CONSIDERATION O F SENATE BILL 4 0 9 :
Sena to r Regan, Dis t r ic t 31, gave an exp lana t ion o f t h i s b i l l , which i s an a c t t o g e n e r a l l y r e v i s e t h e law r e l a t i n g t o a s s a u l t s and i n t e n t i o n a l t o r t s o c c u r r i n g between spouses . She s t a t e d t h a t t h i s b i l l came o u t of a s tudy d e a l i n g w i t h spouse abuse , which t h e Montana Board of Crime Con t ro l funded, and o u t of which came t h e book, "A Study of Spouse B a t t e r i n g i n Montana". (See copy enc losed) She s a i d t h a t on page 3 of t h e book t h a t it d e a l s w i t h Montana law and remedies. She f e l t t h a t t h e s t a t e has an i n t e r e s t and a du ty t o p r o t e c t one i n d i v i d u a l from i n j u r y t o a n o t h e r , and she d i d n o t f e e l t h a t a mar r iage l i c e n s e should be a l i c e n s e t o b a t t e r .
Ca ro l M i t c h e l l , from t h e S t a t e Task Force on Spouse Abuse, and i n p r i v a t e p r a c t i c e i n Missoula , Montana, s t a t e d t h a t t h e common law of Montana p r e v e n t s s u i t s between husbands and wives, and p a r e n t s and c h i l d r e n ; and she f e l t t h a t w e should a b o l i s h t h a t immunity.
Pam Larson, an Eng l i sh t e a c h e r from Eas t e rn i n B i l l i n g s , and mother of two sons , age 1 4 and 15, s t a t e d t h a t she and h e r sons were p a r t of a b a t t e r i n g exper ience . She s a i d t h a t s h e p r e f e r r e d cha rges a g a i n s t h e r husband i n beha l f of h e r s e l f and h e r youngest son , t h a t h e r former husband was found g u i l t y o f a s s a u l t , t h a t t hey had e x t e n s i v e medical expenses; and t h e man w a s f i n e d $50 .00 and r e l e a s e d . She s t a t e d t h a t she was fo rced t o pay t h e medical b i l l s f o r h e r son because she was h i s l e g a l r e p r e s e n t a t i v e , She a l s o p a i d medical expenses f o r h e r s e l f .
Sharon McVicker, r e p r e s e n t i n g h e r s e l f , s t a t e d t h a t s h e was a l a b t e c h n i c i a n and when she had been marr ied f o r approximately one y e a r and when she was f o u r months pregnant , h e r husband he ld h e r a g a i n s t a w a l l whi le h i s 16-year o l d daughte r from a p rev ious mar r i age , k icked h e r i n t h e stomach. She s a i d t h a t she d i d n o t s u f f e r any more b a t t e r i n g u n t i l a f t e r h e r c h i l d was born; when she was v i o l e n t l y shoved through t h e f r o n t door and h e r r i g h t a r t e r y was severed and a p e r i p h e r a l nerve damaged. She s t a t e d t h a t she i n c u r r e d medical b i l l s over a six-month pe r iod and t h a t she had no p r o t e c t i o n and she was r e s p o n s i b l e f o r t h e b i l l s . She f u r t h e r s t a t e d t h a t a f t e r h e r f i r s t o p e r a t i o n she s u f f e r e d two more b e a t i n g s

