BOROUGH OF SOUTH TOMS RIVER

A Regular Caucus Meeting of Council of the Borough of South Toms River was held at the Borough Hall on Monday, May 14, 2012 at 7:00 pm.

Those present were Mayor Champagne; Councilmen Cradle, McCormack, Murray, Ross, Sykes, Williams. Also present Solicitor Hensel.

Notice of this meeting was given to the Asbury Park Press on December 16, 2011 and notices were posted on the bulletin boards in the Clerk's Office and Meeting Room on said date.

A motion was made by Councilman Cradle seconded by Councilman Ross to approve the following resolution:

RESOLUTION AUTHORIZING COMBINED SALE AND ISSUANCE OF BOND ANTICIPATION NOTES IN AN AGGREGATE AMOUNT NOT TO EXCEED $1,591,477 GENERAL IMPROVEMENT BOND ANTICIPATION NOTES OF THE BOROUGH OF SOUTH TOMS RIVER, IN THE COUNTY OF OCEAN, NEW JERSEY.

WHEREAS, the Borough of South Toms River (the "Borough"), in the County of Ocean, New Jersey has determined it is in the best interest of the Borough to have a combined sale of the Borough's Bond Anticipation Notes as set forth herein; and WHEREAS, the Borough has determined to issue Bond Anticipation Notes for General Improvements in an amount not to exceed $1,591,477 pursuant to the following Ordinances:

NOW, THEREFORE, BE BOROUGH OF SOUTH JERSEY, AS FOLLOWS:

Section 1. Pursuant to N.J.S.A. 40A:2-8, the following amounts of General Obligation General Improvement Bond Anticipation Notes (the "Notes") shall be issued at such dates and in such amounts as determined by the Chief Financial Officer and/or acting Chief Financial Officer in accordance with this resolution:

a. Pursuant to Bond Ordinance No. 07-04, Notes in the principal amount of not to exceed $64,000 to redeem the Prior Note and for the purpose stated therein.

b. Pursuant to Bond Ordinance No. 11-05, Notes in the principal amount of not to exceed $114,000 to redeem the Prior Note and for the purpose stated therein.

c. Pursuant to Bond Ordinance No. 10-06, Notes in the principal amount of not to exceed $49,911 to redeem the Prior Note and for the purpose stated therein.

d. Pursuant to Bond Ordinance No. 08-07, Notes in the principal amount of not to exceed $139,843 to redeem the Prior Note and for the purpose stated therein.

e. Pursuant to Bond Ordinance No. 08-08, Notes in the principal amount of not to exceed $193,953 to redeem the Prior Note and for the purpose stated therein.

f. Pursuant to Bond Ordinance No. 06-09, Notes in the principal amount of not to exceed $209,770 to redeem the Prior Note and for the purpose stated therein.

g. Pursuant to Bond Ordinance No. 02-10, Notes in the principal amount of not to exceed $270,900 to redeem the Prior Note and for the purpose stated therein.

h. Pursuant to Bond Ordinance No. 04-11, Notes in the principal amount of not to exceed $549,100 for the purpose stated therein.

Section 2. Pursuant to the provisions of Section 40A:2-26 of the Local Bond Law of New Jersey, particularly paragraph (f) thereof, and in lieu of the sale of more than one (1) issue of bonds or notes as provided for in said Local Bond Law, the issues of bonds and notes of the Borough authorized pursuant to the Bond Ordinances of the Borough hereinabove set forth shall be combined into one (1) issue of Notes to be sold in the aggregate amount of not to exceed $1,591,477. Section 3. The following matters in connection with said Notes are hereby determined:

(a) All notes issued hereunder and any renewal thereof, shall mature at such times as may be determined by the Chief Financial Officer and/or acting Chief Financial Officer of the Borough, provided that any note issued pursuant hereto shall be issued for a period not to exceed one (1) year, but all such notes, including renewals shall mature and be paid in accordance with the Local Bond Law.

