels, covering hard rock, techno, R&B/rap, alter-native music and pop, plustwo channels gearedtowards gay men andyoung women. "We want toshow that we can cover allstyles," says Spraydio's creative director Jonas Troeds-son. Launch dates and channel names for the two newservices are yet to be confirmed.

    RIGHTS BODY CHOOSES CAMPOMAORHILVERSUM - Victoria Campomaor, who has beenworking for Spanish author rights body SGAE since1991, has been appointed director of operations atAmsterdam -based International Music Joint Venture(IMVJ), which handles music processing in the digitalage for rights societies ASCAP, MCPS/PRS andBUMA/STEMRA. Campomaor, who is to relocate fromMadrid to Amsterdam, will report to IMVJ CEO Ms -brand Galema.     director of music services MoDarbyshire (pictured) as a con-sultant in its development of alicensing system for music online.AIM launched a trial two monthsago as the first step towards for-mulating a licensing system forthe use of streaming music,including Internet radio, in theUK. Darbyshire, who is alsofounding member at copyrighting

    JIM -TV has been set upby the Flemish media com-pany VMM (VlaamseMedia Maatschappij)-theparent company of commer-cial TV stations VTM andKanaal 2 and radio net-works Top Radio andMango. The new channel isbeing aimed at a 15 -25 -year -old audience.

    Schmidt leads fight for ratingsby Gesa Birnkraut

    BERLIN - For the first timea woman will be head ofprogramming in Germany'smost competitive radio mar-ket-Berlin.

    Antje Schmidt(38) has taken onthe job at BerlinerRundfunk 91!4 ina city where some26 radio stationsfight for the lis-teners' attention.

    "I don't thinkthat it's harder forwomen to get into the posi-tion of a programme direc-tors," says Schmidt. "But Iam convinced that womenthink more about this stepthan men and because of

    that I would say women area lot easier about the rank-ings of positions."

    Schmidt and her deputyAlex Kind (30) will lead theCHR/AC-formatted station

    in the fight for rat-ings. BerlinerRundfunk 91!4lost its marketleadership in thelast survey, butthe station saw anincrease of 20% inreach, attracting ayounger audience.

    "There is noneed for major changes inprogramming because mypredecessor RiidigerKreklau already focusedthe programming perfectlyin tune with the needs of

    the Berlin market,"explains Schmidt.

    Schmidt takes over fromKreklau (44), who, with hisdeputy Sebastian Fitzek(28), left the station tofound their own consultingcompany and will advisethe station in Berlin andBrandenburg.

    Antje Schmidt has beenworking in radio for 12years, including four yearsas deputy head of program-ming at commercial HitRadio Antenne Niedersach-sen and four years in thesame position at commer- cial R,adio ffn.

    ARS INKS UNIVERSAL DEAL

    BRUSSELS - Antwerp -based ARS Productions hassigned a distribution deal with Universal Music. Thedeal involves the company's new releases, back cata-logue and compilation projects. ARS was previouslydistributed by Sony Music Belgium. "The main reasonfor the move was the fact that compilations becomemore and more important to us-with UniversalMusic we have access to a much broader cataloguecompared to Sony Music," comments Patrick Buss-chots, managing director at ARS. Their first releasewill be Tina Bride's Get To You and a double -albumcompilation titled Ambi.

    WOMEN TAKE OVER AT BBC RADIO 1

    LONDON - BBC Radio l's newest recruit, Nemone, hastaken over the Saturday breakfast show, meaning allof the public broadcaster's breakfast shows are nowhosted by women, with Sarah Cox weekdays, andSarah HB on Sunday mornings. Nemone began hercareer on local radio in Manchester, where her Greekinfluences have shown through in her Olympic athlet-ic achievements. Last year she became the GreaterManchester 400 metres champion. She takes overfrom Mark Goodier who is to concentrate on present-ing the station's Official UK Top 40 show. Radio l'sother new recruit, Vicky Marsden has already taken tothe air, providing holiday relief for other DJs, beforeshe takes on overnights and the Saturday early break-fast show from the end of the month.

    Surefire winnersThe majors have lined up a lot ofsurefire winners. S.O.A.P.'s first sin-gle (Soap is in the Air) is makingwaves in Scandinavia, and NRJSweden is also giving it heavy rota-tion. Other European territories andAustralia are also responding, saysSony promotion manager KatrineSevelius. A top priorityat EMI -Medley isCartoons' follow-up totheir multi -millionseller Toonage, thistime with an albumcalled Toontastic.

    New release time is upon us and all the major labels aregearing up for the traditionally lucrative pre -Christmasmarket by preparing to launch major new releases-many of them long-awaited-into a highly chargedmarketplace.

    In the second of a three-part report, Music & Mediacorrespondents from Scandinavia and Holland previewthe major label releases in their respective territories.Medley's director of internationalexploitation. Meanwhile the season'sbig one for BMG will be ThomasHelmig, a sure seller whose Dreamalbum was one of the best selling CDsof last year.

    FINLAND

    Despite its recent fixation with dis-covering new talent with internation-al potential, the Finnish music scenewill be dominated by major releasesfrom established talent during theautumn. MOR station Radio Suomi islooking at a swarm of new titles withdefinite hit potential.

    "The quality this autumn willmake it tough even for establishedacts to get noticed," says MikaSuikkanen, music presenter at the

    station.One of the most

    anticipated newalbums comes fromsinger Kirka, celebrat-ing his 50th birthdaywith the release ofSuuri Hetki (GrandMoment)."His latestsingleKatkera a

    viini (Bitter Wine) isalready one of our most -played, and I'm suremore tracks will be liftedoff the album," saysSuikkanen. BMG's pro-motion manager PekkaNieminen also has highhopes for the release:"Kirka is the most suc-cessful Finnish male -singer ever, having soldover a million copies ofhis albums."

