Minutes of the eighty eighth meeting of the State Level Expert Appraisal Committee, West Bengal held on 28.06.2014 at 11:30 hrs. at the Conference Room, Paribesh Bhawan, Salt Lake.

In the beginning of the 88th meeting of SEAC, which was held on 28.06.2014 at 11:30 hrs. at the Conference Room, Paribesh Bhawan, Bidhan Nagar, the Secretary, SEAC welcome all the members. After introductory session, two cases were discussed under 'Miscellaneous' section. Eleven applicants were requested to make their presentation before the committee. Ten applicants appeared before the SEAC for technical presentation on their respective project proposal. Fourteen cases were placed for reconsideration.

SESSION I

A. Miscellaneous Section :

1. Proposed IT Park by M/s. Dhunseri Petrochem & Tea Ltd. at Jl. No. 35, Mouza – Gangapur, Kolkata Information Technology Park (KITP), Bantala, PS – Kolkata Leather Complex, Dist. – 24 Parganas (South).

SEAC has recommended EC in the 67th meeting held on 21.05.2012 for M/s. Dhunseri Petrochem & Tea Ltd. SEIAA has sent a letter to SEAC on 16.08.2012 requesting to study the water balance in CLC area.

The above matter was discussed in the 71st meeting held on 24.09.2012, 73rd meeting held on 30.11.2012 & 75th meeting held on 30.01.2013 and SEAC had requested Director, SWID, GoWB to provide opinion on the status of water availability based on latest water census in the concerned area.

The above issue was discussed in the 77th SEAC meeting held on 26.03.2013 and the committee has issued a reminder letter to the SWID for providing opinion as per latest water census of the area and this case has been kept pending due to nonavailability of opinion of SWID.

SEAC has received a letter dated 25.04.2013 issued by the Director, SWID regarding EC application in respect to applicants namely M/s Phoenix Software Ltd., M/s Dhunseri Petrochem and Tea Ltd., and M/s Cognizant Technology Solutions India (P) Ltd. at KITP Bantala mentioning that M/s. Dalmiya & Co. should apply in prescribed form at the office of the Geologist & Member Secretary, DLA of South 24 Parganas & necessary permission in this regard will be provided by DLA, South 24 parganas as per provisions under GWAct duly approved by SLA and Technical Subcommittee.

M/s. Dhunseri Petrochem & Tea Ltd. submitted a letter to the Member Secretary, WBPCB on 03.10.2013 informing that M/s M L Dalmiya has already applied to SWID for installation of an additional tubewell as recommended by SWID.

The case was considered in the 79th meeting held on 28.12.2013 and the committee recommended to forward the case to SEIAA for necessary action.

SEIAA referred the proposal back to SEAC mentioning that it is not conclusive whether M/s. ML Dalmiya & Co. Ltd. had obtained necessary permission for abstracting ground water for subsequent distribution of water to the project proponent.

M/s. Dhunseri Petrochem & Tea Ltd. submitted a letter on 12.06.2014 to SEAC that M/s. ML Dalmiya & Co. Ltd. has obtained necessary permission from SWID for abstracting ground water of 90m3/hrs. @ 10 hrs./day.

Name of the Environmental Consultant is M/s. Centre for Sustainable Development. The case was placed for information in the 88th meeting held on 28.06.2014. The SEAC discussed the project proposal & submission of the project proponent and recommended to forward the submission (permission for abstraction of ground water issued by SWID in favor of M/s M.L Dalmia & Co.) of the project proponent to the SEIAA for consideration.

2. Proposed application for amendment of Environmental Clearance from 3x135 MW CFBC based boiler to 3x150 MW PF based boiler by M/s. India Power Corporation (Haldia) Ltd. at Jl. No. – 94, Mouza – Kismatshibrampur, Jl. No. – 170, Mouza – Tentulberia, Jl. No. – 147, Mouza – Sovarampur, Jl. No. – 146, Mouza – Kashbere, PS – Bhabanipur, Haldia, Dist. – Purba Medinipur, West Bengal.