(b) All notes issued hereunder shall bear interest at such rate or rates as may be determined by the Chief Financial Officer and/or acting Chief Financial Officer of the Borough.

(c) The notes shall be in a form as permitted by law and approved by Bond Counsel, and issued pursuant to the Local Bond Law, and any such notes or any renewal thereof, may be signed or sealed by officers of the Borough in any manner permitted by Section 40A:2-25 of said Law notwithstanding what is otherwise set forth herein.

Section 4. The Chief Financial Officer and/or acting Chief Financial Officer of the Borough is hereby authorized and directed to determine all matters in connection with said Notes or any renewal thereof, no determined by this or a subsequent resolution and his/her signature upon said Notes shall be conclusive as to such determinations. Section 5. The Chief Financial Officer and/or acting Chief Financial Officer of the Borough is hereby authorized to sell said Notes or any renewal thereof, from time to time at public or private sale in such amounts as he/she may determine at not less than par value and to deliver same from time to time to the purchasers thereof upon receipt of payment of the purchase price plus accrued interest from the dated date of the Notes to the date of delivery thereof and payment therefore. Section 6. Any instrument issued pursuant to this resolution shall be a general obligation of the Borough, and the Borough's faith and credit are hereby pledged to the punctual payment of the principal of and interest on said obligation and, unless otherwise paid or payment provided for, an amount sufficient for such payment shall be inserted in the budget and a tax sufficient to provide for the payment thereof shall be levied and collected. Section 7. The governing body of the Borough hereby covenants on behalf of the Borough to take any action necessary or refrain from taking any action in order to

preserve the tax exempt status of the debt obligations authorized hereunder as is required under the Internal Revenue Code of 1986, as amended, including compliance with said Code with regard to the use, expenditure, investment, timely reporting and rebate of investment earnings as may be required thereunder. Section 8. This resolution shall take effect immediately.

A motion was made by Councilman Sykes seconded by Councilman McCormack to approve the following resolution:

RESOLUTION OF THE BOROUGH OF SOUTH TOMS RIVER, COUNTY OF OCEAN, STATE OF NEW JERSEY, AWARDING A BID TO GRANTURK EQUIPMENT CO., INC., IN THE AMOUNT OF $256,250.00 FOR AN AUTOMATED REFUSE COLLECTION VEHICLE, PURSUANT TO AND IN ACCORDANCE WITH N.J. S.A. 40A:11-1, et seq.

WHEREAS, bids have heretofore been received by the Borough for an automated refuse collection vehicle, pursuant to and in accordance with N.J.S.A. 40A:11-1, et seq.; and WHEREAS, sealed bids were received and publicly opened on May 3, 2012; and WHEREAS, the Borough Engineer has advised the Borough Council that GranTurk Equipment Co.. Inc. is the lowest responsible bidder on the basis of those proposals received within the meaning of N.J.S.A. 40A:11-1 et seq.; and WHEREAS, the Borough Attorney has reviewed and approved the form of the bid submission in compliance with the Local Public Contracts Law and responsive to the bid specification; and WHEREAS, the Borough Council is satisfied with the recommendation offered by the Borough Engineer and wishes to award the contract to GranTurk Equipment Co., Inc. NOW, THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of South Toms River, County of Ocean, State of New Jersey, as follows:

1. That the bid is hereby awarded to GranTurk Equipment Co., for an automated refuse collection vehicle in the amount of $256,250.00, on the basis of its bid dated May 3, 2012, the specifications, general conditions and other contract documents pursuant to N.J.S.A. 40A:11-1, et seq. 2. That the Mayor is authorized to execute and the Clerk to attest to the proposed form of contract aforesaid. 3. That the contract to be entered into with such bidder shall include the mandatory affirmative action language as set forth in P.L. 1975, c. 127. 4. The Mayor and the Clerk are authorized to execute any and all documents necessary to effect the purposes of this resolution. 5. That the award of the contract aforesaid shall be conditioned upon the certification of availability of funds by the Chief Financial Officer. 6. A certified copy of this Resolution shall be sent to GranTurk Equipment Co., Inc.

