HORTICULTURAL PRODUCTS IMPORT
BY THE GRACE OF GOD ALMIGHTY
THE MINISTER OF TRADE REPUBLIC OF INDONESIA,
Considering:
a. that to enhance the effectiveness of the implementation of the
provisions on horticultural product import, there need to be
amendment on several provisions of the Regulation of the Minister of
Trade Number 30/M_DAG/PER/5/2012 concerning Provisions of
Horticultural Products Import as amended by Regulation of the
Minister of Trade Number 38/M-DAG/PER/6/2012;
b. that based on considerations as intended in item a, need to establish
Regulation of the Minister of Trade;
In view of:

REGULATION OF THE MINISTER OF TRADE CONCERNING
SECOND AMENDMENT OF REGULATION OF THE MINISTER
OF TRADE NUMBER 30/M-DAG/PER/5/2012 REGARDING
PROVISION OF HORTICULTURAL PRODUCTS IMPORT.

Article I
Several provisions in the Regulation of the Minister of Trade Number
30/M-DAG/PER/5/2012 concerning Provision of Horticulture Products
Import as amended by Regulation of the Minister of Trade Number 38/M-
DAG/PER/6/2012, has been amended as follow:
1. Provision of Article 1 was amended to read as follow:
Article 1
In this Ministerial Regulation what is referred as:
1. Horticulture are all matters relating to fruits, vegetables, medicinal
plants ingredients and floriculture including mushrooms, mosses
and water plants which functions as vegetables, medicinal plant
ingredients and/or aesthetic materials.
2. Horticultural Products are all products derived from horticultural
crops that are still fresh or that are already processed.
3. Fresh Horticultural Products are plant based foods which are
resulting product of post-harvest processing for consumption or for
industrial raw materials, and/or products which has gone through
minimal processing.
4. Processed Horticultural Products are foods or drinks which results
from certain means or methods with or without additives.
5. Import is activity of entering goods into Customs Area.
6. Producer Importers of Horticultural Products, hereinafter referred
to as Producer Importers of HP/ IP-Produk Hortikultura are
industrial companies which use Horticultural Products as raw
materials or supporting materials in the production process itself
and not trading or transferring to other parties.
7. Registered Importers of Horticultural Products, hereinafter referred
to as Registered Importers of HP/ IT-Produk Hortikultura are
companies which import Horticultural Products for the purpose of
business activity by trading or transferring to other parties.

8. Distributors are national trading companies acting for and on its
own behalf, whose scope include buying, storing, selling, as well
as marketing of goods, especially delivering goods from importers
to retailers.
9. Label is every information regarding Horticultural Products in the
form of picture, writing, a combination of both or other form
which contain information about the product and the business as
well as other information in accordance with the provision of
legislation in effect, is included on the product, incorporated into,
placed on or part of the packaging.
10. Food Grade Logo is a marking which indicates that the food
packaging is safe to use for food.
11. Recycling Code is a marking which indicates that the food
packaging can be recycled.
12. Packaging is material used to contain and/or encase Horticultural
Products, either in direct contact or not.
13. Import Approval is a Horticultural Products import permit.
14. Horticultural Products Import Recommendation (HPIR) /
Rekomendasi Impor Produk Hortikultura is a letter issued by the
official agency/related technical unit in charge and a requirement
for the issuance of Import Approval.
15. Verification or technical inquiry is a technical inspection activity
on imported products carried out at the loading port by surveyor.
16. Surveyor is a survey company which is authorized to carry out
imported product verification or technical inspection activity.
17. Minister is the minister who held government affairs in the field of
trade.
18. Director General is the Director General of Foreign Trade,
Ministry of Trade.

2. Article 2 deleted.
3. Article 4 deleted.
4. Provisions of Article 7 was amended to read as follow:
Article 7
(1) To gain recognition as Producer Importers of HP as intended in
Article 5, companies must apply to the Minister in this case the
Director General, by attaching:
a. Photocopy of Industrial Business License or other similar
business license which make use of raw materials from
Horticultural Products, issued by authorized agency or
technical offices;
b. Photocopy of Company Registration Card / Tanda Daftar
Perusahaan (TDP).
c. Photocopy of Tax Identification Number / Nomor Pokok Wajib
Pajak (NPWP);
d. Photocopy of Producer Importer Identification Number / Angka
Pengenal Importir Produsen (API-P);
e. Proof of storage area in accordance with product
characteristics;
f. Proof of means of transport in accordance with product
characteristics;
g. Horticultural Product Import Recommendation (HPIR) /
Rekomendasi Impor Produk Hortikultura (RIPH) from the
Minister of Agriculture or appointed official.
(2) The Director General on behalf of the Minister published
admission as Producer Importers of HP at the latest 5 (five)
working days after field inspection by Assessment Team to verify
the authenticity of the document as intended in subsection (1).
(3) Inspection as intended in subsection (2) shall not exceed 3 (three)
working days from reception of completed application.
(4) Assessment Team as intended in subsection (2) consists of officials
assigned by the Director General.