The proponent earlier applied for environmental clearance on 31.12.2008 for the proposed Coal based Thermal Power Plant (3x135 MW) at Haldia for the captive energy requirement of Bhaskar Silicon Ltd. for the proposed Poly Silicon Solar PV project. The proponent obtained EC from SEIAA on 12.04.2010.

The proponent has again applied for environmental clearance on 20.04.2011 for 450 MW TPP instead of 405 MW TPP. Earlier proposal was for AFBC Boiler, present proposal is for PF Boiler.

The SEAC has considered the project proposal in the 57th meeting held on 25.07.2011. SEAC decided that since CEPI related moratorium in Haldia is still in force the SEAC is not in a position to consider the case and accordingly informed to SEIAA dated 27.07.2011.

Accordingly, SEIAA informed the project proponent on 11.08.2011 that this proposal which involve expansion in capacity cannot be processed at a state level.

The project proponent has again requested vide their letters dated 26.12.2013 to consider the proposal in the SEAC meeting since moratorium imposed by MoEF has been lifted for Haldia industrial clusters in West Bengal.

The case was put up for consideration in the 80th SEAC meeting held on 18.01.2014. The SEAC after detailed discussion recommended to forward the case to the SEIAA for taking necessary action as moratorium imposed by MoEF has been lifted for Haldia industrial clusters in West Bengal still Haldia industrial cluster is considered as Critically Polluted Areas and attract general conditions as per

EIA Notification, 2006 and its amendment thereafter. Member Secretary, WBPCB and Secretary, SEAC, WB also sent a letter to MoEF seeking opinion in this regard.

SEAC, WB received a letter from MoEF vide D.O no. J13015/16/2014IA.I dated 27.06.2014 regarding EC application of the project proponent. The SEAC discussed and reviewed the project proposal in light with the letter issued by MoEF, in the 88th meeting held on 28.06.2014. During the meeting SEAC recommended that above mentioned proposal including Form I and other relevant documents as submitted by the project proponent are to be forwarded to MoEF for consideration of the project.

SESSION II

B. Note on Technical presentations

Industry Sector:

1. ToR presentation for the proposed expansion of 1x4 MT induction furnace by M/s. Steel Crackers Pvt. Ltd. at J.L no.14, MouzaBighati, Vill Dhobapukur, P.SBhadreshwar, DistHooghly, West Bengal.

Activity:

This is a proposal for expansion of 1x4 MT induction furnace in the existing plant.

After carefully considering the submission by the project proponent and presentation, SEAC recommended ToR (Annexure – I) for preparing draft EIA/EMP reports.

2. ToR presentation of proposed expansion of the Cement Grinding Unit of M/s. Pristine Cement (P) Ltd., at Jl. No. – 15, Dag No. – 636, 637, 638, 639, 646, 650 and 650/780, Vill. & PO – Suryapur, Mouza – Navarand, Tehsil – Barrackpore, Sewli Gram Panchayat, Khardah Barasat Road, Dist. – 24 Parganas (N), Pin – 700121, West Bengal.

Activity:

This is a proposal for expansion of a Cement Grinding unit for manufacturing Portland Slag Cement (200 TPD / 60000 TPA) and Portland Pozzolona Cement (100 TPD / 30000 TPA). It is noted that clinker will not be manufactured at the site. The manufacturing process will involve grinding of Cement Clinker with Slag / Flyash and Gypsum. The proponent has earlier obtained EC from SEIAA and NOC from WBPCB for installation of a Cement Grinding unit with Oil fired Slag drier for manufacturing Portland Slag Cement (50 TPD / 14400 TPA). However, the proponent has now proposed to install Coal fired Slag Drier.

ii. Land Area – 1.653 acres (earlier 1.16 acres). iii. Raw Materials Clinker, Slag, Flyash, Gypsum, Coal for Slag Drier.iv. Additional Production Capacity Portland Slag Cement (200 TPD / 60000 TPA) and Portland

Pozzolona Cement (100 TPD / 30000 TPA). v. Emission Sources Raw Material Handling Section, Transfer Points, Ball Mills (1x200 TPD and

1x100 TPD), Cement Silo, Packing Section etc. to be provided with high efficiency Bag Filters and Coal fired Slag Drier.

vi. Air Pollution Control System – Bag Filters with stack of height 30m from GL shall be provided at Raw Material Handling Section, Transfer Points, Ball Mills (1x200 TPD and 1x100 TPD), Cement Silo, Packing Section etc. Wet Cyclone with stack of height 30m from GL. should be provided for Coal fired Slag Drier, as proposed.

