Indian banks will not have topay goods and services tax(GST) on reverse chargemechanism for facilitatingtrade for exporters orimporters through foreignbanks, if a recent ruling by anappellate tribunal is to go by.

In a ~110-crore relief to StateBank of Bikaner & Jaipur(SBBJ), now merged with StateBank of India, the DelhiCustoms, Excise Service TaxAppellate Tribunal (CESTAT)has ruled that the bank is notliable to pay the erstwhile serv-ice tax on a reverse chargemechanism. This is because itwas not the recipient of anyservice rendered by the foreignbank and no consideration waspaid by it.

The case may act as a prece-dent for other service tax andGST cases, where banks maybeen held liable to pay tax onreverse charge for merely beingfacilitators for exporters orimporters.

To facilitate trade, Indianbanks provide services toexporters by sending the exportdocuments to the bank of theimporter abroad and collectpayment. The role of the Indianbank, SBBJ in this case, is to set-tle the payment relating toexport/import of trade, forwhich it charges service tax tothe exporters. All such foreigntrade transactions have to benecessarily routed through nor-mal banking channels as is pro-vided for in the ForeignExchange ManagementRegulations.

In a 2017 order, commis-sioner of central excise andservice tax had served SBBJ ademand of ~110.84 croretowards service tax. It camewith interest and penalty for not

paying service tax on foreignbank charges under the reversecharge mechanism for the peri-od between October 2010 andMarch 2015.

The CESTAT, in its 39-pageorder, said the bank cannot besaid to be the recipient of serv-ice for the activities undertakenby the foreign banks situatedoutside India, the charges forwhich are deducted at sourceon the export bill. The appel-lant bank merely acts on behalfof the Indian exporter and facil-itates the service.

“The appellant bank, there-fore, would not be liable to payservice tax under the reversecharge mechanism,” the ordersaid.

The appellate body notedthat a similar demand for anearlier period was dropped ontwo grounds. The foreign bankdoes not transact the businessof banking in India. Therefore,it would not fall in the definitionof a banking company, whichis a pre-requisite for a service tobe covered under ‘banking andother financial services.’Secondly, the Indian bank doesnot pay any amount to the for-eign bank and, in fact, onlyplays the role of a mediatorbetween the Indian exporter

and the foreign banker, repre-senting the foreign importer.No ‘consideration’ was paid toSBBJ for the transactions.

Ranjeet Mahtani, partner,Dhruva Advisors, said that theprincipal bench of the tribunalhas settled the vexed issue ofwhether the exporter’s Indianbank is the recipient of servicesfrom the correspondent / inter-mediary foreign bank, whichco-assists in settling accountsfor an export invoice.

The judgment rendered inSBBJ’s case concludes that theIndian bank does not receivethe services, that there is noconsideration paid by it. So, itconcludes that there can be noobligation for payment of serv-ice tax on reverse charge basis.Previously, in BGR Energy’scase, the Madras High Courtconcluded that the exporter isliable to pay service tax, as it isthe recipient of services.

He added that the ratio ofthis judgment is relevant for tax-payers and banks in the GSTregime as well.

The Central Board ofIndirect Taxes and Customs(CBIC) had provided a contraryclarification that the Indianbank receives services from theoverseas correspondent bank.

As the government plans to pro-vide incentives to boost domesticmanufacturing and drastically

cut down on incoming goods, officialdata shows that India continues toimport more from almost all major tradepartners than it exports.

According to official data from theCommerce Department, India had atrade deficit with 9 of its top 10 bilateraltrade partners at the end of 2019-20, lead-ing to cumulative imports being $113 bil-lion more than exports to these nations.While this figure dropped from the $118billion registered in the previous year,deficit rose for five countries, whilefalling for the other five.

While India has maintained a com-fortable surplus of more than $17 billionwith the United States, its largest exportmarket, deficits have become deeper forall other nations. In 20019-20, the UnitedArab Emirates (UAE) was the latestentrant in the long list of nations afterNew Delhi lost its slim $341-millionexport lead. Tighter norms for diamondtrading after successive scams in the sec-tor, slipping market share for Indianapparels and lower export of refinedpetroleum to the UAE are to be blamedfor this, according to the Federation ofIndian Exports Organisations (FIEO).

