Gracious and loving God, in this moment of quietness, we pause not toescape the realities of our day, but instead to acknowledge that being "one nationunder God" is part of the fabric of our society. Therefore, we humbly invite youto guide and instruct us as we navigate our way through the waters of life.

Faithful Lord, on this Memorial Day, we would be remiss if we did not liftup to you the many men and women who have served and are serving in ourmilitary. Lord, we give you thanks for their zeal for service as well as theirincredible sacrifice. Undoubtedly, their sacrifice is costly—families have beenseparated, childhoods shortened, and countless lives have been lost. And yet,their costly sacrifice has resulted in a priceless gift of freedom that stirs our hearts

to joyfully proclaim, "My country, ’tis of the, sweet land of liberty." Therefore,loving God, we ask that you will continue to pour out your peace that surpassesall human understanding on all those who serve our state and our country, andalso comfort those who continue to grieve the loss of loved ones.

Dear God, as these servants gather here today as the Texas House ofRepresentatives, we pray that they may live securely in your grace; that they maybe guided by your providence; that they will be filled with your wisdom andstrength; and most of all, that they, even in the midst of differing opinions, willembody the humility of the one who did not cling to his position of power, buthumbled himself to serve the poor, the oppressed, and the hopeless. May they usetheir authority to promote the general welfare of all of us who call the great Stateof Texas home.

Lord, we humbly call upon your name to heal where there is brokenness; tocomfort where there is pain; to bring reconciliation where there is separation; toprovide peace where there is anxiety; to stir up courage where there is fear; andmost of all, to rain your grace down upon all who are gathered here this day, thatthey may be filled with your joy to be the people you have called them to be.

Now, Lord God, may you relentlessly bother us and challenge us; may youset an impossible task before us and dare us to meet it; may you give us strengthand courage to do our best; open our eyes that we may see; give us ears to listenfor your will and discipline to do it; and remind us that it is not how many breathswe take, but the moments that take our breath away. Indeed, we are "one nationunder God." In the name of the one who is "the way, the truth, and the life," wepray. Amen.

The speaker recognized Representative Hunter who led the house in thepledges of allegiance to the United States and Texas flags.

(1)iithe number of times an unmanned aircraft was used, organized bydate, time, location, and the types of incidents and types of justification for theuse;

(2)iithe number of criminal investigations aided by the use of anunmanned aircraft and a description of how the unmanned aircraft aided eachinvestigation;

(3)iithe number of times an unmanned aircraft was used for a lawenforcement operation other than a criminal investigation, the dates and locationsof those operations, and a description of how the unmanned aircraft aided eachoperation;

(4)iithe type of information collected on an individual, residence,property, or area that was not the subject of a law enforcement operation and thefrequency of the collection of this information; and

(5)iithe total cost of acquiring, maintaining, repairing, and operating orotherwise using each unmanned aircraft for the preceding 24 months.

SCR 48 - POINT OF ORDER DISPOSITION

The chair sustained the point of order and submitted the followingstatement:

Representative Simpson raised a point of order against further considerationof SCRi48 under Rule 8, Section 13(f) and Rule 10, Section 8 of the HouseRules. Representative Simpson asserts that the resolution is not a correctiveresolution because it would add substantive provisions to SBi1678 and is,therefore, not in order. The point of order is sustained.

SBi1678 contains provisions governing events and expenses related to theMajor Events Trust Fund; it does not contain provisions that alter the definition ofa "site selection organization." SCRi48 provides for the addition of a new sectionof text in the bill that would add "ESPN or an affiliate" and "the NationalAssociation for Stock Car Auto Racing (NASCAR)" to the definition of a "siteselection organization." Rule 8, Section 13(f) of the House Rules provides: "Novote shall be taken upon the passage of any bill or resolution within 24 hours ofthe final adjournment of a regular session unless it be to reconsider the bill orresolution to make corrections, or to adopt a corrective resolution." Thecorrections permitted by this provision, and referenced in Rule 10, Section 8 ofthe House Rules, include corrections such as remedying accidental deletion oftext or typographical errors usually caused by the rush of activity that occurs asdrafters and others are meeting end of session deadlines.