3. ToR presentation of proposed standalone cement grinding unit of capacity1.5 MTPA and CPP 10 MW of M/s. Emami Cement Ltd. at Raghunathpur Industrial Park, Mouza—Durmut, Raghunathpur, DistPurulia, Pin 713336, West Bengal.

Activity:

This is a proposal for installation of a stand alone Cement Grinding unit (1.5 MTPA) with Coal fired TPP 10 MW. It is noted that clinker will not be manufactured at the site. The manufacturing process will involve grinding of Cement Clinker with fly ash and Gypsum.



i. Location of the Site – Raghunathpur Steel & allied industrial Park, Mouza Durmut, Raghunathpur, Dist – Purulia.

Name of the Environmental consultant M/s. JM EnviroNet Pvt. Ltd. The case was put up for consideration in the 88th meeting held on 28.06.2014. After carefully considering the submission by the project proponent and presentation, SEAC recommended ToR (Annexure – III) for preparing draft EIA/EMP reports.

4. ToR presentation for proposed expansion of 2x12 T Induction Furnace by M/s. Shree Parasnath ReRolling Mills Ltd. at 3511(P) & 4010 (P), JL No. 85, Touzi No. 1, Khatian No. 93, Mouza – Gopinathpur, Dist – Burdwan, West Bengal.

Activity:

This is a proposal for expansion of 2x12 T Induction Furnace at the existing unit at 3511(P) & 4010 (P), JL No. 85, Touzi No. 1, Khatian No. 93, Mouza – Gopinathpur, Dist – Burdwan.

5. Proposed Upardanga Granite Mine project by M/s. Todi Minerals Pvt. Ltd. at Upardanga Granite Block, Mouza – Talsankara, JL No. 163, Plot No. 3310, PS – Raghunathpur, Dist – Purulia, PIN – 723 133, West Bengal.

Activity:

This is a proposal for mechanized mining of granite of 1 ha. Lease area for 5 years. Total gross Granite 8730 m3 volume. The granite blocks from the granite deposit in the form of Hilock will be extracted and further upto 10 mtr. depth below the surface will also be extracted.


Salient features of the proposed project are :

1) Location of the Site – Mouza – Talsankara, JL No. 163, Plot No. 3310, PS – Raghunathpur, Dist – Purulia, PIN – 723 133, West Bengal.

The case was put up for consideration in the 88th meeting held on 28.06.2014. The project proponent vide letter dated 26.06.2014 requested SEAC to allow them to make a proper presentation in the next SEAC meeting.

6. Proposed modernization of existing Ductile Iron Pipe Plant by M/s. Rashmi Metaliks Ltd. at Vill. Gokulpur, PO Shyamraipur, PS – Kharagpur, Dist. – Paschim Medinipur, West Bengal.

Activity:

This is a proposal for modernization of existing Ductile Iron Pipe Plant without changing any production capacity at the existing unit at Vill Gokulpur, PO Shyamraipur, PS – Kharagpur, Dist. – Paschim Medinipur.


M/s. Rashmi Metaliks Ltd. has obtained EC from SEIAA on 09.10.2009 for expansion project for installation of Ductile Iron Pipe Plant of capacity 2,00,000 TPA. Now, they have applied for modernization of existing plant without changing any production capacity.

The case was put up for consideration in the 88th meeting held on 28.06.2014. The SEAC scrutinized the documents submitted by the unit. During the presentation the committee noted there is gross mismatch in the information provided in the Form I submitted to SEIAA as compared to the presentation. SEAC also noted that the proposed Environmental Clearance application is not a modernisation project as submitted.

Therefore the committee recommended that project proponent should submit their Environmental Clearance application afresh for further consideration.

