    Article IPurpose and Scope

    The purpose and scope of the Honor Code of the Dr TJ Owens Gilroy Early College Academy atGavilan College shall be

    To foster an atmosphere of mutual trust and interdependence among students! faculty! andparents"

    To encourage both individual self#respect and the appreciation of! and respect for! diversity

    within both the Early College and Gavilan communities To promote honesty! integrity! and individual human dignity among the student body"

    To reinforce the ongoing commitment of the Early College Academy to rigor! achievement!

    and e$cellence in all academic areas"

    Each student! upon acceptance to the Early College Academy! and! by virtue of that acceptance!shall automatically ascribe to the following

    The Honor Code of the Dr. TJ Owens Gilroy Early Collee Acade!y at Ga"ilan Collee

    "As a responsible member of the student body of the Early College Academy, I realize thateverything I do and say must be above reproach. I will be honest with myself and with others,and I will practice appreciation of, and respect for, diversity within both the Early College andGavilan communities. I will refrain from all acts of dishonesty and intolerance, and I will notaccept those acts from others. I will practice citizenship by actively encouraging my fellowstudents to follow the highest standards of both personal integrity and academic ecellence.In addition, I will care for my character as much as, if not more than, academics.

    I recognize that attending the Early College Academy is a privilege not to be ta!en lightly, andthat we, as a school family, are guests of Gavilan College, and that I must, therefore, conductmyself appropriately at all times and in all situations.

    I understand that my enrollment at the Early College Academy gives epressed, and implied,consent to be governed by the onor Code of the Early College Academy. I, and my

    parents#guardians, formally ac!nowledge our assent by my acceptance into, and attendanceat, the Early College Academy. I also understand that, should I be accused of any onorCode violation, I will be eamined by the onor $ribunal, will be allowed a fair trial in whichthe $ribunal will hear testimony both for and against my case, and will be presumed to beinnocent of any violation until the $ribunal either determines guilt or confirms my innocence.If found guilty of a violation, I understand that I will be sub%ect to disciplinary action, up to,and including, removal from the Early College Academy program."

    The Chief Justice of the GECA Honor Tribunal shall be a member of the 0enior Cohort of the EarlyCollege Academy! shall be appointed by the 'rincipal and )aculty Advisor! and shall preside over allmeetings and deliberations of the Tribunal" *n the absence of the Chief Justice! the )aculty Advisorand(or 'rincipal shall appoint one 273 of the 0enior Cohort Associate Justices to assume the interimduties of that position"

    A sitting Associate Justice may be re#seated at the discretion of the incoming Chief Justice and with

    the approval of the )aculty Advisor and 'rincipal" Each member of the Tribunal is permanent unlesshe or she chooses to resign at the end of the school year or if he or she is removed from Tribunal"

    Each of the voting members shall have an e,ual vote in the proceedings of the Tribunal" Thedecisions of the GECA Tribunal shall be by ma-ority vote in ,uorum! or by situational pluralities"// Alldecisions receive automatic Judicial 6eview by the 'rincipal" At his or her sole discretion! the GECA'rincipal may accept! modify! remand! or set aside the Tribunal decision after hearing the reasoningof Tribunal" 0aid decision shall be binding on all parties"

    Article $Tri#unal Sessions and Procedures

    To proceed in bringing forward a student before the Honor Tribunal! one must full out a Tribunal6efferral" A Tribunal 6eferral may be issued by any member of the Administrative 0taff or )aculty ofthe Early College Academy! or by any member of the GECA 0tudent .ody" The Tribunal 6eferral

    shall be presented! using the GECA Tribunal 6eferral )orm available in the GECA main office 2'.#783! to a member of Tribunal! the )aculty Advisor or 'rincipal who shall then forward the Tribunal6eferral to the Attorney General" The AG will present his(her findings to the Chief Justice! who! aftere$amining the evidence! will then! if warranted! issue a 'rovisional Honor Code 1iolation 2'HC13!place the case on the -udicial doc%et for an upcoming Tribunal session! and direct the AG to issue a0ummons to Appear 20A3 to the student or students involved"

    Tribunal sessions shall meet all of the following criteria

    9hen situations arise! Tribunal sessions shall be held at the discretion of the Chief Justice"

    Time shall be considered to be :of the essence: in the scheduling of said sessions"

    All matters not brought to final resolution by the Tribunal during a session shall automatically

    be resumed during the ne$t Tribunal session" *nvited witnesses may be allowed to presentoral and(or written testimony as re,uired during the Tribunal session! but shall not be presentduring either Tribunal voting or deliberation prior to voting"

    Other than members of the Tribunal! invited witnesses! and guests of the 'rincipal()aculty

    Advisor! the proceedings of the Tribunal shall be confidential"

    0tudents accused of an Honor Code 1iolation shall have the right to hear and respond to the

    testimony presented by witnesses or evidence presented by the GECA Attorney General"

    *nterested parties may present written amicus curiae briefs regarding any scheduled

    deliberation regular or emergency" The Chief Justice! at his or her sole discretion! may allowverbal presentation of such a brief to the Tribunal"

    *n the case of a tie vote by the Tribunal! the tie shall be bro%en by the vote of the Chief

    Justice" *f the Chief Justice abstains from voting and no decision can be reached! the casewill be dismissed"

    Tribunal cases will be conducted in the following manner

    6ecorder calls role of all present Tribunal members

    An Associate Justice reads the Honor Code

    Attorney General presents the case

    Teachers(faculty and witnesses present their accounts of the situation

    The accused presents his or her account

    Chief Justice opens ,uestioning to Tribunal

    Chief Justice as%s for final statements from any present parties

    Chief Justice closes the case and dismisses the student at issue and faculty member2s3