The China strategy

On the other hand, imports from China’sspecial administrative region of HongKong have also increased, leading toCustoms authorities inspecting charges

of rules of origin violations by Chineseexporters. The government is focused onusing non-tariff barriers to restrict thefree flow of goods, mostly from China.

According to official sources, the gov-ernment has been gearing up to placetighter restrictions on the import of 371items — ranging from toys and plasticgoods to sports items and furniture —worth $127 billion. “A large chunk of theseoriginate in China and for those goods,we will pursue import substitution,” asenior official said. Electronics, drugs,apparels, and consumer durables fromChina are also on the list.

But there may not be an immediatehike in tariffs as the move may hit man-ufacturing in India.

Tricky trade

Goods coming from China have seenincreased tariffs as policy measures tocut down on non-essential imports havebeen gaining pace since 2018.

But the government may have amuch harder time reining in the deficitdue to bulging oil imports, most of whichcomes from Saudi Arabia and Iraq.

On the other hand, while the dis-course has been dominated bywhether India should revise its exist-ing free trade agreements or ink new,strategic ones, India’s trading fortunesdo not seem to be impacted by them.Only three of the top 10 trade partners— Singapore, Indonesia and SouthKorea — are nations with which India

has already signed a trade pact. Thelack of diversity in India’s trade rela-tions has also halted its efforts toreduce the trade deficit.

“The number of nations whichhave significant trade with India hasnot gone up as hoped. Increasing thenumber of markets for indigenousgoods and opening sourcing to a widerset of nations will help reduce tradedeficit. Much work is being done nowwith the help of Indian diplomatic mis-sions in various countries to marketIndian products,” said a seniorCommerce Department official.

Case in point, India’s $113 billion tradedeficit with its 10 top partners forms over70 per cent of its total global trade deficit.

Banks may not haveto pay service tax forfacilitating int’l trade

Consumer confidence fell to a record low lastmonth as Indians grew more pessimistic abouttheir jobs, incomes and spending, a surveyfrom the Reserve Bank of India (RBI)showed.

Sentiment had been steadily fallingsince the government imposed the world’sbiggest pandemic lockdown in late Marchand collapsed further in July to reach 53.8,the RBI said in a report on Thursday. That’s wellbelow the 100 mark, which represents the divid-ing line between pessimism and optimism.

“Consumer perception of the prevailing eco-nomic situation, employment scenario and own

income was significantly lower than that inMay,” the RBI said in the report. “Mostrespondents reported a reduction in dis-cretionary spending” and didn’t expect toincrease non-essential spending in thecoming year as well, it said. At the sametime inflation expectations of households

are rising, a separate report showed, making it dif-ficult for the RBI to cut interest rates in comingmonths to spur spending. BLOOMBERG

NCAER’s Business Confidence Index (BCI), an indicator of thebusiness sentiment across the Indian industry, stood at 46.4 inthe first quarter of 2020-21, a drop of 40.1 per cent from its lev-el of 77.4 in the previous quarter. It fell 62 per cent in the June2020 quarter on a YoY basis, according to a survey by theNational Council of Applied Economic Research (NCAER).

“This is the lowest that the BCI has ever fallen in the histo-ry of 113 Rounds of the NCAER Business Expectations Survey(BES),” the think-tank said on Friday. The decline came on theback of a 30.4 per cent QoQ fall in the BCI in April 2020. PTI

Covid-19 has brought lessons aplentyfor the world, among which is the needto quickly access and analyse macrodata. Digitised health records couldhelp collate and analyse data in a morecomprehensive and ‘real time’ mannerfor policymaking.

With this objective, the Centre hasrolled out the National Digital HealthMission (NDHM), which proposes aunique health ID for each citizen. Theannouncement is expected on August15 by the Prime Minister.