Construction Sector:

1. Proposed Residential Complex by M/s. Bikas Chandra Sinha & Ors. at 59 B.T Road, P.SChitpur, Ward no. 4 under KMC, Kolkata – 700 002, West Bengal.

Activity:

This is a proposal for construction of a Residential Complex having 159 flats (1 block of B+G+21 storied having two towers connected at basement, Gr. & 1st floor level) with club and community facilities.


Salient features of the proposed expansion project are –

Name of the Environmental Consultant is M/s. Centre for Sustainable Development. The case was put up for consideration in the 88th SEAC meeting held on 28.06.2014. After carefully considering the proposal and presentation, the SEAC recommended stipulated conditions for environmental clearance for the project.

2. Proposed Office Building by M/s. Madgul Infrastructure Pvt. Ltd. at C.S Plot no 306(P), 306/222(P), Jl. No. – 35, Mouza – Gangapur, PS – Kolkata Leather Complex, Dist. – 24 Parganas (South), West Bengal.

Activity:

This is a proposal for construction of the Office Building having 1 block of G+11 storied building mostly IT and general office spaces along with retail facilities.


Salient The above proposal has been considered in the 78th SEAC meeting held on 08.05.2013. During the 78th SEAC meeting, committee recommended for delisting the project due to nonsubmission of relevant documents for more than six months as asked by SEAC.

As per fresh EC application dated 19.05.2014, salient features of the proposed project are –

Name of the Environmental Consultant is M/s. Centre for Sustainable Development. The case was put up for consideration in the 88th SEAC meeting held on 28.06.2014. The SEAC scrutinized the documents submitted by the unit. During the presentation the committee recommended that the project proponent should submit the following:

1. Source and availability of fresh water intake for the proposed project, along with necessary permission.

2. Detailed solid waste management plan for disposal of inorganic and organic waste.

3. Revised rain water harvesting proposal excluding recharging.

4. At least 2% of total project cost should be dedicated for CSR activities. Time bound financial commitment in this regard to be submitted.

It has been decided that the case shall be further considered only after submission of the necessary clarification/information.

3. Proposed Residential Complex by M/s. Fortune Park Housing Projects (P) Limited at 168 Krishnanagar Road, Vill. – Paschim Khilkapur, L.R Khatian no.1772, J.L no.6, Mouza – Moynagadi, PS Barasat, Dist. 24 Parganas (N).

Activity:

This is a proposal for construction of a Residential Complex having 819 flats (13nos. G+11 storied buildings and 1no. G+7 storied building) and Club cum Community Building (G+2 storied).

The above proposal has been considered in the 87th SEAC meeting held on 11.06.2014.

As per fresh EC application dated 27.03.2014, salient features of the proposed project are –

The unit presented their proposal before SEAC on 84th SEAC meeting held on 01.04.2014. During the presentation the committee recommended that the unit should submit reconciled and updated status map showing existing mining activities within 500m radius of their existing lease hold area, authenticated by the appropriate authority.

The project proponent submitted on 16.06.2014 the reconciled and updated status map showing existing mining activities within 500 m radius for the existing lease hold area prepared by approved Mine Planner of Mining Department, GoWB.

The case was put up for reconsideration in the 88th meeting held on 28.06.2014. After careful consideration, the committee recommended the project for Environmental Clearance.

2. Proposed expansion of 20033 TPA Black Stone Mining project by M/s. Aryans Stone Quarry at Vill – Jamkandar, Mouza Tarachua, PS Rampurhat, PO – Kastogora, Jl No. 36, Plot No. 3943(P), 3944, 3945, 3946(P), Dist – Birbhum, West Bengal.

