7. Awards/ Delegations/ Presentations a) Presentations:

i) Tabling of the Property Standards By-law – Town Clerk

The Town Clerk provided a presentation, attached as Appendix A and forming part of these minutes, and responded to questions.

8. Public Meetings

i) Zoning By-law Amendment – 123 John Street North Resolution No. 125-16 (6:45 PM) Moved by Dan Lynch Seconded by Walter Stack That Council move into a public meeting regarding an application for Zoning By-law Amendment for 123 John Street North.

Resolution CARRIED Mayor Reid called the meeting to order at 6:45 PM., welcomed those present and the Planner noted requirements for oral or written submissions prior to adoption of the amending by-law for the purposes of the Ontario Municipal Board requirements. Staff confirmed that notice of this Public Meeting was mailed to all properties within 120 metres of the subject land, as well as posted on site, in accordance with the Ontario Planning Act and Ont. Regulation 545/06. No written comments were received prior to the meeting. Robin Smith, Planner, explained that the site is designated Mixed Use Commercial by the Town’s Official Plan and is currently zoned Mixed Use Commercial (MUC) by By-law 4990-01, as amended. A variety of commercial uses, including retail and restaurant are permitted in this designation. The former use of the property is for a retail store. The current owner proposes an upper-floor apartment and restaurant on the main floor. The proposed zoning amendment would rezone the lands from MUC to MUC-Exception Thirteen (MUC-E13). The amendment will reduce the required minimum parking spaces from 24 to 5 parking spaces. The floor was opened to the public for comments,

o The owner, Mr. Xidous, submitted a letter for Council’s consideration, attached as Appendix B and forming part of these minutes.

o Ms. Hogan provided an overview of the current renovation project for 123 John Street North.

Council requested the Town Planner to provide information from the past decisions made for new restaurant businesses in the Downtown, in the past 5 years, when it comes to parking requirements and cash in lieu of parking.

Mayor Reid thanked everyone for their comments and noted that all comments received will be taken into consideration when making the final decision.

The public meeting was declared closed at 7:06 PM. Resolution No. 126-16 (7:06 PM) Moved by Tom Burnette Seconded by Dan Lynch That Council resume to the Regular Meeting of Council.

Staff Reports a) Tabling of the Use and Care of Roads/Road Activity By-laws – Director of Public Works Resolution No. 127-16 Moved by Lynn Grinstead Seconded by Ted Strike That Council receive Report No. 16-04-11-01 regarding the draft Use and Care of Roads bylaw and draft Road Activity by-law as information.

The Director of Public Works provided an overview of the report and responded to questions. b) Emergency Preparedness Week – May 1- 7, 2016 – Town Clerk Resolution No. 128-16 Moved by Tom Burnette Seconded by Dan Lynch That Council proclaim May 1- 7, 2016 as “Emergency Preparedness Week” in the Town of Arnprior and encourage residents to take three simple steps to become better prepared to face a range of emergencies: “Know the Risks, Make a Plan and Get an Emergency Kit”

Resolution CARRIED

Councillor Lynch noted that Emergency Kits are available for purchase through the Canadian Red Cross, and that First Responders Day is on the first Monday in May (May 2, 2016).

Councillor Ted Strike noted that as per the resolution in the Operations Advisory Committee Minutes (Section 6, Item#2) that staff forward the Use and Care of Roads By-law as well as the Road Activity By-law to the Operations Advisory Committee Members.

Hearings (37-41 McGonigal St. East & 308-312 McLean Avenue) o Councillor Dan Lynch provided photos of the properties in question for

information. Item #3 – Page 8 - Information from the Arnprior Fire Fighters Fundraising Association

– SCBA Assemblies o Councillor Dan Lynch thanked the Arnprior Firefighters Fund Raising Association

on behalf of Council and the residents of Arnprior for their contribution of $72,000 towards the purchase of the new 24 Self Contained Breathing Apparatus’ that will be used by members of our fire department.

Item #4 – Page 9 - Information from the County of Renfrew - Physical Activity Equipment Lending Hub

o Councillor Dan Lynch congratulated staff on their hard work in procuring a $10,000 grant from the County of Renfrew for the Physical Activity Equipment Lending Hub. This grant will be used to promote physical activity and healthy living for children and families in our community.

Item #5 – Page 10 - Letter from Cheryl Gallant, MP Renfrew-Nipissing-Pembroke - Small Community Fund – New Building Canada Fund

o Councillor Dan Lynch expressed his disappointment with the letter received from the office of Cheryl Gallant, MP addressing the Infrastructure Grant funding that was promised, which is no longer being issued to the Town of Arnprior.

o In response to Councillor Lynch the CAO noted staff will forward the name of our Senior of the Year, to the Province of Ontario, Minister Responsible for Seniors Affairs, for recognition prior to the due date of April 30, 2016.