(5) In terms of the result of the inspection as intended in subsection (2)
where incorrect data is found, the Director General refused to
publish appointment as Producer Importers of HP.
(6) Recognition as Producer Importers of HP as intended in subsection
(2) apply in accordance with HPRI as intended in subsection (1)
item g as of the date issued.
(7) Recognition as Producer Importers of HP as intended in subsection
(2) is forwarded to online portal Indonesia National Single
Window (INSW).
(8) In the case of Horticultural Products import through ports that are
not connected to Indonesia National Single Window (INSW), copy
of admission as Producer Importers of HP will be manually
submitted to the relevant agencies.
5. Provisions of Article 9 was amended to read as follow:
Article 9
(1) To obtain designation as Registered Importers of HP as intended in
Article 5, companies must submit a written request to the Minister
in this case the Director General, by attaching:
a. Photocopy of Trading License / Surat Izin Usaha Perdagangan
(SIUP) whose scope of business includes horticulture or other
similar business license published by authorized agency or
technical office;
b. Photocopy of Company Registration Card / Tanda Daftar
Perusahaan (TDP).
c. Photocopy of Tax Identification Number / Nomor Pokok Wajib
Pajak (NPWP);
d. Photocopy of General Importer Identification Number / Angka
Pengenal Importir Umum (API-U);
e. Proof of storage area in accordance with product
characteristics;
f. Proof of means of transport in accordance with product
characteristics;

g. Proof of Horticultural Product sales collaboration contract at
least with 3 (three) distributors for at least 1 (one) year;
h. Proof of experience as Horticultural Product distributor for 1
(one) year; and
i. Stamped letter of statement stating that it will not sell
Horticultural Product directly to consumers or retailers.
(2) The Director General on behalf of the Minister published
admission as Registered Importers of HP at the latest 5 (five)
working days after field inspection by Assessment Team to verify
the authenticity of the document as intended in subsection (1).
(2a) Inspection as intended in subsection (2) shall not exceed 3
(three) working days from reception of completed application.
(3) Assessment Team as intended in subsection (2) consists of officials
assigned by the Director General.
(4) In terms of the result of the inspection as intended in subsection (2)
where incorrect data is found, the Director General refused to
publish appointment as Registered Importers of HP.
(5) Appointment as Registered Importers of HP as intended in
subsection (2) is valid for 2 (two) years as of the date issued.
(6) Appointment as Registered Importers of HP as intended in
subsection (2) is forwarded to online portal Indonesia National
Single Window (INSW).
(7) In the case of Horticultural Products import through ports that are
not connected to Indonesia National Single Window (INSW), copy
of admission as Registered Importers of HP will be manually
submitted to the relevant agencies.
6. Provisions of Article 14 subsection (1) and subsection (2) was
amended to read as follow:
Article 14
(1) Horticultural Product imported by Registered Importers of HP
must meet packaging requirements:

a. Packaging in direct contact with food must use materials
permitted for food in accordance with regulating legislation.
b. Packaging which used plastic must include Food Grade Logo
and Recycling Code in accordance with regulating legislation.
c. Packaging which used wood must be dried and be marked in
accordance with regulating legislation.
(2) Packaging compliance as intended in subsection (1) must be
proven by:
a. Certificate of test results published by competent testing
laboratory and approved by local government; or
b. Letter of statement from importer which state that the
packaging used is in accordance with regulating legislation by
stating food grade and recycling code on the packaging.
(3) Packaging provisions as intended in subsection (1) is excluded for
Ornamental Plant Products.
7. Provisions of Article 15 subsection (1) was amended so that Article 15
read as follow:
Article 15
(1) Horticultural Products imported by Registered Importers of HP
must have label in Bahasa Indonesia on every product and/or
packaging.
(2) Horticultural Products as intended in subsection (1), during entry
into Republic of Indonesia territory has been labeled in Bahasa
Indonesia and at least include:
a. Product name and/or brand;
b. Product net weight or amount;
c. Name and address of producer and/or exporter; and
d. Name and address of importer.
(3) Labeling as intended in subsection (2), at least use Bahasa
Indonesia that is clear and easy to understand.

(4) The use of language other than Bahasa Indonesia, Arabic
numerals, Latin letters is permitted if there is no equivalent.
8. Article 18 deleted.
9. Article 19 deleted.
10. Article 20 deleted.
11. Provisions of Article 22 subsection (1) was amended so that Article 22
read as follow:
Article 22
(1) Verification as intended in Article 21 subsection (1) is conducted
on Horticultural Product import, that include data or information
regarding:
a. Country and port of origin;
b. Tariff post or HS number and product description;
c. Type and volume;
d. Date of shipping;
e. Port of destination;
f. Inclusion of Food Grade Logo and Recycling Code on
packaging;
g. Health Certificate;
h. Phytosanitary certificate for fresh horticultural product;
i. Certificate of Origin;
j. Food grade packaging test result certification or letter of
statement from importer stating that packaging used is in
accordance with the regulating legislation for fresh
horticultural products;
k. Inclusion of Food Grade Logo and Recycling Code, or letter of
statement stating that packaging used is in accordance with the
regulating legislation for fresh horticultural products; and
l. Compliance in labeling as intended in Article 15, except for
Ornamental Plant Products and Horticultural Products used as
industrial raw materials.

