creating a mixed use zoning district for properties located in the area defined by the Bearden Village Opportunities Plan.

THIS ITEM WAS POSTPONED EARLIER IN THE MEETING. 6. METROPOLITAN PLANNING COMMISSION 5-A-16-OA Amendments to Knoxville Zoning Ordinance regarding parking in the

City of Knoxville. STAFF RECOMMENDATION: Approve the ordinance. Gerald Green: Update attempts to bring the City’s ordinance into the modern area. Established minimum and maximum number of parking spaces Landscape requirements Bicycle parking required for new uses except single family homes and

duplexes Updated engineering standards for drive isle area, angles of parking

spaces, size of parking spacing and other issues identified by the engineering department.

Public input from public meetings will be forwarded to City Council for their final action.

Three staff recommendations for revisions were added regarding landscaping maintenance, missing plants be replaced and individual resident parking and number of trees recommended from the recommending planting guide.

Joyce Feld: 1548 Aquala Avenue, Knoxville, TN. Board member of

Scenic Knoxville and Trees Knoxville and they support the needed ordinance.

Each reiteration of this has weakened the landscaping requirements. Would like to see it return to language from May 2016 draft. Also ask minimum height requirement for trees and shrubs be restored. We think specifications are important for attractive shady landscape

which will have multiple environmental benefits and enhance walkability.

Would like to see an approved list of trees linked to this ordinance. Green: Requirement with regard to size and maturity was deleted by Plans

Review Department. Inspector looking at the parking lot with no signage will not know and inspectors may not be able to enforce.

Approved planting list agree should be part of it. Deletion of two evergreen trees in the perimeters because realized

there was not adequate room for planting. Three deciduous trees plus shrubs adequate to buffer the parking area. Concern was with the initial number required may not leave adequate room for survival.

Carlene Malone, 6051 Fountain Road. Parking lot landscaping Section 11 alternative landscaping and 12

conservation of existing trees. Flexibility to successfully enforce. Standards need to be tighter and clearer.

City Administrative Review Board should be provided with written decisions from city-employed experts...

Subsection 12 needs minimum number of trees in the perimeter and the site regardless of the number of trees conserved. Needs to be a backstop.

Green: Alternative landscape wanted flexible enough to enable it to be able

used. Will make additional recommendations to City Council and tighten it up some.

Tree conservation – will send these comments on to City Council. With regard to location we will look at that again to tighten up before

this goes on to City Council. Margo Kline 8845 Ebenezer Oaks Lane, Council of Knox County

Homeowners. Concerned the City property bordering County that the 15 foot buffer

not going to be adequate. Northshore Town Center, Sherrill Hills, Assisted Living on Northshore

where zoned City but County property beside it. In those cases the neighbors asked for and got 50 to 100 foot buffers.

Ask that that there be a clause for where property abuts property outside the city limits be looked at on a case by case basis.

Green: City does not have a comprehensive buffering ordinance and that will

be addressed in the comprehensive City zoning update. Staff felt parking was not the place to tackle comprehensive

landscaping ordinance. Planting areas are a minimum and this Commission could require larger

buffer at use on review. Currently there is no buffer required between parking and residential and this is the first step.

Mary English, 810 Oak Grove Lane, on behalf of the League of Women

Voters. Major flaw is efficient use of land and infrastructure. Table 1 section D

establishes maximums then D.6 additional parking can be added if use pervious surfaces. Instead of having no boundary on D6 that a cap be put such as a maximum of 20 to 25 percent of additional spaces if you have pervious pavement. The same thing should apply to brownfields.

Green: Staff is comfortable with setting that limit on excess parking to 20 to

25 percent and that recommendation would be sent on to City Council. MOTION (CLANCY) AND SECOND (JOHNSON) WERE MADE TO

APPROVE STAFF RECOMMENDATION WITH THE THREE REVISIONS ADDED AND REDUCE CREDIT FOR TREE CONSERVATION IN SUBSECTION 12 BY HALF.

Elizabeth Eason: Plant and tree selection, maintenance and inspection should be part of the

landscape ordinance and link to the future landscape ordinance between now and City Council.

STAFF RECOMMENDATION: POSTPONE until the October 13, 2016 MPC meeting to ensure adequate time for public review and input. The Planning Commission may wish to accept public comment at the meeting on September 8, 2016 prior to postponement.