    *n the process of deliberation! the Tribunal shall consider all relevant factors of the situation!including! but not limited to! the seriousness of the violation! the intent of the accused in committingthe violation! and other Honor Code violations within the student;s attendance at GECA" Afterdeliberation by the Tribunal! if an Honor Code 1iolation is assessed! the recommended disciplinaryaction shall be forward to the 'rincipal for Judicial 6eview" .ecause of their potential for seriousconse,uence! certain disciplinary events may be immediately referred to the 'rincipal! who may

    choose to either act independently in his(her capacity as 'rincipal or refer the matter to the fullTribunal for deliberation" *f the matter is referred to the full Tribunal! the process of deliberation shallbe as described above"

    Decisions of the Tribunal! upon Judicial 6eview by the 'rincipal! shall be delivered in a timelymanner and in person to the GECA student at issue by the Attorney General! or! in his(her absence!by an Associate Justice of the Tribunal as assigned by the Chief Justice" 0uch decisions shall beeffective immediately upon delivery to said GECA student" A written confirmation of the Tribunal&sdecision shall be prepared on GECA stationary by the 6ecorder of the Tribunal for delivery by mail tothe GECA student;s parents(guardians" This letter shall bear the concurring signatures of the ChiefJustice! the )aculty Advisor! and the 'rincipal"

    A#sences and Tardies&0tudents are given great freedom at the Early College Academy! but withthat freedom comes an e,ual measure of responsibility" Attendance is a critical aspect of learning!and a crucial part of the student;s academic success # especially at GECA" GECA students aree$pected to be in their assigned and enrolled college classes! Academic 0eminars! and(or GECAclasses on a regular and timely basis"There are two categories of absences! :E$cused: and :=ne$cused:"

    :E$cused: absences are those absences for which your parents have made either verbal orwritten contact with the GECA office! indicating their %nowledge of! and approval for! thereason for your absence" This includes medical! probation! counselor! funeral! or D>1related matters" >a%e#up wor% for :E$cused: absences may be handed in for full credit on aone#for#one basis? i"e"? *f you are absent for one day! then you have one # and only one #school day to complete and hand#in the ma%e#up wor%" At their sole discretion, #ECAinstructors may allow additional time for $Ecused$ absence ma%e&up wor%"

    :=ne$cused: absences are defined as any absence other than :E$cused:! and! in

    accordance with Gilroy =nified 0chool District policies may result in the e$tremely seriousmatter of you being declared truant! which is a violation of California state law" Any'(necused$ absence will result in an Honor Code violation and no ma%e&up wor% will beallowed, ecept at the discretion of the teacher"

    Tardiness is defined as any lateness to any class period # whether :E$cused: or :=ne$cused:"Tardiness results in disrupted and unproductive class time! and is unfair to fellow students" 0tudentsare considered tardy to class if they are not physically present in the classroom! in their assignedseat! when the class is called to order" *f a Gavilan instructor is not present in a college class within@ minutes of the scheduled start time or if he(she releases the class early! each student must reportto the GECA office"

    There are two types of Tardies :E$cused: and :=ne$cused:"

    :E$cused: tardies are defined as lateness e$cused by either written(verbal notification from

    the GECA office or written(verbal notification from a GECA faculty member"

    :=ne$cused: tardies are defined as any other lateness! for any other reason" Three 2B3

    :=ne$cused: tardies to any class automatically e,ual one 273 :=ne$cused: absence! and anHonor Code 1iolation will be issued by the instructor"

    Off %i!its Areas&Any area not considered to be part of the Gavilan College campus is consideredto be :Off through BB '> daily 2e$cept for short#scheduled )ridays3? however! =pper Classmen noton Academic 'robation may be sub-ected to =nscheduled first or last periods where they are notre,uired to be on campus and(or are allowed to be in the 0tudent Center" As with all GECAstudents! every high school and college class must be attended on a timely basis" Failure to adhereto these restrictions will result in an Honor Code violation"

    Other Early Collee Acade!y) Ga"ilan Collee) and Gilroy 'nified School District *ules and*e+uire!ents&GECA students are responsible to be familiar! and to comply fully! with all of theEarly College Academy! Gavilan College! and Gilroy =nified 0chool District rules and re,uirements"Failure to do so may result in an Honor Code violation, and potential suspension, reassignment to ahome area high school, and/or recommendation for epulsion" Any action incompliant with the 0i$'illars of Character Counts will result in an Honor Code 1iolation"

    Article $IIDisciplinary Options

    =pon the GECA Tribunal&s finding of guilt based on the evidence presented at a Tribunal session!and(or upon admission of guilt by the accused to either the 'rincipal or the assembled GECATribunal! the Tribunal will recommend disciplinary action to the 'rincipal! who will conduct a Judicial

    6eview of the case"

    The following are e$amples! but not an inclusive list! of disciplinary options available to the Tribunal"Discipline options may be combined and(or modified at the discretion of the Tribunal"

    A phone call from the 'rincipal to the parent2s3(guardian2s3 prior to the sending of an Honor

    Code violation letter of notification! which is mailed to the student&s home

    A conference held by the 'rincipal with the student and! if necessary or desirable! the

    student&s parents and(or the teacher2s3 involved )or plagiarism convictions! blatant plagiarism may result in recommendation for removal

    from the GECA program 0uspension! in or out of school" 2

    All -udicial opinions rendered by the Tribunal are automatically sub-ect to review by the GECA'rincipal! who maintains absolute and sole discretionary authority to accept! modify! re-ect! orremand the suggested -udicial action after hearing the reasoning of the Tribunal"

    At his(her sole discretion! the 'rincipal may do any of the following Affirm the decision of the Tribunal as delivered
