Merrill, Superintendent NOTICE OF SPECIAL SCHOOL BOARD MEETING OF THE SCHOOL BOARD OF THE CITY OF VIRGINIA BEACH Pursuant to Bylaw 146, and Virginia Code § 2.23707, while the School Board was in session May 8, 2012, and while all Board members were present, it was decided a Special Meeting would be held on Tuesday, May 15, 2012, at the School Administration Building, 2512 George Mason Drive, Virginia Beach. The purpose of the Special Meeting is for the Board to: 1) gather in workshop format in the einstein.lab at 5:00 p.m. to receive and discuss options for the reconciliation of the FY2012/13 School Operating Budget to the FY201213 Resource Management Plan Ordinance approved by City Council May 8, 2012; and 2) commence a formal meeting in the School Board Room following the workshop for the School Board to act on resolutions for the adoption of the a. FY2012/13 School Operating Budget, as amended; and b. FY2012/13 Salary Resolution 1. Convene School Board Workshop (einstein.lab) .............................................................. (5:00 p.m.) Chairman Edwards convened the Board in the einstein.lab in workshop format at 5:05 p.m. All Board members were present with the exception of Ms. Holtz, Ms. Davis and Ms. Weems who all arrived shortly thereafter at 5:08 p.m., 5:11 p.m. and 5:18 p.m., respectively. Chairman Edwards addressed two issues of concern sent to the Board. He reported 1) the Ropes Course will be sustained for the 201213 school year while pursuing a public/private enterprise operation; and 2) the letter received regarding Beach District high school Assistant Principals was a miscommunication and confirmed those positions will remain a twelve month contract. Mr. Farrell E. Hanzaker, Chief Financial Officer, provided a brief overview of the total budget by revenue sources, categories and expenditures, and presented the proposal for reconciliation to the City Council approved School Operating Budget funding ordinance of $657.4 million; $4.3 million below the March 6 School Board request, but up from original cuts totaling $39.6 million identified in the Superintendent’s Estimate of Needs. He reported items not restored in the reconciliation included cuts to all nonpersonnel line item budgets by 2%, the reduction of 16 positions for custodial allocations, the reduction of permanent substitutes and Central Office positions, reductions for professional development, travel and tuition reimbursement. He noted two critical unfunded needs were fullday kindergarten at a cost of $11.6 million; and needed adjustments to the unified salary scale at a cost of $6.8 million. NOTICE OF SPECIAL SCHOOL BOARD MEETING OF THE SCHOOL BOARD OF THE CITY OF VIRGINIA BEACH

Pursuant to Bylaw 1‐46, and Virginia Code § 2.2‐3707, while the School Board was in session May 8, 2012, and while all Board members were present, it was decided a Special Meeting would be held on Tuesday, May 15, 2012, at the School Administration Building, 2512 George Mason Drive, Virginia Beach.  The purpose of the Special Meeting is for the Board to:  

1) gather in workshop format in the einstein.lab at 5:00 p.m. to receive and discuss options for the reconciliation of the FY2012/13 School Operating Budget to the FY2012‐13 Resource Management Plan Ordinance approved by City Council May 8, 2012; and

Assembly’s requirement that all state employees, (including teachers and other school employees) begin paying into the Virginia Retirement System (VRS).  He noted the VRS offset begins the phase in approach to the General Assembly mandate that by SY2016‐17 all VRS‐eligible employees will have to pay five percent (5%) of their base salaries into VRS.   

Chairman Edwards reported plans to follow‐up on a letter he sent to the Mayor making a strong plea for a lump sum appropriation by Council. 

Mr. Hanzaker then reviewed the Salary Resolution for FY2012‐13 outlining the proposed compensation increases and job title additions/deletions/changes of certain job titles on the Unified Pay Plan.  Mr. John A. Mirra, Assistant Superintendent for Human Resources, explained the process as it relates to the possibility of renewing P1 contracts that had been notified of non‐renewal due to budget constraints.  

