TEHACHAPI-CUMMINGS COUNTY WATER DISTRICT REGULAR MEETING OF THE BOARD OF DIRECTORS
April 16, 2014 4:00P.M.

Approve Minutes of the Regular Meeting of March 19, 2014
The Minutes of the Special Meeting of March 3,2014 and the Regular Meeting of March 19, 2014 were approved as presented with a motion made by Director Hall, seconded by Director Hadley and carried on the following vote: Ayes: Cowan, Hadley, Hall, Prel, Schultz; Noes: None; Abstain: None; Absent: None.
Manager's Report
Mr. Martin reported the District's imported water system is still idle. Pumping is scheduled to begin on May 5. There is 3,228 acre feet available to import through the California Aqueduct. This total includes all ofthe carryover water and the water being recovered from West Kern Water District. All of the District's wells, plus the Golden Hills Iriart well are in operation and pumping at a combined rate of 7.6 cubic feet per second. As of April 11, Jacobsen Reservoir held 1,556 acre feet of water. At this time, the SWP allocation is still at zero. Mr. Martin reviewed a letter received from the DWR, forecasting a small allocation later this summer if enough water is captured in the delta. Mr. Martin said he is anticipating a 5% allocation to be announced later this week.
FUGRO has all the information needed to complete the Cummings Basin groundwater update.
The Letter ofIntent between the City of Tehachapi, Golden Hills CSD and TCCWD for water supply coordination was approved by the City Council and the Golden Hills CSD Board of Directors.
Golden Hills scheduled the bid opening for the Steuber Well Project on April 7. No bids were received, so this project is now terminated.
Mr. Martin reported on the Tehachapi Area Association of Realtors' water conservation workshop held on April 9,2014. He also reported on other planned events: TVRPD annual Brite Lake Fishing Derby on April 19; Jim Beck, General Manager of the Kern County Water Agency, and John Martin will be speaking to Smart Growth Tehachapi Valleys on May 17 at the Moose Lodge from 10:00 a.m. until noon.

Item 4.
The annual pump plant tour is scheduled for May 22,2014. We are scheduled to meet at the District Office at 8:00. A sign-up sheet is available in the office.
The water purveyors in the area worked together to come up with a new website called Report Leaks.com. This is an internet-based reporting tool for the purpose of reporting water leaks. If someone witnesses a leak or waste, they can report it to the appropriate agency.
Mr. Martin reported on the "Recommendations to Improve Groundwater Management," prepared by the Association of California Water Agencies and directed to various State agencies that have authority over groundwater.
There has been a tentative agreement on the SWP Contract renewal. Mr. Martin reported that the contract has been extended to 2085 and he reviewed some of the changes to the contract. This contract will be subject to CEQA.
Mr. Neisler reviewed a graph and details on inflow and outflow of the Jacobsen Reservoir.
Mr. Martin reviewed the Central Valley Project and the State Water Project Drought Operations Plan and Operational Forecast for April 1, 2014 through November 15, 2014.
Director Hall had questions regarding the operation of Jacobsen Reservoir, which were answered by staff.
Mr. Nelson asked ifthe trees surrounding the reservoir were at risk from the high water levels and how long the water levels would be this high. Staff responded to the questions as needed.
Operations Manager's Report
Mr. Neisler explained that most of the items covered in the Operations Manager's Report were agenda items for the meeting. He then reviewed details of his remaining report.
Two of the three new pumps have been installed. The third pump will be kept as a spare this year and two additional pumps will be ordered, which will increase the District's pumping capabilities All of the old pumps will be replaced with stainless steel, impeller pumps; which are more reliable. Bench tests were consistent and all exceeded design specifications. Preliminary testing was confirmed by the bench testing in the field.

Mr. Neisler reported the above-grade, elevated oil storage tanks at the pump plants have been removed and replaced with at-grade, pressurized facilities in accordance with State regulations. New facilities will be inspected later this year by the State.
A new phone and data system has been installed throughout the District's facilities. Details of this project were reviewed by Mr. Neisler. Installation of this new system will allow an approximate $400 per month savings.
ACWAIJPIA conducted their annual risk management inspection. There were some minor recommendations and suggestions for training.
Pipeline maintenance activities were reviewed.
Comments by Any Party on Items of Interest to the Public and Within the Subject Matter Jurisdiction of the Legislative Body
Mr. William Nelson reviewed his written comments that were provided to the Board regarding suggested task areas for the Water Conservation Coordinator and Water Conservation Technician to consider and suggestions for the pump plant tour scheduled for May 22.
Public Hearing and Adopt Resolution 5-14, Increasing Ag Water Rates
A. President's Opening Remarks
President Cowan said that this is a public hearing to consider adoption of Resolution 5-14, which increases the water rates for agricultural water and reduced the regular M&I rate.
B. Staff Presentations:
(1) Declaration of Mailing of Notice, Mark as Exhibit
Mr. Martin introduced the Declaration of Mailing Notice and it was marked as Exhibit A by the Secretary.
(2) Explanation of Proposed Rate Increase by General Manager
Mr. Martin gave a brief explanation ofthe proposal, which was broken down in two parts.
The first part was the proposal to reduce the Regular M&I Rate from $1,486 per acre foot to $1,385 per acre foot. Mr. Martin explained that this recommendation was based on a continuation of the method that has been used to calculate this rate since 2010 and he reviewed the calculation.