(2) Verification result as intended in subsection (1) is manifested in
Surveyor Report to be used as a complementary document for
Customs office in completing customs on import.
(3) The implementation of verification or technical inquiry and
intended in subsection (1), Surveyors collect fees from Registered
Importers of HP or Producer Importers of HP where the amount is
determined by the principle of benefit.
12. Provisions of Article 24 subsection (1) was amended to read as follow:
Article 24
(1) Producer Importers of HP and Registered Importers of HP must
submit a written report on the implementation of Horticultural
Product import by attaching Import Control Card / Kartu Kendali
Realisasi Impor scan result that has been signed and stamped by
Custom officials.
(2) The report as intended in subsection (1) is delivered every month
through http://inatrade.kemendag.go.id no later than by the 15th
(fifteenth) of the following month to the Director General with a
copy to the Director General of Marketing and Processing of
Agriculture Product, The Ministry of Agriculture and The Head of
The National Agency of Drug and Food Control.
(3) The report form as intended in subsection (1) attached in Appendix
II which is an integral part of this Ministerial Regulation.
(4) Import Control Card / Kartu Kendali Realisasi Impor as intended
in subsection (1) is a control card on import realization of
Horticultural Product.
13. Provisions of Article 26 item c was amended so that Article 26 read as
follow:
Article 26
Recognition as Producer Importers of HP dan appointment as
Registered Importers of HP is revoked if the company:
a. Does not perform the obligations to submit reports as intended in
Article 24 as many as 3 (three) times;

b. Proven to have alter information contained in Horticultural Product
import documents;
c. Proven to have violated packaging provisions as intended in
Article 14 and/or labeling provisions as intended in Article 15;
d. Proven to have been trading and/or transferring imported
Horticultural Products as intended in Article 12 for Producer
Importers of HP; and/or
e. Proven to have been trading and/or transferring imported
Horticultural Products to other than Distributors as intended in
Article 12 for Registered Importers of HP; and/or
f. Found guilty by a court decision which is legally binding for
criminal offense related to abuse on Horticultural Product import
documents.
14. Provisions of Article 30 was amended to read as follow:
Article 30
(1) Companies that import Horticultural Products not in accordance
with packaging and labeling in this Ministerial Regulation will be
sanctioned in accordance to the regulating legislation.
(2) Import of fresh Horticultural Products, if:
a. not in accordance with recognition as Producer Importers of
HP and/or Import Approval; and/or
b. not in accordance with packaging provisions as intended in
Article 14 and/or labeling provisions as intended in Article 15,
will be destroyed in accordance to the regulating legislation.
(3) Imported Ornamental Plant Products, if not in accordance with
recognition as Producer Importers of HP and/or Import Approval
will be destroyed in accordance to the regulating legislation.

(4) Import of Processed Horticultural Products, if:
a. not in accordance with recognition as Producer Importers of
HP and/or Import Approval; and/or
b. not in accordance with packaging provisions as intended in
Article 14 and/or labeling provisions as intended in Article 15,
will be destroyed in accordance to the regulating legislation.
(5) Costs for the implementation of extermination and re-export as
intended in subsection (2), subsection (3) and subsection (4) is the
responsibility of the importer.
15. Provisions of Article 30 was amended to read as follow:
Article 35
Technical implementation guidance of this Ministerial Decree is set by
the Director General of Standardization and Consumer Protection in
accordance with the duties and functions.
16. There are 2 (two) articles inserted in between Article 35 and Article
36, namely Article 35A and Article 35B which read as follow:
Article 35A
Exemptions from the provisions set out in this Ministerial Decree must
be with the approval of the Minister with considerations to proposals
from related technical agencies.
Article 35B
Recognition as Producer Importers of HP, appointment as Registered
Importers of HP, and Import Approval as a complementary document
for Customs in completing customs on import starting in 30 (thirty)
days since this Ministerial Regulation takes effect.
17. There is 1 (one) article inserted in between Article 36 and Article 37,
namely Article 36A which read as follow:

Article 36A
(1) Provision of this Ministerial Regulation is not applicable for
imported Horticultural Product that is shipped from country of
origin before 28 September 2012.
(2) Horticultural Product import as intended in subsection (1) can be
proven by Bill of Lading or Airway Bill and Invoice.
(3) Horticultural Product as intended in subsection (1) must arrive at
the port of destination at the latest by 28 November 2012 evidence
by custom documents in the form of manifest (BC 1.1).
18. Appendix I of Regulation of the Minister of Trade Number 30/M-
DAG/PER/5/2012 concerning Provision of Horticultural Product
Import as amended by Regulation of the Minister of Trade Number
38/M-DAG/PER/6/2012 amended to be as detailed in Appendix I
which is an integral part of this Ministerial Regulation.
Article II
This Ministerial Regulation shall come into effect on 28 September
2012.
For public cognizance, ordering the promulgation of this Ministerial
Regulation by including it in the Official Gazette of the Republic of
Indonesia.