Although these technical corrections can sometimes impact the substance ofa bill, the rule does not permit the wholesale addition of a new section of text thatwas never in disagreement, unless it is uncontroverted that the addition of suchtext is essential to the purpose of the bill. Representative Simpson argues that theaddition of this text is not essential to the bill ’s purpose of changing therequirements for eligible events to be funded, prohibiting certain disbursements,and providing for the comptroller to gather information about funded events. Thechair notes that the changes proposed in the corrective resolution did not appearin any version of the bill, from the time it was filed on March 8 through when itwas adopted. Nor did anyone introduce an amendment—in committee or on thefloor—of either chamber to add the language proposed by the resolution. Then,when the bill was sent to conference committee, the conferees, who wereappointed in the senate on May 22 and in the house on May 23, did not seek toadd the text proposed by the resolution, and instead, the conferees weredischarged on Mayi25, and the bill was adopted without evidence that addingESPN and NASCAR to the definition of a site selection organization was vital tothe purpose of the bill. Thus, the proponents of SCRi48 did not take advantage ofprior opportunities to remedy the omission of the amendment the resolutionproposes. Because SCRi48 sought to add an entirely new substantive provisionto the bill, it was not a technical correction within the meaning of Rule 8, Section13(f) and Rule 10, Section 8 of the House Rules, and was, therefore, out of order.

The ruling precluded further consideration of SCRi48.

RESOLVED by the 83rd Legislature of the State of Texas, That the enrollingclerk of the house of representatives be instructed to correct HBi5 as follows:

(1)iiIn SECTION 16 of the bill, in amended Section 28.025(c-3), EducationCode, strike "(c-2)(1)(B)" and substitute "(c-2)(1)(B)(ii)".

(2)iiIn SECTION 77 of the bill, strike added Section 130.008(f) andsubstitute the following:

(f)iiExcept as provided by this section, a student may not enroll in more thanthree courses under this section at a junior college if the junior college does nothave a service area that includes the student ’s high school. A student enrolled atan early college high school may enroll in a greater number of courses to theextent approved by the commissioner of education.

HCR 224 - POINT OF ORDER

Representative Herrero raised a point of order against further considerationof HCR 224 under Rule 10, Section 8 of the House Rules.

The speaker overruled the point of order and submitted the followingstatement:

Representative Herrero raised a point of order against further considerationof HCRi224 under Rule 10, Section 8 of the House Rules, asserting that theamendments proposed by the corrective resolution are not technical corrections.(See also Rule 8, Section 13(f) of the House Rules, prohibiting consideration ofmeasures other than for the purpose of making corrections.) Specifically,Representative Herrero argues that the addition of Subsection (f) in Section 77 ofthe bill is a substantive addition to HBi5 rather than a correction. The point oforder is respectfully overruled.

HCRi224 rewrites Subsection (f), which, in the bill, provided that "a studentdescribed by Subsection (a) may enroll in not more than three courses eachschool year offered as provided by this section." Rather than referring toSubsection (a), the rewrite provided in HCRi224 describes the students eligiblefor enrollment and includes an exception allowing that a student enrolled at anearly college high school can enroll in more than three courses to the extentapproved by the commissioner of education. These changes clarify the meaningand intent of Subsection (f) without changing its purpose. Accordingly, theresolution does not violate Rule 10, Section 8 or Rule 8, Section 13(f) of theHouse Rules.

HCR 224 - STATEMENT OF LEGISLATIVE INTENT

REPRESENTATIVE AYCOCK:iiMembers, this makes clear the intent of the billas we spoke yesterday. Those of you who had the little wiring diagram, youremember we intended for one and one science only to be opted out—in the finearts folks––where they could opt out of one science and replace that with one

course related to the fine arts endorsements. There were some questions thatarose earlier today that might be interpreted the way it was written by saying thatthere might be an opt-out for all three science courses. That was never the intent,and that ’s the first section of the bill.

The second section relates to the intent of the bill––that it allows three andonly three courses to be used for early college high school that were provided bycommunity colleges that were outside the service area. There was a questionabout that language, because they can presently receive any number from withinthe service area, and this allows them to go outside the service area for threecourses. And we wanted to be sure that there was clarity in that language as well,because there was some discussion. As it was written, some people felt like theycould go all the way to infinite and all the way to zero, and we wanted to be surethe intent of the bill––to the best of our ability––was that they ’d be able to getthree from outside the service area that they reside in.