“Let’s say the NDHM getsimplemented. Imagine, then, howquickly policymakers could accessand assess data related toresponsiveness of patients to aparticular treatment. We will know inreal time, the number of patients puton any drug (for example remdesivir),how many recovered or died, the ageand gender profiles of these patients,and also how people with co-morbidities responded to treatment,”said the chief of a private hospital,who was privy to discussions for theNational Digital Health Blueprint.

This could potentially reduce thelong wait for data from clinical trialswhen a pandemic is raging andexperimental (off-label) therapies arebeing tried.

The NDHM has been planned as acomplete digital health ecosystem thatwill comprise unique health IDs(voluntary participation), digitisedpersonal health records, and a registryfor doctors, hospitals, diagnostic labs,and pharmacies. There will be four keybuilding blocks — the health ID (whichgovernment officials say will resemble aUPI ID instead of an Aadhaar-stylenumber), personal health records(PHR), Digi-Doctor, and registry forhealth facilities.

“Once the legal and regulatorystructure of e-pharmacies are finalised,they will be a part of this ecosystem,”said a senior government official. TheNDHM will not be mandatory but thegovernment feels the sheer utility ofbeing part of the ecosystem wouldensure on-boarding.

But the USP of scheme will be theimportance of consent by an individualto allow access to his PHR. “If someonewants to access my data, theorganisation or individual (registeredwith NDHM) has to seek mypermission. I will get a notification — itcould be an app notification, an OTP byway of an SMS, or an interactive voice

response,” the official explained.An individual may choose to provide

access to selective documents, or makethe access time-bound. The person mayrevoke access at any point. There will be aconcept of delegated consent for theelderly, children, or unconscious patients.

Data will be encrypted and notpulled into any central server,government officials have assured.

The National Health Authority, ledby senior bureaucrat Indu Bhushan,will be responsible for implementation.

“India being an IT powerhouse, weshould have had this long back. We aretrying to implement the NDHM asthink-big, start-small and scale-fast. Wewill start with some pilots and based onthe learnings, scale it up,” said Bhushan.He added that the major challengewould be “change management”.Hospitals and doctors are used to doingthings in a particular way.

Bharat is different. The NDHM is forevery Indian. However, he said thatthe PMJAY had electronic medicalrecords for 10 million people, and over23,000 hospitals on board. Thesecould, perhaps, be brought on boardand there could be some convergencehere in terms of facilitating or giving‘initial momentum’ to the NDHM.

With personal health records collated,patients can walk into a health facilitywithout historical documents. Diagnosisbecomes easier for a physician who nowaccess historical records. Any need for afollow-up test can be customised oravoided, if not necessary.

Hospitals will have higher inter-operability. The government will haveaccess to anonymous and macro-leveldata like immunisation, infantmortality, childbirth, and chronicdiseases like diabetes, hypertension,and nutrition that will helppolicymakers target their initiatives.

Hospitals and e-pharmacies arealso upbeat on the NDHM. Terming ita ‘progressive step’, Joy Chakraborty— chief operating officer of PDHinduja Hospital in Mumbai andchair (healthcare) of CII (west) — said:“To bring all providers andbeneficiaries on a single platform willnot only benefit them by way of earlydiagnosis — especially for long-termtreatment for chronic care — but isalso a win-win for all stakeholders.”

“Let’s say a patient arrives inemergency without health records.Doctors can easily access the medicalhistory through the unique ID,” he added.

Citizens will be in full control oftheir data, said officials. The schemeplans to achieve this through threebuilding blocks — Consent Manager,Anonymizer, and Privacy OperationsCentre (POC) — according to the finalversion of the blueprint, released by theMinistry of Health and Family Welfare.

The goal of the Consent Manager isto ensure the citizen/patient is incomplete control of the data collectedand with whom it is shared. TheAnonymizer collates matter fromhealth data sets, removes all personallyidentifiable information and providesanonymised data to the seeker.

The POC will monitor all access toprivate data, review consent artefacts,audit services for privacy compliance,and evangelise privacy principles onwhich the ecosystem will be built on.

Bhushan said there were no plans tomake it a marketplace or fee-basedservice. “We will be conservative withdata and cautious regarding use forcommercial purposes,” he added.
