MAINTENANCE NOTES
ALL LANDSCAPING AS SHOWN ON APPROVED LANDSCAPED PLAN SHALL BE MAINTAINED
IN A VIGOROUS GROWING
CONDITION. ANY PLANTS NOT SO MAINTAINED SHALL BE REPLACED WITH HEALTHY NEW
PLANTS OF COMPARABLE SIZE, TYPE, AND QUALITY AT THE BEGINNING OF THE NEXT
IMMEDIATELY FOLLOWING GROWING SEASON.
ALL LANDSCAPING SHALL BE MANAGED ORGANICALLY TO PREVENT GROUND WATER,
POND, AND WETLAND CONTAMINATION. THE USE OF ORGANIC SLOW-RELEASE
FERTILIZERS, COMPOST TOPDRESSING, AND/OR COMPOST TEAS ARE SPECIFICALLY
ENCOURAGED.
IN ACCORDANCE WITH THE NYSDEC HOUSEHOLD DETERGENT AND NUTRIENT RUNOFF
LAW (SECTION 35-105), THE FOLLOWING CONDITIONS APPLY:
1. USE OF PHOSPHORUS-CONTAINING LAWN FERTILIZERS ARE PROHIBITED (EXCEPT
WHEN ESTABLISHING A NEW LAWN OR A TEST SHOWS THE LAWN IS
PHOSPHORUS-DEFICIENT).
2. ANY FERTILIZER SPILLED ON IMPERVIOUS SURFACES MUST BE PICKED UP.
3. APPLICATION OF LAWN FERTILIZER WITHIN 20 FEET OF SURFACE WATER IS
PROHIBITED, EXCEPT WHERE THERE IS A VEGETATIVE BUFFER OF AT LEAST 10 FEET;
OR WHERE THE FERTILIZER IS APPLIED BY A DEVICE WITH A SPREADER GUARD,
DEFLECTOR SHIELD OR DROP SPREADER AT LEAST THREE FEET FROM SURFACE
WATER.
4. LAWN FERTILIZER CAN ONLY BE APPLIED BETWEEN APRIL 2ND AND NOVEMBER 30 (
PROHIBITED DEC 1ST - APRIL 1ST) .
NOTES
1. THERE SHALL BE NO PLANT SUBSTITUTIONS UNLESS AUTHORIZED BY STAFF OF THE OYSTER
BAY TOWN PLANNING AND ENVIRONMENTAL DEPARTMENT.
2. THE LOWER BRANCHES OF STREET TREES OVERHANGING PUBLIC SIDEWALKS OR
WALKWAYS SHALL BE PRUNED TO ALLOW FOR A SEVEN (7) FOOT GROUND TO HEIGHT
CLEARANCE
3. ALL PLANT MATERIAL GUARANTEED FOR A PERIOD OF ONE YEAR FOLLOWING ACCEPTANCE
BY OWNER.
4. ALL PLANTING BEDS SHALL BE WEEDED AND HAVE A MINIMUM OF FOUR (4) INCH THICK LAYER
OF WOOD CHIPS (OR SHREDDED BARK).
5. LANDSCAPING SHALL BE PLANTED AND MAINTAINED FOR ONE YEAR AFTER LAST
CERTIFICATE OF OCCUPANCY IS GRANTED.
6. NO PLANT MATERIAL, EXCEPT LAWN OR GROUNDCOVER, IS TO BE LOCATED WITHIN 2 FEET
OF ANY PARKING LOT CURB.
7. ALL DECIDUOUS TREES TO BE GUYED TO TWO 3" DIAMETER CEDAR STAKES 180 DEGREES
APART.
8. ALL TIES AND WRAPPING SURROUNDING THE ROOT BALL AND TRUNK SHALL BE REMOVED AT
TIME OF PLANTING.
9. NO TREE IS TO BE LOCATED WITHIN 10' OF DRYWELLS, WALLS, DRAINAGE STRUCTURES, AND
PIPING.
10. FIELD PLANTING OF STREET TREES AND OTHER PLANT MATERIALS MUST BE UNDER THE
SUPERVISION OF A LICENSED NEW YORK STATE REGISTERED LANDSCAPE ARCHITECT OR
QUALIFIED HORTICULTURIST DEEMED QUALIFIED BY THE REVIEWING AGENCY TO OVERSEE
LANDSCAPE INSTALLATION IN ACCORDANCE WITH THE TOWN REQUIREMENTS. THE
DEVELOPER MUST SUPPLY THE TOWN ENGINEER WITH AN AFFIDAVIT FROM THE REGISTERED
LANDSCAPE ARCHITECT OR QUALIFIED HORTICULTURIST STATING THAT THE QUALITY,
