1.0 INTRODUCTION

This document is an Incorporated Document in the Cardinia, Casey, Greater Dandenong, Monash and Stonnington Planning Schemes pursuant to section 6(2)(j) of the Planning and Environment Act 1987.

The land identified in Clause 3.0 of this document may be used and developed in accordance with the specific control in Clause 4.0 of this document.

The control in this document prevails over any contrary or inconsistent provision in the Cardinia, Casey, Greater Dandenong, Monash and Stonnington Planning Schemes.

2.0 PURPOSE

The purpose of the control in this document is to allow the use and development of land described in Clause 3.0 of this document for the purposes of the Monash Freeway Upgrade Project (Stage 2) (‘the Project’).

3.0 LAND

The control in this document applies to land marked as SCO1 on Cardinia Planning Scheme Maps 11SCO, 12SCO, 14SCO, 16SCO; Casey Planning Scheme Maps 8SCO, 9SCO, 12SCO, 13SCO; Greater Dandenong Planning Scheme Map 2SCO; Monash Planning Scheme Maps 7SCO, 8SCO, 9SCO, 15SCO, 16SCO, 22SCO, 23SCO; and Stonnington Planning Scheme Map 10SCO.

The land is also identified in this incorporated document as:

Project Area Land for land coloured blue in Appendix 1. Wider Project Area Land for land coloured yellow in Appendix 1.

4.0 CONTROL

4.1 Exemption from Planning Scheme Requirements

Despite any provision to the contrary or any inconsistent provision in the Cardinia, Casey, Greater Dandenong, Monash and Stonnington Planning Schemes, no planning permit is required for, and no planning provision in those planning schemes operates to prohibit, restrict, or regulate the use and development of the land described in Clause 3.0 of this document for the purposes of the Project.

Use and development of the Project Area Land for the Project includes, but is not limited to the following:

a) Roadworks including widening and duplication, collector-distributor arrangements, new freeway entry and exitramp connections, signalised intersection upgrades, bridges widening or modification, shared off-roadpedestrian and bicycle paths, bus stops and associated infrastructure, safety barriers, bridge strengthening,bridge pier/abutment protection, retaining structures, pavement rehabilitation and new pavement, line marking,pedestrian crossings (at grade, overpasses and underpasses), upgrade to existing and new noise walls,freeway and street lighting, drainage, landscaping, Lane Use Management System and Variable MessageSigns, road directional and road information signage and gantries, ramp metering, vehicle detection and CCTV,increased ramp storage, associated structures, earthworks, drainage, cuttings, batters and fill.

b) Creating or altering access to roads, including roads in a Road Zone Category 1 or land in a Public AcquisitionOverlay if the purpose of acquisition is for a Category 1 road.

Use and development of all land described within Clause 3.0 for the Project includes ancillary activities including but not limited to:

a) Creating and using lay down areas for construction purposes.b) Stockpiling of excavation materials.

c) Constructing and using temporary site workshops and storage administration and amenities buildings.d) Displaying direction, construction and temporary business identification signs.e) Construction of scaffolding, working platforms and provision of pedestrian access to the construction site.f) Remove, destroy or lop vegetation, including dead native vegetation.g) Demolishing and removing buildings and works.h) Constructing fences.i) Relocating, modifying, upgrading and installing services and utilities.j) Constructing and using temporary access roads, diversion road and vehicle parking areas.k) Constructing fences, temporary site barriers and site security.l) Constructing or carrying out works to create or alter roads, car parking areas, bunds, mounds, landscaping,

excavations, shared use paths, wetlands, excavate land and salvage artefacts and alter drainage.m) Earthworks including cutting and spoil removal, and formation of drainage works.n) Subdividing and consolidating land.o) Creating, varying and removing easements resulting from works required for the Project.p) Restoration and reinstatement works.

The Project may proceed in stages. Each stage must comply with the conditions in Clause 4.2 of this document.

4.2 Conditions

The use and development permitted by this document must be undertaken in accordance with the following conditions:

Native Vegetation

4.2.1 To offset the removal of native vegetation associated with the Project, an offset that meets the offset requirements described in the Native vegetation removal report (Report ID BIO_2018_102) must be secured in accordance with the offset statement.

If detailed design results in a revised area of impact, an updated Native vegetation removal report detailing revised offset requirements, with an updated offset statement must be provided to Deputy Secretary, Planning, DELWP for approval.

4.2.2 Evidence of the secured offset must be in accordance with the Guidelines for the removal, destruction or lopping of native vegetation (DELWP, 2017) and be provided to the Deputy Secretary, Planning, DELWP prior to native vegetation removal.