The workshop concluded at 5:43 p.m.  

2. Formal Meeting Call to Order and Electronic Roll Call:  Chairman Edwards convened the Board in the School Board Room at 6:06 p.m.  All Board members were present.  He noted the purpose of the meeting was for the completion of the budget process. 

3. Adoption of the Agenda:  Dr. Davidson made a motion, seconded by Ms. McLeod, that the Board adopt the agenda.  The motion was unanimously approved. 

4. Action:   A. Resolution for the Adoption of the FY2012‐13 School Operating Budget, amended:  

Chairman Edwards noted the Board had just completed an hour‐long review of budget reconciliation details and asked Mr. Farrell E. Hanzaker, Chief Financial Officer, to provide a brief synopsis of what was presented.  Following the summation, Vice Chairman Brunke made a motion, seconded by Dr. Davidson, that the Board approve the proposed resolution for the adoption of the FY2012‐13 School Operating Budget as amended.  Board members expressed their gratitude to staff and the community for their advocacy and support during the budget season.  The motion was passed unanimously and the resolution approved as follows: 

Budget Resolution – FY 2012/13

WHEREAS, the mission of the Virginia Beach City Public Schools (VBCPS), in partnership with the entire community, is to empower every student to become a life-long learner who is a responsible, productive and engaged citizen within the global community; and

WHEREAS, the School Board of the City of Virginia Beach has adopted a comprehensive strategic plan and school improvement priorities to guide budgetary decisions; and

WHEREAS, the School Board has studied the recommended FY 2012/13 Operating Budget in view of state and federal requirements, additional demands for space and operations, the strategic plan, priorities, expectations, competitive compensation for employees and the best educational interests of its students; however, the primary drivers of the budget are the down economy and its impact of reduced revenues at the state and local levels as well as significant increases in VRS rates and the employee health care program; and

WHEREAS, the City Council has adopted its Budget Ordinance for FY 2012/13 to include appropriations for VBCPS; and

WHEREAS, the School Board is grateful to the City Council for the funding level provided to VBCPS for FY 2012/13; and

WHEREAS, the budget reconciliation between the FY 2012/13 School Board Proposed Operating Budget dated March 6, 2012 and the City’s funding for VBCPS in its Budget Ordinance for FY 2012/13 adopted on May 8, 2012 will require the City Council to amend its FY 2012/13 Budget Ordinance to reflect the revised budget numbers for the Schools; and

WHEREAS, the savings remaining in the School Reserve Special Revenue Fund is $11,000,000, which would have normally been used for major one-time purchases; and construction projects, which have been deferred in anticipation of these economic challenges; and have been budgeted to use these funds in the FY 2012/13 Operating Budget; and

WHEREAS, the School Board intends to use these school-generated reserves and savings to offset reductions in both state and local revenues; and

WHEREAS, the total funds appropriated FY 2012/13 from the City of Virginia Beach to the School Board of the City of Virginia Beach is $387,445,180, which includes $2,000,000 of the Sandbridge TIF; and

WHEREAS, the debt service payment is $44,747,986, leaving a balance of $342,697,194 to allocate between the Operating Budget and the Capital Improvement Program (CIP); and

WHEREAS, the Commonwealth now requires school divisions to segregate all technology related budgeted expenditures. VBCPS has now shown these technology funds in a separate fund (106 Fund) and these funds totaling $26,881,028 will be moved into the “other special revenue funds” shown below and the funds available to allocate to the Operating Budget are $315,816,166.

