1. CALL TO ORDER Hon. Vice-Mayor Efren F. Piñol, the Presiding Officer, called the session to order at 2 o’clock in the afternoon.

2. INVOCATION,NATIONAL ANTHEM & MAGPET HYMN Hon. Councilor Hermana Talotalo led the invocation. The singing of the National Anthem and Magpet Hymn followed.

3. RECITATION OF COUNCILOR’S CREEDThe members of the 8th SB of Magpet recited the councilor’s creed.

4. ROLL CALL OF MEMBERS In the roll call, all members were present.

5. AMENDMENT /APPROVAL OF AGENDAThe body unanimously approved to include in the agenda the following items: 1. Draft resolution no. 47 – Author: Hon. Councilor Marañon- A resolution

requesting Hon. Governor Emmylou T. Mendoza to lend one (1) unit bulldozer, one (1) unit backhoe and two (2) units dump truck to augment the heavy equipment of the Municipality of Magpet for road rehabilitation and gravelling.

2. Draft resolution no. 48- Author: Hon. Councilor Marañon – A resolution requesting Hon. Mayor Florenito T. Gonzaga through PSI Realan E. Mamon, Magpet PNP Chief of Police, to create task force tugis to conduct immediate investigation to resolve the criminalities in Barangay Gubanta, Magpet, Cotabato

3. Draft resolution no. 49- Author: Hon. Councilor Marañon - A resolution requesting DPWH to fast track the completion of a concrete bridge in Barangay Binay, Magpet, Cotabato.

4. Draft resolution no. 51 – Author: Hon. Councilor Marañon – A resolution requesting DPWH to furnish the Sangguniang Bayan of Magpet, Cotabato copies of Program of Works of all the projects implemented in the Municipality of Magpet. Items 1 to 4 were all approved to be included in the agenda through the motion of Hon. Councilor Marañon duly seconded by Hon. Councilor Lobaton.

5. Draft resolution no. 45- Author: Hon. Councilor Lobaton – A resolution requesting Hon. Vice-President Jejomar Binay to cause fund for the construction of one (1) unit school building intended for Binay Elementary School, Binay, Magpet, Cotabato.

This item was approved to be included in the agenda through the motion of Hon. Councilor Lobaton duly seconded by Hon. Councilor Mamon.

6. Draft resolution no. 50 – Author: Hon. Councilor Mamon- A resolution requesting the Philippine Tourism Authority to allocate funds for the concreting of tourism road from Barangay Bongolanon to Bongolanon Water Falls.This item was approved to be included in the agenda through the motion of Hon. Councilor Mamon duly seconded by Hon. Councilor Apostol. 7.Draft resolution no. 46- Author: Hon. Councilor Takinan - A resolution requesting Hon. Congressman Nancy A. Catamco, to cause funding for the construction of Municipal Tribal Multi-purpose building. This item was approved to be included in the agenda through the motion of Hon. Councilor Takinan duly seconded by Hon. Councilor Lobaton.

With no other matters to be included in the agenda, Hon. Councilor Lobaton moved for the adoption of the agenda as amended. Hon. Councilor Aboy seconded the motion. The body unanimously approved the motion.

At this juncture, the Presiding Officer declared for a recess. On resumption, they proceeded to the question hour.

6. QUESTION HOUR Mr. Dindo Porquiado, OIC – GSO – RE: Garbage Compactor matters

The Presiding Officer remarked that the OIC of the General Services Office was called by the body to answer queries regarding the garbage compactor which up to this time was not being used. He then called Hon. Councilor Aboy to make an opening statement.

Hon. Councilor Aboy in his opening statement raised one query. He asked why the garbage compactor is still not used until this day. He noted that during the blessing of the said unit, he witnessed that it is in good condition.

The Presiding Officer recognized Mr. Porquiado to answer the query.

In the answer of Mr. Porquiado, he stated two explanations why the said unit is still not utilized. First, he mentioned that the unit is not suitable to traverse the terrain in the dump site because it is not a four-wheel drive type of vehicle. Second, there are parts of the unit which are deemed not appropriate like some push buttons that are not functioning, the container which is just covered with cellophane and the wirings that are scattered like noodles.

The Presiding Officer inquired why the road was not repaired if that is the problem.