4.2.3 In exceptional circumstances, the timing of offset security may be varied and specified in the updated offset statement or reviewed on application to the Deputy Secretary, Planning, DELWP.

Floodplain Management

4.2.4 Building and works on land within the Urban Floodway Zone, Floodway Overlay, Land Subject to Inundation Overlay and Special Building Overlay must be undertaken to the satisfaction of the relevant floodplain management authority.

Environmental Management

4.2.5 Prior to the commencement of any works associated with the Project, an Environmental Management Plan, or equivalent i.e. Project Environment Protection Strategy, must be prepared in consultation with the relevant councils and to the satisfaction of the Minister for Planning.

The Document must include:

The approvals, consents and related statutory instruments that will underpin environmentalmanagement for the Project.

The applicable environment management framework/system including the organisational accountabilities and responsibilities assigned to the Project.

The environmental management measures required to address key environment risks and issues. The environmental performance objectives and indicators for guiding management actions. The processes for monitoring, reporting, auditing and evaluating performance and environmental

outcomes, as well as revising management measures.

Tree Reserves

4.2.6 Where, but for this incorporated document, a planning permit would be required pursuant to Clause 52.29 (Land Adjacent to a Road Zone, Category 1, or a Public Acquisition Overlay for a Category 1 Road) to create or alter access on land identified as Lot RES 1 PS421774, Lot RES2 PS508465, Lot RES1 PS514678, Lot RES 1 PS718996 (part), the footprint of the pavement and associated works will be minimised to the greatest extent practicable, in consultation with the City of Casey.

4.2.7 Where, but for this incorporated document, a planning permit would be required pursuant to Clause 44.05 Special Building Overlay (SBO) and the Schedule to the SBO for buildings and works on land identified as Lot RES 1 PS421774 and Lot RES1 LP217811 (part), the footprint of the pavement and associated works will be minimised, to the greatest extent practicable, in consultation with the City of Casey.

Create or Alter Access to a Category 1 Road

4.2.8 Any change to the use or development of land that may create or alter access to a road in a Road Zone, Category 1 or land in a Public Acquisition Overlay if the purpose of acquisition is for a Category 1 Road, must be undertaken to the satisfaction of the Roads Corporation.

Utility Installation

4.2.9 Buildings and works associated with a utility installation (excluding a minor utility installation or any telecommunications facility that is either located within a Road Zone or proposed road zone or, were it not for this incorporated document, would be exempt under Clause 52.19-1 of the planning scheme) must be undertaken in accordance with site plans and elevations prepared to the satisfaction of the Minister for Planning.

Other Conditions

4.2.10 Unless otherwise stated, the plans and other matters listed in Clause 4.0 must be approved prior to the commencement of works. The plans and other documents may be prepared and approved for separate components or stages of the Project but each plan or document must be approved before commencement of works for that component or stage.

4.2.11 The plans and other documents may be amended from time to time to the satisfaction of the Minister for Planning or relevant approving authority.

4.2.12 The use and development of land for the Project must be undertaken generally in accordance with the approved plans and documents.

4.3 Preparatory buildings and works

The following buildings and works may commence on the land described within Clause 3.0 of this incorporated document before the plans and other documents listed in Clause 4.2 are approved.

4.3.1 Preparatory works for the Project including, but not limited to:

a) Works, including vegetation removal, that would not require a planning permit under the provisions of the Cardinia, Casey, Greater Dandenong, Monash and Stonnington Planning Schemes.

b) Investigation, testing and preparatory works to determine the suitability of land, and property condition surveys.

c) Creation and use of construction access points and working platforms. d) Site establishment works including site fencing and hoardings, site offices, amenities, hardstand and

lay down areas. e) Construction, protection, modification, removal or relocation of utility services, overhead and

associated infrastructure. f) Establishment of environment and traffic controls, including designation of “no go” zones. g) Establishment of temporary car parking. h) Demolition to the minimum extent necessary to enable preparatory works. i) Salvage of aboriginal cultural heritage material and other management actions required to be

undertaken in compliance with the cultural heritage management plan approved under the Aboriginal Heritage Act 2006 or other compliance with that Act.

4.3.2 Any native vegetation removed to enable preparatory works under Clause 4.3 forms part of the total extent of native vegetation removal necessary for the construction of the Project and native vegetation offsets must be provided in accordance with Clause 4.2.1, 4.2.2 and 4.2.3, except as otherwise agreed by the Secretary to DELWP.

5.0 EXPIRY

5.1.1 The control in this document expires if any of the following circumstances applies:

The development allowed by the control, including preparatory works, is not started by 31 March 2024.

The development allowed by the control is not completed by 31 March 2027.

5.1.2 The Minister may extend these periods if a request is made in writing before the expiry date or within three months afterwards.