M a r t i Adr ian gave a s t a t e m e n t c o n c e r n i n g s e x u a l a s s a u l t . She s a i d t h a t t h e c o u p l e may be g e n e r a l l y l i v i n g a p a r t w i t h o u t any s e x u a l a c t i v i t y . She s a i d t h a t s e x u a l a s s a u l t i s common and c u r r e n t l y w e p r o h i b i t p e o p l e from p r o s e c u t i o n b e c a u s e t h e y have n o t y e t f i l e d f o r a c i v i l a c t i o n o r d i v o r c e . She was b a t t e r e d a f t e r s h e had t r i e d t o g e t a d i v o r c e . T e c h n i c a l l y , s h e was s t i l l m a r r i e d and t h e r e was no way t o c o l l e c t f o r h e r permanent i n j u r i e s . C a r o l M i t c h e l l e x p l a i n e d t h a t from 1 4 t o 2 0 p e r c e n t o f t h e m a r r i e d women w i l l b e h o s p i t a l i z e d a s a r e s u l t o f v i o l e n c e i n t h e i r own homes and s h e f e l t t h a t t h i s was no minor problem.
S t e v e Waldron, R e p r e s e n t a t i v e and a member o f t h e Task F o r c e , s t a t e d t h a t it became a p p a r e n t t o him o f t h e overwhelming need t o a b o l i s h t h e i n t e n t i o n a l i m u n i t y , b u t i n r e g a r d t o t h e r e s t r a i n i n g o r d e r , he d i d t h i n k t h e r e was l i t t l e need f o r t h a t b e c a u s e i t i s j u s t a p i e c e o f p a p e r ; and when d e a l i n g w i t h t h e emot ions , he d i d n o t t h i n k i t would h e l p t h a t much.
. S e n a t o r Regan s t a t e d t h a t s h e t h o u g h t it was i m p e r a t i v e t h a t w e p a s s a l l t h r e e s e c t i o n s and s h e c o u l d a s s u r e t h e committee t h a t i t was e n t i r e l y n e c e s s a r y .
I S e n a t o r Towe q u e s t i o n e d on s e c t i o n 1, why t h i s i s n o t b e i n g
hand led i n t h e d i v o r c e d e c r e e ? t h a t i f i n j u r i e s have been i n t e n t i o n a i l y i n f l i c t e d , t h a t c e r t a i n l y t h i s i s a m a t t e r t h a t t h e d i v o r c e c o u r t 4

S e n a t o r Olson q u e s t i o n e d i f i n t h e i r Task Force s t u d y , d i d t h e y uncover any male s p o u s e a b u s e , and it was n o t e d t h a t 2 t o 7 p e r c e n t o f a b u s e c a s e s a r e abuse t o men.
M r . Bauer s t a t e d t h a t many women c a n c o l l e c t on t h e i r m e d i c a l , b u t he d i d n o t know of any c o u r t s t h a t would award any amount of money f o r permanent i n j u r i e s .
S e n a t o r Van Valkenburg s t a t e d t h a t i n s e c t i o n 3 , it would seem t h a t you would have more t h a n a p i e c e o f p a p e r i f you had a p e a c e bond.

He s t a t e d t h a t t h e y do n o t i n t e n d t o c o n f i s c a t e anybody 's c a r i f t h e y have j u s t a s m a l l amount o f m a r i j u a n a . H e commented t h a t t h e d rug t r a f f i c i s b i g b u s i n e s s and i n Montana i t i s g e t t i n g t o be b i g b u s i n e s s t o o . H e t h o u g h t t h a t t h i s m i g h t s low it down a l i t t l e .
Mike McGrath from t h e Department of J u s t i c e made a s t a t e m e n t i n s u p p o r t o f t h e b i l l .

S e n a t o r Turnage q u e s t i o n e d what a c o n t r o l l e d s u b s t a n c e is. M r . McGrath s t a t e d t h a t it was d e f i n e d i n T i t l e 50.

S e n a t o r Anderson wondered how long it would t a k e t o g e t a n a i r p l a n e back t o a n owner i f t h e y had s e i z e d one. M r . Honzel s t a t e d t h a t t h e r e i s a n e x c l u s i o n u n l e s s t h e y use t h e l e a s e a s a f r o n t .
S e n a t o r Van Valkenburg s t a t e d t h a t t h e p r o p e r t y would b e s o l d and t h e money p u t i n t o t h e g e n e r a l fund b u t t h e o t h e r a l t e r n a t i v e i s t h a t t h e l a w en fo rcement a g e n c i e s s t a r t b u i l d i n g t h e i r own armada o f cars, p l a n e s , e t c .