NOW, THEREFORE, BE IT

RESOLVED: That the remaining Sandbridge TIF funds in the amount of $1,591,000 be allocated to the Schools’ CIP; and be it

FURTHER RESOLVED: That the $315,816,166 be allocated as follows: $315,816,166 to the Operating Budget, and $0 to the CIP; and be it

FURTHER RESOLVED: That $11,000,000 of the School Reserve Special Revenue Fund be added to the Operating Budget, bringing the total with these additions to $326,816,166; and be it

FURTHER RESOLVED: That Federal Funds in the amount of $17,141,085 along with State Funds in the amount of $310,119,673 and Other Local Funds in the amount of $3,305,837 be added to the Operating Budget bringing it to a total for FY 2012/13 of $657,382,761; and be it

FURTHER RESOLVED: That the School Board of the City of Virginia Beach requests a Lump Sum Appropriation of $657,382,761 for FY 2012/13 from the City Council of Virginia Beach for the School Board FY 2012/13 Operating Budget; and be it

FURTHER RESOLVED: That the School Board of the City of Virginia Beach requests an appropriation of $145,385,873 for special grants revenue funds comprised of Federal Grants in the amount of $49,930,082, State Grants in the amount of $18,471,230, and other special revenue funds in the amount of $76,984,561 for the 2012/13 fiscal year and that the total of these funds be included in the Lump Sum Appropriation; and be it

FURTHER RESOLVED: That the total of the Lump Sum Appropriation is $802,768,634; and be it

FURTHER RESOLVED: That for informational purposes only, the Categorical breakdown of the Lump Sum Total of $802,768,634 is as follows:

FINALLY RESOLVED: That a copy of this resolution be spread across the official minutes of this Board, and the Clerk of the Board is directed to deliver a copy of this resolution to the Mayor, each member of the City Council, the City Manager, and the City Clerk.

B. FY2012/13 Salary Resolution:  Mr. Farrell E. Hanzaker, Chief Financial Officer, reviewed composition of the proposed three percent (3%) compensation increase including a one percent (1%) Virginia Retirement System (VRS) offset.  Following the review, Mr. Salyer made a motion, seconded by Mr. Reid, that the Board approve the FY2012‐13 Salary Resolution as presented.  The motion passed unanimously and the resolution approved as follows:

SALARY RESOLUTION FY 2012/13

WHEREAS, the mission of the Virginia Beach City Public Schools, in partnership with our entire community, is to empower every student to become a life-long learner who is a responsible, productive and engaged citizen within the global community; and

WHEREAS, the School Board has adopted a comprehensive strategic plan and school improvement priorities to guide budgetary decisions; and

WHEREAS, the School Board has studied the recommended School Operating Budget in view of state and federal requirements, additional demands for space and operations, the strategic plan, priorities, expectations, competitive compensation for employees and the best educational interests of its students; and

WHEREAS, the School Board Proposed Operating Budget has been reconciled to meet the funding levels provided by the State and the City Council; and

WHEREAS, the Instructional and Unified scales and part-time hourly rates as shown in the attachments are approved and will be effective July 1, 2012; and

WHEREAS, the total compensation increases will be provided as follows:

Instructional Personnel (Attachment A & Attachment B) Personnel on the Instructional Salary Schedule will move up the 2012/13 scale one step to reflect a year of creditable teaching experience

(average of 3% increase including a 1% VRS offset), The Instructional Salary Schedule entry step will be increased by 2% over the current scale and the top of the scale will be increased by

1.5% including a 1% VRS offset, Unified Scale (Attachment C) Employees on this salary scale will be provided a 3% pay increase including a 1% VRS offset , except for the minimum of each pay grade

will be increased by 2% and the maximum of each pay grade will be increased by 1.5% including a 1% VRS offset; and

WHEREAS, Part Time/Temporary Rates for FY 2012/13 have been adjusted as reflected in Attachment D; and

WHEREAS, the Unified Pay Plan – Grade Assignments FY 2012/13 have been revised to reflect the addition/deletion/change of certain job titles as shown in Attachment E.

NOW, THEREFORE, BE IT

RESOLVED: That the Board adopts the Salary Scales, the compensation increases, and the job title additions/deletions/changes as outlined in this resolution and attachments; and be it

FINALLY RESOLVED: That a copy of this Resolution be spread across the official minutes of this School Board.
