In the Joint Meeting of the represe-ntatives of all State Bar Councils JUld Bar Council of India. concerns were raised by all that trend of Advocates switching over to other prof~sions/serviceslbusiness w1thout any information to the State Bar Council has reached alarm..ing.fX9POrtions. This trend is endangering the legal profession as a whole. lt has also made a dent in its .sancti!Y~.an(i,standa.r.ds. Names of such advocates continue to be included in the " Roll of advocates'' being ~otained ' by the State Bar Councils, notwithstanding the fact that they have left the 1~1 profession or-have since died. Though under section 19 of the Advocates Act, the State bar Councils arc under legal obligation to-send a copy of the. Roll ofaqvocate~ prcp:tred by ir under section 17 ofthe Act and subsequent alterations/additions thereto but practicaJiy no state bar Council has observed th•s mandatory provision of the Act up till now.

Under these c ircumstances it appears that a oefinite trend is visible that the control of Bar ;\<;soc1ations and of other elected bod ies under rhc AdvocaLcs Act . is s lipping out of the hands of the ad.,ocatcs who practice bw. 'variOUS welfare schemes for advocates have been noatcd ml.ndla both under State Legislations as well as under vanous welfare schemes framed by different Stat:.: Bar Councals and by Bar Council of lnd::1 but benefits thereunder arc being enjoyed by those also who have left the pro.t:cssiou. ·

There is also an urgent need for laying down some conditions for practicing law in diiTerent Courts so as to give due wcightagc and credence to experience. Before an advocate could pr:actice law in highl!r COUI1s, there is need that he is exposed to real court e:<pcrience in low.er Courts/trial Ceurt.s. This w111 help in intcgratmg the whole judicial system from the perspective ofthe Bar.

The other object was/is also to introduce certain electoral reforms in the Bar Council/Bar Association electiolls, because Jn recent ·past, the Bar Council of India and the State Bar Counci ls have come across 1he ·cases of rigging in -the -polls and the allegations of bogus voting has now become frequent. since the State Bar C<)uncils·.andlor m-.jority of Baa As!>ociations of the country have no record of the Advocates who died after enrolment or w~lo joined othe1 jobs. business or professions. the Bar Counci l of India being the r~o.lar <Jf Legal profession and Lega •'ducat ion of rhe country has. therefore, decided to undertake tl1c .detailed vcrifioaHon and then to prepare l Yotcrs' List alongwith recent photographs of the Advocate (Voter). · The Council has framed 1hese Rules ir the light of the verdict of Hon 'blc Apex Court in the case 'O'f'·Supreme Court ~r Association. Furthermore, since some of the Bar Associations have raised baseless objection with regard to the sum of Rs. 500/- as Practice F~ (as per them it is a l·,eavy amount); the major portion (about R.s.400/-) of this Rs. 400/- was aimed (in 2014 Rules) for providing welfare schemes (like Insurance for Advocates and their family members and improvement of infrastn1eture and Library of Bar 1\ssociationo;. Pensions etc.) Out due to objection, now the Coundl has resolved to segregate this amount of Rs. 400/- for wcll'are-schcmes from the process fee of verification. Now on I} Rs I 00/- is to be charged from the Advocates as Process fcc and rest of Rs. 400/- would be OP.tbnal not mandatory. depending upon the decision of concerned State Bar Council and the concerned AdH>Cntc. These rules will be .applicable to all the advocates whose names appear on the State RoUs bein1 maintained by the State Bar Councils 1Jnder section 17 o(lh~ Advocates Act.. l 961 .

3. Date ofcommencement:

These rules, except Rule 7 of Chapter Ill, shall come into force at once from the date or publicatior of these Rules in the Gazette of India. Rule 7 of Chapter Ill shall come into force on such date as th< Bar Council of India may, by notification in the Gazette of India. appoint in this behalf.

4. Definitions:

(a) Act means the Advocates Act. 1961

(b) Advocate means an advocate whose name is entered in the Roll of advocates being maintained by the State Bar Councils under section 17 of the Advocates Act. 1961.

(c) Certificate of Enrolment means the certificate of enrollment held b} an advocatt. :ssued under section 22 of the Advocates Act. 1961 .

(d) Certificate of Pntcticc in relation to an advo.:ntc having obt:unc!d graduate ~h.:grci:- in Ia'' before the academic year 20 I 0 enrolled on the roll of Advocates shall mean Certificate ol Practice issued under Rule 13 and in relation to an advocate graduating in Ia"" 111 academ1c year 2009-20 I 0 (I~ July, 2009 to JO'" Junc, 201 0) and thereafter, enrolled on or after 1th Day of June, 2010, Ccrt1fic~ne of Practice means the "Certificate of Practice•· issued under All India Bar Examination Rules or under Rule I 3 of these Rules or the enrolment certificate issued by the State Bar Council.