Activity:

This is a proposal for expansion of stone quarry / mining of capacity 20033 ton/year of lease area 3.62 acres in Vill – Jamkandar, Mouza Tarachua, PS Rampurhat, PO – Kastogora, Jl No. 36, Plot No. 3943(P), 3944, 3945, 3946(P), Dist – Birbhum, West Bengal. The quarry shall be semimechanised with down hole blasting and with shovel dumper combination. Mining will be carried out with the help of heavy earth moving machineries for digging, excavation and removal of stone in conjunction with deep hole drilling and blasting. The quarry shall be semimechanised with down hole blasting and with shovel dumper combination. Mining will be carried out with the help of heavy earth moving machineries for digging, excavation and removal of stone in conjunction with deep hole drilling and blasting. No abstraction of water is required. Requirement of water is 5 KLD will be available from borewells. Existing DG set of 1x250 KVA. 6. expansion project for enhancement of production of Unsaturated Polyester Resins by M/s. Strongbonds Polyseal Pvt. Ltd. at Plot No. – 26/C, 26/D/1 & 26/D/2, Kalyani Industrial Estate Phase I, Block – D, Dist. – Nadia, Pin – 741235, West Bengal.

Activity:

This is an expansion proposal for enhancement of production capacity of Unsaturated Polyester Resins (UPR) by 690 TPA. The proposed plant will be located adjacent to the existing plant at Kalyani Industrial Estate. During the 52nd SEAC meeting it has been understood by SEAC that the proposed expansion work has been started before obtaining environmental clearance. The PP has given an undertaking that they will not continue any work for expansion project before getting all statutory clearances to SEAC on 13.10.11


The case was recommended by SEAC in the 60th SEAC meeting held on 24.10.2011 with condition that the effluent as well as kettle wash water should be suitably treated in ETP to meet environmental standards. The effluent should be reused within the plant as much as possible and only the excess flow is to be discharged after compliance with the environmental standards. Effluent treatment plant should be monitored on a regular basis.

The Member Secretary, SEIAA noted that there is a lack of clarity regarding effluent treatment unit (both existing as well as proposed unit) and returned the case to SEAC with a request to get the clarification on effluent treatment from the project proponent.

The case was placed in the 63rd SEAC meeting held on 31.01.2012 and the committee has sought observation from WBPCB regarding the present status of effluent treatment plant.

The unit was inspected by Board officials on 02.04.2012 and it was observed that the process does not require any water. Water is byproduct generated due to polymerization process which is collected in a container for pH correction by caustic soda and then evaporated in an evaporator and released through a stack of ht. 24 m from ground level.

The unit has submitted a letter dated 03.05.2012 mentioning that earlier the unit had biological effluent treatment plant for treatment of water generated from the process. However, the unit has failed to maintain the anaerobic bacteria, in most cases it died and instead controlling the oxygen deficiencies it was actually increasing the BOD and COD level. Therefore, the unit has installed evaporator by discarding the ETP.

The unit has also proposed to install higher capacity evaporator for the expansion project and mentioned that as the polymerization reaction is hydrophobic in nature, no water is used to clean the reactor. Styrene Monomer which is used as raw material and is also a solvent for the product is used for cleaning.

The solid waste remaining after evaporation is sent to WBWML, Haldia and unit has obtained hazardous waste authorization from WBPCB for existing plant.

The SEAC has reviewed the letter of the project proponent submitted on 07.05.2012 in the 67th

meeting held on 25.04.2012 and made the following recommendations. Subsequent response dated 28.02.2013 from the unit is given below :

1. A detailed proposal for Effluent Treatment Plant.

1. The project proponent mentioned that the wastewater from the reaction chamber is slightly acidic in nature. Such acidic effluent is initially neutralized using caustic. Neutralized effluent is then put into an evaporator (functioning at more than 100°C). Water vapour from the evaporator is released to the atmosphere through a piping system (comprising of SS and FRP pipes). Wastewater treatment flow sheet submitted in this regard.

2. Analysis report of stack gas emitted from the evaporator especially with respect to composition of volatile substances for the existing plant.

2. The unit has submitted Chromatogram Plot of organic compounds present in flue gas. The unit has also submitted list of organic compounds identified by GC/MS analysis.The proponent mentioned that Sludge generated in the evaporator is hazardous in nature. Such sludge is being handed over to West Bengal Waste Management Ltd. for ultimate disposal which is accomplished by incineration at WBWML’s own facility. The unit has also submitted application for renewal of Hazardous Waste Authorization to WBPCB, Authorization was valid upto 30.04.2012.