A motion was made by Councilman McCormack seconded by Councilman Murray granting permission for the South Toms River First Aid Squad to hold a Coin Toss on June 30, 2012 from 8:00 am to 4:00 pm at the intersection of Railroad Avenue and Dover Road.

At this time, Mayor Champagne thanked everyone who made Founder's Day on May 5, 2012. He especially thanked Councilmen Ross and Cradle and the South Toms River First Aid Squad. He also wished all of the mothers present a belated Happy Mother's Day.

At this time, Mayor Champagne presented certificates to the following "Students of the Month" from South Toms River Elementary School for the month of April: Mea Applegate, Gabriel Lezama, Kellia Butterbrodt, Jahleel Grant, Dante Gant, Jayden Barcliff, Elizabeth Tschirpke, Michael Lego, Julain Sabella-Vitale, Hector Hernandez, MiSun Harvey, Haylee Hillard, Mason Pyle, Mikayla Rosser, Logan Rispoli, Zamya Lawrence, Brandon Radcliffe-Bivins, Christine Estelle, Alexis Arena, Isabella Sanchez, Dossy Felts, Donato Madera

At this time, Ms. Antoinette Figueroa, Principal of Sung Stars Academy gave a talk to the students present about the importance of education and how to achieve their goals. She also encouraged them to help their mothers.

A motion was made by Councilman Ross seconded by Councilman Cradle to enter into a brief recess.

At this time, Councilman Ross drew the names of the winners from the raffle from the Borough's Founder's Day held on May 5, 2012.

Public Comments:

William Gleason, 19 Long Drive — Summer Camp registration is this Saturday from 9:00 am to 11:00 am.

Rob Krohn, South Toms River first Aid Squad — The Squad is having a fund raising drive and will give monthly reports. Anything on the ambulance. Have a quote for $150,000.00 for a new ambulance. EMS Week.

A motion was made by Councilman Ross seconded by Councilman McCormack to close the Public Comments section of the meeting.

At this time, Greg and Thomas from Avaya Systems spoke to the Governing Body regarding the installation of a new telephone system for the Borough.

NOTICE OF PENDING BOND ORDINANCE AND SUMMARY

The bond ordinance, the summary terms of which are included herein, was introduced at a meeting of the Governing Body of the Borough of South Toms River, in the County of Ocean, State of New Jersey, on May 21, 2012. It will be further considered for final passage, after public hearing thereon, at a meeting of the governing body to be held at the Borough Municipal Building, 144 Mill Street, South Toms River, New Jersey, in said County, on June 18, 2012 at 7:00 p.m. During the week prior to and up to and including the date of such meeting copies of the full ordinance will be available at no cost and during regular business hours, at the Clerk's office for the members of the general public who shall request the same. A motion was made by Councilman Murray seconded by Councilman Ross for a resolution authorizing the Mayor and Clerk to execute an agreement between the Borough and Johnson Baran Corp. for the Lakeview Drive Roadway Improvements project in the amount of $117,107.00.

A motion was made by Councilman Cradle seconded by Councilman McCormack to approve the following resolution:

WHEREAS, the Borough of South Toms River has received liquor license renewal applications for the year 2012; and WHEREAS, the Division of Alcoholic Beverage Control requires all existing licenses to be renewed by the issuing municipality; and WHEREAS, the Borough of South Toms River has received renewal application for a Club License in the name of GROUNDSWIPERS ROD AND GUN CLUB CORP., for the premises known as 213 Magnolia Ave. trading under the same name, license No. 1529-31-004-001; and WHEREAS, the Borough of South Toms River held a hearing to renew said license on May 21, 2012; and WHEREAS, the Borough of South Toms River received no objection to the renewal application; and WHEREAS, the Borough of South Toms River has reviewed the application for renewal and determined it to be in order. NOW, THEREFORE, BE IT RESOLVED THIS 21st day of May, 2012 that the applicant's request for a one year renewal of its previously issued liquor license be and hereby is approved.