The OIC-GSO answered that in his opinion it is no longer practical to make the road concrete because the site is already full. He added that to purchase a new dump site would be the most proper thing to do.

The Presiding Officer inquired if the unit was tested.

The OIC-GSO answered that it was Engr. Homez who tested the unit which was witnessed by the Mayor.

The Presiding Officer suggested that the unit be referred to a person who has technical knowledge on the unit so that it would be tested properly.

Hon. Councilor Aboy rose to say that during the blessing of the said unit, he witnessed that the container has a proper cover and not covered by cellophane. He suggested to look for a person who really has a knowledge on how to operate the unit because it will not function properly if it is operated by a driver who does not really know the technicalities of the unit.

The Presiding Officer reacted by stating that “it was purchased during my term. Ako mismo dili ko modawat kung naay mga deperensya o may mga cellophane nga naga taklob-taklob diha. No, I will not allow it to happen because that was properly purchased based on the specifications.”

Hon. Councilor Apostol was recognized. He asked if the municipal compound is safe because the container in the unit is now only covered with cellophane and it was claimed by Hon. Aboy that such has proper cover during the blessing. He also asked if the unit is a surplus or brand new.

The Presiding Officer answered that such is not brand new because a brand new garbage compactor would cost 12 million Pesos.

Hon. Apostol inquired further if the LGU is allowed to purchase a surplus.

The Presiding Officer answered that it is allowed as long as the specifications are followed.

Hon. Councilor Takinan inquired if the unit has a warranty.

The Presiding Officer answered that it is seldom that a surplus unit has a warranty.

Hon. Councilor Marañon inquired if the unit was ever utilized even once or twice.

The OIC-GSO answered that he cannot answer the question because he just assumed as OIC-GSO last August 1, 2013 and that he has no idea if Engr. Homez utilized it.

Hon. Councilor Marañon further asked that if the said unit was not utilized, why is it damaged already?

The Presiding Officer answered that Engr. Porquiado cannot answer his question because he only assumed office last August 1. He reiterated what Engr. Porquiado stated that the reason why said unit could not be utilized is that it is not suitable to traverse in the terrain of the dump site. He concurred to the suggestion that a new dump site would be purchased with a terrain that is suited for the garbage compactor. He informed the body that there is already an appropriation for that purpose which was allocated during his term.

Hon. Councilor Mamon rose to suggest that the unit be tried out so that all our questions will be answered.

Engr. Porquiado answered when it was tested, some push buttons were not functioning.

Hon. Councilor Mamon further suggested that Engrs. Homez and Porquiado be called for the question hour next session in order to answer our questions.

Hon. Councilor Lobaton rose to say that the issue on the terrain of our dump site should also be addressed because he reasoned that no matter how good the condition of the garbage compactor is but it is not suited to traverse the terrain of the dump site, it would still be useless.

At this juncture, Hon. Councilor Apostol moved to call Engrs. Homez and Porquiado during the question hour to answer queries regarding the garbage compactor. Hon. Mamon seconded the motion. The body unanimously approved the motion.

Hon. Councilor Takinan suggested that a demonstration on how to operate the garbage compactor should be done to be witnessed by all members of the august body. He then moved a motion relative to his suggestion. Hon. Councilor Marañon seconded the motion. The body unanimously approved the motion.

Hon. Councilor Talotalo rose to make a statement regarding the MRF at the public market. She observed that said MRF is already full of garbage that needs to be disposed.

The Presiding Officer first inquired to Engr. Porquiado if he will answer the query because it is no longer part of the subject matter to which he was invited.

Engr. Porquiado answered that he is willing to answer the question. He stated that it is true that the MRF in the public market is already full. He added that previously the items in the MRF were sold but such is no longer done now. He assured the body that the garbage will be disposed and thanked Hon. Councilor Talotalo for reminding him of the said matter.

With no other questions raised, the Presiding Officer thanked Engr. Porquiado for gracing the session and for answering the questions of the councilors.

In closing, Engr. Porquiado clarified that the engine of the garbage compactor is functioning, there are only some push buttons that are not functioning. He then thanked the body for the opportunity given to him to answer matters regarding the garbage compactor.