    Despite major releases catering tomore traditional tastes, national CHRstation Radiomafia will be keeping aneye on emerging genres, according tohead of music Ville Vilen. "There is alot of quality material coming outfrom the dance music and hip -hopscenes, music that can do well any-where," he says.

    Definite hitAnother eagerly awaited effort istrance -act Darude's debut &fore TheStorm. "That is a definite hit inFinland, thanks to two excellent sin-gles and success abroad," Vilen says,referring to Darude's Sandstorm sin-gle which reached No.3 in the British

    charts duringthe summer.Nieminen atBMG saysthat the stormhas yet tostop: "Thingsare happeningall around,the single alsowent into theGerman top10 recently."

    Finnishlanguage rappers Fintelligens havebeen growing in popularity single bysingle, with extensive air -play espe-cially on national CHR stationRadiomafia, whose head of musicVille Vilen believes their debutRenesanssi (Renessaince): "Could beone of the biggest releases thisautumn."

    In traditional Swedish fashion, thealbum repertoire from the countrythis season is packed with solid localacts as well as exportable world classartists, only this year things lookbetter than ever.

    "This is a strong autumn, fantasticcompared to last year," says StefanGullberg MD EMI Svenska, who saysthat EMI's priorities this season willbe two debut acts. "Modern pop actStand Fast have recorded the bestalbum that's been made in Sweden inten years and I think they will also dovery well internationally," saysGullberg. Stand Fast's first single

    Carcrashes goes to radio at the end ofSeptember, and will be followed bythe duo's debut album, which was co -produced by Arnthov, who has workedwith Ronan Keating, and BradGilderman who has worked with 98°and Madonna.

    International breakEMI also has hopes for an interna-tional break -through for its otherdebut act Shimoli. "We playedShimoli's first single Damned, whichwas brilliant," says Wow 105.5'sMarcus Onnestam. "[The station is]really more guitar based, but[Shimoli's] a good cross -over act."Both Stand Fast and Shimoli will bereleased in Scandinavia before goingto the rest of Europe.

    At Zomba, Jessica Folcker's newalbum Dino is a big priority, and willbe released in Scandinavia in October,before hitting the Benelux countries

    before Christmas, and in the US andthe rest of Europe in the new year. Thefirst single To Be Able To Love isalready out on radio in Sweden.

    Top prioritiesPer Sundin, managing director atSony Music Entertainment Sweden,says that Sony's main priorities forthe season are Peter Joback and

    Higher went to number two in theSwedish sin-gles chart lastweek and thealbum will bereleased inFinland theweek after itsSwedish date,with Norwayand Denmarkexpected to fol-low beforeChristmas. Swedish -singing MagnusUggla is a local priority, but also hasa fanbase in Norway, and Sundinexpects the album to be releasedthere as well.

    Another Sony priority is Meja'ssecond album which will be releasedlater in the autumn.

    Warner's internationalexploitation manager HeleneWigren says that Dr. Bombayis back in a new guise asScottish -inspired Dr. MacDoo,and the first Macahula Dancecomes with a dance a laMacarena.

    "The album will bereleased simultaneouslythroughout Scandinavia andthe rest of Europe just after,"says Wigren. Another priorityis Tomas Andersson Wij. "Heis a wonderful artist whosings in Swedish with stronglyrics, who could possibly bereleased in Norway as well,"says Wigren.

    The hit Big Big Worldmade a name for Emilia inEurope and her second albumis a priority for Universal this

The followup single, Josephine, a more relaxed song thanthe highly emotional Supergirl, came out atthe end of August and quickly gained radioattention across Germany.     Going back to her roots is nothing new for theever evolving Madonna (pictured during an earlyincarnation). This time she has returned to herdance music roots, in addition to her coiffeur, and

    it's proved to be a good move. Music(Maverick/Warner) climbs the finalnotch this week to become the 40thNo.1 in the history of the chart.

    Eighteen years after her firstdance chart number one in theUS-Everybody (Sire)-Madonnanow has a worldwide hit and thecut features on 18 out of the 23charts that contribute to the

    European Dance Traxx (debuting in Austria andSpain this week).

    Only one track moves into the top ten. ATFCpresents Onephatdeeva's Bad Habit (Defected)jumps from 11 to seven due to heavy sales. Thisrepresents progress for the act, whose last trackIn And Out Of My Life peaked at 11 last January.

    Aussie duo Madison Avenue are in the fast laneto the top with the sophomore Who The Hell Are You(Vicious Grooves). Currently favoured in The UK,Scandinavia and the Czech Republic, a predictedhigh entry in the German sales chart should in turnsend the cut into the Traxx top ten next week.

    Italian act Floorfilla's Anthem (DFC/ExpandedMusic) series continues and becomes ever moresuccessful. Anthem #1 didn't make the Traxx 40,but #2 reached 36 at the end of last January and#3 peaked at 20 last May. The current edition,Anthem #4, soars from 33 to 15 this week. Thetrack performs well in its home market, Germanyand Austria, as well as in the Italian dance trackfriendly country of France.

    UK DJ Sonique's It Feels So Good (Serious)drops out of the chart's top ten this week.However, her new track, Sky (Serious), scores thehighest new entry at 30. The UK and tranceyNorway are the current supporters, but DJs inother territories are sure to reach for it shortly.

    Germany's act Andre Tanneberger aka ATBteams up with York on The Fields of Love (Kontor)and it looks set to enter the chart next week.Fellow German DJ Tomcraft's Silence (Kosmo) isanother contender.