The SEAC has reviewed the letter submitted by the pp on 28.02.2013 in the 77th meeting held on 26.03.2013. The SEAC has recommended that a detailed proposal for effluent treatment plant to be submitted.

The unit has submitted the detailed proposal for effluent treatment plant along with the flow diagram on 14.05.2013. The proposed ETP shall comprise of the following: Reaction Chamber, Settling Chamber, Sand Filter Bed, Collection pit, Carbon Bed, Biological Chamber followed by another Carbon Bed.

The SEAC has reviewed the letter submitted by the project proponent on 14.05.2013 in the 79th

meeting held on 28.12.2013. The SEAC has recommended that project proponent should submit waste water characteristics and schematic of the proposed wastewater treatment system with influent and effluent data. SEAC also noted that the unit has already started construction and accordingly forwarded to SEIAA for necessary action.

SEIAA requested SEAC to verify the current ground possession whether they have stopped expansion work as per their undertaking on 25.03.2014.

The project proponent submitted letter on 05.05.2014 schematic of the proposed waste water treatment system along with influent and effluent data.

WBPCB has conducted an inspection on 15.05.2014 and observe that activity related to expansion unit not yet completed and no activity related to expansion work was going on.

The SEAC has reviewed the reply of the project proponent dated 05.05.2014 in the 87th meeting held on 11.06.2014 and recommended that the project proponent should submit the proposal for effluent

treatment plant indicating dimensional details and inlet / outlet characteristics of effluent generated from the process.

The project proponent has submitted dimensional schematic diagram of proposed ETP through their letter dated 26.06.2014.

The case was put up for reconsideration in the 88th meeting held on 28.06.2014. During the meeting, SEAC noted that no expansion work is being done at present as observed during inspection carried by WBPCB officials on 15.05.2014 and recommended to forward the proposal for effluent treatment plant as submitted by the project proponent on 26.06.2014 to SEIAA for consideration.

It has been decided that the case shall be further considered only after submission of the necessary clarification.

7. Proposed Township project (PHASE – IA) by M/s. Kolkata West International City Pvt. Ltd. at Mouza – Kona, Baltikuri, Bankura, Pakuria, Tentulkuli, Khalia & Salap, PO & PS – Domjur, Dist – Howrah, West Bengal.

Activity

This is a proposal for development of a Township with 9000 dwelling units, commercial facilities and other infrastructural facilities. The proposed development shall comprise of 5 phases.


The State Level Expert Appraisal Committee (SEAC) has granted Provisional Environmental Clearance for the proposed Township project in the 7th meeting held on 26.07.2007. The proponent mentioned that the proposed development shall comprise of 5 phases.

Subsequently, the proponent obtained Environmental Clearance from the State Environment Impact Assessment Authority, West Bengal for PHASE – I of the proposed project on 11.11.2008 and amendment of the said Environmental Clearance from the State Environment Impact Assessment Authority, West Bengal for PHASE – I of the proposed project on 04.02.2010.

The proponent has submitted vide letter dated 08.09.2011, sanctioned plan for PHASE – IA along with key plan sanctioned by KMDA, comparative statement and other documents.

The case was placed in the 59th SEAC meeting held on 20.09.2011 and the SEAC noted that the total project area is 390.165 acres. The project proponent earlier obtained Environmental Clearance from the State Environment Impact Assessment Authority, West Bengal for PHASE – I comprising of 89.174 acres. Now the unit applied for PHASE – IA which is only 4.283 acres. The SEAC requested the project proponent vide letter dated 30.09.2011 to consider the project in an integrated manner and also to explain the reasons for reverting to the proposal for sending the sewage to the KMW STP instead of augmenting the capacity of the STP at the project site in a modular form. desired to review the compliance status of the PHASE – I for which Environmental Clearance has already been granted.

The proponent has submitted their reply on 22.11.2011. The proponent has mentioned that as per development agreement with KMDA, the sewer line is to be connected to KMW & SA STP at Kona. However, Kona STP was too far from PHASE – I development and development planning for finalisation of the route of the sewer line could not be done for PHASE I. Hence, construction of STP of 650 KLD was considered for PHASE – I. If it is not feasible to connect the sewer line for PHASE – IA, the capacity of the existing STP will be enhanced.