Margo Kline, 8845 Ebenezer Oak Lane, Council of West Knox County

Homeowners Concern about not much public input. Main concern is sidewalks and removal of provision to keep mature

trees if at all possible. Request delay of 90 days so sidewalk section can be considered along

with everything else. Kendall Aaron, 6531 Deane Hill Drive, Community Health Council, East

Tennessee Children’s Hospital and Childhood Obesity Coalition and Safe Routes to School.

Ask to change language from may to require sidewalks in the ordinance.

Read statistics supporting sidewalks. Jack Woodall, 9520 Westland Drive, on behalf of Community Forum.

Key issue is whether or not MPC includes sidewalk requirements in the subdivision requirements.

MPC’s responsibility is to develop subdivision regulations with mandatory sidewalks in all new subdivisions.

Ask for a postponement in order to address and hear other comments about public sidewalks and consider what to do about sidewalks.

Caroline Cooley, 903 Wingate Street, Bike Walk Knoxville. Here to support requiring sidewalks in new and other construction. Time to get new sidewalks regulations. Increase land value, walkability, physical and mental health. Complete Streets Ordinance would be supported by this. Robert Hill: Farragut. Look at the sidewalks problem without questioning the circulation plan. Alternatives are walking trails that are not on the road without as much

grading. Need to look at how else you can do the job for walking. Cindy Pionke: County Engineering. Study has been done regarding parental zones. County Commission has given funds for sidewalks. Public hearing next month for sidewalks for Powell Elementary School

and Powell Middle School. Sharing plans with developers to see if they can add to the network as

well.

Parks and Recs Department looking at trails that would tie into sidewalks.

Gerald Green The sidewalks separated from the subdivision regs based on issues

such as what are our options, when should sidewalks be required, what are ADA, what are options when topography or other issues make the cost of sidewalks so great they are infeasible. Number of questions we need answered so we as staff then can answer questions.

Any subdivision with current regs or as proposed could be required to have sidewalks.

Sidewalk committee trying to answer those questions so we have a better ground on which to stand and treat all developers fairly.

In October have the Sidewalk Committee come up with recommendations for November.

That will likely include some amendments to the subdivision regulations and comprehensive sidewalks policy in all developments.

This is just one phase of the subdivision regulation updates. Art Clancy Makes sense to do a comprehensive sidewalk ordinance and get buy in

from County Commission. New subdivisions with sidewalks would just put in pockets of sidewalks.

POSTPONE FOR 60 DAYS. Scott Smith We currently do require sidewalks in parental responsibility zones or

near planned walking trails. Issue is are we going to put sidewalks in every development. Charles Thomas Support alternative to sidewalks when topography can handle it. Gerald Green With trails we have to also look at ADA requirements and trails usually

put where topography is rough. CLANCY AND JOHNSON AMENDED MOTION TO POSTPONE 90 DAYS

Sector Plan, also amending the Knoxville-Knox County General Plan 2033.

Robert M Hill, 11504 Mountain View Road, Farragut, 37934. Ask for 90 day deferment of this plan. Suggest breaking the plan into three parts. Would like to see an operating plan on how to implement the plan. Gerald Green Currently doing a survey to look at making the boundaries of plans

different or doing community-based and corridor plans. Margot Kline, 8845 Ebenezer Oaks Lane, Council of West Knox County

Homeowners. Community has given a lot of input over several meetings. Question about park land and understand school and church

playgrounds were included which are not truly accessible public park areas. Southwest sector has a need for neighborhood parks close to home.

Jeff Archer Yes schools have been included in the total because park plan has

identified that schools should be used as community park places. Becky Longmire Knox County Schools are now fencing schools for safety might not want

to include in park area. Art Clancy One of the largest Parks in Knox County, Victor Ashe Park, is gated at

night. If Knox County maintains it, it should be considered parks and public spaces.

designed the concept plan which has no variances and lots of preservation areas.

Representing the 8th District Preservation Association. Showed a power point presentation and handed out copies of the presentation.

The 1995 East County Sector Plan pointed out the sinkholes, solution channels and cavern areas that MPC had previously determined were unsuitable for intensive large-scale developments. Showed a map with sinkholes or limestone or dolomite formation with risks and safety concerns about this development on this area.

Problem is may affect the groundwater in this area. We think this area should not be developed until TDC can show what

the impact may be and show what plans are to address those concerns.

Sandra Carboluck, 5212 Daphne Drive, 37914. Site not suitable because of the steep slopes, bad soils and hydraulic

concerns. Recommend a 25 foot buffer around the preservation area. Habitat and

habitat edges are essentially. Proposed main road be only vehicular intrusion into the property. Would like to see preservation area be extended into lot 20 to include

the farm pond and stream, delete lot 16 due to small size, irregular shape, and steep frontage slopes, do not develop lots with slopes of 15% or greater, do not fill or develop over closed topo depressions on lots 6, 14, 22, 23, 38 and 39 not suitable for developing.