The second part of the proposal involves increasing the agricultural water rates. Mr. Martin reviewed the aspects of this proposed rate. He said the District is incurring additional costs to supply water to the agricultural users and these costs were reviewed with the Board. Mr. Martin said this rate should stay in place until these added costs are recovered.
President Cowan declared the hearing open at 4:45 p.m.
C. Public Comment
Public comments were heard at this time.
Penny Melko, resident of Sand Canyon, stated her concerns regarding increasing the ag rates.
Ted Wyman, made comments regarding the history of the District; the reason for the adjudication and the original purpose of the District.
William Nelson submitted a letter to the Board on April 14, 2014. He read Principle 5 of his letter and asked that his letter be made part of the record ofthe meeting. Additional comments were made by Mr. Nelson.
Stan Beckham made comments regarding the County financial situation. and how it affects all ofthe other agencies in the County.
President Cowan, Director Hall and Director Schultz responded to public comments.
D. Call for Written Protests and Receipt of Written Protests
Mr. Martin asked if there were any protests. No protests were submitted. There were 27 protests received by mail.
E. Verify and Tabulate Protests
Protests were verified and tabulated by staff.
F. Announcement of Results
Mr. Martin reported the results. Out of 396 properties notified, 27 written protests were filed, which is 6.8%. For customers notified, 112 customers were notified and 13 protests were received, which is 11.6%. The threshold is 50%. Therefore, there was not a successful protest.

G. Close Hearing
The hearing was closed at 5:16 p.m.
The current rates and proposed rates were reviewed and discussion took place. After discussion took place, Director Schultz introduced Resolution 5-14 and moved for its adoption. Director Hadley seconded the motion and the resolution was adopted on the following vote:

Item 7. Adopt Negative Declaration Re: The Tehachapi Turf Temporary Recycled Water Project
Mr. Martin reviewed this project and explained that it was subject to the CEQA requirements. He said the study found that the proposed project would have no significant effect on the environment.
After discussion, Director Hadley made a motion to adopt the Negative Declaration. The motion was seconded by Director Schultz and carried on the following vote: Ayes: Cowan, Hadley, Hall, Prel and Schultz; Noes: None; Abstain: None; Absent: None.
Item 8. Approve Recycled Water Agreement with Valley Sod Farms, Inc.
This item was tabled.
Item 9. Discuss 2014 Drought Management Plan
A presentation on the Drought Management Plan was made by Mr. Martin. The plan contained three options for dealing with the drought situation. Each option was reviewed in detail. Mr. Martin recommended that the Board choose Option 1 and asked that President Cowan appoint an ad-hoc committee to develop a new priority list for water supply to bring to the Board next month.
After the presentation was made, comments were made by Mr. Wyman and Mr. Nelson and discussion took place. Mr. Martin's asked the Board to answer five questions listed below:
1. Should we sell Cummings return flow water to M&I users outside of Cummings? Board members answered, yes and suggested that staff aggressively pursue signature of the new Term M&I agreement, which requires groundwater banking.

2. Should we fill all Cummings Ag surface water orders to keep Ag off of wells? Board members answered, yes.
3. Should banked water from TB be used in other basins (Brite/Cummings)? Board members answered, yes.
4. Does Board desire to adopt an ordinance establishing restrictions and priorities? The Board answered, yes. Director Hall and Director Schultz were appointed to work on the Drought Management Ad-hoc Committee.
5. Which option should we pursue to survive the drought of2014? The Board members chose to pursue Option 1, which includes: Recover Banked Water to Fill All Orders: Sell return flow water for conjunctive use M&I customers in Cummings; Recover banked water in Tehachapi Basin for delivery anywhere in system; Store maximum amount of recovered water in reservoir for peak demand; Reduce 12/31/14 reservoir storage, if needed? Increase recovery capacity; Replenish water bank in 2015-16.
Item 10. Approve Contract with L.O. Lynch, Inc. to Clean and Test Pump Wells
Mr. Neisler reviewed the details of this contract, which had a total price of $66, 151. A map showing the location of the wells to be rehabilitated was provided and a detailed report was given on the work to be included in the contract. After discussion, Director Hadley made a motion to approve the contract. The motion was seconded by Director PreI and approved on the following vote: Ayes: Cowan, Hadley, Hall, Prel and Schultz; Noes: None; Abstain: None; Absent: None.
Item 11. Adopt Resolution 6-14, Amending Fiscal Year 2013-14 Budget
Mr. Martin reviewed the proposed changes to the budget. After discussion, Director Hall introduced Resolution 6-14 and moved for its adoption. The motion was seconded by Director Schultz and roll call was taken on the vote:

Item 12. Discuss Snyder Well Intertie Project and High School Pressure Problem
Mr. Martin explained that the Snyder Well Project would require that the school district dedicate easements for the pipeline to connect to the well, the location of the booster tank and pressure reducing station. The high school has a pressure problem with the District's service connection at the high school. Mr. Martin recommended that the District repair the pressure problem at the high school in return for the easements required for the Snyder Well Intertie Project. The Board agreed with the recommendation. Staff will work out an agreement with the school district.

Declare Certain Equipment Surplus to the Needs ofthe District and Authorize Sale/Disposal
Mr. Neisler explained that with the installation of the new voice and data communications system, the District now has old communications equipment that is surplus to the District's needs. Director Schultz made a motion to declare the items surplus and authorize disposal or sale. Director Hadley seconded the motion and it was carried on the following vote: Ayes: Cowan, Hadley, Hall, Prel and Schultz; Noes: None; Abstain: None; Absent: None.
Financial Report and Approve Payment of Bills
Vouchers #638-639 totaling $4,920.50, Vouchers #640-693 totaling $209,270.46, Vouchers #694-714 totaling $87,615.49 to be paid from 60170; Vouchers #11-12 totaling $2,966.00 to be paid from 60186 were reviewed and approved for payment on motion made by Director Hadley, seconded by Director Hall and carried on the following vote: Ayes: Cowan, Hadley, Hall, Pre1and Schultz; Noes: None; Absent: None; Abstain: None.
Closed Session in Accordance with Exhibit A Attached Hereto
The Board went into closed session at 8: 10 p.m. The Board returned to open session at 8:24 p.m.
Report on Closed Session
President Cowan reported that the Board approved the Settlement Agreement and General Release and the Second Amendment to Horse Thief Golf Course Recycled Water Agreement with Oak Tree Affiliates, Inc. and authorized the President and Secretary to sign the these documents on motion made by Director Hall, seconded by Director Hadley and carried on the following vote: Ayes: Hadley, Hall, Prel and Schultz; Noes: Cowan; Abstain: None; Absent: None.

NOTICE OF PUBLIC HEARING CONCERNING INCREASING AGRICULTURAL WATER RATES
PLEASE TAI<E NOTICE that on April 16, 2014 at 4:00 p.m. at the office of Tehachapi-Cummings County Wate,- District (the "District"), located at 22901 Banducci Road, Tehachapi, California, the District's Board of Directors will hold a public hearing at which time the Board will receive oral or written comments and will consider written protests filed before the close of the hearing concerning the proposed adoption of Resolution No. 5-14, increasing agricultural water rates charged by the District for water effective May 1, 2014.
The procedural requirements of Proposition 218 require the District to provide notice of the proposed rate adjustment to all owners of real property who will be affected by the proposed adjustment. The District has elected to send notice to not only its existing agricultural water cllstomers but also to all owners of land within the District's service area who potentially could connect to the District's transmission facilities and receive direct water service from the District. Record owners of land receiving direct water service or capable of receiving direct water service from the District or a tenant who is a "water user," as detlned in Section 8 of District Resolution No. 13-09, as amended, may file a written protest against the proposed rate adjustments before close of the public hearing. As provided in Government Code section 53755(b), one written protest per parcel, filed by an owner or tenant water user, shall be calculated in considering whether a majority protest exists. Upon conclusion of the hearing, the Secretary of the Board will determine the validity of filed protests and tabulate valid protests. The Secretary will usc the current Kern County Assessor's Roll to verify that a protest is signed by the current record owner and that correct Assessor Parcel Number or Numbers are listed.
Written protest'> may be presented at the hearing, delivered to the District oftlce or mailed to the District at P.O. Box 326, Tehachapi, CA 93581, but they must be received by the District before the close of the hearing to be considered.