Now the project proponent has submitted on 27.05.2014 mentioning that KMDA has assured supply of treated water as per the agreement from Padmapukur water Treatment Plant by the end of December, 2015 and another letter was submitted on 10.06.2014 along with copy of application for sinking of bore well.

The case was put up for reconsideration in the 88th meeting held on 28.06.2014. The SEAC reviewed the reply of proponent and recommended that project proponent should submit permission for abstraction of ground water/ concurrence regarding availability of water from the competent authority as per requirement for Phase I and Phase IA also. It has been decided that the case shall be further considered only after submission of the necessary clarification.

8. Proposed Residential Complex “IDEAL EXOTICA” by M/s. Ideal Real Estates Pvt. Ltd. at 21, Pramatha Choudhury Sarani, KMC Ward No. 81, PS – New Alipore, Kolkata – 700 053.

Activity

This is a proposal for construction of Residential Complex having 158 flats (5 blocks of 2B+G+21 storied buildings) and club house.


The During the presentation in the 59th meeting held on 20.09.2011, the SEAC has observed that this housing project has been proposed in a site which is likely to be contaminated due to past industrial activity. The SEAC directed vide letter dated 10.10.2011 that the project proponent should first assess the level and type of remediation required, prepare specific site remediation plan and get the site remediated properly. The project proponent should also obtain necessary approval from West Bengal Pollution Control Board after remediation. The SEAC decided that this case would be considered only after the above actions are satisfactorily executed.

The proponent submitted their reply on 21.11.2011. The proponent has submitted the test results conducted by National Test House for nickel content only. The project proponent has mentioned that since the nickel content at site is 10 times lower than the threshold limit, no remediation is necessary.

The State Level Expert Appraisal Committee (SEAC) has considered the submission of the project proponent dated 21.11.2011 in the 61st meeting held on 29.11.2011. The committee requested the

project proponent to assess the level of contamination in the proposed site by a competent agency like NEERI and address all the issues raised in the previous letter dated 10.10.2011.

The project proponent again submitted a reply on 30.01.2012 mentioning that they have obtained test result through National Test House, a Govt. of India organisation, it is observed from their report that nickel content was determined to be 0.05% by mass. The threshold limit for nickel as per Hazardous Waste (Management & Handling) Rules is 5000 mg/kg which is equivalent to 0.5% by mass. As the nickel content is 10 times lower than the threshold limit no remediation measures are deemed necessary.

The project proponent has submitted a reply along with the test report of NEERI on 21.03.2013. They also mentioned that the nickel content in soil at the above mentioned site is 68.12 mg/kg. by mass. The threshold limit of nickel as per the Soil Guideline Values (Environment Agency 2009) for land use for residential use is 130 mg/kg and the Soil guideline Values for Nickel as per India Standards is 75150 mg/kg. Therefore, the nickel content at their proposed site is 55% lower than the threshold limit, hence there will be no harmful effect.

During the 78th meeting held on 08.05.2013 SEAC opined that opinion of Waste Management Cell, WBPCB to be obtained on the report provided by the project proponent.

The SEAC considered the submission by the proponent and remarks of the WMC, WBPCB in the 79th

meeting held on 28.12.2013 and recommended that the project proponent should submit the report after incorporating necessary modifications as suggested by the WMC, WBPCB.

The project proponent submitted on 11.03.2014 the modified report incorporated by NEERI.

The modified report was considered in the 83rd SEAC meeting held on 25.03.2014 and after careful consideration the SEAC recommended to refer the case to the Waste Management Cell, WBPCB for opinion on the revised report submitted by the project proponent.

WBPCB reviewed the revised report and provided their comments.

The name of the Environmental Consultant is M/s. Ghosh Bose & Associates Pvt. Ltd. The case was put up for reconsideration in the 88th meeting held on 28.06.2014. After careful consideration of all the documents, SEAC recommended stipulated conditions for environmental clearance for the project.