Consider not accepting the internal roads as public roads due to maintenance.

Ed Reed, 435 S East End Road. Local community has given input multiple times that it does not want

this. MPC had a meeting and listed 10 different options for what to do with the property. Farm land preservation had the most votes from the community and open space came in second.

Ground is not compatible for development. No primary State or US roads there. Why do you have public input meetings?

Becky Longmire We actually want citizen input but citizens want lots of things. We listen

to both sides. Bob Wolfenbarger, President of the 8th District Preservation Association. For more than 15 years this community has been asking how are you

going to protect the groundwater. No one has ever addressed groundwater.

Opposed so that you will know that development will pollute and destroy the eco system of the area. Evidence is irrefutable.

Intent is to make all that hear this know the conditions so you will know the consequences and cannot say you did not know.

McAdams Multiple engineering firms from every specialty have been on this site.

There have been test borings on the site and TDEC has been involved in the process and aware of what is going on.

Question is this the best use of this site. We will be addressing the stormwater issues. That is not before you

today. Design plan requires detailed drainage and stormwater information.

We have gone out of our way to give information and get public input. Art Clancy We ask for public opinion because we want to know how everyone

feels, not just the Thorngrove Pike area. If you ask all the citizens of Knox County about the best use of the land, it affects everybody and it will differ.

the area that is really at risk and that is the area surrounding the business park.

A business park is less invasive than mile upon mile of subdivisions which is intensive sprawl.

Elizabeth Eason The area might not be the best area for this, but this is an excellent concept

plan with preservation and things in place to make this a good concept plan. If we do not approve it, something else will go in there.

Thomas Concerned with the sink hole issue since most people have groundwater wells.

Not sure I heard an objective analysis of the situation. Is there a process for an independent study or listen to each side.

Charles Lomax Lots of time we tell citizens this is not the time to discuss something and then

when it is the appropriate time so much steam has gathered that those that have not been paying attention have to recourse.

Green Detailed design plans for each phase and individual development of lots within

each phase would address sinkholes. If that is a concern they could attach a condition to the approval of the concept plan that the sinkhole and groundwater issues be addressed specifically with the design plans for each stage.

Clancy We rely on TDEC, EPA and County Engineering to take care of the design

stages. We make our decision based on the fact that we know they are going to do their job.

Mac Goodwin I am really concerned about the adequacies of TDEC doing adequate studies.

I can’t support it until there is adequate science that it is not going to affect people. We need to protect people that live there.

Scott Smith Sinkholes have buffers and a special process and core drilling. We are not at

the engineering stage but approval so they can get the engineering done. Commissioner Len Johnson called for the question. Janice Tocher Would like to know what that condition might look like or read. Longmire Condition No. 6 talks about obtaining required permits from Tennessee

Department of Environment and Conservation, a subsurface investigation and design recommendation by a geotechnical engineer and approval by the Knox County Department of Engineering and Public Works.

Property owner is ultimately responsible for inspections and maintenance at the cost of a few hundred dollars upon inspection then $1,000 to $7,000 to have it cleaned out.

Only access is Wallwood Road which is 17’ of pavement. Current zone provides for reasonable use and provides protection for

residential. Plans do currently recommend general commercial, but we are saying

those plans are not appropriate and error in plans. James Apodaca, 8420 Gardenside Lane, Powell When we first called it looked more promising to change to commercial

and then received denial recommendation in the mail. Residential houses are far away from this property. Want to do specific business of RV storage facility with covered storage. Plan on nice facility with a buffer zone with evergreens. Only 150 feet from Clinton Highway before directly access property. Entrance fence will be back from the road for them to pull off the road

Looked at only two of the signs-existing 2003 directory and take out Ruby Tuesday sign and put in a new sign.

All the existing signs need to be and should be looked at. Amy Tyson, represent JBL Investments which owns Harvest Towne

Center, 282 Silverleaf Lane, Dallas, GA 30157. The sign that is existing does not fit the code as being a unified sign

plan and does not represent all the people in that shopping center. Concern is if a sign no longer fits needs to be redone. Want to solidify what exactly is Harvest Towne Center. Tom Brechko Original plan did not include all the properties. Planning Commission determines if this is a unified development that

functions as a whole. Original sign did not meet what the Planning Commission approved. It