7. PRIVILEGE HOUR

Hon. Councilor Aboy rose to avail of the privilege hour. His speech was about the incident that happened in the tourism activity at Kabacan river where in there was one fatality. A resident of Barangay Poblacion and a student of USM died during the conduct of a river tubing. He suggested that protection for the tourists should be strengthened because they might not come here in Magpet anymore if they are not well protected.

At this juncture, the Presiding Officer relinquished the chairmanship to Hon. Councilor Marañon, the Presiding Officer Pro tempore, because he would deliver his privilege speech. The Presiding Officer Pro Tempore then gave the floor to Hon. Vice-Mayor Piñol.

8. READING OF THE PREVIOUS MINUTES 7.1. September 2, 2013 regular session minutes.

Hon. Councilor Apostol moved to suspend the reading of the previous minutes. Hon. Councilor Aboy seconded the motion. The body unanimously approved the motion.

He then moved for the adoption of the minutes as presented. Hon. Councilors Aboy and Yunting seconded the motion. The body unanimously approved the motion.

9. FIRST READING AND REFERRALS TO COMMITTEE OF PROPOSED RESOLUTIONS AND ORDINANCES, PETITIONS, MEMORIALS AND OTHER COMMUNICATIONS:9.1. Resolution no. 12-302 of SP Kidapawan City – A RESOLUTION STRONGLY SUPPORTING HOUSE BILL 2142 AUTHORED BY THE ALLIANCE OF CONCERNED TEACHERS (ACT PARTYLIST) OTHERWISE KNOWN AS THE PUBLIC SCHOOL TEACHERS’ SALARY GRADE ACT – AN ACT UPGRADING THE MINIMUM SALARY GRADE OF PUBLIC SCHOOL TEACHERS FROM SALARY GRADE 11 TO 15 AND ENJOINING OTHER SANGGUNIANG BAYAN OF COTABATO PROVINCE TO DO THE SAME Hon. Councilor Marañon moved to suspend the Internal Rules of Procedure, Hon. Councilors Aboy and Lobaton seconded the motion. The body unanimously approved the motion. Hon. Councilor Marañon noted that it is important that the body would strongly support this house bill to give tribute to the teachers who are doing noble service to the students but are receiving small salary. With no clarifications made, he made the final motion to pass a resolution supporting house bill 2142. Hon. Councilors Apostol and Lobaton seconded the motion. 9.2. Request for accreditation to the local special bodies of the Integrated Rural Development Foundation, Inc. This was referred to the Committee on Ordinances and Legal Matters.

9.3. 9.8. Draft resolution no. 42 – 2013 - Author: Hon. Councilor Apostol - A resolution requesting PCSO 1 unit ambulance for the Municipality of Magpet. Hon. Councilor Apostol moved to suspend the Internal Rules of Procedure to tackle this item. Hon. Councilor Takinan seconded the motion. The body unanimously approved the motion.

9.10. Draft resolution no. 43-2013 – Author: Hon. Councilor Apostol – A resolution requesting DILG Secretary Mar Roxas , thru PNP Chief Allan Purisima to grant 1 unit patrol car for the Municipality of Magpet. Hon. Councilor Apostol moved to suspend the Internal Rules of Procedure to tackle this item. Hon. Councilor Marañon seconded the motion. The body unanimously approved the motion.

9.11. Draft resolution no. 44-2013 – Author: Hon. Councilor Yunting – A resolution requesting Hon. Governor Emmylou Mendoza to grant livelihood project to the KALIPI women’s organization of the Municipality of Magpet.

Hon. Councilor Yunting rose to present her draft resolution.

Hon. Councilor Mamon rose to ask why the author only focused to the KALIPI organization. She suggested that other women organization like the BHW should also be included.

The author answered that they cannot all be accommodated. She added that she would also make another request for other women organization next time.

Hon. Councilor Talotalo reacted that it is just alright that the resolution is for the KALIPI women’s organization because other women who are member of the other organization such as the BHW are also member of the KALIPI.

Hon. Councilor Apostol inquired on what KALIPI acronym stands for. Hon. Yunting answered that she forgot and promised to answer the question next session.

Hon. Councilor Mamon rose to state that not all BHWs are member of the KALIPI. She reiterated her suggestion to include all women organization in the resolution.

Hon. Councilor Aboy rose to support the statement of Hon. Mamon.