WHEREAS, emergency medical services is a vital public service; and WHEREAS, the members of emergency medical services teams are ready to provide lifesaving care to those in need 24 hours a day, seven days a week; and WHEREAS, access to quality emergency care dramatically improves the survival and recovery rate of those who experience sudden illness or injury; and WHEREAS, the emergency medical services system consists of emergency physicians, emergency nurses, emergency medical technicians, paramedics, firefighters, educators, administrators and others; and

WHEREAS, the members of emergency medical services teams, whether career or volunteer, engage in thousands of hours of specialized training and continuing education to enhance their lifesaving skills; and WHEREAS, it is appropriate to recognize the value and accomplishments of emergency medical services providers by designating Emergency Medical Services Week; and WHEREAS, the Borough of South Toms River would like to recognize and honor the South Toms River Volunteer First Aid Squad for their dedication in providing emergency medical services. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of South Toms River, in the County of Ocean and State of New Jersey, in recognition of this event, do hereby proclaim the week of May 20 — 26, 2012 as:

RESOLUTION OF THE BOROUGH OF SOUTH TOMS RIVER, COUNTY OF OCEAN, STATE OF NEW JERSEY, SUPPORTING COMMUNITY MEDICAL CENTER'S APPLICATION FOR A NEW CARDIAC SURGERY PROGRAM

WHEREAS, Ocean County, New Jersey is the 6th largest county in the State of New Jersey, and has the highest population of citizens over the age of 65; and WHEREAS, cardiovascular disease is the leading cause of death in the United States and the leading cause of death for those over the age of 65 and more Ocean County residents die from heart disease than any other county in New Jersey; and WHEREAS, Ocean County does not have a hospital that provides cardiac surgery although there are 18 approved facilities in New Jersey, including 14 in Northern New Jersey and at least one in 11 other counties; and WHEREAS, the distribution of cardiac surgery programs in New Jersey leaves the highest concentration of citizens most vulnerable to cardiovascular disease underserved and without comparable access as other senior populations throughout the State; and WHEREAS, the length of travel for Ocean County residents to receive the services associated with cardiac surgery not only has negative criminal impacts, but puts undue financial stress on County residents with fixed incomes and who rank #1 in households receiving Social Security and other retirement income; and WHEREAS, Ocean County residents are not only denied access to cardiac surgery within the County, they are denied a series of other cardiac procedures that should be easily accessible to populations most in need; and WHEREAS, Community Medical Center in Toms River, provides the greatest access to the underserved senior population in Ocean County, including three of the top 5 senior populations in New Jersey in Berkeley, Manchester and Toms River and is centrally located between other cardiac surgery facilities; and WHEREAS, Community Medical Center currently performs an array of cardiac services and the performance of these services indicates a unique capacity to successfully provide cardiac surgery to Ocean County residents; and WHEREAS, the State of New Jersey has not accounted for the senior population in Ocean County who are most vulnerable to cardiovascular disease and in need of the full array of cardiac services when issuing a certificate of need for Cardiac Surgery in the past. NOW, THEREFORE, BE IT RESOLVED, that the Mayor and Council of the Borough of South Toms River, County of Ocean, State of New Jersey do hereby call upon the State of New Jersey to allow Community Medical Center in Toms River the ability to perform cardiac surgery in order to provide sustainable access that currently does not exist for Ocean County residents most in need of this lifesaving procedure; and