Attached please find the two-page document titled "Tehachapi Region Guiding Principles and Practices for water Allocations from Public Groundwater-Banked Supplies by the Tehachapi-Cummings County Water District (part of a 2014 Drought Emergency Action Plan)", which I drafted after reviewing present circumstances and recent activities and intentions of the District, including its Watermaster administration for the Tehachapi Basin.
The Principles are intended to provide certainty, consistency and stabilization for jUdgments formed by the Board. The Board is urged to proceed with caution and formalities, as it makes decisions with significant present and future impacts, economic and otherways, on the Tehachapi Region.
The principles are grounded in certain understandings of equitable and legally express positions of affected interests, and intended to be broadly publicly interested.
Please make this written communication a part of the record of every relevant Agenda Item of the April 16 Board meeting, in particular, make it part of the Public Hearing on water Rates proposed for M&I and Agricultural users. Thank you.

TEHACHAPI REGION GUIDING PRINCIPLES AND PRACTICES
for Water Allocations from Public Groundwater-Banked supplies
by the Tehachapi-Cummings County Water District (part of a 2014 Drought Emergency Action Plan)
TRANSPARENT GROUNDWATER BANK ACCOUNTING.
Groundwater accounting shall be understandable by the general public, and legally decisionable by the County Water District's Board of Directors, with such categorical identifications as:
a. physical source, e.g. California State Water Project ("SWP"), Native GroundWater ("NGW"), Agricultural/Other Return Flow ("ARF", "ORF");
b. groundwater storage site, e.g. In-District Storage Site ("IDSS"), Out-of-District Storage Site ("ODSS"), aboveground storage ("AGSS");
c. water importations wholly pUblicly underwritten, further identified by Water District or Purveyor account;
d. importations sUbsidized by pUblic financing, with balance funded by Customer commitments/purchases.
NO EXPORT OF BANKED GROUNDWATERS FROM BASIN WITHOUT FORMALITIES.
Unless expressly and legally provided for in District-Customer Agreements as identified in categories 1.c. or 1.d. above, and/or as duly promulgated in the Rules and Regulations for Watermaster (District) Operations ---- groundwater supplies banked within District boundaries under District control, shall only be used for beneficial purposes within the groundwater basin area where stored.
20% BANKED SUPPLY USE RULE.
Based on prudent judgment and the requirement that climate uncertainty and volatility, and longer-term economic stabilization, dictate judicious constraint on release of banked supplies ---no more than 20% of the District's presently combined banked groundwater and aboveground supplies shall be utilized in any one year, factoring system losses and Return Flow gains attributable to use. Such "20% Banked Use Rule" shall be used in calculations, notwithstanding that the District's sum of banked accounts under its management, have yet to achieve a segregated 5-year drought and ,other emergency supply.
District allocations overriding the 20% Banked Use Rule shall only be made by unanimous consent of the District's Board of Directors, by Resolution with findings and justifications set forth.

-4. EQUITABLE TREATMENT FOR CUSTOMER-FUNDED RETURN FLOWS BANKED.
The Water District shall give consideration to the amounts and sources of funding of water importations and resulting Return Flows calculated as banked in a basin's groundwaters, in subsequent allocations, sales and use from such categorized accounts. Consideration shall be made in both non-emergency circumstances, as well as emergency devisings (by Ordinance or otherwise) ---- of allocations, sales, ratesettings and pricings. Inter-basin transfers of Return Flow banked supplies shall not be conducted without formal authority as identified in Principle 2.
5. ACCURATE AND USEFUL WATER COST INDEXES AND PRICE REFERENCES.
For purposes of informed Water District Director judgments and decisions, and public understandings of the present and future value of water, as well as associated potential impacts on real property, the District shall maintain accurate and useful Water Cost Indexes and Price References. Cost Indexing of District-managed water resources shall exhibit fully all public cost/tax subsidies, as well as other cost/charge components, including necessary charges for environmental remedies such as spring and stream restorations, and reserves to finance future water supply stabilization. CONCLUSIONS FOR 2014
o Tehachapi-Cummings County Water District Board needs to adopt a 2014 Drought Emergency Ordinance or Resolution.
o As Watermaster, the District needs to formalize additional Rules and Regulations for management of the Tehachapi Basin, in the interests of promoting greater transparency and equity for water users in the Tehachapi Region.
All Water District 2014 potential importations of carryover SWP as well as ODSS banked water, have tentatively been allocated to Cummings Basin water users. Cummings Basin possesses substantial Return Flow banked groundwater supplies. Tehachapi Basin is governed by a Superior Court refereeing, and the Rules and Regulations of the District/Watermaster. Nowhere is Tehachapi Basin groundwater export provided for, and is actually prohibited by terms of the Court decision. Therefore, no inter-basin transfers of Tehachapi Basin to Cummings Basin should be conducted in 2014. Such transfers do not represent reasonable mutual aid, in the light of Cummings Basin water users' inability to conclude formal water use agreements for limited water supplies, and the complete and reckless failure of CCI and the Stallion Springs and Bear Valley Springs CSD's to develop any banked supplies.
