Hoffman LaRoche:Thiscaseinvolvedjudicialexpansionofthediscoverydoctrine,permittingacasetobefilednineyearsaftertheonsetofinjuriesallegedtobeattributedtouseofaprescriptiondrug.MSNJurgedthecourtnottofurtherexpandthetwo-yearstatuteoflimitationsonpersonalinjuriesbeyondareasonableinterpretationofwhenthepatientknewofshouldhaveknownthattheinjurieswererelatedtouseofthedrug.TheNewJerseySupremeCourtallowedthecasetogoforward.• Nicholas v. Mynster (pending):Thiscasereviewsalowercourtdecisionallowingamedicalmalpracticecasetogoforwardeventhoughtheplaintiffdidnothaveanexpertfromthe“samespecialty”availabletotestifytotheappropriatestandardofcare.MSNJurgesthehighcourttoapplytheexperttestimonystatuteaswritten,requiringamatchoftheboardcertifications.

Class Action Cases against Aetna & CIGNA on UCR Fees:

ThesecasesarependingintheUSDistrictCourtinNewark.MSNJisaplaintiffseekingdamagesforphysicianswhowereunderpaidforcarerenderedtopatientswithout-of-

networkbenefits.Thefeesweretobepaidattheusual,customary,andreasonable(UCR)rates,butwerepaidlessthanUCRbasedontheuseoftheIngenixdatabasewhichwasfoundinotherlegalforumstobeflawed.

Enforcement of National Class-Action Settlement Agreement against Horizon:

ThissettlementagreementterminatedinMayof2012.MSNJassistedmemberswithindividualcompliancedisputesandalsofiledcompliancedisputesonbehalfofourmembersoverthecourseofthefouryearcomplianceperiodwhichresultedinpaymentsofhundredsofthousandsofdollarstophysicians.Twocompliancedisputesarepending.BothinvolvecorrectinterpretationandpaymentunderCPTguidelines.

Advocacy for Physicians Treating Medicare Patients Under New Payment Models:

MSNJprovidededucationandresourcestophysiciansontheMedicareSharedSavings-ACO-ruleandonothercareintegrationmodelsthrough:

• ACollaborationandForumwiththeNewJerseyHospitalAssociationandHorizonHealthcareInnovations,featuringnationalandstateexpertsonhealthcaredeliveryandcarecoordinationmodels

• IndependentlegalreviewanddiscussionofACOagreementswithhospitalmedicalstaffs

• Seminars