(c) State Bar Council means the State Bar Counci ls as defined under section 3 (I) (a) of the Advocates Act, 1961 .

(f) Verification/process fcc means the amountls payable under these rules as fee and amount for processing of Application and its verification This amount may be varied by the Bar Council of India from time to time and on such variation, the varied amount shall mean the fee.

(g) Bar Association of a given area/town/city means an area/territory and court work based association of advocates, weather rcg1stercd under the Societies Registration Act (Act No xxr of 1860) or not having its area/territory defined in tcnns of the whole or part of tht: territorial jurisdictiOn of Courts/Tribunal$/Persons. or any other Authorities lcg.ally competent to take evidence before which its members ordinarily practice law and it includes Oar Association exclusively dealing in specific fields of law viz Income Tax. Corporate Law, CentraVStatc Excise Law etc. in relation to the authorities/tribunals/boards etc. thereunder.

(b) "Roll of advocates" means .. roll" as defined in the Advocates Act.

(i) ..Administrative Committee" shall mean a committee comprising of three members of the State Council. constituted by the State Bar Cot~ncil by way of election. for discharging such functions and duties as are entrusted to it under these Rules. The~ may be more than one such Committee depending upon the work load ofa particular State Bar Council.

G) An non-practicing advocnte means an Advocate enrolled with any State Bar Council, but is not in actual practice of Law and is engaged in some other public or private job, business, contract etc. not related to Legal profession: and who has been so declared under Rule 13 and Rule 20.2 of these Rules and whose name stands published under Rule 20.4.

(k) Fake Person is ~ person who is involved in prc1cticing in Courts of Lawfrribunals or other Legal forums without having a valid Degree in Law (without any enrolment in any State Bar CouAcil) and use to appear in such Courts, Tribunals or Forums illegally posing him as an Advocate. · ·

(I) All terms and phrases used in these rules shall have the same meaning as lhcy have under the Advocates Act, 1961, unless the coutc:<t in which such words and phrases are used. ex~ressly suggcs~ to the contrary.

order, it shall be placed along with the personal file of the applicant before the J\dministrat Committee, for passing the requisite ordeT allowing or disrpissing the application.

Such application is liable to be dismissed only in case it is found that the advocate has left Ia\\ practice and that he/she has no bona fide intent and interest in continuing it in future also and such an advocate shall be treated as a non-practicing advocate under these Rules.

No adverse order can be passed under this rule unless a reasonable opportunity of being heard i! afforded to the applicant.

J4. Objection Petition:

14 .I An advocate or any person may file an objection petit ton before the State Bar Counci seeking to add the name/names of an advocate/advocates in the List of Non-Practicinf Advocates on the ground that such an advocate has left law practice and that he/she bas nc bona fide intent and interest in continuing it in future also.

14.2 Rule A . 14.3 That in case the State Bar Council finds that there is a prima facie case in favor of th< applicant. it shall refer it for decision to its Administrative Committee

14.4 That the "Administrative Committee" of the State fiar Council shalt decide and dispose o· such an objection petitaon along with application for issuance/verification of Certificate o· Practice of the concerned advocate, if any. But if no such proceedings arc pendmg, sud objection petition shall be decided independently.

Such procedure as is applicable to complamts under section 35 of thc.J'dvocates Act shal apply, mutatis mutandis, to proceedings under this rule.

14.5. That in case the complamt is found to be vexatious. frivolous and mala ride. the secunt) amount deposited with the obJection petition shall be forfeited to the State rlar Council.

1t.\.6 The "Administrative Comminee" shall be required to decide the objection pcuuons within l

period of 15 day,s from the date ofobjccuon.

Explanation:- An Advocate shall be deemed to be in practice, if he is able to establish that he: has appearet in any Court of law or has filed Vakalatnama even in one case before any Court of Law/other forum in a yeru before these Rules came into force.

CHAPTER V

FOLLOW UP ACTION

15. Follow up action of order passed under rule 13:

15.1 That immediately after the application for verification of Certificate of Practice is allowe< under Rule l3 of these Rules; the Office of the State Bar Council shall prepare the verifiet Certificate' in FORM 'B' in duplicate duly signed by the Chairman of the State Bar Counci and in his absence by the Vice chairman of the State Bar Council or by such other member o the State Bar Counc1l who is specifically authorized for the said purpose by the State Ba Council.
