Commission adopted the ALJ ’s recommenda t ion to acknowledge the

set t lement agreement en tered in to by the pa r t ies on Apr il 18, 2011.

However , the Commission found it necessa ry to address the except ions and

cross except ions filed by the pa r t ies. The proposed fina l decision is now

submit ted for the Commission’s review.
