Box 201401 Chief Deputy Attorney General Helena, MT 59620-1401 May 31, 2019 My Fellow Montanans: It’s been said that statistics are human beings with the tears wiped away. While the pages that follow are full of data that is both insightful and alarming at times, there’s no yardstick with which to measure the cost of lives lost to impaired driving. Too many Montana families have grieved the loss of a beloved son or daughter killed driving home from a party that involved drugs or alcohol. Too many Montana businesses have struggled to stay viable when valued employees are injured or killed in crashes stemming from substance abuse. Montana has consistently ranked among the worst states for per-capita DUI deaths. Since 2011, more than 850 people have died on our roads because of drivers impaired by alcohol or drugs. Each day, the men and women of the Montana Highway Patrol fight diligently to combat the biggest danger on our roadways, and I’m proud of their long-standing dedication to public safety. During the recent legislative session, my office made some meaningful strides in fighting substance abuse in our state. For example, my bill to increase access to drug treatment courts is now law. HB 654, carried by Zach Brown, ensures better access to these specialized courts, an essential component to tackling opioid addiction and substance abuse in general. For many in the criminal justice system, treatment courts are a more effective, cheaper alternative to incarceration. Additionally, my bill to fight opioid addiction is now law. HB 86, sponsored by Vince Ricci, requires patients to present a photo ID to fill a prescription of a controlled substance at Montana pharmacies starting October 1. Beginning that same day, opioid-naïve individuals — those who haven’t been prescribed an opioid in 90 days — won’t receive more than a one-week supply of a prescribed opioid, with some exceptions for certain patients. And starting July 1, 2021, with some exceptions, including hospice patients, physicians will be required to consult their patient’s history in Montana’s Prescription Drug Registry before prescribing them an opioid or benzodiazepine. As a life-long Montanan, I’m proud to call this place home. But clearly, it’s time for a wake-up call when it comes to our DUI problem. Unfortunately, some Montanans are still in denial. Nowhere is that more evident than in the halls of the state legislature, where every attempt to strengthen our DUI laws has been an uphill battle. I’ve been fighting that battle for more than six years, and I will continue to do so. We can’t give up. This is our home, these are our roads, and the blood spilled upon them because of DUIs belongs to our loved ones. Sincerely,

I respectfully submit to you and the citizens of Montana, the Montana Highway Patrol Annual Report. This report contains information and statistics concerning Montana Highway Patrol activities and Montana crashes for the 2018 calendar year.
The many employees, uniformed and civilian, of the Montana Highway Patrol take pride in serving the citizens of this state as well as the tourists and travelers traveling to and through our state. We hold our mission of safeguarding the lives, and constitutional rights of people traveling the ways of our state to the highest standard. The Montana Highway Patrol addresses highway traffic safety in three main areas: Enforcement, Education, and Highway Engineering, with all Montana Highway Patrol employees contributing toward our mission.
Although this report is filled with a myriad of statistics and data, some of the most important data deals with fatal crashes, overall crashes, and enforcement in critical crash contributing areas. In 2018, 182 people lost their lives on Montana roadways as a result of vehicle crashes. While this number is viewed by our agency and me as unacceptable, we continue to see a downward trend in traffic fatalities over the last four years and we will continue to work diligently to continue this trend. 2018 data suggests “Driving Under the Influence” as a serious contributing circumstance in fatal crashes. Other major contributing factors in fatal crashes include: “Reckless Driving,” “Inattentive Driving,” and “Driving Too Fast for Conditions.” The Montana Highway Patrol sees these critical areas as a high priority for enforcement and going forward, these enforcement areas will continue to be targeted.
As for all crashes, “Inattentive Driving” is the leading contributing circumstance. Unbuckled vehicle occupants continue to be a major factor in injury severity and always remain a high priority for enforcement and education.
The Montana Highway Patrol Safety Enforcement Traffic Team (SETT) continues to do incredible work to curb crashes and injuries on our roadways.
The Montana Highway Patrol continues to build our Drug Enforcement program. We recognize the high importance of our role in battling the drug crisis in our state, and we continue to allocate resources in this area. Over the past five years we have seen a disturbingly steady trend in increased contact with, and seizures of illegal substances on our roadways, and we remain committed to this fight.
Attorney General Fox, I would like to thank you for your continued support, and I wish to thank all the men and women of the Montana Highway Patrol for their dedicated service in protecting our roads and way of life in this great state. We will continue to serve the people of this state with Service, Integrity, and Respect.

SAFETY ENFORCEMENT TRAFFIC TEAM (SETT)

Andrew Novak Trooper Luke Burson Trooper Charles Burton Trooper Stephen Gaston Trooper Blaine Heavner Trooper Tyler Swartz In 2013 the name for the STET team of the Montana Highway Patrol was changed to Safety Enforcement Traffic Team (SETT). Funded by the Department of Transportation, Highway Traffic Safety Division, this team of troops consists of 5 full-time troopers and 1 sergeant. The SETT team provides high visibility enforcement to selected areas and regions of the state using strategically deployed, aggressive, inter-agency enforcement patrols. The team bolsters high visibility enforcement efforts to educate the public about a variety of behaviors that contribute to traffic crashes, including the dangers of speeding, impaired driving, aggressive driving, distracted/inattentive driving, and the lack of safety belt usage. SETT enforcement has had a very positive effect on the areas patrolled, the hours of concentrated enforcement during fiscal year 2018 yielded:

MHP DRUG INTERDICATION ACTIVITIES
In 2012, the Montana Highway Patrol purchased their first K-9 for assistance in foot pursuits and drug interdiction activities. Since then the MHP has acquired a total of 8 K-9’s stationed at various locations throughout Montana. These dogs are used in drug interdiction activities not only by the Highway Patrol but also to assist other law enforcement agencies throughout the state. With the help of these K-9’s and through the dedicated work of all troopers the following statistics and information has been generated:
