News of the coming Circus Festival was relayed to CR by Ivan Vladivirov, of the Romanovi Troupe on Ringling's Blue Unit. The Romanovis, who came from Europe with the reputation of being the best, have improved their position and are anticipating an opportunity to prove this fact at the Moscow event. Ever since their initial appearance in Tel Aviv in 1965, the group has brought new di- mensions into bareback acrobatics, adding teeterboards and trampoline and inventing a forearm board which catapults the topmount ers into double and double-twist somersaults to paired horses. eral knowledge that Moscow will host the World Circus Festival in 1980.

10QO/Q PROOFHuman cannonball Mary Connors did a strip-tease in mid-flight thus proving to skeptics thatshe is a woman. The 22 year old British circusperformer normally does her act dressed in apadded abestos suit.

Early in the year businessman David Cobboldclaimed the cannonball was a man and thenplaced a bet to that effect.

For her special performance Miss Connors worea helmet, dress and calf-length boots. She tookher dress off just before sliding into the cannonand shortly after she was fired into the air sheshed her bra, landing topless in the safety net.

"We're convinced. She provided a very pow-erful argument," said Cobbold as hi- handedover the money.

Off-hand, you wouldn't think being shot from acannon before the grandstand at a count> fairwould qualify as an act of privacy, shielded,from publicity. Yet, the famed "Human Can-nonball" himself, Hugo Zacchini. is makingjust such a claim in I S. Supreme Court.

On Aug. 30. 1972, Zacchini. had been hired toperform at the Geauga County Pair in Burton.Ohio. There he noticed a TV reporter from aCleveland station and asked him not to film th«>performance. However, the next day a cameracrew did film it. A 15-second clip was shown onSept. 1st on the 11 p.m. newscast.

Contending that the TV station had appro-priated his talent for its own use. Zacchini suedfor invasion of privacy. The trial judge dismissedZacchini's complaint, on a motion by the own-ers of the TV station. However, an intermed-iate state appeals court reversed, contendingthere was an arguable question over conver-sion and copyright (the act of one person con-verting another's property to his own use wi th-out the original owner's consent.).

Ohio's Supreme Court held that a public per-formance at a county fair is a matter of legiti-mate public interest iust as the courts have heldthe opening of a neu play to be.

The court was sympathetic to Zacchini's claim,but said the proper standard that a court mustapply, in judging restrictions on news, is whe-ther the matters reported arc of puh l i r interest

A news media might be liable for appropriatinga performer's right of publicity only if its in-tent was not to report, but to appropriate theperformance for some other private use or ifthe actual intent was to injure the performer,the state justices declared.

Justice Anthony L. Celebreeze dissented. Hecontended that there were many issues thatshould be resolved at trial and he favored send-ing the cast- back to the trial court. He said "itis now largely beyond dispute that an individ-ual, such as Zacchini," prominent in the enter-tainment or competitive a thle t ic businesses,has a valuable property r ight in his or her name,photograph or performance and that right maybe sold

If the justices decide to review the issue, theyprobably would do so dur ing a session of (hecourt in the rommt w i n t e r or spring.

New RulesThe U. S. Dept. of Agriculture ( l 'SI)A) ha*proposed new health certification by foreignnations for commercial export of exolic birdsto the U. S.

The new rules would require that foreigngovernment veterinarians certify that (l)-allbirds in each shipment had been in thecountry1 of export for the preceding 90 days,(2)-that they had been isolated from otherbirds for 30 days before export in facilitiessupervised by veterinary officials.

The new action is a means of reducing thepossibility of importing birds that have beenexposed to communicable diseases beforeshipment, or if exposed, would provide timefor latent infection to become evident.

Seven out of 68 lots of birds offered for en-try into the U. S. during April, May andJune of 1976 were refused because of di-seases discovered during the mandatory 30

He's FinedA Mt. Orab, Ohio, horse trainer has been fined$500 as a civil penalty to settle charges that heviolated the Horse Protection Act, according tothe U. S. Dept. of Agriculture.

Paul Whitehead had been charged with viola-tions at two horse shows with his TennesseeWalking Horse named "Ebony's Moonshot."The violations were said to have occurred onAug. 27,1973, at the Celebration in Shelby-ville, Tenn., and on Oct. 11, 1974 at a Cele-bration at Columbus, Ohio.Mr. Whitehead settled the charges under anadministrative procedure that permits him toneither deny nor admit guilt. A federal judgeimposed the Tine of $250 on each count ofviolation.

MRS BRYAN (Billie) WOODS (77) died at anursing home in Independence, Mo., on Nov.10th. She and her late husband spent most oftheir lives in show business, traveling w i t h theWortham Shows, Al G. Barnes and Kay Bros,circuses. For several years they had their ownshow "Bryan Bros. Circus" on the road Theyretired in 1953 and then operated a KiddielandPark in Orange, Texas. Two sisters survive.
