FATF has developed a series of recommendations that are recog- nised as the international standard for combating money laundering and the financing of terrorism and proliferation of weapons of mass destruction. They form the basis for a co-ordinated response to these threats to the integrity of the fi- nancial system and help ensure a level playing field. FATF’s decision-making body, the FATF Plenary, meets three times a year. Members According to its official website, there are 39 member of FATF, rep- resenting most financial centres around the world. India is also one of its members. What is the Black List and Grey List of FATF? Technically, FATF does not have a “blacklist”, which is a term for gen- eral usage. In FATF, the legal jar- gon for a blacklist is a “public state- ment”, while a grey list is called a “compliance” document. 1. BLACK LIST: Only those countries are included in this list that FATF considers as unco-operative tax havens. These countries are known as Non-Cooperative Countries or Territories (NCCTs). In other words, countries which are sup- porting terror funding and money laundering activities are listed in the Black List. 2. GREY LIST: Countries which are considered as the safe heaven for sup- porting terror funding and money laundering are included in this list. The inclusion in this list is not as se- vere as being blacklisted. Now Grey List is a warning giv- en to the country that it might come in the Black List (Just like a yellow card in a football match). If a coun- try is unable to curb mushrooming of terror funding and money laun- dering, it is shifted from Grey List to Black List by FATF. When a country is in the Grey List, it faces many problems like, 1. Economic sanctions from inter- national institutions (Internation- al Monetary Fund, World Bank, Asian Development Bank etc.) and countries. 2. Problem in getting loans from in- ternational institutions and coun- tries. 3. Reduction in its international trade and international boycott. Pak – Blacklisted? Pakistan was included in the Grey List for the first time in 2012 and re- mained in it till 2015. In 2018, FATF Grey Listed Pakistan for the second time. Pakistan was recently placed in the “enhanced expedited follow- up list” by the Asia-Pacific Group (APG) for its failure to act credibly against terror financing and money laundering. APG is a regional affili- ate of FATF. This is tantamount to being blacklisted, and the APG’s con- clusion will have an impact on Pak- istan’s prospects at FATF Plenary in October. Given his instinct to cut to the chase, an out- right buy would certainly seem more sensible, and cheaper, than angling for sections on lease. He could well reason that if Harry Truman wanted to strike a bargain with Denmark for Greenland at $100 million in bullion back in 1946, he, as a former real estate mogul, should be able to swing it for a few billion dollars. Of course, Greenlanders would beg to disagree even if more Danes might get greedy as the territory now costs its former colonial ruler some $700 million in subsidies. Besides, the US is quite used to buying territories, including hydrocarbon Alaska, for a mere $7.2 million back in 1867 and, even earlier, the Louisiana Purchase (Louisiana) in 1803 from France for $15 million. So rare earth-laden Greenland, so tempt- ingly close to the US, is a no-brain- er. When countries like China have also been buying land on faraway continents, Trump may not even be the only bidder for Greenland. Today this largest tropical forest on the plan- et is a vital source of oxygen. Even more importantly, the CO2 that it is holding is the equivalent of 140 years of human emissions. The Financial Action Task Force (FATF) was established in July 1989 by a Group of Seven (G-7) Summit in Paris to examine and develop measures to combat money laundering What do money laundering and financ- ing of terrorism mean? Both are financial crimes. In simple terms, money laun- dering pertains to disguis- ing money earned from a crime as money earned through legitimate sources. The crime could be corrup- tion, drug trafficking, fraud or tax evasion. Terrorist financing involves collection of funds to support acts of terror or terrorist organisations. A key difference between the two is that, in money laun- dering, the source of funds has to be a crime. In the financing of terrorism, funds may come from perfectly legitimate sources, such as donations from ordinary citi- zens, but the purpose has to be a crime.