Item #13 – Page 49 – AMO – Watch File (March 31, 2016) o In response to Councillor Lynch the Director of Corporate Services/Treasurer

noted the Town is part of a consortium of municipalities who purchase group insurance in bulk. The Town did have significant savings by way of payment vacations over the last few years. Opportunities are always monitored, however the Town’s current plan is very competitive due to bulk purchase, and thus staff would not be recommending the LAS Group Benefits program at this time.

Item #13 – Page 47 & 48 – AMO – Watch File (March 24, 2016) o The Safer and Vital Communities Grant and the Proceeds of Crime Front Line

Policing Grant to help fund community led safety and corrections projects in the Province of Ontario are currently being offered. The province will invest up to $3.7 million under these two grant programs to support communities in the specified areas.

o In response to Councillor Lynch the CAO noted staff is currently considering both the Safer and Vital Communities Grant and the Proceeds of Crime Front Line Policing Grant, for applicability.

o Councillor Lynch also noted in follow up to Reeve Stack’s comments from the previous Council Meeting, with regards to getting more residents involved in becoming a Councillor; the Association of Municipalities of Ontario (AMO) is now offering on-line courses for “So You Want to Be a Councillor” at a cost of $30.00/ person. There are also numerous courses available for serving Councillors.

Reeve Walter Stack noted the following:

Item #3 – Page 8 - Information from the Arnprior Fire Fighters Fundraising Association – SCBA Assemblies

o Reeve Stack thanked the Arnprior Fire Fighters Fundraising Association for their generous donation towards the purchase of the new 24 Self Contained Breathing Apparatus’.

Item#6 – Page 11-12 – Information from Killaloe-Hagarty-Richards – Shaw Woods Outdoor Education Centre Programs

o Reeve Stack asked Members of Council to, at a future meeting, entertain the thought of contributing some funding towards this organization, as children from this area do attend the programs offered.

Mayor David Reid noted the following: Item#1 – Page 1 – Information from Trans Canada – Energy East Pipeline Project

Update o A report will be coming forward from staff, outlining the Energy East Pipeline

concerns identified by Council, and the proposed next steps by Trans Canada.

Reeve Walter Stack and Mayor David Reid commended the Arnprior and Area Physician Recruitment Committee for a well done “Guys Night Out – Casino Night”.

Mayor David Reid also took the time to recognize and provide condolences to the family of a former Councillor, longtime resident and business owner in the Town of Arnprior, Dr. Douglas Spaull, who passed away last week.

17. Media Questions Derek Dunn of Metroland Media inquired as to the current discussion about the Energy East Pipeline Project, asking what the decision would look like, and when the decision would take place.

Mayor David Reid responded to Mr. Dunn, indicating this information will be available, once staff brings forward their report to Council.

18. Closed Session

Resolution No. 132-16 (8:05 PM) Moved by Lynn Grinstead Seconded by Ted Strike That Council move into Closed Session regarding matters to discuss personal matters about an identifiable individual including municipal or local board employees; litigation or potential litigation, including matters before administrative tribunals, affecting the municipality or local board; and advice that is subject to solicitor-client privilege, including communications necessary for that purpose pursuant to Section 239(2) (b) (e) and (f) (Claims and Appeal ).

2001, as amended, gives municipalities the authority to pass and enforce by-laws.

• The Town of Arnprior has enacted By-laws to encourage residents and businesses to be responsible and respectful of their neighbours and contribute to the health, safety and vibrancy of the Town of Arnprior.

• Municipal Law Enforcement Officers respond to complaints of infractions related to certain municipal by-laws and related Provincial statutes.

• Typically by-law enforcement with regards to Property Standards was done on a reactive basis in response to community complaints.

• In 2015, staff were requested to bring forward a by-law to require that the property owner keep the property clean and free of refuse (Clean Yards); and

• Update the Property Standards By-law as appropriate.

(inoperative/unlicensed vehicles, indoor furniture, overgrowth of grass/weeds, appliances)

• providing compliance date (days/hours)

• In most cases compliance was achieved.

• Additional time was provided for extenuating circumstances.

• Five (5) Orders to Comply were Issued.

• Proactive enforcement deemed a success

Property Standards By-law• The current Town of Arnprior Property

Standards By-law No. 6065-12 was passed in 2012.

• The Property Standards By-law sets minimum standards to ensure that property owners’ maintain their properties.

• These standards are put in place to protect the health and safety of occupants as well as the general public.

Property Standards By-law • Standards within the current by-law were

reviewed by the Planner, CBO, MEDO, Town Clerk, Deputy Clerk, Public Works Supervisor, Deputy Fire Chief, MLES and the CSAC

• Staff amended definitions and incorporated additional standards that best add to the preservation, renovation and rehabilitation of existing buildings

Property Standards By-law

• Recommended changes have been highlighted in the draft by-law.

• With this review, staff is confident that the Town has an updated and comprehensive Property Standards By-law to serve the residents of Arnprior.

Next Steps

• It is the goal of staff to continue to educate the public with respect to the laws and to negotiate compliance.

• Property Standards By-law will be brought forward for consideration of Council at the Regular Meeting of Council on April 25, 2016.