WHEREAS, the Borough of South Toms River recognizes and acknowledges the hard work and diligence of Larry Anzovino in his achieving the honor of being the Executive Director of the New Jersey Mayor's Association; and WHEREAS, Larry Anzovino has tirelessly served the Borough of Dunellen as Mayor, Councilman, Volunteer Fireman and Life Member of the Dunellen-Rescue Squad; and WHEREAS, Larry Anzovino established and led the statewide effort to have all Fire Departments throughout the State receive a Thermal Imaging Camera; and WHEREAS, Larry Anzovino further established and led the statewide effort to have all Police or Fire Departments throughout the State receive an Automatic External Defibrillator; and WHEREAS, these successful efforts have led to the Governor proposing to equip police patrol cars statewide with video cameras and recording equipment. NOW, THEREFORE, BE IT RESOLVED, that the Mayor and Council of the Borough of South Toms River, County of Ocean, State of New Jersey, pay tribute and acknowledge the efforts made by Larry Anzovino as Executive Director of the New Jersey Mayor's Association.

RESOLUTION OF THE BOROUGH OF SOUTH TOMS RIVER IN SUPPORT OF HAITIAN HERITAGE MONTH AND HAITIAN FLAG DAY

WHEREAS, throughout the history of Haiti, May has been a month for commemorating Haitian culture with Haitians across the globe celebrating their achievements and contributions both in Haiti as well as the many historic, cultural, social and economic contributions of Haitians to the United States and the world; and WHEREAS, in 1779, a legion of free Haitian soldiers in the army of Comte d'Estang, commanded by Vicomte de Frontages, came to the Southern part of the United States, in Savannah, Georgia to fight alongside the Army of George Washington against the British. They met the fierce charge of Lieutenant Colonel Maitland and save the retreating Franco-American army from total disaster. One of the drummer boys from this brigade, Henri Christophe, returned and later became the King of Haiti. WHEREAS, Toussaint Louverture assisted by several Haitian revolutionaries defeated Napoleon Bonaparte's army and forced him on May 2, 1803 to liquidate the Louisiana Territory of 820,000 square miles of land or 565 million acres to Thomas Jefferson for only $15 million, a territory now home to 14 states, which essentially doubled the size and greatness of the United States without costing one American soldier's life. WHEREAS, In 1816, with the military and financial support of Haitian President Alexandre Petition, Simon Bolivar freed Latin America from Spanish control. Included in those territories were Venezuela, Bolivar, Panama, and Ecuador. WHEREAS, Haitians around the world remain proud of their history and culture, and urge that this year's celebrations to embrace the theme, "The Contributions of the Haitian People to The United States of American and Latin America"; and WHEREAS, the adoption of the Haitian flag on May 18, 1803 was the single most important event that officially ended a 12 year war, marking the end of slavery in Haiti and eventually in North and South America; and WHEREAS, promoting understanding and harmony among people is important to a community and their institutions; and WHEREAS, the Toms River Schools' efforts to provide its students with programs and services which emphasize ethnic pride, cultural sensitivity, positive inter-group relations and cross-cultural communications is ongoing; and WHEREAS, Friday, May 18, 2012, is set aside to celebrate Haitian Flag Day throughout the world and particularly in the United States from municipalities to the White House. NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the Borough of South Toms River, in the County of Ocean and State of New Jersey, hereby extends its support of Haitian Heritage Month to be celebrated yearly throughout the month of May. BE IT FURTHER RESOLVED, that the Mayor and Council of the Borough also extends its support of the celebration of Haitian Flag Day on May 18 of every year and urges all schools and educational institutions to support this community-wide observance. Public Comments:

Jennifer Zimerla, 417 Chamberlain Street — I have some questions in frustration. I do a lot for this town and I feel there is a lack in communications. I received a summons and a fine in the amount of $100.00 for not getting a new dog license. I assumed that I would receive a notice. I spend thousands on the Christmas party for the town's children. The trash pickup was changed without notice. Also, I was told that there was going to be a meeting on May 7th.

Rob Krohn, Captain, South Toms River First Aid Squad — I sent a letter regarding the purchase of a new ambulance. I spoke to someone from the USDA for a reimbursement grant and I am looking into other grants to aid in the cost of this purchase.

A motion was made by Councilman Cradle seconded by Councilman McCormack authorizing the First Aid Squad to go out for bids for a new ambulance.
